What it does
These regulations, titled the National Electricity (South Australia) (Local Provisions) Regulations 2019, perform two discrete mechanical functions.
First, they modify the application of the National Electricity Rules (the Rules) insofar as those Rules form part of the law of South Australia. The modifications are focussed on the retailer reliability obligation regime and the T‑3/T‑1 reliability instrument processes. Regulation 3 instructs that, when the South Australian Minister makes a T‑3 reliability instrument under section 19B of the National Electricity (South Australia) Act 1996 (the Act), specified Parts and provisions of the Rules are to be read as if references to a forecast reliability gap period or forecast reliability gap include the period or gap specified in the Minister’s instrument (reg 3(1)(a)-(b)). Regulation 3(1)(ba) and 3(1)(c) insert the Minister as an alternative trigger in two specific Rules provisions (Rule 4A.C.5(a) and Rule 4A.H.3(a)(1)) so that the Rules operate not only when the Australian Energy Regulator (AER) makes a T‑3 instrument but also when the South Australian Minister does so.
Second, the regulations make a local declaration under the National Electricity Law that a particular stand‑alone power system forms part of the national electricity system. Regulation 4 declares that the stand‑alone power system comprised of the distribution network described in the maps annexed to the licence granted by the South Australian Independent Industry Regulator on 11 October 1999 (the licence held by SA Power Networks (ACN 332 330 749) and as varied from time to time) forms part of the national electricity system, in accordance with section 6B of the National Electricity Law.
The instrument also contains targeted textual amendments to Rule operation for a subset of T‑3/T‑1 instruments referred to in s 19B(8) of the Act (reg 3(2)). Those amendments change timing and numerical parameters in several Rules (for example, deleting "second" and substituting "first" in Rule 4A.C.3(b)(3) (labelled in the regulations as (i1)); changing a day to "the day that falls 6 months before the first day of the reliability gap period" in Rule 4A.C.10(b) (reg 3(2)(a)(i)); substituting an 18‑month reference in Rule 4A.D.7 with "that falls 6 months before the contract position day" (reg 3(2)(a)(ii)); changing a numeric 5 to 20 in Rule 4A.G.16(a)(1) (reg 3(2)(a)(iii)); and replacing subparagraph text in Rule 4A.G.16(d)(1) with "(1) the contract position day" (reg 3(2)(a)(iv)). Additionally, if the AER has not established an Auditors Panel under Rule 4A.E.5(a) by a specified date, references to an Independent Auditor in parts of Rule 4A.E.5 are to be read as references to an auditor appointed from a panel established and maintained by the South Australian Minister (reg 3(2)(b)).
