73 Subsequent payments

(1) Subject to sections 81 and 82, VicGrid, for each relevant year, must ensure that a payment is made, in accordance with the regulations, to an eligible person in relation to the relevant transmission interest of either—
(a) an amount calculated in accordance with section 74; or

(b) if VicGrid considers that exceptional circumstances exist, an amount greater than the amount described in paragraph (a) calculated in accordance with any guidelines made under section 79(1)(b).

(2) In determining whether exceptional circumstances exist for the purposes of subsection (1)(b), VicGrid—

(3) VicGrid must ensure that a payment to an eligible person under subsection (1) is made—
(a) if a day is prescribed for the purposes of this subsection, on or before that day; or
(b) if no day is prescribed for the purposes of this subsection, on or before the day of the relevant year that is the anniversary of the registration of the relevant transmission interest.
***relevant year*** means—
(a) the year beginning on the first anniversary of the registration of the relevant transmission interest; and
(b) each subsequent year for a period of 23 years.
