What it does
This determination, the Mutual Recognition (Automatic Deemed Registration Notification,South Australia) Determination 2021, prescribes a pre-condition for relying on automatic deemed registration under the Mutual Recognition Act 1992 (the Act). It is made by the South Australian Treasurer and is expressly made under subsection 42J(4) of the Act, as recorded at section 3 of the instrument. The core operative rule is in section 5(1): for the purposes of subsection 42J(1) of the Act, any person who intends to carry on an activity covered by an occupation listed in the instrument must notify the local registration authority for that occupation in South Australia before the person begins to carry on the activity in South Australia.
Mechanically, the instrument does three things. First, it identifies the legal basis for the direction: it is made under the Commonwealth Act (s 3) and defines the shorthand Act to mean the Mutual Recognition Act 1992 (s 4). Second, it sets the temporal operation: the whole instrument is taken to commence at the commencement of the Mutual Recognition (South Australia)(Further Adoption) Amendment Act 2021 (South Australia), as provided in section 2 and the commencement table. Third, it creates a notification requirement for particular occupations, enumerated in the table at section 5(2). The table connects each listed occupation to the applicable South Australian legislation and the local regulator in South Australia (for example, “Accredited Assessor - High Risk Work” paired with the Work Health and Safety Act 2012 and the regulator SafeWork SA).
The instrument does not itself set out the form, content, timing beyond “before the person begins to carry on the activity in South Australia”, or sanctions for non-compliance. It also does not restate or reproduce the text of subsection 42J(1) or subsection 42J(4) of the Commonwealth Act. The only specific procedural mandate the instrument creates is a prerequisite notice to the identified local registration authority prior to the commencement of the activity in South Australia for the occupations listed in Table 1 to section 5(2).
