What it does
This Act is a personal statute applying solely to the Honourable Donald Gerard Stewart, the first Chairman of the National Crime Authority (NCA). It ensures that if he resigned his office as a Judge of the Supreme Court of New South Wales, either before or after the Act commenced, he retains the rank, status and conditions of service equivalent to a Judge of the Supreme Court of the Australian Capital Territory (ACT) while serving in certain Commonwealth offices. The offices covered are: Chairman of the NCA (s 5(a)); Chairperson of the Resource Assessment Commission (RAC) (s 5(aa)); and any other full‑time office under the Commonwealth declared by the Governor‑General by notice published in the Gazette (s 5(b)). The Act also overrides the ordinary conditions of service provisions of the National Crime Authority Act 1984 and the Resource Assessment Commission Act 1989, replacing them with conditions (including leave entitlements) that are, with appropriate changes, the same as those applicable to an ACT Supreme Court judge (s 7(1), (1A)).
Mechanically, the Act does several things. It deems Stewart’s service as NCA Chairman and RAC Chairperson to be service as a judge for the purposes of the Judges’ Pensions Act 1968 (s 8(a), (aa)). It pegs his pension‑related “appropriate current judicial salary” to the salary of a New South Wales Supreme Court judge (s 8(b)). It aggregates his periods of service as a NSW Supreme Court judge, NSW District Court judge, NCA Chairman, and RAC Chairperson for the purpose of long leave entitlements (s 7(2)(b)). It defers any payment under the Judges (Long Leave Payments) Act 1979 until he ceases to hold a full‑time Commonwealth office, and recalculates the amount based on the NSW Supreme Court judge salary at that later time (s 7(4)). Finally, it modifies the to permit Stewart to be appointed as a full‑time Deputy President of the AAT even while he holds the NCA or RAC offices (s 9(1)), and it prevents double‑dipping on remuneration when he holds both a qualifying office and the AAT Deputy President role (s 9(2), (3)).
