Mutual Recognition (Victoria) Act 1998

Adoption: The pivotal legal concept in the Act is adoption. The term is not a new statutory invention; the Act defines “Commonwealth Act” to mean the Mutual Recognition Act 1992 of the Commonwealth (s 3), and s 4 declares that the Commonwealth Act is adopted within the meaning of s 51(xxxvii) of the Commonwealth Constitution (s 4(1)). Adoption is therefore an incorporation by reference and a constitutional exercise of the State’s power to refer legislative competence to the Commonwealth. The Act treats adoption as time-bound and revocable: each adoption under s 4 “terminates” at the end of the day fixed under s 6 as that adoption’s termination day (s 4(3)).

Partial or staged adoption: The Act recognises more than one adoption step. Section 4 refers separately to the Commonwealth Act “as originally enacted and as amended by regulations made before the enactment of the Mutual Recognition (Victoria) Act 1993” (s 4(1)), and separately to the amendments made to the Commonwealth Act by the Mutual Recognition Amendment Act 2021 (s 4(2)). The statutory architecture therefore contemplates multiple layers of adoption, and the 2021 amendments to the Victorian Act created explicit treatment of the later Commonwealth Amendment Act (s 4(2)-(3)). Section 6A addresses the interaction if an adoption under s 4(2) terminates before the adoption under s 4(1), preserving the continued operation of s 4(1) adoptions (s 6A).

Regulations for temporary exemptions for goods: Section 5 authorises the Governor in Council to make regulations “for the purposes mentioned in section 15 of the Commonwealth Act as adopted.” The provision emphasises that this power is without limiting any other power under any other Act (s 5). The delegated regulation power is therefore expressly broad in formulation, and it ties Victorian regulatory action to the operational provisions in s 15 of the Commonwealth Act that the Victorian Parliament has chosen to import.

Termination and revocation: The Act provides a two-step proclamation architecture for termination. The Governor in Council may fix a day by proclamation in the Government Gazette as the day on which an adoption under s 4(1) or s 4(2) terminates (s 6(1)). The Governor in Council may also revoke that proclamation (s 6(2)). The revocation has a specific legal effect: in such a case, the revoked proclamation, for the purposes of s 4, is taken never to have been published (s 6(2)). The revocation will have effect only if published before the day fixed under subsection (1) (s 6(3)). The revocation does not prevent publication of a further proclamation (s 6(4)). These provisions create specific timing and publication mechanics that govern the effective life of an adoption.

Transitional deeming: Section 7 operates as a remedial deeming clause. It deems that anything done or purported to have been done after the expiry of the earlier Victorian Mutual Recognition (Victoria) Act 1993 and before enactment of the 1998 Act had, and always had, the same effect as it would have had if the 1993 Act had not expired (s 7). That is a retroactive continuity measure for acts taken during the interregnum between the expiry and enactment of the 1998 Act.

Commencement structure: The Act staggers commencement. Part 1, s 8 and Part 3 came into operation on Royal Assent; Part 2 (except s 8) is deemed to have come into operation on 1 July 1998 (s 2). The text records these dates in the endnotes, and the table of amendments records later changes to particular sections.

Constitutional basis: The Act explicitly ties the adoption to s 51(xxxvii) of the Commonwealth Constitution, that is, to the State’s power to refer matters to the Commonwealth or to adopt Commonwealth law. The text repeats the constitutional reference and treats each adoption as terminating on the day fixed by s 6 (s 4(1), s 4(3)).

Legal import versus operational detail: The Act is primarily an enabling and continuity instrument. It imports the substantive mutual recognition rules by reference; it does not itself restate those rules, nor does it prescribe detailed compliance obligations, penalties, registration requirements or enforcement mechanisms within its text. Those sit in the Commonwealth Act as adopted and in any regulations made under it and under s 5.

Direct legal subjects: The Act itself names few classes of people. It defines “Commonwealth Act” (s 3) and describes institutional actors: the Governor in Council is given powers to make regulations and to publish proclamations in the Government Gazette (s 5; s 6). The primary immediate effect of the Victorian Act is therefore on the legal applicability of the Commonwealth Act in Victoria. Any person, body or entity subject to the Mutual Recognition Act 1992 at Commonwealth level will have their rights and obligations operate in Victoria to the extent the Commonwealth Act is adopted (s 4). The Act’s text does not enumerate those persons, but by adopting the Commonwealth Act it imports whatever classes of regulated persons, traders, professional certificate-holders, suppliers and regulators the Commonwealth Act covers.

State regulators and administrators: The Governor in Council is the decision maker for two important state-level levers: making Victorian regulations for temporary exemptions for goods (s 5) and fixing or revoking termination days by proclamation (s 6). Administrative and regulatory agencies within Victoria will be affected to the extent they are required to give effect to the Commonwealth Act’s rules in Victoria, and to the extent they must administer temporary exemptions made by Victorian regulation under s 5.

Businesses trading across jurisdictions: The policy of mutual recognition generally concerns goods and occupations crossing state lines. While the Victorian Act does not spell out who the goods or occupational applicants are, the adoption of the Commonwealth Act (s 4) means businesses that rely on interstate movement of goods or recognition of occupational standards will be subject to the regime that now operates in Victoria via adoption. The Act makes the Commonwealth regime the operative text in Victoria so those businesses should be treated as subject to the Commonwealth Act as adopted.

Legal practitioners and advisers: Lawyers, compliance officers and accountants working for businesses or regulators need to know three concrete points from this Act: (a) the relevant operative mutual recognition rules will be found in the Commonwealth Act as adopted (s 3-4); (b) temporary exemptions may be made by Victorian regulation (s 5); and (c) the Victorian Government can terminate the adoption by proclamation (s 6). These are the Victorian-level levers that affect clients; the Act itself contains no penalty or enforcement regime that practitioners can advise upon without reading the Commonwealth Act.

Those relying on the interregnum provisions: Section 7 specifically affects persons who acted in the period after expiry of the earlier 1993 Act and before enactment of the 1998 Act, by deeming those acts to have had continuous effect (s 7). That is a protective measure for anyone who undertook steps during the gap. The provision will be relevant to any person whose status or rights depended on the earlier Act’s operation during that gap.

Public interest and parliamentary record users: The endnotes show the Act’s amendment history and commencement dates; practitioners relying on historical status, commencement or retrospective validity will use those parts. The Act’s structure means that keeping track of proclamations in the Government Gazette and of sub‑ordinate Victorian regulations made under s 5 is essential for anyone affected.

Primary right imported: The Act’s central legal effect is to import by adoption the rights and obligations contained in the Commonwealth Mutual Recognition Act 1992 (s 4). The Act does not itself list the substantive rights; it creates the legal mechanism by which those Commonwealth rights and duties operate in Victoria. Practitioners must therefore read the Commonwealth Act to identify the specific rights and duties that will apply to individuals and entities.

Governor in Council duties/powers: The Governor in Council has two discrete powers under this Act that function as duties when exercised. First, to make regulations for the purposes mentioned in s 15 of the Commonwealth Act as adopted (s 5). Second, to publish proclamations to fix a day on which an adoption under s 4(1) or s 4(2) terminates, and to revoke such proclamations (s 6(1)-(2)). The timing rules attached to revocation are prescriptive: a revoking proclamation has effect only if published before the day fixed under s 6(3), and a revoked proclamation is treated as never having been published for purposes of s 4 (s 6(2)-(3)). These are mandatory drafting mechanics for any proclamation action the Governor in Council takes under the Act.

Transitional deeming duty: Section 7 imposes no active duty but creates a legal consequence: acts done in the interregnum between expiry of the 1993 Act and enactment of the 1998 Act are deemed to have been effective as if the 1993 Act had not expired (s 7). This is a protective legal right insofar as it preserves legal effect, not an affirmative administrative obligation.

Rights arising from adopted Commonwealth Act: Because the text adopts the Commonwealth Act, rights created by that Act , for example, rights to mutual recognition of goods or occupational registrations , will be available in Victoria through the adoption (s 4). The Victorian Act itself does not define or quantify those rights; it is the Commonwealth Act’s substantive provisions that define them. The Victorian statute therefore grants the procedural right to rely on the Commonwealth Act as part of Victorian law.

Limitations and termination rights: The Act gives the State the unilateral power to terminate its adoption of the Commonwealth Act by proclamation (s 6(1)). That power is subject to the publication mechanics in s 6(2)-(4). The existence of an express termination power is a structural limitation on the permanence of the rights conferred by the adoption. Section 6A limits the uncertainty that could arise when different adoption layers terminate at different times by specifying that termination of the adoption under s 4(2) before s 4(1) does not affect the continued operation of the s 4(1) adoption (s 6A).

No penalties or enforcement in the Victorian Act: The text contains no penalty clauses, offence provisions or enforcement processes triggered by non-compliance with the mutual recognition obligations (none of which are in the Victorian Act text). Any penalties, sanctions or enforcement mechanisms must therefore be sought in the Commonwealth Act as adopted, or in other Victorian legislation that the Commonwealth Act interacts with. Practitioners advising on compliance will need to examine the incorporated Commonwealth Act for those details.

Monitoring and notice duties implied by publication requirements: The Act requires proclamations to be published in the Government Gazette (s 6(1)-(2)). This establishes a public notice mechanism: the duty on the state to publish is explicit, and the legal consequences of publication or revocation are set out in statutory language. A practical right for affected parties follows: legal certainty about termination depends on Gazette publication.

The Mutual Recognition (Victoria) Act 1998 contains no express penalties, offence provisions or enforcement mechanisms. The Victorian text is an adoption and enabling instrument; it does not itself create criminal or civil sanctions. That absence is visible throughout the operative Parts: Part 2 is limited to definitions, adoption, power to make regulations for temporary exemptions, termination mechanics and a transitional clause (s 3-7). There is no schedule of penalties, regulatory infringement notices or enforcement agency powers in this Act.

Consequences for enforcement analysis: Since the Act adopts the Commonwealth Mutual Recognition Act 1992 (s 4), any penalties and enforcement arrangements that affect conduct under the mutual recognition regime will arise from the Commonwealth Act as adopted, or from Victorian regulations made under s 5 to the extent those regulations create offences or civil penalties. The Victorian Act therefore operates as a gateway: it brings the Commonwealth Act’s enforcement regime into Victoria by adoption, but the text of the Victorian Act itself contains none of the enforcement detail. Practitioners must consult the Commonwealth Act and any Victorian regulations made under s 5 for the substantive penalties and enforcement procedures that apply to regulated persons.

Publication and procedural enforcement mechanics: The Act does prescribe particular procedural mechanics that have legal effect and could become a focus for litigation: proclamations fixing termination days must be published in the Government Gazette (s 6(1)). Revocation of a proclamation is taken never to have been published for the purposes of s 4 (s 6(2)), and revocations only have effect if published before the day fixed by the proclamation (s 6(3)). These provisions determine timing and legal effect and therefore could be material in disputes about whether an adoption had terminated at a particular time. In that narrow procedural sense, the Act creates legal effects that bear on enforcement outcomes because the availability of the Commonwealth Act in Victoria depends on whether an adoption is in force.

No enforcement delegation or agency powers: The Act does not nominate an enforcement agency or delegate investigatory powers to Victorian departments. The Governor in Council has regulatory and proclamation powers (s 5; s 6), which are administrative, not enforcement, powers. If enforcement powers are required in practice, they must be derived from the adopted Commonwealth Act or from other Victorian statutes.

Implication for compliance practitioners: The absence of penalties in the Victorian adopting Act shifts the focus of compliance advice to (a) the text of the Commonwealth Act as adopted, and (b) monitoring Victorian regulations and proclamations made under this Act that may create obligations or limit the operation of the Commonwealth Act in Victoria. It also means that parties cannot rely upon enforcement detail being present in the Victorian text; instead, enforcement is imported or delegated.

Constitutional referral/adoption mechanism: The Act expressly adopts the Commonwealth Mutual Recognition Act 1992 “within the meaning of section 51(xxxvii) of the Commonwealth of Australia Constitution” (s 4(1)). That locates the Act within the constitutional mechanism of voluntary state adoption or referral of legislative power to the Commonwealth. The Victorian Act therefore interacts with Commonwealth law at the constitutional level: it makes the Commonwealth Act operative in Victoria by adopting it, subject to the limits and timing the Act itself sets.

Imported Commonwealth rights and duties: Because the Act imports the Commonwealth Act by adoption, any interaction with other Victorian laws will occur primarily through that imported text. The Victorian Act does not itself amend or displace other Victorian statutes; rather, it makes the Commonwealth Act part of the law operating in the State. Practitioners must therefore analyse interactions between the Commonwealth Act as adopted and relevant Victorian statutes on a case-by-case basis, using the Commonwealth Act’s text as the driver of cross-jurisdictional effect.

Regulatory competence and overlapping powers: Section 5 authorises the Governor in Council to make regulations for purposes mentioned in s 15 of the Commonwealth Act “without limiting any other power under any other Act.” That phrasing preserves the continuing operation of other statutory powers in Victoria. It also signals that the Victorian regulations made under s 5 may exist alongside, and must be reconciled with, other Victorian regulatory regimes. The Act therefore contemplates overlapping regulatory competence and preserves it rather than displacing it.

Temporal interaction with earlier Victorian Act: Section 7 expressly addresses the interrelationship between the 1998 Act and the earlier Mutual Recognition (Victoria) Act 1993. It deems acts done after expiry of the 1993 Act and before enactment of the 1998 Act to have always had the same effect as if the 1993 Act had not expired (s 7). That clause operates to remove gaps that could otherwise produce legal uncertainty, and therefore smooths interaction between successive Victorian statutes relating to mutual recognition.

Termination and layered adoptions: The Act contemplates more than one adoption (s 4(1) and s 4(2)). Section 6 permits termination of the adoptions set out in s 4(1) or s 4(2) by proclamation. Section 6A deals with the particular situation where the adoption under s 4(2) terminates before that under s 4(1), stating the latter remains in force (s 6A). The interaction this creates is temporal: different layers of adopted Commonwealth amendments may be brought into, or taken out of, force at different times, and s 6A determines how those layers operate together.

Interaction with Commonwealth amendments: The Act specifically adopts amendments to the Commonwealth Act as a discrete adoption step in s 4(2). By importing those Commonwealth amendments into Victoria’s operation, the Act makes Commonwealth legislative changes relevant to Victorian statutory operation. The Victorian text therefore creates a direct legal link tying the reach of Victoria’s mutual recognition regime to changes at Commonwealth level. The table of amendments in the endnotes records the Mutual Recognition (Victoria) Amendment Act 2021 and other amending instruments and their commencement dates; that is relevant to practitioners tracking the timing and content of inter-jurisdictional interaction.

No express ouster of Victorian law: The Act contains no provision that expressly ousts any Victorian law beyond the adoption mechanics. It does not assert that the Commonwealth Act overrides particular Victorian statutes. The text preserves the Crown-in-Council’s power to make regulations and to terminate the adoption, and the phrase in s 5 that the Governor’s regulation power is “without limiting any other power under any other Act” indicates the Victorian Parliament’s intention to preserve other enactments’ operation unless and until a specific operation arises from the adoption of the Commonwealth Act itself.

Publication and Gazette interaction: The Act requires proclamation publication in the Government Gazette (s 6). That is a procedural interaction with Victoria’s Gazette publication regime and with any legal rules that attach legal effect to Gazette publication. The effectiveness of termination and revocation depends on such publication.

The Act’s endnotes set out a concise amendment history and show the provisions and commencement dates that materially altered the 1998 Act.

Primary amendments recorded in the text and endnotes are:

• Mutual Recognition (Victoria) Amendment Act 2021, No. 25/2021: This amending instrument is recorded in the Table of Amendments. The endnotes state that ss 3 and 4 of that amending Act commenced on 1 July 2021 (Special Gazette No. 346, 29 June 2021). The 2021 amendments effected textual changes in the 1998 Act: s 4(2) was substituted by No. 25/2021 s 3; s 4(3) was inserted by No. 25/2021 s 3; s 5 was substituted by No. 25/2021 s 4; and s 6A was inserted by No. 25/2021 s 4. These amendments reflect a legislative update that explicitly adopts the Mutual Recognition Amendment Act 2021 of the Commonwealth and adjusts the Victorian regulation-making and termination architecture. The endnotes record the assent date for the Victorian Amendment Act as 28 June 2021 with commencement of particular sections on 1 July 2021.

• Statute Law Revision Act 2013, No. 70/2013: Part 3 (heading and ss 9,10) of the 1998 Act was repealed by No. 70/2013 s 3(Sch. 1 item 38), with commencement 1 December 2013. The Table of Amendments records the assent date and commencement particulars.

• Statute Law Revision Act 2015, No. 21/2015: Section 8 of the 1998 Act was repealed by No. 21/2015 s 3(Sch. 1 item 35), commencing 1 August 2015. The Table of Amendments records these details.

Commencement history: The original enactment of the 1998 Act had a mixed commencement. Part 1 (sections 1, 2), section 8 and Part 3 (sections 9, 10) commenced on 27 October 1998; the rest of the Act was deemed to have commenced on 1 July 1998 (s 2). The endnotes repeat these dates and record the parliamentary second reading references for historical context.

Effect of amendment entries: The amendment entries identify which sections were changed and by which Victorian instrument. Where the text shows amendments (for example, the substitution and insertion in s 4), the endnotes cross‑reference the specific amendment instrument and provision numbers. The 2021 amendments are the most recent substantive amendments to the Act recorded in this version.

No amendments not in operation: The publication states that this version contains no amendments not yet in operation (Endnotes, item 3). That confirms the text’s currency as at the version date (1 July 2021).

Practical consequence: Because several amendments altered the Act’s operational wording , especially the 2021 amendments that address adoption layers and regulation-making , practitioners should track the specific amending provisions when advising clients. The endnotes provide the precise instrument citations and commencement dates necessary for historical or transitional analysis.

The Act’s text and endnotes do not record any litigation history. There are no cases, judicial decisions or litigation examples cited in the statute text or in the endnotes or explanatory details. The Act itself is primarily an adoption instrument and contains procedural mechanics for proclamation and regulation making; it does not record judicial interpretation.

Implication of the absence of recorded cases: The absence of litigation material in the instrument means that any legal uncertainty about the Act’s provisions must be assessed by direct reading of the statutory text and of the adopted Commonwealth Act, combined with searches of external case law databases and subsequent judicial treatment of the Commonwealth Mutual Recognition Act 1992. The domestic Victorian text contains no internal guidance from courts.

Procedural provisions that are likely to generate legal questions: The mechanics of termination and revocation of proclamations (s 6(1)-(4)) and the saving provision in s 6A that resolves potential sequencing problems if s 4(2) terminates before s 4(1) are the most legally consequential Victorian provisions in the Act. Disputes about whether an adoption was in force on a particular date, or whether a revocation had legal effect, would turn on the publication record in the Government Gazette and on applying the definitions and timing mechanics set out in s 6 and s 6A. Although the Act contains clear timing language, litigation could arise over facts (dates of publication, content of proclamations) or over application of the Commonwealth Act as adopted. The Act itself, however, provides no litigated examples.

Transitional clause and potential litigation: Section 7 retroactively deems acts done during the interregnum between expiry of the 1993 Act and enactment of the 1998 Act to have always had the same effect as if the 1993 Act had not expired. That clause reduces the scope for litigation about the legal effect of acts taken in that interval, by statutory deeming; nonetheless, litigation might still occur about the application of that deeming to particular acts. The Act itself does not provide litigation outcomes or case names.

Requirement for external research: Because the Victorian Act imports the Commonwealth Act by adoption, litigators and advisers will need to consult case law on the Commonwealth Mutual Recognition Act 1992 to understand judicial interpretation of the substantive mutual recognition rules. The Victorian Act’s adoption mechanics and the procedural proclamation and regulation powers may also have been the subject of litigation in other contexts, but no such materials are included in the Act’s text or endnotes.

Termination by proclamation can be reversed but only with strict timing and publication consequences: Section 6 allows the Governor in Council to fix a day by proclamation on which an adoption terminates and to revoke such a proclamation (s 6(1)-(2)). However, a revoked proclamation is taken never to have been published for the purposes of s 4 (s 6(2)), and a revoking proclamation has effect only if published before the day fixed under s 6(3). In practical terms, if a proclamation terminating an adoption is published but not revoked before its effective day, the termination stands. Reversal after the fixed day does not undo the published termination for s 4 purposes. That timing constraint places a premium on monitoring Gazette publication carefully.

Layered adoption sequencing complexity: The Act contemplates separate adoptions and separate terminations for different layers of Commonwealth amendments (s 4(1), s 4(2) and s 4(3)). Section 6A addresses one sequencing risk by stating that termination of the adoption under s 4(2) before termination under s 4(1) does not affect continued operation of the s 4(1) adoption (s 6A). However, that clarity only addresses the particular scenario of a s 4(2) termination preceding a s 4(1) termination; other sequencing permutations or questions about partial operation of adopted provisions may require careful statutory and factual analysis. Practitioners should not assume that all uncertainties are covered by s 6A.

No penalties or enforcement in the Victorian Act: The absence of offences or penalties within the Victorian Act is not an oversight but a design feature: the text imports the substantive Commonwealth law. However, that means practitioners who read only the Victorian Act may miss the actual compliance and enforcement regime. Advisers must read the adopted Commonwealth Act and any Victorian regulations made under s 5 for penalties, sanctions or administrative remedies. Relying solely on the Victorian text risks incomplete advice.

Regulation power breadth: Section 5 authorises regulation-making by the Governor in Council “without limiting any other power under any other Act,” and it ties the purpose to s 15 of the Commonwealth Act as adopted (s 5). The “without limiting” language may be read as preserving other statutory powers, but it also creates a trap for those who do not monitor the full suite of Victorian and Commonwealth regulations: temporary exemptions for goods can be made under Victorian regulations that operate alongside Commonwealth provisions, and those Victorian instruments could materially alter the effective rights and obligations on the ground.

Transitional deeming may not cover every factual permutation: Section 7 deems acts taken after the expiry of the 1993 Act and before enactment of the 1998 Act to have had continuous effect (s 7). That is a broad saving provision, but its language is not infinitely detailed. Advisers should test whether particular acts, licences or registrations in the interregnum are fully covered by the deeming clause for the specific purposes their clients need. Do not assume blanket coverage for all types of acts without matching the factual pattern to the deeming language.

Reliance on Gazette publication for notice: Because termination and revocation mechanics rely on publication in the Government Gazette (s 6(1)-(3)), parties that do not monitor Gazette notices may be unaware of changes. That creates a practical compliance risk. Legal certainty about the adoption’s existence on particular dates depends on the Gazette record.

Amendment history timing: The 2021 amendments changed the text. Section insertions and substitutions listed in the endnotes (e.g. s 4(2), s 4(3), s 5, s 6A) mean that earlier commentary or notes about the 1998 Act may be out of date. Practitioners must check the version and commencement dates recorded in the Table of Amendments and in the endnotes rather than relying on an older printout.

No local enforcement agency specified: The Victorian Act does not nominate a Victorian enforcement agency. If practitioners need to know who will enforce mutual recognition obligations in Victoria, they must look to the Commonwealth Act as adopted or to other Victorian statutes that supply enforcement mechanisms.

Locate the operative text: The Mutual Recognition (Victoria) Act 1998 is an adopting Act. Compliance for any regulated person begins by reading the Mutual Recognition Act 1992 of the Commonwealth , the “Commonwealth Act” as defined and adopted by s 3-4. The Victorian Act does not restate substantive obligations. Therefore, practitioners must identify the specific rules, procedural requirements, qualification recognition processes, or goods exemptions in the Commonwealth Act that apply to their client.

Monitor Government Gazette publications: Section 6 makes the Government Gazette the statutory publication vehicle for proclamations fixing termination days and for revocation proclamations (s 6(1)-(3)). Entities relying on mutual recognition rights should subscribe to or otherwise monitor the Government Gazette so they can detect any Victorian proclamation that terminates an adoption, and any revocation published before the day fixed. The Gazette publication timing determines whether a termination stands and whether a revocation has legal effect.

Track Victorian regulations under s 5: The Governor in Council may make regulations for the purposes mentioned in s 15 of the Commonwealth Act as adopted (s 5). These regulations may create temporary exemptions for goods that change compliance obligations in Victoria. Practitioners should maintain a current register of Victorian regulations made under s 5 and cross-check those against the Commonwealth Act’s s 15 to assess the scope and duration of any exemptions.

Confirm which adoption layer applies: The Act contains separate adoption references in s 4(1) and s 4(2) and a sequencing safeguard in s 6A. When advising clients, determine whether the operative adoption in force in Victoria is the original Commonwealth Act as enacted, the pre-1993-regulation-amended version referenced in s 4(1), or the 2021 Commonwealth amendments adopted under s 4(2). Check the current proclamations and regulations to confirm whether any adoption has been terminated or partially modified.

Document historical actions during the interregnum, if relevant: If a client took action during the period after the expiry of the 1993 Act and before enactment of the 1998 Act, s 7 deems those actions to have had continuous effect (s 7). To rely on that deeming, keep contemporaneous records and documents showing dates and the nature of the acts so that you can demonstrate the action falls within the protective scope of s 7 if that becomes relevant.

Advise clients on dual-source compliance: Because the Victorian Act preserves other statutory powers and expressly leaves regulatory powers in place (s 5, “without limiting any other power under any other Act”), clients may have concurrent obligations under Victorian regulation and the Commonwealth Act as adopted. Advise clients to comply with both sets of instruments and to seek to reconcile any differences, giving primacy to the applicable legal text and to the timing of any proclamations or regulations.

Plan for termination risk: The Governor in Council can terminate the adoption by proclamation (s 6(1)). Advise clients whose business models rely on mutual recognition that they face a state-level unilateral termination risk. Practical steps include contingency planning for a loss of the mutual recognition benefits, contractual clauses that anticipate regulatory change, and active monitoring of the Gazette and Victorian executive announcements.

Use the endnotes for version control: The endnotes include the Table of Amendments and commencement particulars. When advising clients about obligations or historical status, rely on the version incorporating amendments as at 1 July 2021 and cross-check the Table of Amendments to ensure you refer to the currently operative wording. Do not assume older interpretations or advice remain valid without checking the amendment record.

If enforcement details are required, consult the Commonwealth Act and Victorian regulations: Since the Victorian Act contains no penalties or enforcement details, obtain the enforcement regime from the adopted Commonwealth Act and from any Victorian regulations under s 5 that create offences or civil penalties. That is essential when advising on compliance risk, exposure to sanctions, or remedies for non-compliance.

Record reliance on statutory publications: If a client depends on a Victorian regulation that provides a temporary exemption for goods, or on a proclamation that a particular adoption remains in force, keep records of the Gazette notices and the exact regulatory instrument. Because legal effect depends on publication, evidencing the published texts is important in any subsequent dispute.

Summary of practical checklist:

• Read the Commonwealth Mutual Recognition Act 1992 as adopted (s 3-4).
• Monitor the Government Gazette for proclamations and revocations under s 6.
• Maintain a register of Victorian regulations made under s 5 and check their link to s 15 of the Commonwealth Act.
• Confirm which adoption layer (s 4(1) or s 4(2)) is operative and whether s 6A issues are material.
• Use the transitional deeming in s 7 when advising about actions taken during the 1993-1998 gap.
• Check the Table of Amendments in the endnotes for commencement and amendment history.
• Where enforcement or penalties are a concern, consult the adopted Commonwealth Act and any Victorian regulations that create sanctions.
