88Applying for orders to deliver travel documents

#### 88 Applying for orders to deliver travel documents (1) The Commissioner may apply to a Judge of the Federal Court for an order that a person deliver a travel document to the Commissioner if: (a) either of the following apply: (i) a summons has been issued requiring the person to attend a hearing (whether or not the summons has been served); (ii) the person has appeared at a hearing to give evidence or to produce documents or things; and (b) there are reasonable grounds to believe that the person may be able: (i) to give evidence, or further evidence, that is relevant to the corruption investigation concerned; or (ii) to produce documents or things, or further documents or things, that are relevant to the investigation concerned; and (c) there are reasonable grounds to suspect that the person has a travel document and intends to leave Australia. (2) Each of the following is a travel document: (a) an Australian travel document that has been issued to the person; (b) a passport or other travel document that has been issued to the person by or on behalf of the government of a foreign country. (3) The Commissioner must give the Judge information on oath, or by affirmation, in support of the grounds for the application.
