What it does
This instrument, the Mutual Recognition (Automatic Deemed Registration Exemption , Western Australia) Declaration 2022, is a declaration made under subsection 42S(1) of the Mutual Recognition Act 1992 (the Act), as the instrument itself states at s 3 and defines the term Act at s 4. Its mechanical effect is narrow and specific: it excludes certain Western Australian registrations from the operation of "automatic deemed registration" for the purposes of the Act. Section 5(1) says, "the registrations specified in column 1 of the table are excluded from the operation of automatic deemed registration in Western Australia." The instrument also records explanatory statements for each exclusion. Section 5(2) expressly links those statements to the statutory requirement that the Minister be satisfied a significant risk exists, by saying the statements "explain, under subsection 42S(2) of the Act, the significant risk to consumer protection, the environment, animal welfare or the health or safety of workers or the public on which basis the Minister is satisfied."
The actual exclusions are set out in the instrument’s table. The table lists certain named licences or registrations under specified Western Australian statutes and regulations, and alongside each entry contains the Minister’s statement of the significant risk relied upon. The table entries are the operative list of which registrations are not subject to automatic deemed registration in Western Australia. The instrument also places a temporal limit on one of those entries: s 5(3) provides that the exclusion of the registrations specified in item 1 of the table (the electrical licences under the Electricity (Licensing) Regulations 1991 of Western Australia) "has effect for the period of 3 years beginning on the day on which this instrument commences." No commencement date is included in the text of the instrument itself, so the 3 year period is measured from the instrument’s commencement date.
