National Health Funding Pool and Administration (National Uniform Legislation) Act 2012

The Act organises several recurring concepts that structure legal and fiscal relationships. Set out below are the core concepts and the immediate legal consequences that the Act attaches to them.

National Health Funding Pool and State Pool Accounts

• National Health Funding Pool: defined as the combined State Pool Accounts for each State (s 3). It is therefore an aggregation rather than a single commingled account. Each jurisdiction must open and maintain a separate State Pool Account with the Reserve Bank of Australia (RBA) for NHRA funding purposes (s 11(1)-(2)). This creates separate legal accounts in each jurisdiction but an administrative national pool for reporting (s 19).

State Managed Fund

• A State Managed Fund is a bank account or fund established, designated or maintained by a State for the purposes of health funding under the NHRA that must be undertaken through a State Managed Fund (s 3 definition; s 14). The CEO (Health) must open or designate a State Managed Fund (s 14). State Managed Funds are distinct from State Pool Accounts: payments for particular purposes may flow from Pool Accounts to State Managed Funds (s 13(1)-(3); s 17(1)(c)-(d)).

Administrator of the National Health Funding Pool

• Office established under the Act (s 4(1)). The person appointed is intended to be the same individual across Commonwealth and States (s 4(2)). The Administrator’s functions include:
  • calculating and advising the Commonwealth Treasurer on payments into State Pool Accounts under the NHRA, including reconciliation based on actual service delivery (s 10(1)(a));
  • monitoring State payments into State Pool Accounts (s 10(1)(b));
  • making payments from State Pool Accounts in accordance with State directions (s 10(1)(c), s 13(2));
  • public reporting on payments into and from State Pool Accounts and other matters required by the Act (s 10(1)(d), ss 17-18).
• The Administrator must personally authorise each payment from a State Pool Account (s 13(3)) and is not subject to Commonwealth Ministerial control although subject to directions from the First Ministers’ Council in relation to the manner of exercising functions (s 10(2)-(4)).

Inter-governmental decision-making

• Ministerial Council and First Ministers’ Council: appointment and suspension processes require coordination among Council members (s 5(2)-(3); s 6). The First Ministers’ Council can give directions to the Administrator about the manner of exercising functions (s 10(3)-(4)).

Financial governance and reporting

• Financial management obligations: the Administrator must develop financial management policies, keep records and prepare audited financial statements for each State Pool Account and a combined statement (s 16; s 19).
• Reporting: monthly reports to Commonwealth and States (s 17) and an annual report to responsible Ministers within four months of the end of each financial year (s 18). Monthly reports must be made publicly available (s 17(3)).
• Audit: each State’s Auditor-General audits the financial statement for that State Pool Account in accordance with that State’s relevant legislation (s 20). Performance audits of the Administrator may be conducted to test effectiveness, economy and compliance (s 21).

Application and exclusion of other laws

• The Act specifies that several Territory Acts do not apply to the Administrator or functions exercised by the Administrator (s 24(1)), including the local Information Act 2002 and Ombudsman Act 2009, while some Commonwealth Acts (Archives Act, Australian Information Commissioner Act, Freedom of Information Act 1982 (Cth), Ombudsman Act 1976 (Cth), Privacy Act 1988 (Cth)) apply to the Administrator in this jurisdiction subject to modifications made by regulation with agreement of all Ministerial Council members (s 25). The Act is intended to operate extraterritorially as far as possible (s 26).

Terminology and statutory cross-reference

• The Act defines specific actors and terms used throughout: Administrator, NT Administrator (to distinguish the NT’s own Administrator under the Self-Government Act), responsible Minister for a jurisdiction, local hospital network, State Pool Account, State Managed Fund, and National Health Reform Agreement (s 3). The Act is to be interpreted in accordance with Schedule 7 to the Health Practitioner Regulation National Law (NT) with necessary modifications (s 3(5)).

Financial Management Act amendments

• The Act amends relevant provisions of the Territory’s Financial Management Act 1995 so that NHFP accounts are Operating Accounts and to specify receipts and expenditure arrangements for NHFP accounts (Part 6, ss 32-37). This changes the mechanics of how these accounts appear in Territory financial management and who may rely on records created under the NHFP Act.

Taken together the concepts allocate custody of funds to RBA accounts, allocate authorised decision-making to responsible Ministers for disbursement, create an inter-jurisdictional calculation and monitoring role for the Administrator, and impose reporting and audit obligations intended to support transparency and reconciliation across Commonwealth and State NHRA funding flows.

Primary financial actors

• Commonwealth Treasurer and Commonwealth Government: the Administrator calculates and advises the Commonwealth Treasurer of the amounts required to be paid by the Commonwealth into each State Pool Account under the NHRA, and the Administrator’s advice will underpin Commonwealth payments (s 10(1)(a); s 23(3)). The Commonwealth is a payer into State Pool Accounts (s 12(a)).
• States and Territories: each State/Territory is required to open and maintain a State Pool Account with the RBA (s 11). States must also establish or designate State Managed Funds through the CEO (Health) (s 14). States are payers into their State Pool Accounts (s 12(b)) and may have to pay into other States’ Pool Accounts under the NHRA (s 12(c)).
• Responsible Ministers: the responsible Minister for each jurisdiction directs the Administrator on payments from that State Pool Account; the Administrator must make payments strictly in accordance with those directions (s 13(2)). Responsible Ministers are also obliged to provide requested information to the Administrator about State Managed Funds (s 22).
• Administrator: the person appointed under s 5 performs calculation, monitoring, payment authorisation and reporting functions (s 10, s 13). The Administrator is intended to be the same individual across jurisdictions (s 4(2)) and is appointed by the responsible Minister for the jurisdiction (s 5(1)) but only after agreement of all Ministerial Council members (s 5(3)).

Operational and support bodies

• National Health Funding Body (established under the National Health Reform Act 2011 (Cth)): must provide staff and facilities to assist the Administrator (s 9(1)). However, the Administrator cannot delegate functions to that body (s 9(2)).
• CEOs and Agency (Health): the CEO (Health) opens and maintains the State Pool Account with the RBA (s 11) and must open or designate a State Managed Fund (s 14). The Financial Management Act amendments identify NHFP accounts as Operating Accounts for the relevant Agency (Pt 6, s 33).
• Auditor-Generals: the Auditor-General of each State audits the financial statement for that State Pool Account in accordance with the State’s legislation (s 20). Performance audits of the Administrator may be conducted by the Auditor-General of each jurisdiction coordinated across jurisdictions (s 21).

Service providers and local hospital networks

• Local hospital networks (LHNs): the Act expressly contemplates payments to LHNs for services, teaching, training and research (s 13(1)(a)-(b)). Payments to LHNs may be made directly from State Pool Accounts or via State Managed Funds (ss 13; 14).
• Other organisations: the Act contemplates funding “other organisations or funds” and payments on behalf of LHNs for corporate or other services (s 13(1)(c); s 13(7)).

Information and oversight bodies

• Commonwealth information and oversight bodies: certain Commonwealth Acts (Archives Act, Australian Information Commissioner Act, Freedom of Information Act, Ombudsman Act, Privacy Act) apply to the Administrator as laws of the Territory subject to modification by regulation with agreement of all Ministerial Council members (s 25(1)-(2)).
• Territory information and oversight bodies: a number of Territory Acts do not apply to the Administrator or their functions (s 24(1)). This affects the scope of local administrative law and oversight that would otherwise apply.

Who bears costs and compliance duties

• States fund State Managed Funds and contribute to State Pool Accounts (s 12(b)); the Commonwealth funds part of State Pool Accounts under the NHRA (s 12(a)). Account maintenance costs such as RBA charges are payable out of the State Pool Account (s 13(5)). The Administrator bears administrative duties in relation to records, reports and financial statements (s 16; s 17; s 19), while States must provide information necessary for those reports (s 22).

Decision rights, dependencies and operational chokepoints

• Responsible Ministers retain decision rights over the distribution of their State Pool Account (s 13(2)); the Administrator’s role is operational and supervisory but subject to direction from the First Ministers’ Council in relation to the manner of exercising functions (s 10(3)).
• The Administrator must personally authorise each payment from a State Pool Account (s 13(3)), creating an operational dependency on the Administrator’s presence and capacity. A partial mitigation exists: if no Administrator is available, an official of the State directed by the responsible Minister may make the payment (s 13(8)).

Jurisdictional reach and interactions

• The Act applies to the Territory and is intended to operate extraterritorially “as far as possible” (s 26), and it includes specific provisions to align Territory financial law with the NHFP arrangements (Part 6). It also provides for coordinated appointment and oversight across Commonwealth and State Ministerial Councils (ss 5-8; s 10(3)-(4)).

In sum, the Act affects Commonwealth and State treasuries, State health agencies and CEOs, LHNs and service providers, the National Health Funding Body providing staff support, Auditor-Generals, and Ministers who exercise direction and oversight. The principal shift in roles is to centralise calculation and monitoring of NHRA flows in an Administrator office while retaining State Ministerial control over disbursement from State Pool Accounts.

This section lists the primary statutory duties imposed by the Act and the rights or discretions conferred on particular actors, with references to the exact provisions that create them. Readers should treat each item as a standing legal obligation or authority under the Act.

Administrator: duties, constraints, and rights

• Calculation and advice: must calculate and advise the Commonwealth Treasurer of amounts required to be paid by the Commonwealth into each State Pool Account under the NHRA, including advice on reconciliation based on actual service delivery (s 10(1)(a)).
• Monitoring State payments: must monitor State payments into each State Pool Account for the purposes of Part 4 (s 10(1)(b)).
• Payments from State Pool Accounts: must make payments from each State Pool Account in accordance with directions of the State concerned (s 10(1)(c); s 13(2)). Payments must be authorised personally by the Administrator (s 13(3)).
• Reporting and public disclosure: must report publicly on payments into and from State Pool Accounts and other matters under Part 4, provide monthly reports to Commonwealth and States (s 17), and an annual report to responsible Ministers within four months after the end of each financial year (s 18(1)).
• Financial management and record-keeping: must develop and apply appropriate financial management policies and procedures with respect to the State Pool Accounts, keep proper records including basis of payments, and prepare financial statements and arrange audits (s 16; s 19; s 20).
• Non-delegation to National Health Funding Body: staff and facilities are provided by the National Health Funding Body but the Administrator may not delegate functions to that body or its staff (s 9(1)-(2)).
• Compliance with First Ministers’ Council directions: must comply with directions of the First Ministers’ Council in relation to manner of performance (s 10(3)); such directions are to be given by written resolution, notified in writing and made publicly available (s 10(4)).
• Provision of information: must provide information requested by a responsible Minister that relates to that jurisdiction and provide a copy of advice to the Commonwealth Treasurer to all responsible Ministers (s 23(1), (3)).

Responsible Minister for a State

• Direction and control over disbursements: the responsible Minister for the State directs the Administrator with respect to payments from the State Pool Account; the Administrator must follow those directions strictly, including amount, party or account to which payment is to be made and timing of payment (s 13(2)).
• Repayment decisions: the Administrator is required, at the direction of the responsible Minister, to repay money paid by the State into the State Pool Account that the responsible Minister is satisfied was an overpayment (s 13(4)).
• Provision of information: the responsible Minister must provide the Administrator with required information about the State Managed Fund, including amounts paid in and out and the basis of payments (s 22).

CEO (Health)

• Account creation and maintenance: the CEO (Health) must open and maintain the State Pool Account with the RBA (s 11(1)) and must open or designate the State Managed Fund (s 14).

States and Commonwealth

• Payments into State Pool Account: State Pool Accounts are to receive Commonwealth payments under the NHRA, State money for funding in the State through the State Pool Account, money from other States for payment into the Account under the NHRA, and interest on money deposited in the Account (s 12). States therefore have the duty to provide monies required by the NHRA and supply information on State Managed Funds to the Administrator (s 22).
• Receipt composition and constraints: payments from State Pool Accounts are for funding local hospital network services, health teaching/training/research for LHNs or other organisations, and any other matters under the NHRA to be funded through the NHFP (s 13(1)). Section 13(6) clarifies payments for the listed services are not required to be made only from the State Pool Account.

Auditor-General and auditing duties

• Audit of State Pool Account financial statements is by the Auditor-General of that State under relevant State audit legislation (s 20). Performance audits of the Administrator may be conducted by the Auditor-General of the jurisdiction, subject to prior notification and coordination with other Auditors-General where audits occur concurrently (s 21).

Ministerial Council and First Ministers’ Council

• Appointment, suspension and removal governance: appointment of the Administrator requires all members of the Ministerial Council to agree on the individual, the appointment date, period and conditions (s 5(3)); the Chair must suspend the Administrator if requested by at least three State Ministers or the Commonwealth Minister (s 6(1)), and the Administrator must be removed if a majority of the Ministerial Council agree (s 7(1)). The First Ministers’ Council may give directions about how the Administrator exercises functions (s 10(3)).

Information and disclosure duties

• Monthly and annual reports must include prescribed line items such as amounts paid into and out of State Pool Accounts and State Managed Funds, the basis on which payments were made, and numbers of public hospital services funded under activity-based funding (ss 17(1), 18(2)). Monthly reports must be publicly available (s 17(3)). The Administrator must provide information requested by responsible Ministers in given timeframes (s 23(1)-(2)).

Legal and procedural constraints on applicability of other laws

• Certain Territory Acts are excluded from applying to the Administrator (s 24(1)); certain Commonwealth Acts apply as laws of the Territory to the Administrator subject to modifications by regulation with unanimous Ministerial Council agreement (s 25(1)-(2)). This creates rights and constraints over access to information and oversight consistent with those Commonwealth Acts as applied.

Other practical duties and constraints

• The Administrator must personally authorise each payment (s 13(3)), which is a procedural duty that creates a control requirement and an operational bottleneck.
• If the Administrator is unavailable, a State official directed by the responsible Minister may make the payment (s 13(8)), creating a contingency that vests authorising power temporarily with an authorised State official.

These duties and rights allocate the principal operational roles for funds and reporting. Several duties are procedural (personal authorisation, record maintenance, monthly public reporting), while the major substantive decision rights over distribution of funds remain with State responsible Ministers under the Act (s 13(2)). The Administrator’s advisory, monitoring and reporting rights create an informational and compliance role designed to support the implementation and oversight of the NHRA.

The Act primarily establishes administrative controls, reporting obligations and audit mechanisms; it does not create a schedule of criminal penalties or detailed civil sanctions within the text provided. Enforcement is effected through institutional and statutory oversight mechanisms, appointment and removal powers, audit processes and obligations on Ministers and the Administrator. The Act therefore relies on administrative accountability, audit, public reporting and intergovernmental governance rather than standalone penal sanctions. The key enforcement and accountability mechanisms in the Act are the following.

Suspension and removal mechanisms for the Administrator

• Suspension: the Chair of the Ministerial Council must suspend the Administrator if requested by at least three State Ministers or the Commonwealth Minister (s 6(1)). Grounds for requesting suspension include incapacity, failure to comply with obligations or duties, being accused or convicted of an imprisonable offence, or bankruptcy (s 6(2)). A suspension is effected by instrument in writing and notified to all Council members (s 6(3)). Suspension terminates after 60 days unless removal, resignation, termination or extension is effected by a majority of Council members (s 6(4)). Re-suspension within 90 days is restricted unless a majority requests suspension (s 6(5)). These provisions create administrative checks on the Administrator’s conduct.
• Removal: the Minister for the jurisdiction is required to remove the Administrator when a majority of the Ministerial Council agree (s 7(1)-(2)). The Administrator may resign in writing to the Chair (s 7(3)-(4)). These provisions allow political and inter-jurisdictional removal.

Audits and audit findings

• Financial audit: each State Pool Account’s financial statement is audited by the Auditor-General of that State under relevant State audit legislation (s 20). Audit findings can be reported publicly by the Auditor-General in accordance with that office’s statutory powers and may be tabled in Parliament with the Administrator’s annual report (s 18(4)).
• Performance audit: the Auditor-General may conduct a performance audit of the Administrator’s functions to determine whether the Administrator is acting effectively, economically, efficiently and in compliance with relevant laws (s 21(1)). Performance audits require prior notice to other jurisdictions’ Auditors-General (s 21(2)) and coordination where audits run concurrently (s 21(3)). Audit outcomes may be a basis for removal requests or for parliamentary scrutiny by responsible Ministerial jurisdictions.

Reporting and parliamentary tabling

• Annual report tabling: a responsible Minister must cause a copy of the Administrator’s annual report to be tabled in that jurisdiction’s Parliament as soon as practicable after receiving it (s 18(4)). Tabling brings reports into parliamentary and public scrutiny and can generate political or administrative consequences.

Information disclosure constraints and FOI

• The Act specifies which jurisdictional information and oversight regimes govern the Administrator. Several Territory Acts are excluded from applying to the Administrator (s 24(1)); certain Commonwealth Acts (including FOI, Privacy and Ombudsman Acts) apply as laws of the jurisdiction (s 25). The application of Commonwealth Acts is subject to regulatory modifications agreed by the Ministerial Council (s 25(2)). The availability and scope of FOI, privacy complaints and Ombudsman investigations are therefore governed by a combination of Commonwealth statutory frameworks as applied and any modifications made under regulations , enforcement through those regimes will depend on the form of applied provisions and any limitations that are prescribed.

Operational controls

• Personal authorisation requirement: the Administrator must personally authorise each payment (s 13(3)). Failure to comply with this procedural duty would be an internal non-compliance issue potentially exposed by audit and could trigger suspension or removal requests (ss 6-7) but the Act does not prescribe a separate criminal penalty for failing to authorise payments personally.
• Payment at direction of responsible Minister: the Administrator must make payments strictly in accordance with State directions (s 13(2)). If payments were made inconsistently with such directions, responsible Ministers could require remedies, seek audit inquiries, or pursue other administrative or political remedies. The Act itself provides the mechanism of intergovernmental oversight and audit rather than specific statutory fines.

Limitations and absence of civil/criminal penalties

• The Act does not insert standalone criminal offences specific to misuse or misappropriation of NHFP funds in the text reproduced, nor does it specify civil penalties tied to particular contraventions. Enforcement thus principally operates through:
  • removal and suspension of the Administrator (ss 6-7);
  • audit and performance audit findings (ss 20-21);
  • public reporting and parliamentary scrutiny (ss 17-18); and
  • the applicable Commonwealth and State administrative law and criminal law regimes outside this Act (for example, general criminal offences for theft, fraud or corruption that would apply independent of the Act).

Practical enforcement channels open to States and Commonwealth

• Inter-jurisdictional political checks: Ministerial Council decisions (appointment, suspension, removal) are multi-jurisdictional and can be used where performance or compliance issues arise (ss 5-7).
• Auditor-General reports: financial or performance audit outcomes can be tabled and used as the basis for public and parliamentary scrutiny, which may precipitate administrative or political action (ss 18(4), 20-21).
• FOI/Privacy/Ombudsman: where and to the extent Commonwealth Acts are applied by regulation (s 25), affected stakeholders may have recourse to information access and privacy complaint mechanisms and to Commonwealth Ombudsman review of administrative action as permitted by the applied law.

In short, the Act relies on institutional accountability, audit, reporting and intergovernmental checks to enforce compliance. Those mechanisms can lead to administrative removal or political consequences; the Act itself does not create a bespoke set of penalties for breach beyond removal, audit, and public disclosure remedies.

The Act both imports the National Health Reform Agreement (NHRA) as the substantive funding framework and modifies Territory financial management law. It also creates bespoke relationships with Commonwealth information and oversight laws and limits the application of certain Territory Acts to the Administrator. The interaction points are specific and require close coordination with other statutes and intergovernmental instruments.

Interaction with the National Health Reform Agreement

• The Act exists for and is expressly tied to the NHRA, defined in s 3 and referenced throughout. The Administrator’s core functions are framed by, and intended to give effect to, the NHRA , for example, calculation and advice to the Commonwealth Treasurer on Commonwealth payments into State Pool Accounts are performed under the NHRA context (s 10(1)(a)). Payments into and out of State Pool Accounts are to be those specified under the NHRA, including reconciliation based on actual service delivery (s 10(1)(a); ss 12-13). The Act therefore operates as a domestic implementation mechanism for the NHRA’s financial flows.

Application and modification of Commonwealth Acts

• A set of Commonwealth Acts apply to the Administrator as laws of the Territory (s 25(1)). The Acts listed are:
  • Archives Act 1983 (Cth);
  • Australian Information Commissioner Act 2010 (Cth);
  • Freedom of Information Act 1982 (Cth);
  • Ombudsman Act 1976 (Cth);
  • Privacy Act 1988 (Cth).
• These apply subject to modifications made by regulations under the National Health Reform Act 2011 (Cth) with the agreement of all Ministerial Council members (s 25(2)). That creates two interaction effects:
  • the Administrator’s information access, privacy obligations and Ombudsman reviewability will generally be governed by Commonwealth law as applied; and
  • the applied Commonwealth law may be modified by regulation, but only with unanimous intergovernmental agreement, which creates an inter-jurisdictional gate on any modifications to those regimes as they apply to the Administrator.

Exclusion of Territory Acts

• The Act excludes certain Territory Acts from applying to or in respect of the Administrator or their functions: specifically the Information Act 2002 and Ombudsman Act 2009, and any other Act prescribed by regulation to enable the application of a Commonwealth Act under s 25 (s 24(1)). The Interpretation Act 1978 (NT) is excluded except for prescribed provisions relating to subordinate legislation and the NT Administrator (s 24(2)-(3)). This produces a dual regime for information and oversight: Commonwealth Acts will apply subject to regulation, while Territory-level information and Ombudsman regimes are displaced.

Financial Management Act amendments

• Part 6 amends the Financial Management Act 1995 (NT) to add NHFP accounts as Operating Accounts, to include NHFP receipts in the list of funds payable into Operating Accounts (s 34), to allow expenditure to be paid from Operating Accounts in accordance with the NHFP Act (s 34(3)), and to permit the Accountable Officer to rely on records kept under Part 4 of the NHFP Act in complying with Financial Management Act obligations (ss 35-36). Section 37 adds an express exclusion that the Financial Management Act’s section 27 does not apply to NHFP bank accounts. These amendments integrate NHFP accounts into the Territory’s financial governance machinery while preserving certain special rules and carve-outs.

Audit and performance audit legislation

• Auditing of State Pool Account financial statements occurs under the relevant legislation for each State’s Auditor-General (s 20). For the Territory, the relevant legislation is the Audit Act 1995 (s 20(2)). Performance audits by the Auditor-General into the Administrator’s activity are to be conducted under the Audit Act 1995 (s 21(4)). The Act therefore depends upon and plugs into existing audit legislation for enforcement and oversight.

Delegation, staff and the National Health Funding Body

• The National Health Funding Body constituted under the National Health Reform Act 2011 (Cth) is responsible for providing staff and facilities to assist the Administrator (s 9(1)). However, the Administrator may not delegate a function conferred by this Act to that body or to its staff (s 9(2)). That preserves a legal separation between the Administrator’s statutory functions and the operational support provided by an external national body.

Extraterritorial intent

• The Act expresses an intention that it operate extraterritorially where possible, including in relation to things, acts, transactions and matters situated or occurring outside the jurisdiction (s 26). That phrase signals an intent for the Act’s reach to cover cross-jurisdictional activities relating to the NHRA but operates within the limits of constitutional and legislative competence.

Parliamentary and administrative oversight

• The Administrator is required to report to responsible Ministers (s 18) and such annual reports are to be tabled in Parliament (s 18(4)), creating a parliamentary oversight link that interacts with standing parliamentary processes for public accounts and committees.

Practical interaction issues and potential points of friction

• Tension between State directions and the Administrator’s advice to the Commonwealth on payments into State Pool Accounts: section 15 requires State directions for distribution of Commonwealth funding to be consistent with the Administrator’s advice to the Commonwealth Treasurer regarding the basis of Commonwealth payments to that Account (s 15(1)). But s 13(2) still requires strict compliance with State directions. This creates an interaction point where State political preferences could conflict with the Administrator’s calculation and the expectation of the Commonwealth.
• Information regimes: the displacement of local Territory information law and the application (subject to modification) of Commonwealth FOI and Privacy Acts sets up a two-tiered framework that will need resolving by regulation under the NHRA and agreement of all Ministerial Council members (s 25(2)).
• Reliance on other jurisdictions’ laws: because the Administrator is to perform functions under the corresponding provisions of other jurisdictions (s 4(4)) and may have regard to information obtained under another jurisdiction’s law in exercising functions under Part 4 (s 10(6)), cross-jurisdictional legal coordination is necessary for records, disclosures and audits.

Overall, the Act embeds the NHFP arrangements into the existing financial management, auditing and information frameworks by modifying Territory law where required and creating a deliberate overlay of Commonwealth law for information and oversight matters. Implementation therefore requires active coordination between the NHFP instruments and the NHRA, regulations that apply Commonwealth Acts, and the corresponding laws of other States and the Commonwealth.

This section summarises the Act’s amendment record as set out in the reprint notes included in the text. The record shows the Act has been amended several times since assent and that the reprint captures amendments in force as at 21 April 2023.

Original enactment and commencement

• The National Health Funding Pool and Administration (National Uniform Legislation) Act 2012 (Act No. 21, 2012) received assent on 30 June 2012 and commenced on 19 July 2012 (reprint endnotes 2 and 4). The Act was prepared to implement the NHRA agreed by COAG on 2 August 2011 (s 3 definition).

List of amendments included in the reprint

• The reprint sets out a list of legislative instruments that have amended the Act, referencing particular sections altered. The List of Amendments (endnote 4) records:
  • s 3 amended by Health Services Act 2014 (Act No. 18, 2014), s 99; Health Service Act 2021 (Act No. 10, 2021), s 50; and Statute Law Amendment (National Cabinet) Act 2023 (Act No. 9, 2023), s 13.
  • ss 5-8 amended by Statute Law Amendment (National Cabinet) Act 2023 (Act No. 9, 2023), s 14.
  • s 10 amended by Statute Law Amendment (National Cabinet) Act 2023 (Act No. 9, 2023), s 14.
  • s 24 amended by Interpretation Amendment Act 2021 (Act No. 28, 2021), s 20.
  • s 25 amended by Statute Law Amendment (National Cabinet) Act 2023 (Act No. 9, 2023), s 14.
• The List of Legislation (endnote 2) provides details of the amending Acts, their assent dates and commencement dates:
  • Health Services Act 2014 (Assent 2 June 2014; Commenced 1 July 2014).
  • Health Service Act 2021 (Assent 20 May 2021; Commenced 1 July 2021).
  • Interpretation Amendment Act 2021 (Assent 15 Dec 2021; Commenced 1 Jan 2022).
  • Statute Law Amendment (National Cabinet) Act 2023 (Assent 20 Apr 2023; Commenced 21 Apr 2023).

General amendments

• Endnote 3 notes that general amendments of a formal nature were made by the Interpretation Legislation Amendment Act 2018 (Act No. 22, 2018) to ss 1, 20, 21, 24, 29, 32 and 33 of the Act. These are described as formal amendments of a non-substantive character.

Part 6 amendments to the Financial Management Act

• Part 6 of the Act itself inserts amendments into the Financial Management Act 1995 (NT) (ss 32-37). These create the NHFP account and NHFP account/Operating Account definitions and adjust receipts and payment rules to include NHFP accounts (ss 33-37). Those amendments are part of this Act rather than later amending instruments.

Interpretative and commencement detail

• The Act’s commencement provision (s 2) allows the Administrator to fix the commencement day by Gazette notice. The reprint endnotes record the Act was commenced by Gazette S36 on 17 July 2012 and gives the formal commencement date of 19 July 2012 (endnote 2).
• Part 6 amendments have specific reprint annotations showing how Financial Management Act provisions are altered by the NHFP Act’s enactment.

Effect of amendments recorded

• The 2023 Statute Law Amendment (National Cabinet) Act amendments to ss 5-8 and s 10 (and s 25) indicate that Ministerial Council and Administrator appointment, suspension and powers were fine-tuned in 2023. The 2021 Interpretation Amendment Act altered s 24. The 2014 Health Services Act and 2021 Health Service Act amendments relate to s 3 definitions and cross-references, likely reflecting updates in the Health Service Act framework (see endnote 2 list).

How to read the amendment history in practice

• Practitioners should consult the cited amending Acts for the exact textual changes where necessary. The reprint’s endnotes provide the references and dates so readers can locate the amending provisions in the amending Acts. The reprint indicates the Act is kept current up to 21 April 2023; any developments after that date are not reflected here and should be checked against later publications or consolidated legislation.

Practical consequences of the amendment record

• The amendments demonstrate two types of change: technical alignment with evolving Territory health and interpretation legislation (2014, 2021 amendments) and intergovernmental governance refinements (2023 amendments arising from a Statute Law Amendment (National Cabinet) Act). Where the Ministerial Council procedures, the Administrator’s appointment and suspension processes or the application of Commonwealth oversight laws are altered, those changes will directly affect inter-jurisdictional governance and the availability of information and oversight mechanisms.

In short, the Act has been amended periodically to maintain cross-references and to refine governance arrangements, especially the appointment and oversight architecture involving Ministerial Council members and the Administrator. Users must reconcile the current consolidated text with the specific amending Acts for precise wording in contested matters.

The Act text and accompanying endnotes provided do not record any judicial decisions, reported litigation or legal interpretations. The reprint includes a list of amendments and endnotes but no cases are cited in the statute text. Therefore, there is no litigation history recorded in the material supplied.

Potential areas likely to generate litigation or administrative review (based on the Act’s provisions) While the Act does not narrate past cases, its structure identifies several interfaces that could give rise to disputes or judicial review claims in practice. The following are plausible dispute vectors grounded in the Act’s text that practitioners should note when conducting risk assessment, contract drafting or compliance work.

1. Direction versus calculation tension

• Section 15 requires that directions by a responsible Minister in relation to the distribution of Commonwealth funding be consistent with the Administrator’s advice to the Commonwealth Treasurer about the basis for Commonwealth payments into a State Pool Account (s 15(1)). Section 13(2) then requires strict compliance with the responsible Minister’s directions in making payments from the State Pool Account. This could spawn disputes where the Administrator, Commonwealth Treasurer or other States consider a State’s directions inconsistent with the Administrator’s previous advice, potentially prompting litigation over the proper implementation of s 15(1) and the relative legal effect of the Administrator’s advice versus State Minister directions.

2. Information release and confidentiality

• Section 23(5) restricts public release by another jurisdiction of information relating to a jurisdiction that was provided by the Administrator, unless arrangements approved by the responsible Minister of the jurisdiction to which the information relates permit it (s 23(5)). Disagreements over whether arrangements permit certain disclosures, or over the scope of FOI/Privacy exemptions where Commonwealth Acts have been applied with modifications (s 25), could lead to administrative decisions subject to FOI review or judicial review of administrative action as applied. The interplay between s 24’s exclusion of Territory information and Ombudsman Acts and s 25’s application of Commonwealth FOI/Privacy laws subject to modification is a fertile source of litigation risk concerning access to information.

3. Payment authorisation and liability

• The Administrator must personally authorise each payment (s 13(3)). If an incorrect payment is made, disputes may arise over liability and remedial steps. The Act authorises repayment on direction of the responsible Minister for money the Minister is satisfied constitutes an overpayment (s 13(4)) but does not specify civil remedies for third parties. Litigation could involve questions about the Administrator’s personal liability, the State’s remedies against recipients of incorrect payments, or the scope of a responsible Minister’s power to direct repayment.

4. Audit findings and consequences

• Financial or performance audits under ss 20-21 may expose non-compliance. Parties aggrieved by audit findings or by the manner of subsequent administrative action (suspension, removal) could seek judicial review or seek relief regarding the correctness of the audit process, the sufficiency of notice to other jurisdictions prior to performance audits (s 21(2)), or the coordination of concurrent audits (s 21(3)).

5. Appointment and removal procedural disputes

• The appointment mechanism requires unanimous agreement by Ministerial Council members on the Administrator and terms (s 5(3)), and removal requires a majority (s 7(1)). Procedural disputes about whether the Ministerial Council followed required procedures in nominating, suspending or removing an Administrator could be litigated, or become the subject of intergovernmental litigation or public inquiry.

6. Application and modification of Commonwealth Acts

• The application of Commonwealth FOI/Privacy/Ombudsman Acts to the Administrator but subject to regulations made under the NHRA with agreement of all Ministerial Council members (s 25(2)) could give rise to litigation over whether proper regulation-making procedures were followed, whether modifications are valid, and the extent to which those Commonwealth Acts apply to particular actions or records of the Administrator.

Absence of direct penalties in the Act

• Because the Act does not itself create a detailed penalties framework, litigation is more likely to arise under audit, administrative law review, parliamentary scrutiny, civil recovery actions following incorrect payments, or under general criminal law for any alleged corrupt or fraudulent conduct. Practitioners must look to parallel statutes, contract remedies and ordinary civil and criminal law for enforcement remedies.

Practical approach for practitioners

• Where litigation risk is material, practitioners should: (a) gather the Administrator’s advice and Ministerial directions to document consistency with s 15(1); (b) ensure records and audit trails satisfy s 16 duties; (c) follow the Administrator’s reporting timelines (ss 17-18); (d) use the audit and performance audit provisions proactively to clarify disputed issues before escalation; and (e) consider FOI, privacy and Ombudsman regimes as applied under s 25 when managing disclosure and confidentiality risks.

To reiterate, the source material as provided records no judicial decisions interpreting the Act. The litigation vectors above are derived from the Act’s text and describe areas where disputes are likely to arise in practice.

This section highlights provisions and practical details within the Act that are easily overlooked or give rise to operational friction for governments, health agencies and service providers. Each “gotcha” is tied to a specific statutory source and describes the mechanism causing the issue.

1. Personal authorisation requirement as an operational bottleneck (s 13(3))

• The Administrator is required to personally authorise each payment from a State Pool Account (s 13(3)). This creates a single-person control over all disbursements. If the Administrator is unavailable, payments can be made by an official directed by the responsible Minister (s 13(8)), but that requires ministerial action. The combination of a strict personal authorisation rule and a constrained fallback (ministerial direction) introduces a timing risk for time-sensitive payments or during periods of Administrator vacancy/suspension.

2. Administrator cannot delegate to National Health Funding Body staff (s 9(2))

• Although staff and facilities are provided by the National Health Funding Body under the National Health Reform Act (s 9(1)), the Administrator is explicitly forbidden from delegating a function under this Act to that body or its staff (s 9(2)). Practically this means the Administrator must perform principal statutory acts (for example, personal authorisation) even though operational support is supplied externally. That can cause duplication of effort, administrative strain, and potential confusion over responsibility for records and errors.

3. Unanimity required for appointment, majority for removal (ss 5(3), 7(1))

• Appointment requires agreement by all Ministerial Council members on the individual, the start date, appointment period and conditions (s 5(3)). Removal requires a majority of the Ministerial Council (s 7(1)). The unanimity requirement for appointment can lead to bargaining and holdout behavior among jurisdictions; conversely the majority removal rule can result in a removal even where one or more jurisdictions oppose it. Practitioners should design appointment and contract terms with the possibility of inter-jurisdictional disagreement in mind.

4. First Ministers’ Council directions override Commonwealth Ministerial control but are multi-jurisdictional (s 10(3))

• The Administrator is not subject to control or direction of any Commonwealth Minister in relation to exercise of functions (s 10(2)), but must comply with directions of the First Ministers’ Council in relation to the manner of exercising functions (s 10(3)). First Ministers’ Council directions require written resolution and public disclosure (s 10(4)). This creates a supervision mechanism that is politically collective and potentially slow; reliance on the First Ministers’ Council to resolve operational disputes may not be timely.

5. Displacement and re-application of information laws (ss 24-25)

• The Act excludes certain Territory information and Ombudsman Acts from applying to or in respect of the Administrator (s 24(1)). At the same time, several Commonwealth information and oversight Acts apply as laws of the Territory to the Administrator, but “subject to the modifications made by regulations made under the National Health Reform Act 2011 (Cth) with the agreement of all the members of the Ministerial Council” (s 25(2)). The practical effect is that local FOI/Ombudsman pathways may be closed, and the Commonwealth FOI/privacy regime will govern access and complaint processes but only insofar as any modifications adopted by unanimous Ministerial Council agreement permit. This layered framework complicates access-to-information planning and can delay disclosure decisions.

6. Payment source clarification but no exclusivity (s 13(6))

• Section 13(6) states the section does not require payment for services listed in s 13(1) to be made only from the State Pool Account. That creates ambiguity about whether payments can be made from other State accounts or funds, potentially complicating audit trails and reconciliation efforts required under Part 4 (s 16). Practitioners must therefore ensure clear accounting practices so that activity-based funding and other payments can be reconciled to the State Pool Account even if payments are made from other budget lines.

7. Cross-jurisdictional information release restrictions (s 23(5))

• Information that relates to a jurisdiction and is provided by the Administrator to another jurisdiction may only be publicly released by that other jurisdiction in accordance with arrangements approved by the responsible Minister for the jurisdiction to which the information relates (s 23(5)). That creates a legal constraint on publication of information and potential friction where one jurisdiction wishes to publish data but the origin jurisdiction has not approved the release.

8. Audit coordination requirements (s 21(2)-(3))

• Where Auditor-Generals in multiple jurisdictions intend to conduct performance audits of the Administrator, the Act requires notification and coordination (s 21(2)-(3)). While sensible, the requirement may slow independent audits or lead to disagreements about audit terms and timelines. Auditors must coordinate on requirements imposed on the Administrator, which could complicate joint inquiries into national issues.

9. Regulatory modifications to Commonwealth Acts require unanimous agreement (s 25(2))

• Modifications to the Commonwealth Acts as applied to the Administrator must be made by regulation under the NHRA with agreement of all Ministerial Council members (s 25(2)). This unanimity requirement for regulatory modification may hinder timely calibration of information access or oversight arrangements and gives each jurisdiction a veto over such modifications.

10. Financial Management Act carve-outs (Pt 6)

• The Financial Management Act amendments bring NHFP accounts within Operating Accounts but specifically exclude section 27 of the Financial Management Act from applying to an NHFP bank account (s 37). Practitioners working across Territory financial rules should be alert to which Financial Management Act rules apply to NHFP accounts and which are carved out, to avoid unintended breaches of internal policy that rely on the general Act rather than the specific NHFP rules.

Each of these “gotchas” is traceable to a particular provision of the Act and has operational consequences. Good practice is to model cash flows and authorisation pathways against these statutory constraints, document ministerial directions and Administrator advice contemporaneously, and ensure clear protocols for information release and audit coordination.

This section offers practical, source-grounded steps and checklists for jurisdictions, responsible Ministers, the Administrator, CEOs (Health), and local hospital networks to meet statutory obligations set out in the Act. The guidance refers to the specific statutory provisions that prescribe the duties.

Governance and appointment compliance

• Ensure Ministerial Council processes are followed for appointment: before appointment, the Chair must give each member of the Ministerial Council an opportunity to nominate, and no appointment can be made unless all members agree on the individual, start date, period and conditions (s 5(2)-(3)). Retain written records of the Council’s agreement and the instrument of appointment (s 5(4)).
• Prepare for suspension/removal contingencies: understand the grounds for suspension (s 6(2)) and the procedural requirements (instrument in writing, notification) (s 6(3)-(4)). Ensure the Chair of the Ministerial Council is aware of the procedural steps and timelines; maintain a plan for continuity of payment authorisation if the Administrator is suspended or absent (s 13(8)).

Account set-up and fund designation

• Open and maintain State Pool Account with the RBA: CEO (Health) must open and maintain a separate State bank account at RBA for NHRA purposes (s 11(1)-(2)). Record the account details in financial management systems and reconcile RBA statements against internal ledgers.
• Establish State Managed Fund: CEO (Health) must open, establish or designate a State Managed Fund as the State Managed Fund for NHRA health funding purposes (s 14). Document the legal instrument or administrative decision that designates the fund, and ensure that the fund’s rules permit receipt and disbursement in line with NHRA obligations.

Payment and authorisation procedures

• State directions: responsible Minister must give clear written directions to the Administrator concerning payments from the State Pool Account, including amount, recipient account or party, and timing (s 13(2)). Keep signed directions on file.
• Administrator authorisation: the Administrator must personally authorise each payment (s 13(3)). Implement internal procedures that require contemporaneous record of personal authorisation and safe custody of instruments of authorisation.
• Contingency for Administrator absence: if the Administrator is absent, responsible Minister must provide a direction for an official of the State to make the payment (s 13(8)). Ensure an internal delegated-authority matrix is pre-approved and that ministerial directions can be executed promptly in emergencies.

Financial management, record-keeping and audit readiness

• Develop financial management policies: Administrator must develop and apply appropriate financial management policies and procedures for State Pool Accounts (s 16(a)). These should include segregation of duties, payment authorisation workflows that conform to the personal authorisation requirement, ledger posting, and reconciliation procedures.
• Maintain proper records: keep records of all payments into and from State Pool Accounts and the basis on which payments are made (s 16(b)). Records should enable month-by-month reconciliation, mapping to NHRA activity-based funding and supporting documentation for each payment.
• Prepare financial statements: Administrator must prepare financial statements for each State Pool Account and a combined financial statement after each financial year (s 19). Ensure statements follow accounting standards and are formatted to be auditable by the State Auditor-General (s 20).
• Audit coordination: where performance audits are planned, cooperate with the Auditor-General and coordinate with other jurisdictions’ Auditor-Generals if audits are concurrent (s 21(2)-(3)). Provide timely access to records and staff.

Reporting obligations and content

• Monthly reports: Administrator must provide monthly reports to Commonwealth and each State containing amounts paid into/from State Pool Accounts and State Managed Funds, the basis for payments, and counts of public hospital services funded under activity-based funding (s 17(1)(a)-(f)). A monthly report to a jurisdiction is to be provided to the responsible Minister or a body or officer notified by that Minister (s 17(2)) and must be made publicly available (s 17(3)).
• Annual report: Administrator must provide an annual report to responsible Ministers within four months after the end of each financial year (s 18(1)). The annual report must include the items listed in s 18(2) and be accompanied by audited financial statements for each State Pool Account and a combined financial statement (s 18(3)). Responsible Ministers must cause the report to be tabled in their Parliaments as soon as practicable (s 18(4)).
• Retain supporting documentation for reports: keep source documents (payment orders, ministerial directions, reconciliation schedules, invoices) to support the monthly and annual reports and for audit.

Information sharing and privacy/FOI compliance

• Provide required information to the Administrator: responsible Ministers must provide the Administrator with information about State Managed Funds that the Administrator requires to prepare reports and financial statements (s 22(1)). Implement a timely process for data provision upon request to meet reporting deadlines.
• Understand information law framework: the Act excludes certain Territory information/Ombudsman Acts (s 24(1)) and applies specified Commonwealth Acts as laws of the Territory to the Administrator subject to regulatory modification (s 25(1)-(2)). Consult with legal advisers to confirm which FOI/privacy/Ombudsman provisions apply in practice and prepare disclosure protocols consistent with those applied Commonwealth Acts and any modifications.

Inter-jurisdictional coordination and Ministerial Council directions

• Comply with First Ministers’ Council directions: the Administrator must comply with directions given by the First Ministers’ Council regarding the manner of exercising functions (s 10(3)-(4)). Maintain a process for reviewing and implementing such directions and for public release of the directions as required.
• Ensure distribution consistency: when issuing directions to the Administrator in respect of Commonwealth funds, responsible Ministers should ensure that directions are consistent with the Administrator’s advice to the Commonwealth Treasurer about the basis on which Commonwealth payments were calculated (s 15(1)). Retain written records demonstrating consistency.

Integration with Territory financial rules

• Treat NHFP accounts as Operating Accounts: the Financial Management Act amendments require NHFP accounts to be treated as Operating Accounts and specify receipts and payment rules (Pt 6, ss 33-36). Ensure agency accounting manuals and Treasurer’s Directions reflect the NHFP account status, and that Accountable Officers rely on NHFP Part 4 records where permitted (ss 35-36).

Operational checklists and timelines

• Opening accounts: CEO (Health) must open State Pool Account (s 11) and State Managed Fund (s 14) promptly after legislative commencement or as required. Confirm account numbers with RBA and bank signatories.
• Monthly reporting: Administrator must compile and publish monthly reports (s 17). Build an end-of-month process for aggregating payments, activity-based funding counts, and State Managed Fund flows, and schedule public publication.
• Year-end: prepare and finalise financial statements for each State Pool Account promptly after year-end for audit by the State Auditor-General, and ensure annual report is provided to responsible Ministers within four months of year-end (s 18(1)-(3)).

Risk mitigation and documentation

• Document ministerial directions, Administrator advice to the Commonwealth Treasurer, and reconciliation workpapers to show compliance with s 15(1) and to support any future disputes.
• Keep contemporaneous records of all authorisations, especially the Administrator’s personal authorisations for payments (s 13(3)).
• Establish internal protocols to coordinate with the National Health Funding Body staff support while preserving the Administrator’s statutory non-delegable functions (s 9(2)).

In practice, compliance under the Act involves aligning payment authorisation workflows, accounting systems and audit-ready reporting with the statutory requirement that the Administrator centrally calculate, monitor and report on NHRA flows while States retain the direction of disbursements. Documentation, timely information flows, and clarity on which information laws apply are essential to operational compliance.
