33 Application of amendments

(1) The amendments of Subdivisions A to C of Division 2 of Part 3 made by Schedule 1 to the National Disability Insurance Scheme (Complaints Management and Resolution) Amendment (Dealing with Complaints) Rules 2025 apply in relation to the following: (a) a complaint made on or after the commencement of this section; (b) a complaint made before the commencement of this section if the Commissioner had not made a decision on the complaint before that commencement. (2) The amendments of sections 26 and 27 made by Schedule 1 to the National Disability Insurance Scheme (Complaints Management and Resolution) Amendment (Dealing with Complaints) Rules 2025 apply in relation to the following: (a) an application for reconsideration of a decision, where the application is made on or after the commencement of this section (whether the decision is made before, on or after that commencement); (b) an application for reconsideration of a decision, where the application is made before the commencement of this section if the Commissioner had not made a decision on the application before that commencement. (3) The amendments of section 28 made by Schedule 1 to the National Disability Insurance Scheme (Complaints Management and Resolution) Amendment (Dealing with Complaints) Rules 2025 apply in relation to an original decision made before, on or after the commencement of this section, whether the complaint the subject of the original decision was made before, on or after that commencement.
