103Making investigation material available to courts

#### 103 Making investigation material available to courts (1) This section applies if: (a) a person has been charged with an offence before a federal court or a court of a State or Territory; and (b) the court considers it desirable, in the interests of justice, that the investigation material be made available to the person or to a legal practitioner representing the person. (2) The court may give the Commissioner a certificate to that effect. (3) If the court does so, the Commissioner must make the investigation material available to the court. (4) If, after examining the investigation material, the court is satisfied that the interests of justice so require, the court may make the material available to any of the following: (a) the person or a legal practitioner representing the person; (b) if the person is not the witness in relation to the material—the prosecutor of the person.
