45 Revocation at request of responsible emitter

(1) This section applies if a facility is a trade‑exposed baseline‑adjusted facility in a particular financial year and the next 2 financial years because of a determination in force under section 42. (2) The responsible emitter for the facility may request that the Regulator revoke the determination. (3) The request must be made, in writing, before the end of the first 31 October after one of the financial years mentioned in subsection (1). (4) If the responsible emitter makes the request in accordance with subsection (3), the Regulator must: (a) revoke the determination; and (b) notify the responsible emitter, in writing, that the Regulator has done so. (5) The revocation takes effect at the start of the financial year in which the request was made. (6) This section does not limit subsection 33(3) of the Acts Interpretation Act 1901.
