sec.302 Applications for judicial review of decisions of the AEMC
A person aggrieved by— a decision or determination of the AEMC under this Law, the National Regulations or the Rules; or a failure by the AEMC to make a decision or determination under this Law, the National Regulations or the Rules; or conduct engaged in, or proposed to be engaged in, by the AEMC for the purpose of making a decision or determination under this Law, the National Regulations or the Rules, may apply to the Court for judicial review of the decision or determination, failure or conduct or proposed conduct. The AER is subject to judicial review under the Administrative Decisions (Judicial Review) Act 1977 of the Commonwealth. Unless the Court otherwise orders, the making of an application to the Court under subsection (1) does not affect the operation of the decision or determination referred to in that subsection or prevent the taking of action to implement the decision or determination. (sec.302-ssec.1) A person aggrieved by— a decision or determination of the AEMC under this Law, the National Regulations or the Rules; or a failure by the AEMC to make a decision or determination under this Law, the National Regulations or the Rules; or conduct engaged in, or proposed to be engaged in, by the AEMC for the purpose of making a decision or determination under this Law, the National Regulations or the Rules, may apply to the Court for judicial review of the decision or determination, failure or conduct or proposed conduct.
