This instrument amends the Mutual Recognition Act 1992 by adding state and territory container-deposit laws to the list in Schedule 2 and by updating tribunal references to the new Administrative Review Tribunal. It affects businesses and operators of container deposit schemes and any traders crossing state borders: those state laws remain governed by the listed local Acts (so mutual recognition does not apply) and compliance, enforcement and review stay with the named regulators and Tribunal framework (see sch.1A-sec.1-oc.2; sch.2-sec.1-oc.2; sch.5-sec.16).
This instrument bundle makes targeted amendments to the Mutual Recognition Act 1992 by adding specified State and Territory container deposit scheme legislation and associated instruments to Schedule 2 of the Mutual Recognition Act, and by replacing references to the Administrative Appeals Tribunal with references to the Administrative Review Tribunal in a number of provisions. The package consists of multiple subordinate instruments and an Act, each named and given discrete commencement rules. Examples in the text include the Mutual Recognition Act 1992 Amendment Regulations 2009 (No. ), the Mutual Recognition Amendment (ACT Container Deposit Scheme) Regulations 2018, the Mutual Recognition (Amendment of Act,Container Deposit Scheme) Regulation 2013, the Mutual Recognition Amendment (WA Container Deposit Scheme) Regulations 2020, and the Administrative Review Tribunal (Consequential and Transitional Provisions No. 2) Act 2024 (sch.1-sec.1; sch.1A-sec.1; sch.2-sec.1; sch.4-sec.1; sch.5-sec.1).
Mechanically, each schedule item inserts an entry at the end of Schedule 2 of the Mutual Recognition Act 1992 that identifies particular State or Territory Acts, or Parts of those Acts, and includes "all other provisions of that Act, to the extent that they relate to the container deposit scheme established by that Part" and "regulations or instruments made under that Act, to the extent that they relate to that scheme" (see, for example, sch.1A-sec.1-oc.2; sch.2-sec.1-oc.2; sch.3-sec.1-oc.2; sch.3A-sec.1-oc.2; sch.3B-sec.1-oc.2; sch.4-sec.1-oc.2). The entries are jurisdiction-specific: they add Part 10A of the Waste Management and Resource Recovery Act 2016 (ACT) and related provisions (sch.1A-sec.1-oc.2); Part 2 of the Environment Protection (Beverage Containers and Plastic Bags) Act (NT) and related provisions (sch.2-sec.1-oc.2); Part 5 of the Waste Avoidance and Resource Recovery Act 2001 (NSW) and related provisions (sch.3-sec.1-oc.2); the Container Refund Scheme Act 2022 (Tas.) and related instruments (sch.3A-sec.1-oc.2); Part 6 of the Circular Economy (Waste Reduction and Recycling) Act 2021 (Vic.) and related provisions (sch.3B-sec.1-oc.2); and Part 5A of the Waste Avoidance and Resource Recovery Act 2007 (WA) and related provisions (sch.4-sec.1-oc.2).

sch.1A-sec.3 Authority
sch.1A-sec.3 Authority
This instrument is made under section 47 of the Mutual Recognition Act 1992 .
Separately, the Administrative Review Tribunal (Consequential and Transitional Provisions No. 2) Act 2024 makes consequential amendments to the Mutual Recognition Act 1992 that replace cross-references to the Administrative Appeals Tribunal with equivalent references to the Administrative Review Tribunal, and swaps the office title "Registrar" for "Chief Executive Officer and Principal Registrar" in at least one listed provision (sch.5-sec.16; sch.5-sec.32). The Act sets commencement rules that tie Schedules 1 to 15 to the commencement of the Administrative Review Tribunal Act 2024, and otherwise provides for commencement on Royal Assent for sections 1 to 3 (sch.5-sec.2).
The instruments specify their enabling power: several subordinate regulations are made under section 47 of the Mutual Recognition Act 1992 (sch.1A-sec.3; sch.2-sec.3; sch.4-sec.3). Most of the subordinate instruments commence the day after registration (see sch.1-sec.2; sch.1A-sec.2; sch.2-sec.2; sch.4-sec.2). In short, the package: (1) enumerates particular State and Territory container deposit law materials at the end of Schedule 2 of the Mutual Recognition Act 1992, and (2) updates tribunal and officer cross-references in the Mutual Recognition Act to align with the Administrative Review Tribunal Act 2024.
Main concepts
The text operates around two core legal concepts: the schedule-based listing of State and Territory legislation in the federal Mutual Recognition Act 1992, and the substitution of tribunal and administrative-office cross-references following the creation of a new federal administrative review body.
Schedule entries for container deposit schemes. Multiple schedule items add jurisdiction-specific Acts, Parts and subordinate instruments to Schedule 2 of the Mutual Recognition Act 1992, always qualified by the phrase "to the extent that they relate to the container deposit scheme established by that Part" (see sch.1A-sec.1-oc.2; sch.2-sec.1-oc.2; sch.3-sec.1-oc.2; sch.3A-sec.1-oc.2; sch.3B-sec.1-oc.2; sch.4-sec.1-oc.2). The repeated structure is: (a) identify the principal Part of the State/Territory Act that establishes a container deposit scheme; (b) include "all other provisions" of that Act insofar as they relate to the scheme; (c) include regulations or instruments made under that Act insofar as they relate to the scheme. The schedule text thus ties the listing to the scope of the container deposit scheme material within each named statute and its instruments.
Substitution of federal review references. The Administrative Review Tribunal (Consequential and Transitional Provisions No. 2) Act 2024 amends specified provisions of the Mutual Recognition Act 1992 to replace references to the Administrative Appeals Tribunal and its Act with references to the Administrative Review Tribunal and the Administrative Review Tribunal Act 2024 (sch.5-sec.16; sch.5-sec.32). It also substitutes the office label "Registrar" with "Chief Executive Officer and Principal Registrar" in at least one provision (sch.5-sec.32). The Act repeals and substitutes text for paragraphs 34(3)(a) and (b) to make the right of review, and the right to request reasons, dependent on the Administrative Review Tribunal Act 2024 and to cross‑refer to section 268 of that Act for statements of reasons (sch.5-sec.16).
Commencement mechanics. Several instruments adopt a simple commencement rule of "the day after registration" (sch.1-sec.2; sch.2-sec.2; sch.1A-sec.2; sch.4-sec.2). The Administrative Review Tribunal consequential Act, by contrast, coordinates commencement with the Administrative Review Tribunal Act 2024 for Schedules 1 to 15, and sets Royal Assent commencement for sections 1 to 3 (sch.5-sec.2). The Act includes a conditional rule: Schedules do not commence at all if the Administrative Review Tribunal Act 2024 does not commence (sch.5-sec.2).
Enabling power and instrument form. The subordinate instruments repeatedly state they are made under section 47 of the Mutual Recognition Act 1992 (sch.1A-sec.3; sch.2-sec.3; sch.4-sec.3). Each instrument also contains a schedule provision confirming that listed Acts are to be amended or repealed in accordance with the schedule items (sch.1A-sec.4; sch.2-sec.4; sch.4-sec.4; sch.5-sec.3).
These concepts are implemented by a repeated drafting pattern: list a State/Territory Act Part; qualify that listing by reference to the scheme; capture subordinate instruments; and provide commencement and authority details. The substitution concept uses a schedule of point edits across the Mutual Recognition Act 1992 to update institutional references to a new federal tribunal and to rename administrative office holders in specified provisions.
Who it affects
The measures operate at the intersection of federal mutual recognition machinery and State/Territory container deposit schemes. The principal categories of affected persons and entities, as indicated by the amendments, are:
Entities subject to State and Territory container deposit scheme provisions. Each schedule entry explicitly targets the provisions of a named State/Territory Act "to the extent that they relate to the container deposit scheme established by that Part" and any subordinate instruments "to the extent that they relate to that scheme" (for example, sch.1A-sec.1-oc.2 for the ACT; sch.2-sec.1-oc.2 for the Northern Territory; sch.3-sec.1-oc.2 for New South Wales; sch.3A-sec.1-oc.2 for Tasmania; sch.3B-sec.1-oc.2 for Victoria; sch.4-sec.1-oc.2 for Western Australia). The affected persons thus include producers, distributors, retailers, collectors, refund points, transporters, and any other operators whose activities fall within the state scheme provisions and instruments so listed.
State and Territory regulators and agencies that administer the listed Acts and their instruments. The amendments specifically identify Parts of those Acts and associated instruments as the subject matter to be recorded in Schedule 2 of the Mutual Recognition Act. That affects the agencies responsible for drafting and enforcing the listed provisions, and implies an expectation that those agencies’ regulatory instruments will be treated in the specific, limited manner set out in the schedule entries.
Practitioners and compliance professionals advising on cross-jurisdiction movement of goods and on obligations under container deposit schemes. The listing of particular provisions in Schedule 2 is a federal-level statement that these state instruments are identified for a defined federal purpose. Advisers will need to map obligations in each jurisdiction against the schedule language to advise clients on compliance, inter-jurisdictional movement, and administrative review rights.
Persons who seek merits review or statements of reasons for decisions under the Mutual Recognition Act 1992. The consequential Act amends paragraph 34(3) and other references to direct applicants to the Administrative Review Tribunal Act 2024 and to section 268 of that Act for statements of reasons (sch.5-sec.16). That affects the individuals and corporations who pursue review of decisions that fall within the Mutual Recognition Act framework.
Administrators of the Mutual Recognition Act 1992. The substitution of "Registrar" with "Chief Executive Officer and Principal Registrar" and the substitution of tribunal references modify which federal officers and institutions are named in the Act (sch.5-sec.32). That change affects those office-holders and the organisational arrangements for administrative functions and review.
Users of the Mutual Recognition Act who rely on cross‑references to Tribunal processes. Replacing references to the Administrative Appeals Tribunal Act 1975 with the Administrative Review Tribunal Act 2024 alters the statutory architecture for review embedded in the Mutual Recognition Act and thereby affects review pathways for federal decisions in the mutual recognition context (sch.5-sec.32).
The instrument texts do not themselves create new substantive obligations such as deposit amounts, collection rules, or offence elements. Rather, they alter the federal statutory register (Schedule 2) and replace institutional cross-references that determine which review body and officers are involved in federal procedures. The direct burden therefore falls on actors operating under the listed State/Territory container scheme provisions and on those who seek federal review or interact with the Mutual Recognition Act’s administrative processes.
Key duties and rights
The instruments make no stand-alone creation of new offences or new private rights in the text provided. Instead, they perform textual insertions and substitutions that alter how existing rights and duties in the Mutual Recognition Act and in the listed State and Territory Acts are referenced and flagged at the federal level. The key duties and rights to note from the instrument text are:
The duty on the Commonwealth to record specified State/Territory Acts and instruments in Schedule 2 of the Mutual Recognition Act 1992. Each schedule item instructs an addition "At the end of Schedule 2 Add: Each of the following" and then lists the relevant Part(s) of State or Territory Acts, "all other provisions of that Act, to the extent that they relate to the container deposit scheme established by that Part", and "regulations or other instruments made under that Act, to the extent that they relate to that scheme" (see sch.1A-sec.1-oc.2; sch.2-sec.1-oc.2; sch.3-sec.1-oc.2; sch.3A-sec.1-oc.2; sch.3B-sec.1-oc.2; sch.4-sec.1-oc.2). The practical effect is that the federal schedule is to include these materials.
The right to apply for review of decisions. The Administrative Review Tribunal consequential Act repeals paragraphs 34(3)(a) and (b) of the Mutual Recognition Act and substitutes text that makes the right of application for review "subject to the Administrative Review Tribunal Act 2024", and expressly refers to section 268 of that Act for the right to request a statement of reasons (sch.5-sec.16). That substitution makes the mutual recognition Act’s provision for review conditional on the procedural rules and rights provided by the Administrative Review Tribunal Act 2024.
The change in the named decision-making officer. The amendment that substitutes "Registrar" with "Chief Executive Officer and Principal Registrar" in provision 31(3) (as listed in sch.5-sec.32) indicates a change in the identity and title of the officer named in the Mutual Recognition Act. That affects which official is assigned functions or receives materials under the relevant provision, and therefore imposes a duty on parties to address correspondence and perform procedural steps with the newly named office.
The obligation on subordinate instrument makers to note effect. Each subordinate instrument states that legislation specified in a Schedule to the instrument is "amended or repealed as set out in the applicable items", which is an instruction about the manner in which the schedules operate on the identified Acts (sch.1A-sec.4; sch.2-sec.4; sch.4-sec.4; sch.5-sec.3). That text places a duty on the drafters and publishers to ensure the schedule entries are implemented as prescribed.
Commencement-related rights. The instruments set their commencement dates, with the subordinate instruments generally commencing the day after registration, while the consequential Act ties Schedules to commencement of the Administrative Review Tribunal Act 2024 and sets sections 1 to 3 to commence on Royal Assent (sch.1-sec.2; sch.2-sec.2; sch.1A-sec.2; sch.4-sec.2; sch.5-sec.2). These are procedural rules that determine when any practical consequences of the amendments will be effective and therefore affect the timing of duties and rights.
The instruments do not, in the provided text, specify penalties or enforcement mechanisms in the new Schedule 2 entries. Consequently, substantive enforcement and penalty duties remain those already present in the State and Territory Acts and in the Mutual Recognition Act 1992; this instrument only identifies the State and Territory materials for the federal schedule and updates institutional cross-references for review.
Penalties and enforcement
The material supplied does not introduce new penalty provisions or change existing criminal or civil enforcement mechanisms within the State and Territory container deposit Acts themselves. The amendments focus on identification and cross-reference rather than creation of fresh offences. The points to record are:
No express penalties inserted. The schedule additions simply list specific Parts of State or Territory Acts and subordinate instruments "to the extent that they relate to the container deposit scheme", but the instrument text does not itself create penalty clauses or modify penalty amounts in the listed Acts (see sch.1A-sec.1-oc.2; sch.2-sec.1-oc.2; sch.3-sec.1-oc.2; sch.3A-sec.1-oc.2; sch.3B-sec.1-oc.2; sch.4-sec.1-oc.2).
Enforcement remains with the relevant State/Territory law. Since the schedule entries import references to specific State and Territory statutory materials, enforcement of the substantive obligations and penalty regimes will continue to be governed by those State and Territory Acts and their instruments, insofar as they are in force. The federal text does not re‑enforce or displace those enforcement regimes; it only puts them on the federal schedule list.
Administrative review pathway altered in cross-references. The Administrative Review Tribunal consequential Act substitutes the Administrative Review Tribunal Act 2024 for the Administrative Appeals Tribunal Act 1975 in specified cross‑references (sch.5-sec.32). Paragraphs 34(3)(a) and (b) are repealed and substituted with text making review rights subject to the Administrative Review Tribunal Act 2024 and providing for a request for a statement of reasons under section 268 of that Act (sch.5-sec.16). That substitution affects the enforcement landscape only to the extent that affected parties would seek merits review or statements of reasons under the Mutual Recognition Act; their pathway is now through the Administrative Review Tribunal, and the relevant rules of procedure, powers and remedies available will be those set out in the Administrative Review Tribunal Act 2024.
Office-holder responsibility. The amendment that replaces "Registrar" with "Chief Executive Officer and Principal Registrar" in provision 31(3) (sch.5-sec.32) identifies a different officer as a receiver of administrative responsibilities or as a point of contact. That is an administrative, not penal, change, but it can affect enforcement logistics such as where documents are filed, which office receives notices, and who is responsible for procedural administration.
No federal criminal enforcement for container deposit schemes created. The federal amendments list State and Territory statutory materials. The instruments do not import State offences into federal jurisdiction nor do they create new federal offences for non-compliance with a container deposit scheme. Any compliance and penalty obligations remain within the State/Territory frameworks as they operate under their own Acts and instruments.
Practitioners should therefore look to the substantive enforcement and penalty provisions embedded in the listed State and Territory Acts for the consequences of non-compliance, while recognising that administrative review routes for federal decisions under the Mutual Recognition Act will now reference the Administrative Review Tribunal Act 2024 and its section 268 for requests for reasons (sch.5-sec.16; sch.5-sec.32).
How it interacts with other laws
This instrument package interacts directly with two legal strata: the Mutual Recognition Act 1992 and specified State/Territory container deposit Acts and instruments. It also interacts procedurally with the Administrative Review Tribunal Act 2024. The interactions observable in the text include:
Federal schedule and State/Territory statute identification. By adding jurisdictional Parts and related instruments to Schedule 2 of the Mutual Recognition Act 1992, the federal Act is being told to recognise, catalogue or otherwise treat those State/Territory provisions as specified items. Each addition is qualified by "to the extent that they relate to the container deposit scheme established by that Part" (for example, sch.1A-sec.1-oc.2; sch.2-sec.1-oc.2). The direct interaction is therefore one of federal identification of State materials for a specific federal purpose.
Cross-reference realignment to the Administrative Review Tribunal Act 2024. The consequential Act replaces references to the Administrative Appeals Tribunal Act 1975 with references to the Administrative Review Tribunal Act 2024 in the Mutual Recognition Act (sch.5-sec.32). Paragraphs 34(3)(a) and (b) are reworded to make the right to apply for review and the right to request a statement of reasons subject to the Administrative Review Tribunal Act 2024 and to refer to s 268 of that Act for reasons (sch.5-sec.16). The practical interaction is that procedures, review rights, and remedial powers for matters that invite review under the Mutual Recognition Act will be governed by the new Administrative Review Tribunal Act rather than the Administrative Appeals Tribunal Act.
Administrative officer terminology harmonisation. Provision 31(3) in the Mutual Recognition Act is edited so that "Registrar" is replaced by "Chief Executive Officer and Principal Registrar" (sch.5-sec.32). That interacts with other Commonwealth Acts and instruments that refer to these office titles; any process that requires action by the Registrar under the Mutual Recognition Act will now require action by the Chief Executive Officer and Principal Registrar as named in the Mutual Recognition Act.
Procedural contingency. The commencement provisions condition Schedules 1 to 15 of the consequential Act on the commencement of the Administrative Review Tribunal Act 2024 (sch.5-sec.2). That creates a legal interaction in time: the consequential amendments only operate if the enabling Administrative Review Tribunal Act comes into force. If the Administrative Review Tribunal Act does not commence, the consequential schedule amendments "do not commence at all" (sch.5-sec.2). That creates a dependency between the federal administrative review architecture and the Mutual Recognition Act amendments.
No express displacement of State enforcement regimes. The instrument does not purport to amend the substantive content of the listed State/Territory Acts beyond their identification in Schedule 2. It therefore interacts with State law by labelling and specifying which State materials relate to container deposit schemes. Any substantive conflicts or overlaps between State/Territory obligations and mutual recognition principles are not addressed in this text and would continue to be governed by existing law.
Instrumental authority. Several subordinate instruments are expressly made under section 47 of the Mutual Recognition Act 1992 (sch.1A-sec.3; sch.2-sec.3; sch.4-sec.3). The interaction here is legal: the federal Act gives power to make these subordinate instruments for the purpose of amending the federal schedule.
In sum, the package aligns federal statutory cross-references with a new federal review body and records specific State/Territory container deposit provisions in a federal schedule. The key interactions to monitor are timing dependencies on the Administrative Review Tribunal Act 2024 (sch.5-sec.2), administrative handoffs to differently named officers (sch.5-sec.32), and the reliance on State/Territory Acts to supply substantive obligations and penalties that this federal instrument merely identifies (see the various schedule additions).
Amendment history
The supplied text itself is a compilation of multiple amendment instruments across time. The primary items recorded in the instrument text are:
Mutual Recognition Act 1992 Amendment Regulations 2009 (No. ) , named at sch.1-sec.1 as "These Regulations are the Mutual Recognition Act 1992 Amendment Regulations 2009 (No. )" (sch.1-sec.1). This instrument is recorded but the schedule entry in the supplied text is not a substantive amendment beyond naming.
Mutual Recognition Amendment (ACT Container Deposit Scheme) Regulations 2018 , identified as the instrument name in sch.1A-sec.1 (sch.1A-sec.1-oc.2 adds Part 10A of the Waste Management and Resource Recovery Act 2016 (ACT) to Schedule 2).
Mutual Recognition (Amendment of Act,Container Deposit Scheme) Regulation 2013 , identified in sch.2-sec.1 and used to add Part 2 of the Environment Protection (Beverage Containers and Plastic Bags) Act (NT) to Schedule 2 (sch.2-sec.1-oc.2).
Consecutive schedule additions for NSW, TAS, VIC and WA. The supplied fragments show separate schedule items:
sch.3-sec.1-oc.2 adds Part 5 of the Waste Avoidance and Resource Recovery Act 2001 (NSW).
sch.3A-sec.1-oc.2 adds the Container Refund Scheme Act 2022 (Tas.).
sch.3B-sec.1-oc.2 adds Part 6 of the Circular Economy (Waste Reduction and Recycling) Act 2021 (Vic.).
sch.4-sec.1-oc.2 adds Part 5A of the Waste Avoidance and Resource Recovery Act 2007 (WA).
Mutual Recognition Amendment (WA Container Deposit Scheme) Regulations 2020 , named in sch.4-sec.1 as the instrument name; it includes the addition of the WA Part 5A to Schedule 2 (sch.4-sec.1-oc.2).
Administrative Review Tribunal (Consequential and Transitional Provisions No. 2) Act 2024 , the later Act named as the short title at sch.5-sec.1. This Act contains Schedules 1 to 15 and amends the Mutual Recognition Act 1992 to update tribunal references and office titles; Schedules are contingent on the Administrative Review Tribunal Act 2024 commencing (sch.5-sec.2; sch.5-sec.16; sch.5-sec.32).
Each subordinate regulation and the consequential Act includes standard commencement and authority clauses. The subordinate regulations are made under section 47 of the Mutual Recognition Act 1992 (sch.1A-sec.3; sch.2-sec.3; sch.4-sec.3) and have commencement the day after registration unless otherwise specified (sch.1-sec.2; sch.2-sec.2; sch.1A-sec.2; sch.4-sec.2). The consequential Act sets out a table of commencement dates for its provisions, with sections 1 to 3 commencing on Royal Assent and Schedules 1 to 15 commencing with the Administrative Review Tribunal Act 2024, or not at all if that Act does not commence (sch.5-sec.2).
This text therefore documents a sequence of federal amendments across 2013, 2018, 2020 and 2024 instruments, each narrowly targeted at either (a) cataloguing State and Territory container deposit scheme provisions in Schedule 2 of the Mutual Recognition Act, or (b) updating institutional references to reflect the creation of the Administrative Review Tribunal.
Litigation history
The supplied instruments contain no litigation history, no judgments, and no citations to court or tribunal decisions. They are enactments and amendments without accompanying case law in the text provided. The only litigation-relevant elements within the instruments are procedural: the Mutual Recognition Act's provisions for review have been edited to refer to the Administrative Review Tribunal Act 2024 for the right of application and for statements of reasons (sch.5-sec.16; sch.5-sec.32). If litigation or merits review were to arise from decisions under the Mutual Recognition Act, the applicable procedural code for review and statements of reasons would be the Administrative Review Tribunal Act 2024 as cited.
Because the instrument replaces references to the Administrative Appeals Tribunal, any historical body of case law under the Administrative Appeals Tribunal Act remains outside the text. The supply does not purport to recast or import Administrative Appeals Tribunal jurisprudence. For present purposes, no litigation record is contained in or attached to the amendments set out here.
Gotchas
The text contains a number of drafting and timing features that create practical risks or traps for users. They are practical considerations drawn from the instrument wording:
Scope qualification "to the extent that they relate to the container deposit scheme". Each schedule insertion is expressly limited to provisions and instruments to the extent that they relate to the container deposit scheme established by the identified Part (for example, sch.1A-sec.1-oc.2). Users must take care when mapping obligations to the Schedule: only those parts of an Act that "relate to" the scheme are included. That creates an interpretative question about what falls within the phrase "to the extent that they relate", which may not be obvious in complex statutes that mix container scheme, waste management and other regulatory controls.
Fragmented commencement timings. The subordinate regulations typically commence the day after registration (sch.1-sec.2; sch.2-sec.2; sch.1A-sec.2; sch.4-sec.2). The consequential Act, however, ties many of its Schedules to the commencement of another federal Act, the Administrative Review Tribunal Act 2024, and states that the Schedules do not commence at all if that Act does not commence (sch.5-sec.2). There is therefore a risk of asynchronous commencement, and of partial implementation where subordinate schedule entries are in force but consequential amendments to review pathways are not, or vice versa. Parties should check the actual registration and commencement dates rather than relying on the nominal instrument date.
Changed institutional names and titles. Substitution of "Administrative Review Tribunal" for "Administrative Appeals Tribunal" and of "Chief Executive Officer and Principal Registrar" for "Registrar" (sch.5-sec.32) means procedural directions, forms, filings and notices that previously named the AAT or a Registrar will need to be updated. Failure to address the new nomenclature may lead to misdirected filings or timing disputes.
No change to State/Territory substantive obligations in the text. Users might assume that adding State Acts to Schedule 2 changes the legal effect of State offences or obligations. The text does not itself alter substantive State law; it merely records those instruments in the federal schedule. Advisers must therefore consult the underlying State/Territory Acts for substantive duties and penalties. The schedule additions are descriptive of scope rather than prescriptive of content.
Reliance on external Act (Administrative Review Tribunal Act 2024) for review rights. Paragraphs 34(3)(a) and (b) are rewritten so that applications for review and requests for reasons are subject to the Administrative Review Tribunal Act 2024 and its section 268 respectively (sch.5-sec.16). If that Act's procedural architecture differs materially from the Administrative Appeals Tribunal Act 1975, users may find their review rights, remedies and timelines altered. Until the Administrative Review Tribunal Act is examined in full, the practical change to review procedure cannot be fully assessed.
Mixed instrument types and sources. The bundle includes statutory regulations and a standalone Act. Some subordinate regulations are made under s 47 of the Mutual Recognition Act 1992 (sch.1A-sec.3; sch.2-sec.3; sch.4-sec.3). Practitioners should trace whether later amendments or replacement instruments have altered the content of the listed State/Territory Acts or the Federal Mutual Recognition Act, and whether the enabling power has been exercised correctly.
Ambiguity in "all other provisions" phrase. The schedule additions include "all other provisions of that Act, to the extent that they relate to the container deposit scheme established by that Part" (for example, sch.4-sec.1-oc.2). This language may capture some provisions that are not in the named Part but are functionally connected. The breadth of that capture may create uncertainty as to what federal schedule entries encompass.
Identifying and addressing these "gotchas" requires checking the actual text of the State/Territory Acts named, confirming their operative commencement dates, and verifying the commencement status of the Administrative Review Tribunal Act 2024 so that review routes and officer titles are correctly mapped.
How to comply
For practitioners advising clients, compliance is an exercise in statutory mapping, administrative procedure updates, and systems checks. The required practical steps, tied to specific provisions in the instrument text, are:
Identify applicable State/Territory provisions. For any business or operator dealing with beverage containers, determine whether their activities fall within the Parts and associated instruments listed in Schedule 2 additions. The relevant schedule entries are at:
ACT: Part 10A of the Waste Management and Resource Recovery Act 2016 (ACT) and related provisions and instruments (sch.1A-sec.1-oc.2).
NT: Part 2 of the Environment Protection (Beverage Containers and Plastic Bags) Act (NT) (sch.2-sec.1-oc.2).
NSW: Part 5 of the Waste Avoidance and Resource Recovery Act 2001 (NSW) (sch.3-sec.1-oc.2).
TAS: Container Refund Scheme Act 2022 (Tas.) and related instruments (sch.3A-sec.1-oc.2).
VIC: Part 6 of the Circular Economy (Waste Reduction and Recycling) Act 2021 (Vic.) (sch.3B-sec.1-oc.2).
WA: Part 5A of the Waste Avoidance and Resource Recovery Act 2007 (WA) (sch.4-sec.1-oc.2).
Read the limiting phrase. The listings are qualified by "to the extent that they relate to the container deposit scheme established by that Part," so when mapping obligations focus on those provisions in each Act that directly relate to the container deposit scheme, and inspect any cross-referenced sections in those Acts that may "relate to" the scheme (sch.1A-sec.1-oc.2; sch.2-sec.1-oc.2).
Update compliance registers and operating procedures. Once the relevant provisions are identified, update internal compliance registers to reflect State/Territory obligations that are now expressly listed in the federal Schedule 2. Although the federal instrument does not alter State penalties, the practical regulatory profile of the business will include these entries. Note the commencement timing set by each instrument: subordinate regulations typically commence the day after registration (sch.1-sec.2; sch.2-sec.2; sch.1A-sec.2; sch.4-sec.2).
Review dispute and review pathways. The consequential Act makes the Mutual Recognition Act’s review provisions subject to the Administrative Review Tribunal Act 2024 and to section 268 of that Act for statements of reasons (sch.5-sec.16). Therefore, clients should be advised to:
Review the Administrative Review Tribunal Act 2024 to understand applicable review procedures, time limits and remedies.
Update internal procedures for requesting a statement of reasons to cite s 268 of the Administrative Review Tribunal Act 2024 as the statutory authority when seeking reasons under the Mutual Recognition Act (sch.5-sec.16).
Change contact details and filing practices. Amend documents, forms and procedural instructions that previously used the term "Registrar" or referenced the Administrative Appeals Tribunal to instead use "Chief Executive Officer and Principal Registrar" and "Administrative Review Tribunal", as appropriate, in line with the amendments (sch.5-sec.32). Ensure filings, notices and addresses are directed to the correct office after checking the administrative arrangements that designate the Chief Executive Officer and Principal Registrar.
Coordinate timing and contingency. Because the consequential Act ties many changes to the commencement of the Administrative Review Tribunal Act 2024 (sch.5-sec.2), check whether that Act has commenced. If it has not, then the Schedules in the consequential Act will not commence. Businesses should plan for scenarios where the State/Territory schedule entries are in force but the review-route substitutions are not, and vice versa.
Keep monitoring State/Territory instruments. The schedule entries include subordinate instruments "to the extent that they relate to that scheme" (for example, sch.3B-sec.1-oc.2). Practitioners should track new or amended regulations in each State/Territory named, because the scope of the schedule is sensitive to those instruments; any State regulation that materially alters the container deposit scheme may expand or change what is "to the extent that they relate."
Document legal analysis. Maintain a documented legal map setting out:
the exact provisions in each named Act that are captured,
the subordinate instruments that are relevant,
the commencement dates for each federal and State instrument,
the administrative contact points for filings and notices,
the applicable tribunal and statutory provisions for review (noting substitution to the Administrative Review Tribunal Act 2024 and s 268) (sch.5-sec.16; sch.5-sec.32).
Advise on cross-jurisdictional operations. If clients move containers, beverages or packaging across State lines, identify how their cross-border operations interact with the listed State/Territory provisions and whether their business model requires compliance with multiple schemes. The federal schedule additions do not harmonise substantive rules across jurisdictions; they identify the relevant instruments at federal level and therefore will not obviate the need to comply with distinct State or Territory requirements.
Where in doubt, seek administrative clarification. For uncertainties about whether a particular provision of a State Act is captured "to the extent that it relates" to a container deposit scheme, consider seeking guidance from the relevant State regulator or the Commonwealth administrative office named in the Mutual Recognition Act following the title substitutions (sch.5-sec.32).
Following these steps will align operational, compliance and dispute-handling procedures with the amendments recorded in the supplied instruments.
Legislation that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.
