#### 43 Remuneration and allowances CEO and Chair of the Council (1) The CEO or the Chair of the Council is to be paid the remuneration, by way of a yearly amount, that is determined by the Remuneration Tribunal. If no determination of that remuneration by the Tribunal is in operation, he or she is to be paid the remuneration that is prescribed. Members of the Council and committees (2) A: (a) member of the Council, other than the Chair; or (b) member of a committee who is not also the Chair of the Council; is to be paid the remuneration, by way of sitting fees, that is determined by the Remuneration Tribunal. If no determination of that remuneration by the Tribunal is in operation, he or she is to be paid the remuneration that is prescribed. > Note: If the Chair of the Council is also a member of a committee, he or she is to be paid, in respect of his or her duties as such a member, the allowances that are prescribed under subsection (5). (3) If a member of the Council or a member of a committee is also: (a) in the service or employment of, or of an authority of, the Commonwealth, a State or a Territory on a full‑time basis; or (b) a person who holds or performs the duties of an office or position established by or under a law of the Commonwealth, a State or a Territory on a full‑time basis; the member is not, unless the member is the Chair of the Council and the Minister otherwise directs in writing, entitled to remuneration under this Act in respect of his or her duties as Chair of the Council, a member of the Council or a member of a committee. Commissioner (4) The Commissioner is to be paid the remuneration that is determined by the Remuneration Tribunal. If no determination of that remuneration by the Tribunal is in operation, he or she is to be paid the remuneration that is prescribed. Allowances (5) A person appointed under subsection 41(1) or (2) is to be paid the allowances that are prescribed. Remuneration Tribunal Act 1973 (6) This section has effect subject to the Remuneration Tribunal Act 1973.
