The Plan organises land use control around several recurring legal and planning concepts. Each is used repeatedly to translate planning objectives into decision‑making rules and mapped constraints.

• Zoning and Land Use Table (cl 2.1-2.3 and Land Use Table). The Plan follows the standard instrument approach: land is allocated to zones (RU1, RU3, RU4, RU5, R5, E4, SP2, RE1, C1, C2, C4, W1, W2) and the Land Use Table prescribes objectives for each zone, development permissible without consent, development permissible with consent, and prohibited development. Decision‑makers must have regard to the zone objectives when assessing applications (cl 2.3(2)).

• Maps and mapped standards (cl 1.7). The Plan depends heavily on maps , Land Zoning Map, Lot Size Map, Watercourse Map, Terrestrial Biodiversity Map, Groundwater Vulnerability Map, Wetlands Map, Heritage Map and others. Those maps are the operative spatial instruments that trigger different clauses and controls. The Plan allows maps to be amended and requires them to be publicly available (cl 1.7).

• Consent authority discretion and procedural requirements (cl 1.6; numerous Part 6 clauses). The Plan repeatedly frames rules as presumptions requiring the consent authority to be satisfied before granting development consent. Many clauses require the consent authority to consider specified impacts and mitigation measures, and to be satisfied that impacts are avoided, minimised, or mitigated (see cl 6.3-6.10).

• Exempt and complying development (cl 3.1-3.3; Schedule 2; Schedule 3). The Plan recognises exempt development and complying development categories, but it excludes environmentally sensitive areas from exempt/complying development (cl 3.3). The Plan defers to State SEPPs but may add local exempt or complying items.

• Development standards and exceptions (cl 4.1, cl 4.6). Minimum lot sizes and a suite of rural subdivision controls govern fragmentation risk. Clause 4.6 creates an exceptions mechanism for contravening a development standard, subject to an applicant demonstrating that compliance is unreasonable or unnecessary and that sufficient environmental planning grounds exist. Clause 4.6 also expressly limits the scope of exceptions for particular standards (cl 4.6(8)).

• Heritage protection (cl 5.10; Schedule 5). The Plan lists many heritage items and requires development consent for demolition, alteration or subdivision affecting listed heritage items, archaeological sites or Aboriginal places. It sets out notification and consultation obligations (Heritage Council and local Aboriginal communities) and enables the consent authority to require heritage management documents or conservation management plans.

• Environmental overlay controls (Part 6). Separate clauses apply where mapped overlays or sensitive areas are present , terrestrial biodiversity (cl 6.4), groundwater vulnerability (cl 6.5), riparian land and watercourses (cl 6.6), wetlands (cl 6.7), salinity (cl 6.8), river front and riverbed development (cl 6.9, cl 6.10). These overlays impose substantive hurdles and mandatory considerations before consent can be granted.

• Special local provisions. The Plan includes locally specific protections and processes: suspension of covenants to enable development consistent with the Plan (cl 1.9A, with enumerated exceptions), defence communications buffer consultation and prohibitions (cl 5.15), airport obstacle/airspace consultation and ANEF‑based noise controls (cl 6.11, cl 6.12), and a music protection clause that constrains refusal grounds for licensed premises (cl 5.20).

• Public land classification and discharge of trusts (cl 5.2; Schedule 4). The Plan reclassifies certain public land to operational or community land and sets out the effect on trusts and interests (cl 5.2).

Taken together these concepts produce a two‑track instrument: mapped, categorical rules (zones, maps, lot sizes, prohibited development) and discretionary, criteria‑based rules (satisfaction tests, environmental assessments, consultation and notification obligations).

The Plan allocates regulatory rights and obligations across a range of public and private actors. Key affected parties are the following.

• Landowners and applicants. The Plan governs what uses landowners may lawfully undertake without consent, what uses require development consent, and what uses are prohibited (cl 2.3 and the Land Use Table). Owners proposing subdivision must obtain consent (cl 2.6) and must meet minimum lot size requirements set on the Lot Size Map (cl 4.1). Owners of land within environmental overlays face additional consenting hurdles and must supply project‑specific information and mitigation measures (Part 6). Landholders with development applications lodged before commencement have procedural protection under cl 1.8A.

• Consent authority (Council). The Plan explicitly makes the Council the consent authority subject to the Act (cl 1.6). • State agencies and Commonwealth bodies. The Plan integrates other statutory agencies into the decision‑making chain. For instance, a consent authority must consult or be satisfied certain State or Commonwealth bodies have been consulted in specific circumstances: notification to the Heritage Council for archaeological sites (cl 5.10(7)), consultation with the Secretary of the Commonwealth Department of Defence for development on defence communications facility buffer land (cl 5.15(3)), and consultation with the relevant Commonwealth body for development that will penetrate the airport Limitation or Operations Surface (cl 6.11(2)). State SEPPs that prevail remain operative over the Plan (cl 1.9).

• Industry sectors with sectoral rules. Agriculture, aquaculture and intensive livestock operators are directly affected by specific thresholds and locational constraints (cl 5.18, cl 5.19, Schedule 6). For example small feedlots or small poultry farms may be allowed without consent subject to separation distances, while larger operations require consent and environmental assessment (cl 5.18(4)-(5)). Oyster aquaculture has separate permissions and priority areas under cl 5.19.

• Crown and public authorities. The Plan preserves the Crown’s ability to use existing Crown buildings and does not restrict development permitted by State SEPP Chapter 2 infrastructure rules (cl 5.12). The Plan also sets which State authority will be the “relevant acquisition authority” for owner‑initiated acquisition under the Land Acquisition (Just Terms Compensation) Act as mapped (cl 5.1).

• Service providers and certifiers. Complying development certificates and complying development conditions are part of the system (cl 3.2(4)). Private certifiers, fire alarm monitoring service providers and other professionals will be implicated where complying development or permitted works interact with building regulation and monitoring arrangements (for example cl 5.8 on conversion of fire alarms).

Who pays. The Plan assigns most economic and compliance costs to applicants and landowners: costs of preparing statements of environmental effects, heritage management documents, heritage conservation management plans, additional mitigation measures (stormwater retention, biodiversity mitigation), and fees for applications. The Council bears administrative costs for processing consents and undertaking notifications and consultations, and State and Commonwealth agencies bear consultation costs when requested to advise.

Who decides. The Council, as consent authority under cl 1.6, makes primary development decisions within the statutory constraints of the Plan, State SEPPs and the Environmental Planning and Assessment Act.

The Plan prescribes a set of duties for the consent authority, applicants and public authorities and confers rights in the form of permitted uses, exemptions and development assessment pathways.

• Duty to apply zone objectives and Land Use Table (cl 2.3). The consent authority must have regard to objectives for the zone when determining applications. The Land Use Table sets the baseline legal rights to carry out particular development either without consent or only with consent.

• Duty to use and keep maps (cl 1.7). The Plan requires maps to be kept and made publicly accessible, and allows maps to be combined, amended and kept in electronic or paper form.

• Duty to determine pre‑existing development applications in accordance with the prior instrument (savings provision) (cl 1.8A). If an application was made before Plan commencement and not finally determined, it must be determined as if the Plan had not commenced.

• Duty to apply State policies that prevail (cl 1.9). The Plan is subject to State environmental planning policies that might override the Plan under the Act.

• Duty to consider and be satisfied about specific matters before granting consent. The Plan repeatedly uses "must be satisfied" language across Part 6 and elsewhere. Examples include:

  • Stormwater: consent authority must be satisfied development maximises permeable surfaces, incorporates on‑site stormwater retention where practicable, and avoids significant adverse impacts (cl 6.3).
  • Terrestrial biodiversity, groundwater vulnerability, riparian land and wetlands: consent authority must consider specified impacts and must not grant consent unless the development is designed, sited and will be managed to avoid, minimise or mitigate significant adverse impacts (cl 6.4-6.7).
  • Flood planning: consent authority must be satisfied development is compatible with flood function and will not adversely affect flood behaviour or safe evacuation (cl 5.21).
  • Defence communications buffer: consent authority must consult Defence and must not grant consent for specified uses unless Defence has indicated no adverse effect (cl 5.15).
  • Airport airspace: consent authority must consult the relevant Commonwealth body if development will penetrate Limitation or Operations Surface, and must refuse consent if the Commonwealth objects (cl 6.11).

• Duty to require and consider heritage assessment and consultation (cl 5.10). For development affecting heritage items, archaeological sites or Aboriginal places the consent authority may require heritage management documents, conservation management plans and must notify the Heritage Council (cl 5.10(5)-(9)), and must notify local Aboriginal communities for Aboriginal places (cl 5.10(8)).

• Duty to apply exceptions and record assessments (cl 4.6). If a development standard is to be contravened, applicants must demonstrate why compliance is unreasonable or unnecessary and produce environmental planning grounds, and the consent authority must keep a record of its assessment (cl 4.6(3)-(4)). The Plan also limits exceptions for certain standards (cl 4.6(6), 4.6(8)).

• Right to exempt or comply without consent under specified conditions (cl 3.1, cl 3.2). Certain minimal impact works are exempt if they meet the Schedule 2 standards and Building Code requirements; complying development is defined in Schedule 3 subject to meeting the specific standards.

• Right to temporary use for up to 52 days (cl 2.8). The Plan permits the consent authority to grant temporary use for a maximum of 52 days in any 12 month period, with prescribed satisfaction criteria.

• Right for conservation incentives (cl 5.10(10)). The consent authority may grant consent to otherwise disallowed development on heritage land if it facilitates conservation, subject to conditions including an approved heritage management document and required conservation works.

• Right to suspend covenants to enable development consistent with the Plan (cl 1.9A). Private covenants and similar instruments that restrict carrying out of development consistent with this Plan do not apply to the extent necessary to allow that development, subject to enumerated exceptions. • Rights and obligations in relation to public land classification (cl 5.2). The Plan classifies and reclassifies particular public land in Schedule 4 and sets out the effect on trusts and dedications.

The text places obligations on the consent authority and applicants; enforcement mechanisms and sanctions (offences, penalty notices, orders, injunctions) arise under the Act and the regulations rather than inside the Plan.

Where the Plan imposes consent conditions or requires specific approvals, non‑compliance with those consent conditions will typically be enforced under the Environmental Planning and Assessment Act (for example via orders, notices to rectify, fines and prosecutions in accordance with the Act and the regulations). The Plan does, however, build in specific procedural obligations that establish enforcement touchpoints:

• Development consent triggers. The Plan identifies activities that require development consent (for example demolition, subdivision and many listed uses in the Land Use Table). Undertaking development that is not allowed without consent will be subject to enforcement action under the Act.

• Complying development certificate conditions. Where complying development is permitted, development must comply with conditions set out in Schedule 3 and in the State SEPP for Exempt and Complying Development Codes. Certifiers must ensure compliance with those requirements.

• Recorded documentation. The consent authority must keep records of assessments under clause 4.6(4) where a standards exception is granted, creating evidentiary records for enforcement and review.

• Consultation and notification obligations linked to statutory agencies. Failure to discharge prescribed notification steps (for example Heritage Council or Aboriginal community consultation where required under cl 5.10) may expose consent decisions to challenge or require further process.

• Suspension of covenants preserves public authority rights under registered instruments (cl 1.9A(3)). The Plan expressly does not affect public authority rights under registered instruments, which may create separate enforcement avenues.

The Plan therefore relies on the statutory enforcement framework of the Environmental Planning and Assessment Act, State policies and other Acts it references. Practitioners seeking specific penalty amounts or enforcement processes must consult the Act, regulations and enforcement instruments of the relevant authorities because this Plan does not itself set fines or criminal offences.

The Plan integrates with and defers to a wide range of State and Commonwealth laws and policies. The instrument explicitly cross‑references many Acts and State environmental planning policies; it is designed to sit inside the larger statutory ecosystem.

• Supremacy and State policies. The Plan is subject to State environmental planning policies that prevail under section 3.28 of the Act (cl 1.9(1)). The Plan therefore co‑exists with SEPPs such as SEPP (Housing) 2021 and others listed in the Land Use Table notes. Practically, a State SEPP may override a conflicting local provision.

• Environmental Planning and Assessment Act. • Maps are operative. Many controls are map‑triggered (Lot Size Map, Watercourse Map, Terrestrial Biodiversity Map, Groundwater Vulnerability Map, Wetlands Map, Defence Communications Facility Buffer Map, Land Reservation Acquisition Map). Check the maps first. The text repeatedly ties obligations to map identification (cl 1.7, cl 4.1, Part 6 clauses).

• Savings rule for pending applications. If a DA was lodged before the Plan commenced and not finally determined, it must be determined as if the Plan had not commenced (cl 1.8A). • Suspension of covenants has limits. • Music and licensed premises. • Aquaculture and intensive livestock thresholds. Certain smaller scale livestock operations may be carried out without consent subject to strict locational buffers and capacity thresholds (cl 5.18(4)-(5)). Likewise, pond/tank aquaculture is subject to species, discharge and pond design rules in Schedule 6. Failure to observe the specified buffers or operational constraints can convert an exempt/allowed activity into a prohibited or non‑compliant use.

• Temporary uses cap and sales offices exception. Temporary uses are capped at 52 days in any 12 months (cl 2.8(2)), but temporary use of a dwelling as a sales office for a new release area may exceed that period (cl 2.8(4)). Clarify the intended use before relying on the 52‑day rule.

• Minimum lot size and rural dwelling entitlements. Subdivision is only permitted with consent and subject to minimum lot sizes on the Lot Size Map (cl 2.6; cl 4.1). Clause 4.2C places a range of constraints on dwelling erection in rural zones (including existing holding rules and replacement dwelling rules). Strata subdivision standards for residential/tourist uses in rural zones are limited (cl 4.2A).

• Essential services precondition. Development consent must not be granted unless the consent authority is satisfied essential services are available or adequate arrangements exist (cl 6.13). This is a practical hurdle in unsewered or remote areas.

• Public land classification and trust discharges. Compliance means aligning the proposed project with the Plan’s mapped triggers, land use permissions, overlay rules and the procedural obligations imposed on applicants. Recommended practical steps follow, grounded in the Plan’s clauses and schedules.

1. Confirm zoning and maps. Start with the Land Zoning Map and the Lot Size Map to determine permitted uses, minimum lot sizes and whether the land is within any mapped overlays (Terrestrial Biodiversity Map, Watercourse Map, Groundwater Vulnerability Map, Wetlands Map, Defence Communications Facility Buffer Map, Heritage Map, Land Reservation Acquisition Map). These maps are the operative triggers under cl 1.7 and cl 2.2.

2. Determine permissibility. Consult the Land Use Table (cl 2.3 and relevant zone entry) to see whether the proposed use is permitted without consent, permitted with consent, or prohibited. If not specified, development is prohibited in that zone unless Schedule 1 authorises it (cl 2.5). If the use is listed as permitted with consent, plan to prepare a DA.

3. Check exempt and complying pathways. See whether the proposed works are exempt under Schedule 2 or complying development under Schedule 3 and the State SEPP (cl 3.1-3.2). Remember cl 3.3 excludes environmentally sensitive areas from exempt/complying development.

4. Overlay and environmental tests. If overlays apply, identify the specific clause(s) in Part 6 that will be engaged (for biodiversity, groundwater, riparian, wetlands, salinity, flood planning). Prepare the environmental information required by those clauses: statement of environmental effects, heritage management documents if on or adjacent to heritage items, and any additional assessments listed (cl 6.4-6.7, cl 5.21, cl 5.17).

5. Heritage and Aboriginal engagement. Where the site contains or is near a heritage item, Aboriginal place, or archaeological site, follow cl 5.10: notify the consent authority, expect the consent authority to require heritage management documents or conservation plans (cl 5.10(5)-(6)), and note mandatory notification to the Heritage Council for archaeological sites (cl 5.10(7)) and notification to local Aboriginal communities for Aboriginal places (cl 5.10(8)). Provide appropriate heritage impact statements and management plans.

6. Defence, airport and airspace matters. If land is in the Defence Communications Facility Buffer Map, consult Defence early and prepare to demonstrate no adverse effect on the defence receiver station (cl 5.15). For airport Limitation/Operations Surface penetration, consult the relevant Commonwealth body and ensure compliance with AS/NZS guidance referenced by cl 5.15 and cl 6.11. For aircraft noise sensitive development within ANEF contours follow cl 6.12 and AS 2021,2000.

7. Water and wastewater arrangements. Ensure essential services are available or that adequate arrangements exist to provide water, electricity, sewage disposal, stormwater drainage, and vehicular access (cl 6.13). For unsewered land, obtain Council approval for on‑site effluent systems as needed for complying development (cl 3.2(3)(c)).

8. Flood and stormwater risk. Where flood planning areas or stormwater management requirements apply, demonstrate how the development is compatible with flood function, does not increase flood affectation of other properties, and incorporates evacuation and life safety measures (cl 5.21). For residential and employment zone works, maximise permeable surfaces and consider on‑site stormwater retention (cl 6.3).

9. Aquaculture and intensive livestock thresholds. For aquaculture consult Schedule 6 species, pond design and discharge rules; for intensive livestock consult cl 5.18’s thresholds and buffer distances. If proposing intensive plant agriculture on small lots you must meet cl 4.2B’s irrigation licence and lot size tests.

10. Exceptions to standards. If intending to rely on an exceptions pathway (cl 4.6), prepare the required document demonstrating why compliance is unreasonable or unnecessary and the environmental planning grounds. Provide the consent authority with a recordable assessment, because the authority must keep a record of that assessment (cl 4.6(3)-(4)). Note that exceptions cannot be used to contravene specified standards (cl 4.6(8)).

11. Temporary use. If the project is a short term event, apply for temporary use consent (cl 2.8) and be aware of the 52 days per 12 month cap and restoration obligations at the end of the period (cl 2.8(2), (3)(d)), except for specified sales office usages (cl 2.8(4)).

12. Prepare a complete DA pack. The Plan and the Environmental Planning and Assessment Regulation require specific documentation for certain DAs (for example. cl 4.6’s note refers to the Regulation). A complete statement of environmental effects, heritage assessments, flood and stormwater management plans, biodiversity or groundwater studies where overlays apply, and confirmations about availability of essential services will improve assessment prospects.

13. Engage early with the consent authority and external agencies. Because the Plan mandates consultation in several instances (Heritage Council cl 5.10(7), Defence cl 5.15, Commonwealth for airport cl 6.11), engage these agencies early to locate issues and avoid delays.

14. Verify covenants and other instruments. Check whether private or public covenants apply. Clause 1.9A suspends certain covenants to permit development consistent with the Plan but excludes covenants imposed by the Council and certain statutory instruments. Where public authority rights are recorded on title, those rights are preserved (cl 1.9A(2)-(3)). Do not rely on automatic suspension without checking the covenant’s nature.

15. Check classification of public land if acquisition or trust discharge is relevant. If the proposed development touches public land in Schedule 4, verify whether the land has been reclassified or had trusts discharged and whether Governor approval was required for discharge under cl 5.2(5).

16. Comply with conditions and recordkeeping. If consent is granted, ensure that conditions are complied with and the development is delivered in accordance with the approved plans, management strategies and conservation works (for heritage or eco‑tourist facilities cl 5.13, cl 5.10(10)). Keep records sufficient to demonstrate compliance.

17. Plan for appeals and public notification. Understand the Act’s DA notification rights and the possible need to respond to submissions. Recordkeeping under cl 4.6 and the Plan’s requirements may be critical if a decision is challenged.

Following this sequence steers an applicant through the Plan’s mapped and clause‑based triggers, statutory consultations and the environmental and heritage considerations the consent authority must apply. Where complexity arises (overlapping overlays, Defence or Commonwealth referrals, heritage significance), engage relevant technical specialists early and document mitigation measures consistent with the Plan’s “avoid, minimise, mitigate” framing in Part 6.
