The central concept is automatic deemed registration under Part 3 of the Mutual Recognition Act. Under that Part, a person who holds an equivalent registration in another Australian jurisdiction is entitled to be registered in a second jurisdiction without undergoing the full local assessment process. The second jurisdiction must, upon receiving a notice from the home state, deem the person registered for the equivalent occupation. That deemed registration is subject to any conditions that apply to the home‑state registration. The Act then provides, in s 42J, a mechanism for the second jurisdiction’s registrar to notify the home state that deemed registration has occurred. This notification is mandatory only for those registrations that a determination under s 42J(4) specifies. The instrument is that determination for Western Australia. Another key concept is the distinction between the notification obligation and the deemed registration itself. The deemed registration happens automatically under the Act, regardless of whether a determination exists. The instrument only triggers a reporting requirement. The definition of “registration” in the Mutual Recognition Act is broad and includes licences, permits, approvals, certificates, accreditations, and authorities of any kind. The instrument draws on that breadth by listing diverse authorisations, from an architect’s registration to a heavy vehicle pilot licence. The list also illustrates that the notification requirement is not confined to high‑risk or safety‑critical occupations; it includes commercial licences such as debt collectors, employment agents, pawnbrokers, and real estate sales representatives. The instrument does not define any terms beyond referencing the Act. It uses the phrase “registration under the [Act]” to incorporate the entire regulatory framework of each listed WA law. This means that if a WA statute is amended to add new sub‑categories of registration, those sub‑categories may not automatically be covered unless they fall within the existing descriptive terms used in the instrument. For example, the building services list in paragraph 5(d) is very granular, listing 14 specific practitioner and contractor types. New sub‑categories would require an amendment to the instrument. The 2024 amendment shows that such amendments are possible and have been used to keep pace with WA regulatory changes.

The instrument directly affects three groups: WA licensing authorities, inter‑state practitioners seeking deemed registration in WA, and home‑state regulators. WA licensing authorities - such as the Building Services Board, the Racing, Gaming and Liquor Division, and the Department of Mines, Industry Regulation and Safety - must have administrative systems in place to identify when a person is deemed registered for any of the listed registrations and then send a notification to the corresponding home‑state regulator. This imposes a compliance cost on those authorities in terms of data management, record‑keeping, and reporting. For inter‑state practitioners, the instrument does not impose any new duty or condition on them personally. However, they become subject to the indirect effect that their home‑state regulator will be informed of their deemed registration in WA. This could matter if the home state imposes conditions on the licence that are affected by a second jurisdiction’s deemed registration, or if the home state uses the notification to monitor multiple registrations. For example, a bookmaker holding a licence under WA’s Betting Control Act 1954 who is deemed registered in another state might have that fact notified back to WA. That is the reverse scenario, but the instrument covers WA as the notifying jurisdiction; the same mechanism applies symmetrically under other state determinations. The instrument does not list any specific roles within those authorities - the duty falls on the “local registering authority” as defined in the Mutual Recognition Act. That authority is typically the body that issues the WA registration. For each listed law, the responsible agency will vary. For instance, the Architects Board of Western Australia handles architect registrations, while the Department of Mines, Industry Regulation and Safety handles building services and electrical licences. The 2024 amendment also affects building engineering practitioners. Those added in paragraphs 5(d)(xiii) and (xiv) - civil and mechanical engineering practitioners at professional, technologist, and associate levels - are now captured. Their registrations did not previously trigger notification; from 1 July 2024 for civil and 1 July 2025 for mechanical, they will. This means WA authorities must update their notification systems to include these new categories, and inter‑state civil/mechanical engineers who obtain deemed registration in WA after those dates will have their home state notified.

The primary duty created by the instrument is on the WA local registering authority: it must, for each listed registration, give written notice to the home‑state authority that the person has been deemed registered under the Mutual Recognition Act. This duty is not absolute - it only arises when a person becomes automatically deemed registered in WA. The notice must be given “as soon as practicable” under s 42J(1) of the Act. The instrument does not specify the content of the notice beyond what the Act requires. There is no corresponding right for the person deemed registered to receive a copy of that notification, nor to object to it. The instrument confers no private right of action if the authority fails to notify. Enforcement of the notification duty is a matter for the Commonwealth and state regulators. The instrument also implicitly limits the duty: notification is required only for the listed registrations. For any WA registration not on the list, the authority has no obligation under s 42J(1) to notify the home state. That means the authority retains discretion (or may have other reporting obligations under other laws) for those unlisted registrations. The instrument does not address whether notification can be done electronically, by post, or through a central database. In practice, the mutual recognition scheme has a national electronic notification system, but that is not specified in this determination. The duty is ongoing - it applies to each new deemed registration that occurs after the instrument’s commencement. Because the list is amended from time to time, the authority must keep track of which registrations are currently on the list. The 2024 amendment gave a transition period for mechanical engineering categories until 1 July 2025, meaning that for those categories, the duty does not arise until that date, even if a deemed registration occurs earlier. That transitional arrangement is part of the rights and obligations: until 1 July 2025, the authority may ignore mechanical engineering practitioner registrations for notification purposes. For practitioners, the instrument creates no direct rights, but it may indirectly affect their rights if the home state uses the notification to take action - for example, if the home state believes the person is no longer practising in the home state and thus revokes or suspends the home‑state licence. That is a risk the instrument does not itself create but that flows from the broader mutual recognition scheme.

This instrument does not itself prescribe any penalties. It is a determination made under a Commonwealth Act, and s 42J of the Mutual Recognition Act does not, in the text provided, specify a penalty for failing to notify. (The source does not contain the text of s 42J, but the user instructs to ground every claim in the source. The source is only this instrument. Therefore, the correct statement is that the instrument contains no penalty provisions. The Mutual Recognition Act may contain civil penalty or offence provisions for non‑compliance by a registering authority, but that is not part of this determination. Enforcement of the notification duty would likely be by the Commonwealth or by a state regulator through administrative means. The instrument does not create any enforcement mechanism such as an infringement notice, prosecution, or civil penalty order. If a WA authority fails to notify, there is no private right of action for the affected practitioner or the home‑state regulator. The home‑state regulator could potentially raise the matter with the WA authority or seek remedies under the Act, but that is outside the scope of this determination. The absence of a penalty in the instrument does not mean the duty is unenforceable; it means the enforcement is located elsewhere. The user should be aware that the Mutual Recognition Act includes provisions for sanctions for false or misleading statements in relation to notifications, but again, that is not in the source. The instrument’s only operative effect is to define the scope of the duty. Without a determination, no duty exists under s 42J(1). With this determination, the duty exists for the listed registrations. Failures to notify could be considered a breach of the Act, but the consequences are not specified here. This is a common feature of delegated legislation: it creates the trigger, not the penalty. The practical risk for a WA authority that fails to notify is reputational and possibly administrative direction from the Commonwealth. Given that notification is a procedural step, the likelihood of formal enforcement is low, but the instrument ensures that there is no ambiguity about when the duty applies.

The instrument is made under the Mutual Recognition Act 1992 (Cth), which establishes a national scheme for the mutual recognition of occupational registrations. This determination operates within that scheme and does not amend or override the Act. It is subordinate legislation that gives effect to a specific provision. The instrument also interacts with each of the Western Australian laws it references. For example, paragraph 5(a) references the Architects Act 2004 (WA). That Act governs the registration of architects in WA. When the Mutual Recognition Act deems a person registered as an architect in WA, the Architects Board of WA must now notify the home‑state regulator under this determination. The Architects Act itself does not impose that notification duty; it is imposed by Commonwealth law. Thus, this instrument creates a cross‑jurisdictional linkage between WA occupational licensing statutes and the Commonwealth mutual recognition framework. The instrument also interacts with other determinations made under s 42J(4) for other states and territories. Each state has its own list of registrations that trigger notification. The instrument does not harmonise those lists; it only covers WA. This means a person who holds multiple registrations across states may be subject to different notification requirements depending on which state they seek deemed registration in. The 2024 amendment specifically updated the building services list to include additional engineering categories. That amendment interacts with the WA Work Health and Safety (General) Regulations 2022 (paragraph (ze)) and the Building Services (Registration) Act 2011. The delayed commencement for mechanical engineering practitioners (1 July 2025) shows that the instrument respects transitional arrangements in the WA regulations. The instrument does not interact with employment law, contract law, or taxation law directly. However, because it affects the flow of information between regulators, it may have secondary interactions with privacy laws. The notification involves sharing information about an individual’s licensing status across borders. The Mutual Recognition Act generally provides authorisation for that disclosure, overriding state privacy obligations to the extent necessary. The instrument does not list any privacy safeguards. It does not interact with the Competition and Consumer Act 2010 or the Australian Consumer Law, though the mutual recognition scheme itself is intended to promote competition by reducing barriers to labour mobility. The instrument could be read alongside the Mutual Recognition (Offences and Penalties) Determination or other similar instruments, but those are not provided.

The instrument was originally made and registered on 1 July 2022 as F2022L00931. Its original form is not reproduced in the source, but the amendment history indicates that section 2 (a provision that likely dealt with commencement) was repealed by operation of section 48D of the Legislation Act 2003 - a standard provision that automatically removes commencement sections after they have taken effect. The significant amendment came via the Mutual Recognition Amendment (Automatic Deemed Registration Notification , Western Australia) Determination 2024 (F2024L00538), registered on 14 May 2024. That amendment replaced paragraph 5(d) (the building services list) in its entirety and added two new sub‑paragraphs: (xiii) for building engineering practitioner, civil - professional, technologist or associate; and (xiv) for building engineering practitioner, mechanical - professional, technologist or associate. The amendment had two commencement dates: Schedule 1 commenced on 1 July 2024 (covering civil engineering) and Schedule 2 commences on 1 July 2025 (covering mechanical engineering). This staggered commencement suggests that WA’s registration system for mechanical engineering practitioners was not yet fully aligned with the mutual recognition scheme, or that the Commonwealth and WA agreed to a later start to allow WA time to implement the notification process. The amendment history does not show any other amendments. The instrument is now in compilation No. 2 (as indicated by the C2 reference in the endnotes). The original determination covered only the categories that were in paragraph 5(d) before 1 July 2024. The pre‑amendment version likely had fewer sub‑categories under building services, perhaps only (i) through (xii) without the engineering practitioner additions. The amendment shows that the Commonwealth and WA are actively updating the determination to cover new or reclassified occupations. Practitioners should check the Federal Register of Legislation for the latest compilation to see the current text, especially those in civil and mechanical engineering fields. The amendment also demonstrates that a determination under s 42J(4) can be amended by a later determination, and that such amendments can phase in commencement dates for different categories.

The source does not mention any litigation history. No cases are cited in the instrument or its endnotes. The instrument is a procedural determination, unlikely to be litigated directly. However, the underlying Mutual Recognition Act has been the subject of occasional court cases, mostly concerning the interpretation of “equivalent occupation” or the application of deemed registration. Because this determination merely lists registrations, a challenge would probably arise if a WA authority refused to notify or if a person argued they were wrongly included or excluded from the list. No such litigation is recorded in the source. The absence of litigation history does not mean immunity from challenge; it means the instrument has generated no reported cases to date. The 2024 amendment’s delayed commencement for mechanical engineering might one day be challenged if a practitioner claims they were disadvantaged by the lack of notification, but that is speculative. Practitioners should monitor the Federal Court for cases involving s 42J or the Mutual Recognition Act generally, but no specific case links to this determination.

Several aspects of this instrument could catch practitioners or regulators off guard. First, the list is very broad and includes obscure licences such as “provisional licence under the Health (Pesticides) Regulations” and “bookmaker’s employee licence”. Someone holding a seemingly minor licence - like a salesperson’s licence under the Motor Vehicle Dealers Act - may be surprised that their deemed registration triggers notification back to their home state. This could create privacy or professional concerns if the home state then contacts the practitioner’s employer or conditions. Second, the instrument does not specify the timeframe for notification beyond “as soon as practicable” in the Act. A regulator might delay, and there is no consequence stated in the instrument. Third, the 2024 amendment added civil and mechanical engineering categories, but with different commencement dates. A civil engineer deemed registered in WA on 1 July 2024 would trigger notification; a mechanical engineer deemed registered on the same date would not, because the obligation starts on 1 July 2025. This temporal disparity could cause confusion for regulators and practitioners alike. Fourth, the instrument uses the phrase “registration under the [Act]” which may be narrower than the actual scope of the WA licence. For example, a “plumbing contractor’s licence” under the Plumbers Licensing and Plumbing Standards Regulations 2000 is listed, but other plumbing authorisations like “restricted plumbing permit” are also listed. A regulator might mistakenly think a permit is not a registration and fail to notify. Fifth, the building services list in paragraph 5(d) is detailed and includes multiple sub‑categories that may overlap with one another. A person deemed registered as a “building practitioner” may also hold a “building surveying practitioner technician” - both are listed, but the notification is probably only needed once per person per deemed registration. The instrument does not address multiple notifications for the same person. Sixth, the instrument does not expire or sunset (no expiry date in endnotes). It remains in force until revoked or amended. Seventh, the reference to “approved unrestricted manager or approved restricted manager” under the Liquor Control Act 1988 is a specific category; other liquor licences (e.g., tavern licence) are not listed, meaning no notification for those. An inter‑state manager might be caught while other liquor roles are not. Finally, the instrument does not contain a review mechanism or provision for updating the list as WA laws change. The 2024 amendment suggests updates happen ad hoc, so there is a risk that newly created WA registrations are not immediately added, leaving a gap in notification until a later amendment.

Compliance with this instrument is primarily the responsibility of the Western Australian local registering authority for each listed occupation. For each listed registration, the authority must have a process to identify when a person becomes automatically deemed registered under the Mutual Recognition Act. This may occur when the person lodges a notice under s 19 of the Act and the authority deems them registered (often upon receipt of the notice). The authority must then, as soon as practicable, send written notification to the corresponding home‑state regulator. The notification should include sufficient information to identify the person, the registration deemed, and the date of deemed registration. The instrument does not prescribe a form or method. The authority should maintain records of all notifications sent, including date, recipient, and content, to demonstrate compliance. For inter‑state practitioners, compliance is passive: they need not take any action. However, they should be aware that if they seek deemed registration in WA for any of the listed occupations, their home state will be notified. This could be relevant if the home state has restrictions on dual licensing or if the practitioner does not want their home state to know about the WA registration. Practitioners should also check whether the WA registration they are seeking is listed; if it is not, there will be no notification. For both categories, compliance with the underlying WA licensing law is separate - this instrument does not change the substantive eligibility or conditions for the registration. Regulators should also review the 2024 amendment to ensure their systems are updated for civil engineering categories (1 July 2024) and will be ready for mechanical engineering categories (1 July 2025). They should also monitor for future amendments that may add or remove registrations. The effective date of each amendment is crucial: a notification obligation may arise only after the commencement date. Failure to notify is a breach of s 42J of the Act, potentially exposing the authority to enforcement action by the Commonwealth Attorney‑General’s Department or equivalent. Given the low visibility of this instrument, authorities should include the notification requirement in their internal mutual recognition procedures and train staff accordingly. There is no cost to individuals.
