54 Meaning of shale gas extraction facility
(1) A facility is a shale gas extraction facility if: (a) the activity, or the series of activities, that constitutes the facility is or includes the extraction of gas from a geological formation by means of processes that include hydraulic fracturing; and (b) more than 90% of the gas extracted from the geological formation is shale gas; and (c) emissions from the extraction and use of gas from the geological formation would likely exceed 100 million tonnes of carbon dioxide equivalence in total if the formation were fully exploited. (2) A facility is also a shale gas extraction facility if: (a) the activity, or the series of activities, that constitutes the facility is the exploration of a geological formation that contains shale gas; and (b) processes that include hydraulic fracturing would be needed to extract gas from the formation; and (c) emissions from the extraction and use of gas from the geological formation would likely exceed 100 million tonnes of carbon dioxide equivalence in total if the formation were fully exploited.
