National Environment Protection (Movement of Controlled Waste between States and Territories) Measure 1998

This Measure creates a national framework for state and territory systems governing movements of defined categories of waste between Australian States and Territories (clause 5). It does not itself operate as a stand‑alone regulatory code that directly prescribes criminal penalties; rather the Council made the Measure under section 14(1) of the National Environment Protection Council Act 1994 and equivalent state and territory Acts, and provides goals, environmental outcomes and guidance for implementation by participating jurisdictions (clauses 4, 11, 12, Introductory Note). The Measure sets out: (a) what counts as “controlled waste” for the purposes of interstate movements (clause 3; Schedule A Lists 1 and 2); (b) the information that must accompany consignments (Schedule B, and clause 13(f)); (c) recommended institutional arrangements such as licensing, mutual recognition of transport licences, prior notification by producers and consignment authorisations issued by destination agencies (clause 13(a)-(e)); (d) tracking and record keeping specifications, including a minimum retention period for records (clause 13(f), (h)); and (e) reporting to the National Environment Protection Council to support annual assessment of implementation (clause 13(i)).

Mechanically, the Measure requires participating jurisdictions to implement compatible systems so that controlled wastes moved interstate are identified, transported and handled consistent with “environmentally sound practices” (clause 11). The Measure expressly confines itself to interstate movements originating from commercial, trade, industrial or business activities and excludes intrastate movements (clause 5 and clause 8(a)). The Measure lists particular waste streams and hazard characteristics that make waste “controlled” (Schedule A Lists 1 and 2) and sets the content of producer, transporter and facility operator information that must accompany movements (Schedule B Parts 1-3). It instructs jurisdictions to ensure that producers obtain consignment authorisations from the destination agency before moving wastes (clause 13(c)) and that agencies should issue or refuse consignment authorisations within five working days of receiving a completed application (clause 13(g)(iv)).

Although the Measure contains specific operational expectations, much of its legal effect depends on participating jurisdictions adopting laws and administrative arrangements to implement the guidance (Introductory Note; clause 5). It also contains specific exclusions (clause 8), processes for limited exemptions where jurisdictions agree (clause 9), confidentiality principles (clause 15) and a required review timeline (clause 10). Enforcement is left to the jurisdictions, with the Measure envisaging that jurisdictions will take enforcement action where information is withheld or false information is provided, applying criteria such as nature of the offence and offender intent (clause 14).

Controlled waste, as the core legal concept, is defined by two linked elements. First, the Measure identifies categories of matter in Schedule A List 1, ranging from specific substances (eg asbestos, lead, mercury), classes of wastes (clinical wastes, tyres, residue streams), to broad operational waste types (waste from manufacture of solvents, waste pharmaceuticals) (Schedule A List 1). Second, Schedule A List 2 sets hazard characteristics, using UN Dangerous Goods classes (H1-H13) and other environmental impact reasons (for example, potential to adversely impact ambient air or water quality) to capture hazardous characteristics (Schedule A List 2). Clause 3 then declares that matter listed in List 1 is “controlled waste” if it has one or more characteristics listed in List 2; and it creates a presumption that wastes mentioned in List 1 are to be considered as having one or more List 2 characteristics unless the nominated agency in the destination jurisdiction is satisfied otherwise (clause 3).

Institutional concepts: the Measure operates through participating jurisdictions, agencies (nominated state/territory bodies) and the National Environment Protection Council (the Council). The Council’s role in the Measure is to set the national environment protection goal (clause 11), the desired environmental outcomes (clause 12), and to provide guidance on systems for movement (clause 13). Participating jurisdictions are required to implement the Measure by enacting laws or arrangements they consider necessary (Introductory Note; clause 5). Agencies are the bodies nominated by each jurisdiction to manage consignment authorisations, licences and records (clause 3 definition of “Agency”).

Operational instruments: Consignment Authorisation is the approval containing a unique identifier granted by the destination agency or a delegated facility to allow movement (clause 3). Licence has a broad definition encompassing licences, authorisations, permits, notices or approvals relating to a vehicle for the purpose of moving controlled wastes (clause 3). The Measure promotes licensing of transporters, mutual recognition of transporter licences issued by the business-establishment jurisdiction, and prior notification systems (clause 13(a)-(b), (c)-(e)).

Tracking and information standards are central. Clause 13(f) makes it mandatory that all controlled wastes transported under the Measure be accompanied by specified information: Part 1 of Schedule B for producers, Part 2 for transporters, and Part 3 for facility operators upon acceptance. The Measure anticipates electronic tracking but requires that information be available in printed or accessible form for police, emergency workers or authorised officers (Schedule B prefatory paragraph). Record keeping is addressed: jurisdictions should ensure records generated by tracking systems relating to Schedule B requirements are kept for not less than 12 months (clause 13(h)).

The Measure identifies specific categories of participants and assigns roles and expectations to each (clause 3 definitions and clause 13 “Obligations”). The primary private parties affected are producers, transporters and facility operators.

• Producers are defined as persons who produce or consign controlled waste or persons authorised by an agency to act on their behalf (clause 3). Producers are expected to obtain a consignment authorisation from the destination agency before movement (clause 13(c)) and to supply the information set out in Part 1 of Schedule B when moving wastes (clause 13(f)(i), 13(g)(i), Schedule B Part 1). The Measure imposes an evidential presumption that Schedule A List 1 wastes have List 2 characteristics unless the destination agency is satisfied otherwise, which places an evidential and compliance burden on the producer to classify and justify otherwise (clause 3).

• Transporters are persons responsible for moving controlled wastes between jurisdictions or through transit jurisdictions (clause 3). They are affected by licensing expectations: each originating jurisdiction should ensure movement is subject to a licence with sufficient control to enable mutual recognition between participating jurisdictions, and jurisdictions should agree to recognise the licence issued by the jurisdiction where the transporter is established for business purposes (clause 13(a)-(b)). Transporters must carry the information described in Schedule B Parts 1 and 2 when transporting controlled waste (clause 13(f)(ii), 13(g)(ii), Schedule B Part 2).

• Facility operators, defined as persons in charge of a facility receiving controlled wastes (clause 3), must provide the information specified in Schedule B Part 3 on acceptance, and should report any discrepancies noted between the information provided and actual consignment as required by the relevant agency (clause 13(f)(iii), 13(g)(iii), Schedule B Part 3).

Public agencies and regulators are affected in multiple ways. Each participating State or Territory must nominate an Agency to administer consignment authorisations and licensing (clause 3 definition of “Agency”), implement tracking systems (clause 13(f)), maintain records (clause 13(h)), and provide collated summary information to the Council for annual reporting (clause 13(i)). Agencies in the destination jurisdiction have decision-making power to issue or refuse consignment authorisations and are expected to consult where necessary before issuing authorisations (clause 13(d), (e), (g)(iv)-(v)). The Measure envisages agencies enforcing failures to provide information or false or misleading information, but it leaves the shape and severity of enforcement to jurisdictions based on offence nature and effectiveness (clause 14).

The Measure sets out duties and rights primarily as guidance for jurisdictions to implement. The key duties the Measure anticipates are allocated to producers, transporters, facility operators and agencies.

Duties of producers:

• Obtain a consignment authorisation from the destination agency or a delegated facility prior to movement (clause 13(c)). This is expressed as a should/should ensure obligation on jurisdictions but reads as a pre‑movement condition for compliance.
• Provide the Schedule B Part 1 information to accompany the consignment, including waste description, physical nature, waste codes, UN numbers, quantity, facility details, consignment authorisation number, producer ID, date of dispatch and emergency contact details (Schedule B Part 1; clause 13(f)(i); clause 13(g)(i)).

Duties of transporters:

• Hold the appropriate licence or authorisation for the movement of controlled wastes; jurisdictions should ensure licensing has sufficient control to permit mutual recognition (clause 13(a)-(b)).
• Carry the Schedule B information for producer and transporter as they move the waste (clause 13(f)(ii); clause 13(g)(ii); Schedule B Part 2 identifies transporter name, address, vehicle registration, transit states, transport licence number, date and type of transport).

Duties of facility operators:

• Provide information in Schedule B Part 3 upon acceptance of waste at the receiving facility, including type of treatment and date of receipt (clause 13(f)(iii); Schedule B Part 3).
• Report discrepancies between information supplied and actual consignment as required by the relevant agency (Schedule B Part 3; clause 13(g)(iii)).

Duties and expectations of agencies and jurisdictions:

• Issue, or refuse, consignment authorisations within five working days of receipt of a completed application (clause 13(g)(iv)). Agencies should provide an explanation to an applicant when refusing, consistent with relevant state or territory legislation (clause 13(g)(v)).
• Maintain records generated by tracking systems for not less than 12 months (clause 13(h)).
• Provide collated summary information to the Council to facilitate annual reporting, including movements into each jurisdiction by origin, waste code and quantity; discrepancy rates; and benefits from implementation (clause 13(i); note that this reporting requirement is referenced to section 23 of the Commonwealth Act).

The Measure does not itself prescribe specific statutory penalties or a single national enforcement regime. It contemplates enforcement but leaves substance and sanctions to participating jurisdictions. Clause 14 explicitly states that where a producer, transporter or facility operator does not furnish required information or provides false or misleading information, “enforcement action will be taken by that jurisdiction” and that such action should take into account the nature of the offence, intent, repeat occurrences and effectiveness in achieving desired outcomes (clause 14(a)-(b)). The wording “Council envisages” indicates this is an expectation for jurisdictions rather than a prescriptive federal sanction contained in the Measure itself.

Operationally, enforcement mechanisms will therefore be the relevant state or territory laws and administrative enforcement tools adopted to implement the Measure (Introductory Note; clause 5). The Measure requires agencies to provide explanations for refusals of consignment authorisations consistent with their state or territory legislation (clause 13(g)(v)), which implies that administrative law principles (review, merits and/or judicial review) under state frameworks will govern disputes about agency decisions. The Measure points agencies to apply their existing legislative frameworks for confidentiality claims (clause 15(c)), including the Commonwealth’s Freedom of Information Act 1982 for national security claims (clause 15(c)(i)).

Record-keeping and reporting obligations are set out with a minimum retention period: jurisdictions should ensure that records generated by the tracking system relating to Schedule B requirements are kept for not less than 12 months (clause 13(h)). Failure to keep such records may be dealt with under the implementing laws of the jurisdiction. Agencies are also expected to compile and furnish summary information to the Council for annual reporting (clause 13(i)), which creates administrative obligations on agencies that can be used for oversight and performance assessment.

Because the Measure delegates enforcement to jurisdictions, the penalties and enforcement costs vary by state and territory depending on the laws enacted to give effect to the Measure. The Measure itself does not create interstate enforcement instruments, cross-border sanctions or a national penalty schedule. Instead, the Measure anticipates that participating jurisdictions will take enforcement action consistent with local law and with reference to the nature and intent of contraventions (clause 14). This design means that enforcement predictability for private parties depends on the particular state or territory implementing steps, the legal instruments adopted, and how those jurisdictions interpret “effectiveness in achieving the desired outcome” as an enforcement criterion.

The Measure is explicit that it is implemented by participating jurisdictions through laws and arrangements those jurisdictions consider necessary (Introductory Note; clause 5). It therefore operates as a template and set of expectations to be given effect by state and territory legislative and administrative instruments.

Specific statutory interactions are flagged in the Measure itself. Clause 8(c) excludes movements governed by the Hazardous Waste (Regulation of Exports and Imports) Act 1989 from the Measure, thereby segregating the domestic interstate regime envisaged here from the federal export/import control regime for hazardous wastes. Clause 15(c)(i) expressly refers to the Freedom of Information Act 1982 as part of the Commonwealth legislative framework that may be applied when assessing national security claims for confidentiality. Clause 13(i) references section 23 of the Commonwealth Act as the statutory basis for the Council’s requirement for annual reporting on implementation and effectiveness, indicating a direct procedural link to the Commonwealth Act’s reporting architecture.

Operationally, the Measure expects states to rely on their existing environmental protection laws, licensing regimes and administrative procedures. For example, the Measure expects agencies to provide reasons for refusal of consignment authorisations consistent with relevant state or territory legislation (clause 13(g)(v)). That implies interaction with administrative law principles in each jurisdiction (procedural fairness, review rights) and with environmental protection, waste management and transport licensing statutes particular to the state or territory.

The Measure’s mutual recognition aim (clause 13(a)-(b)) interacts with licence regimes in the jurisdictions where transporters are established. If states adopt mutual recognition as recommended, a licence issued by the transporter’s state of business establishment would be recognised solely for the purpose of interstate movements under this Measure. The Measure does not, however, itself impose a national licence; recognition rests on jurisdictions implementing mutually compatible licensing standards.

Exemptions under clause 9 require written agreement between affected jurisdictions, and such agreements must be part of public reporting obligations. Thus, implementation of exemptions will interact with each jurisdiction’s public reporting and administrative transparency obligations. Where an exemption touches on product stewardship or extended producer responsibility schemes, those schemes must be “approved by the affected participating jurisdictions” (definitions of “Approved extended producer responsibility scheme” and “Approved recycling scheme” in clause 3), tying these exemptions into any state-based or national schemes that have approval mechanisms.

The compilation states the Measure was originally made on 8 July 1998 and lists subsequent variations and a minor variation, with the compilation prepared on 1 December 2012 taking into account amendments up to and including National Environment Protection (Movement of Controlled Waste between States and Territories) Measure Minor Variation 2012 (No. 1) (Notes, Table of Instruments). The Table of Instruments records:

• National Environment Protection (Movement of Controlled Waste between States and Territories) Measure , Gazette 8 July 1998 (commencement 8 July 1998);
• Variation 20 December 2004 (commencement 20 December 2004);
• Variation (No. 1) 29 November 2010 (commencement 30 November 2010);
• Minor Variation 2012 (No. 1) , Gazette 30 November 2012 (commencement 1 December 2012).

The Table of Amendments indicates which clauses and Schedules were amended by those instruments. Notably:

• Clause 1 was repealed and substituted by the 2012 Minor Variation (Table of Amendments: “C. 1 rs. 2012 No. 1”).
• Clause 3 (definitions) has been amended by the 2004 Variation, the 2010 Variation No. 1 and the 2012 Minor Variation (Table: “C. 3 am. Variation 2004; 2010 No. 1; 2012 No. 1”).
• Clause 8 and Clause 9 have been amended by the 2004 Variation and later variations (Table entries for C. 8 and C. 9).
• Clause 10 (Review) was amended by the 2010 Variation No. 1 and later repealed/substituted in 2012 (Table: “C. 10 am. 2010 No. 1; rs. 2012 No. 1”).
• Clause 12 was repealed in the 2012 variation (Table: “C. 12 rs. 2012 No. 1”).
• Clause 13, Clause 15, Schedule A and Schedule B were amended by the 2010 and 2012 instruments (Table entries).

The Notes record the instruments and that the compilation accounts for each. The Measure therefore has been updated periodically, reflecting changes to definitions, procedural clauses, Schedules and other provisions. The compilation does not provide the text of earlier versions or a comparative table of textual change; it records only which parts were amended and by which instrument. The presence of multiple variations indicates that participating jurisdictions and the Council have adjusted the Measure’s definitions, operational clauses and Schedules over time. The requirement in clause 10 for a periodic review, to consider effectiveness, resourcing and whether Schedule changes are required, provides a statutory mechanism for amendment through Council endorsement and consequent legislative or administrative action by jurisdictions.

The Measure itself does not record judicial decisions or litigation. The compilation contains no case citations and the text of the Measure does not reference any specific litigation outcomes. Because the Measure is implemented by participating jurisdictions through their laws and administrative arrangements, litigation about consignment authorisations, licensing, confidentiality or enforcement would ordinarily appear in state and territory courts or federal administrative fora under those implementing laws rather than in proceedings naming the Measure itself.

Relevant dispute loci indicated by the Measure include:

• Administrative decisions on consignment authorisations and refusals, which the Measure says agencies should explain consistent with state or territory legislation (clause 13(g)(v)). Any merits review or judicial review claims about refusal decisions would therefore be handled under the relevant state or territory administrative law regimes and judicial processes.
• Confidentiality decisions assessed under the Freedom of Information Act 1982 for national security claims and under state frameworks for commercial sensitivity claims (clause 15(c)). FOI determinations and related litigation typically produce administrative review and judicial review proceedings in federal or state courts or tribunals.
• Enforcement actions for failing to provide required information or providing false or misleading information are to be taken by the relevant jurisdictions (clause 14). That means prosecutions or administrative penalty proceedings will be brought under the particular implementing statutes or regulations, and any litigation records would appear in those jurisdictions’ courts.

Because the Measure delegates enforcement and much of the substantive regulatory mechanics to participating jurisdictions, a search for litigation relevant to its operation should include state and territory environmental protection, transport and administrative law cases concerning consignment refusals, licence recognition disputes, record‑keeping breaches and confidentiality disputes. The Measure’s text does not identify any litigated points of law, nor does it provide precedent or specific sanction amounts. Practitioners therefore cannot rely on the Measure alone to determine the legal consequences of non‑compliance; they must examine the implementing statutes and any case law interpreting those statutes in the jurisdictions where the waste movement, consignment decision or enforcement action occurred.

Several operational and legal “gotchas” arise directly from the Measure’s wording and architecture; practitioners and compliance officers should note the following items grounded in the text.

1. Scope limited to interstate movements: The Measure does not apply to intrastate movements (clause 8(a)). If a business moves waste across local government areas but within the same state, the Measure is not engaged and the state’s intrastate regime applies. Treating an intrastate movement as covered when it is not could lead to unnecessary administrative steps or reliance on incorrect national reporting.

2. Presumption of hazard: Schedule A List 1 wastes are presumed to possess one or more List 2 characteristics unless the destination agency is satisfied otherwise (clause 3). Producers should be prepared to substantiate contrary characterisation to the destination agency; failure to do so may lead to refusal of consignment authorisation or additional controls.

3. Consignment authorisation timing: The Measure requires producers to obtain consignment authorisation from the destination agency prior to movement (clause 13(c)). Moving waste before approval risks non‑compliance and leaves enforcement to the destination jurisdiction (clause 14). The Measure expects agencies to decide within five working days of a completed application (clause 13(g)(iv)); incomplete applications may delay authorisation and movement.

4. Information carriage in emergencies and electronic systems: Even where jurisdictions adopt electronic tracking, the information required should also accompany wastes in printed form or an approved accessible form for police, emergency workers or authorised officers (Schedule B prefatory paragraph). Relying solely on an electronic record that is not accessible in an emergency could breach the Measure’s expectations.

5. Record retention is only 12 months under the Measure’s guidance (clause 13(h)). Jurisdictions may implement longer retention periods, but the Measure sets a floor. Organisations should verify the implementing jurisdiction’s retention rules to avoid under-retaining documents that local law requires to be kept longer.

6. Exemptions require inter-jurisdictional written agreement and public reporting: Geographic, direct reuse, Extended Producer Responsibility and Approved Recycling Scheme exemptions must be formalised through written agreement of affected jurisdictions and provided as part of public reporting, and those jurisdictions must consider that the exemption does not derogate from the Measure’s goal (clause 9). Informal or unilateral exemptions will not satisfy the Measure’s conditions.

Compliance requires coordinated action by producers, transporters, facility operators and agencies, with attention to jurisdictional implementation. The Measure sets out a clear pathway that jurisdictions are expected to follow; the following step‑by‑step checklist maps those expectations to the Measure’s provisions.

1. Classify the waste:

• Refer to Schedule A List 1 to determine if the matter is listed and then to Schedule A List 2 to determine if it has one or more listed characteristics (clause 3; Schedule A Lists 1 and 2).
• If the waste falls into List 1, prepare to treat it as controlled waste unless and until the destination agency is satisfied that List 2 characteristics are absent (clause 3).

2. Secure consignment authorisation before movement:

• Producers must obtain a consignment authorisation from the destination agency or a delegated facility prior to movement (clause 13(c)).
• Prepare a completed application with the information required in Schedule B Part 1 to avoid delays; note agencies are expected to issue or refuse within five working days once a completed application is received (clause 13(g)(iv)).

3. Prepare the documentation required to accompany the consignment:

• Producer documentation: Schedule B Part 1 , ensure inclusion of waste description (proper shipping name), physical nature, waste code(s), UN numbers and codes, DG class and subsidiary risk, packaging group, amount, package type and number, facility name and licence number, jurisdiction of destination, producer name and contact details, emergency contact, consignment authorisation number, producer ID and dispatch date (Schedule B Part 1; clause 13(f)(i)).
• Transporter documentation: Schedule B Part 2 , transporter name and address, vehicle registration(s), transit states/territories, transport licence numbers, date and type of transport (Schedule B Part 2; clause 13(f)(ii)).
• Facility documentation: Schedule B Part 3 , facility to complete type of treatment at facility and date of receipt; report discrepancies as required by the relevant agency (Schedule B Part 3; clause 13(f)(iii), 13(g)(iii)).

4. Ensure carriage of information during transport and emergency accessibility:

• If electronic tracking is used, ensure printed hard copy or an approved accessible form accompanies the consignment for police, emergency workers or authorised officers (Schedule B prefatory paragraph). This is required for compliance with the Measure’s expectations.
