Murray-Darling Basin Act 2008

Agreement and dynamic incorporation: The Act defines Agreement as the Murray‑Darling Basin Agreement, "a copy of which is set out in Schedule 1 of the Water Act 2007 of the Commonwealth, as in force from time to time" (s 3(1)). That phrasing imports the Agreement and any future amendments made at Commonwealth/intergovernmental level into the State’s legal framework without separate State amendment. Section 3(2) further confirms that words used in the Act have the same meanings as in the Agreement, creating lexical alignment between State and Agreement terminology.

Authority and Basin Officials Committee: The Act recognises the Murray‑Darling Basin Authority established under the Commonwealth Water Act 2007 (s 3(1)). It authorises State appointments to the Basin Officials Committee and prescribes eligibility and conditions for those appointments (Part 2, ss 4-5). Appointment eligibility is limited to Public Service employees (s 4(2)). Appointments are vulnerable to termination if the person ceases to be employed in the Public Service (s 5(3)). The Minister may appoint acting members, including during vacancies or absence (s 4(1), (5)), and acts are protected from invalidation for defects or irregularities (s 4(3), (6)).

Works and land powers: The Act defines "works" to include those constructed under a former Agreement or under the Agreement (s 3(1)). Subject to the Act and the Agreement, the Minister is authorised to construct, maintain, operate and control works in the State and to carry out operations and measures referred to in the Agreement (s 6). The Minister may acquire land "whether compulsorily or otherwise" for construction, protection of works, improving water quality or for the Authority to exercise functions (s 7(1)). Compulsory acquisition must be undertaken in accordance with the Land Acquisition Act 1969 (s 7(2)).

Entry, occupation and authorisations: The Minister may authorise persons in writing to enter and occupy land for the Act’s purposes (s 13(1)). An authorised person must be provided with a certificate of authority specifying the statutory basis, name, nature of powers and expiry date (s 13(2)-(3)). Entry and occupation generally require 7 days written notice to owner or occupier, subject to urgency and consent exceptions, and consent is required to enter residential premises (s 14(1)-(3)). The statute prescribes duties when occupying land, including minimising harm and inconvenience, limiting occupation to reasonably necessary periods, leaving land in near original condition and co‑operating with owner and occupier (s 14(4)).

Decision‑making alignment across statutes: Schedule 1 implements numerous amendments that require State permit, licence, allocation, approval and transfer decisions that relate to water resources in the Murray‑Darling Basin to "take into account" the terms or requirements of the Agreement and any resolution of the Ministerial Council, and to consider relevant provisions of the Basin Plan under the Commonwealth Water Act 2007 (see Sch 1 Pt 2-Pt 6, e.g. Pt 4 items 10-14 and Pt 5 items 16-30). The repeated substitution of "take into account" establishes a statutory consideration duty across multiple decision points under the Development Act 1993, Natural Resources Management Act 2004, River Murray Act 2003 and Waterworks Act 1932.

Financial and parliamentary accountability: The Act authorises the Minister to pay compensation for damage caused by State action under the Act or Agreement (s 10). It exempts works and property used or held by a Contracting Government or Constructing Authority from rates, taxes, charges and fees under Acts or statutory instruments (s 15). All State money required under the Agreement is to come from Parliamentary appropriations (s 16). The Minister must lay copies of the Authority’s annual reports and any amendments of the Agreement before Parliament within 15 sitting days (s 17).

Delegation and regulatory powers: The Minister may delegate functions or powers under this Act or other relevant Acts to persons or bodies by written instrument (s 18(1)-(2)). Delegations may be absolute or conditional, may be further delegated if the instrument allows, do not derogate from the Minister’s ability to act and are revocable at will (s 18(2)(a)-(d), (3)). The Governor may make regulations as necessary (s 20), including provisions that leave specified matters to Ministerial or other discretion (s 20(2)(b)).

Criminal and civil enforcement: The Act criminalises obstruction of authorised entry and occupation with a maximum penalty of $5 000 (s 14(5)). It creates a separate offence for destroying or damaging works constructed or operated under this Act or the Agreement with a maximum penalty of $100 000 or imprisonment for 5 years (s 19). These penalties attach to conduct affecting works and the execution of Agreement measures.

Transitional and consequential adjustments: Schedule 1 contains detailed amendments to existing South Australian Acts to reflect the new alignment with the Commonwealth Water Act and the Agreement, changes the statutory meaning of "Murray‑Darling Basin" to mirror the Commonwealth Water Act 2007, replaces references to the Murray‑Darling Basin Commission with the Murray‑Darling Basin Authority, and repeals the Murray‑Darling Basin Act 1993 (Sch 1 Pt 8, s 36; Sch 1 Pt 9 s 37).

Landowners and occupiers within the Murray‑Darling Basin in South Australia: The Act authorises the Minister or authorised persons to enter and occupy land for Basin purposes after 7 days written notice, subject to emergency exceptions and the consent requirement for residential premises (ss 13-14). Landowners and occupiers therefore face potential short term occupation, access obligations and statutory duties on authorised persons to minimise harm, but also exposure to compulsory acquisition under s 7(1) where land is necessary for works or for the Authority’s functions, with compulsory processes governed by the Land Acquisition Act 1969 (s 7(2)).

Water entitlement holders and applicants: The Schedule 1 amendments alter decision‑making under the Natural Resources Management Act 2004 and related instruments so that licence applications, variations, transfers, allocations and works approvals that relate to water resources in the Basin must have regard to the Agreement and any Ministerial Council resolution and relevant Basin Plan provisions (Sch 1 Pt 4 and Pt 5, e.g. items 11, 16-30). This affects irrigators, industry water users, environmental water holders and potential buyers or sellers of water entitlements or allocations because State licensing and allocation outcomes must be informed by intergovernmental basin arrangements and the Basin Plan.

Developers and permit applicants: Decisions under the Development Act 1993 that relate to areas in the Murray‑Darling Basin must now take into account obligations or requirements under the Agreement or Ministerial Council resolutions (Sch 1 Pt 2, item 3). Planning applicants with projects that impact Basin resources will therefore face an additional statutory consideration in approvals and conditions.

State public servants and the Minister: The Minister has authority to appoint the State’s member to the Basin Officials Committee (s 4(1)), limited to persons employed in the Public Service (s 4(2)), and can determine conditions and terms of appointment for up to three years (s 5). The Minister holds power to construct and operate works, acquire land (including compulsorily), pay compensation, delegate functions, and represent the State as a Contracting Government and Constructing Authority under the Agreement (ss 6-11, 18, 9). Public servants acting as Basin Officials Committee members or authorised persons have specific statutory entitlements and limits attached to their roles.

Murray‑Darling Basin Authority and Commonwealth institutions: The Act recognises the Authority (s 3) and creates a statutory mechanism for the State to act consistently with intergovernmental arrangements. The Schedule changes align State statutes with the Commonwealth Water Act 2007 and the Basin Plan, creating cross‑jurisdictional operational effects on how State authorities will consider Commonwealth instruments.

Local government and service providers: The Act exempts works and property used or held by a Contracting Government or Constructing Authority from rates, taxes, charges and fees under Acts or statutory instruments (s 15). Local councils and other charging authorities will be affected by that exemption in relation to works and property used for Basin purposes.

Non‑State constructing authorities and contractors: The Minister may grant leases or dispose of lands acquired under s 7 that are no longer required (s 11). Contractors and other private parties involved in construction, operation or maintenance of works will therefore be affected by State contracting and leasing decisions. They may also be subject to the criminal offence for damage to works (s 19) and the requirement that authorised persons produce certificates (s 13(4)).

Third parties subject to new statutory consideration duties: Any decision maker under the amended statutes (Development Act, Natural Resources Management Act, River Murray Act, Waterworks Act) will now have to take into account the Agreement and Basin Plan where relevant. That change affects administrative bodies, regulators, and licence‑issuing authorities across the State, obliging them to incorporate intergovernmental terms into assessments and conditions.

Persons who obstruct or damage works: The Act creates enforcement consequences for obstructing authorised persons exercising entry powers (maximum penalty $5 000) and for destroying or damaging Basin works (maximum penalty $100 000 or imprisonment for 5 years), thereby directly affecting individuals who might interfere with works or operations (ss 14(5), 19).

Parliament and auditors: The Minister must lay the Authority’s annual reports and any amendments of the Agreement before Parliament within 15 sitting days (s 17). Parliament therefore receives oversight material and is implicated in appropriation obligations for State contributions to Basin measures (s 16).

Ministerial powers and duties: The Minister has authority to act as a Contracting Government and as the Constructing Authority under the Agreement for the State (s 9(a)-(b)). The Minister may construct, maintain, operate and control works and implement Agreement measures in the State, subject to the Act and the Agreement (ss 6, 8). The Minister may acquire land compulsorily or otherwise, but compulsory acquisition must comply with the Land Acquisition Act 1969 (s 7(2)). The Minister is authorised to pay compensation for damage occasioned by the Minister’s actions in implementing the Agreement (s 10). The Minister must lay copies of the Authority’s annual reports and any amendments to the Agreement before each House of Parliament within 15 sitting days (s 17). The Minister may delegate powers and functions by written instrument, and delegations are revocable at will; further delegation is permitted if the instrument allows (s 18).

Basin Officials Committee appointments: The Minister may appoint the State’s member to the Basin Officials Committee and acting members (s 4(1)). Appointees must be employed in the Public Service (s 4(2)). Appointments are for up to three years with eligibility for reappointment, and the Minister may terminate appointments early (s 5(1)-(2)). The office becomes vacant if the appointee ceases to be employed in the Public Service (s 5(3)). Acts done by persons purporting to act are not invalidated merely by defects, irregularity or the absence of a formal occasion to act (s 4(6)).

Rights and duties of authorised persons and landowners: The Minister may authorise persons in writing to enter and occupy land for Basin purposes, and must provide a certificate of authority specifying the basis, name, powers and expiry (s 13(1)-(3)). An authorised person must produce that certificate if requested by an apparent occupier (s 13(4)). Entry and occupation require seven days written notice to owner or occupier (s 14(1)), except in emergency or with consent to shorter notice, and residential premises cannot be entered without occupier consent (s 14(2)-(3)). When exercising entry powers, authorised persons must minimise harm and inconvenience, limit occupation to what is reasonably necessary, leave the land as nearly as possible in the original condition, and co‑operate with owner and occupier (s 14(4)). Owners and occupiers must not unreasonably obstruct or hinder authorised persons; an offence with a maximum penalty of $5 000 (s 14(5)).

Compensation and appropriation obligations: The Minister is authorised to pay compensation for damage arising out of State actions under the Act or the Agreement (s 10). All State money required under the Agreement is to be provided from Parliamentary appropriations (s 16). These provisions allocate financial responsibility to the State Executive but ensure Parliamentary appropriation control over expenditure.

Decision‑making duties under amended State Acts: The Schedule inserts a repeated statutory consideration duty into numerous provisions across State laws. Where licences, permits, allocations, transfers and approvals relate to Murray‑Darling Basin water resources, decision makers must "take into account the terms or requirements of the Murray‑Darling Basin Agreement and any resolution of the Ministerial Council under that agreement (insofar as they may be relevant)" and relevant provisions of the Basin Plan (Sch 1 Pt 4, Pt 5 etc). The phrase "take into account" is a statutory duty to consider intergovernmental instruments when making decisions about water resources and related works and approvals.

Exemptions and regulatory powers: Works and property used or held by a Contracting Government or Constructing Authority for Basin purposes are exempt from rates, taxes, charges and fees under Acts or statutory instruments (s 15). The Governor may make regulations for matters necessary or expedient to carry out the Act, including regulations that leave matters to Ministerial or other discretion (s 20(1)-(2)).

Criminal offences and liabilities: It is a criminal offence to obstruct authorised persons exercising entry powers (s 14(5)), punishable by up to $5 000; and to destroy or damage works constructed or operated under the Act or Agreement, punishable by up to $100 000 or imprisonment for five years (s 19). These offences provide enforcement levers to protect works and to preserve the implementation of Agreement measures.

Delegation formalities and limits: Delegations must be in writing (s 18(2)(a)), may be conditional or absolute (s 18(2)(b)), do not remove the Minister’s power to act (s 18(2)(c)), and are revocable at will (s 18(2)(d)). Further delegation is possible if the original instrument permits it (s 18(3)). This framework establishes the Minister as the principal decision maker while enabling administrative delegation.

Legal definitions and cross‑referencing: The Act’s interpretive clauses define key terms and make explicit the alignment of meanings with the Agreement (s 3). The withdrawal of older State definitions and replacement with definitions that mirror the Commonwealth Water Act 2007 appear across Schedule 1, aligning State statutory language with the Commonwealth instrument and the Basin Plan.

Criminal penalties for interference and damage: The Act establishes two primary criminal sanctions. First, a person who obstructs or hinders someone exercising entry and occupation powers under s 14 without reasonable excuse faces a maximum penalty of $5 000 (s 14(5)). Second, a person who, without lawful excuse, destroys or damages any works constructed or operated under the Act or the Agreement faces a maximum penalty of $100 000 or imprisonment for five years (s 19). These penalties apply to protect works and the administration of Agreement measures in the State.

Procedural enforcement for entry and occupation: Entry and occupation powers are structured to be exercised after giving seven days notice in writing to the owner or occupier (s 14(1)), with emergency and consent exceptions (s 14(3)). The authorised person must carry and, if requested, produce a certificate of authority that states it is issued under the Murray‑Darling Basin Act 2008, names the person, describes powers and states expiry date (s 13(2)-(4)). Failure to comply with the statutory notice or certificate regime may affect the lawfulness of entry and thus the availability of criminal sanctions for obstruction or remedies in respection to unlawful entry.

Civil remedies, compensation and acquisition process: The Minister is authorised to pay compensation for damage occasioned by State actions in constructing, maintaining, operating and controlling works, carrying out Agreement operations or implementing measures (s 10). Compulsory acquisition of land is subject to the Land Acquisition Act 1969 (s 7(2)), which provides the statutory process for valuation and compensation. The Act itself does not detail compensation formulae but authorises payment and imports procedural obligations by reference to the Land Acquisition Act for compulsory takings.

Regulatory instruments and delegations: The Governor may make regulations as necessary (s 20). Regulations may leave certain matters to be determined at the Minister’s discretion or to persons or bodies prescribed by regulation (s 20(2)(b)). Delegations from the Minister must be in writing and are revocable, which affects enforcement because delegated officers can be given powers to implement, enforce or manage works and approvals (s 18).

Interplay with amended State decision regimes: The Schedule 1 amendments require many administrative decisions under State Acts to take into account the Agreement and Basin Plan. Enforcement of that obligation would typically be via merits review or judicial review processes applied to administrative decisions. The statute’s repeated phrase "take into account" creates a statutory duty open to legal challenge if decision makers fail to give consideration to the Agreement or Basin Plan where relevant. The Act does not itself prescribe a specific enforcement mechanism for breaches of the "take into account" duty, but existing administrative law remedies and review mechanisms in the affected Acts would govern challenges.

Financial enforcement and exemptions: Section 15 exempts works and property used or held by a Contracting Government or Constructing Authority from rates, taxes, charges and fees under Acts or statutory instruments. That exemption alters the ordinary revenue basis for local authorities and other charging bodies, and potential disputes about the scope of exemption will arise in administrative contexts rather than as criminal offences.

Parliamentary oversight and transparency obligations: The Minister must cause copies of the Authority’s annual reports and amendments of the Agreement to be laid before each House of Parliament within 15 sitting days after receipt or the amendment taking effect (s 17). Failure to lay these documents would be a parliamentary procedure issue rather than a criminal offence; the Act establishes reporting obligations that enable parliamentary scrutiny of the State’s participation in Basin arrangements.

Regulatory discretion and legal risk: Regulations under s 20(2)(b) may specify that certain matters are to be determined according to the discretion of the Minister or a prescribed person or body, concentrating decision‑making power and creating legal risk if discretion is exercised unlawfully. Delegation provisions (s 18) and the possibility of further delegation (s 18(3)) mean acts may be carried out by subordinates whose exercise of power can be challenged if they exceed delegated authority.

Dynamic incorporation of Commonwealth instruments: The Act defines the Agreement by reference to the copy in Schedule 1 of the Commonwealth Water Act 2007 "as in force from time to time" and directs that words used in the Act have the same meanings as in the Agreement (s 3(1)-(2)). This creates dynamic legal interaction where Commonwealth intergovernmental instruments and their changes, such as the Basin Plan under the Water Act 2007,become relevant to State decision‑making without separate State amendment. Several Schedule 1 amendments expressly reference the Basin Plan as a consideration for State decisions (Sch 1 Pt 4 item 8, Pt 6 item 33(3)(e)).

Amendments to State statutes: Schedule 1 makes wide‑ranging consequential amendments to South Australian Acts to align them with the Agreement and the Basin Plan. Key examples include:

• Development Act 1993: the definition of Murray‑Darling Basin is replaced to match the Commonwealth Water Act 2007 definition (Sch 1 Pt 2 item 2); obligations under the Development Act to consider developments now include obligations or requirements under the Agreement (Sch 1 Pt 2 item 3).
• Natural Resources Management Act 2004: numerous decision points (licences, allocations, transfers, variations, works approvals, site use approvals, delivery entitlements) are amended so decisions that relate to water resources in the Basin must "take into account" the terms or requirements of the Agreement, Ministerial Council resolutions and relevant Basin Plan provisions (Sch 1 Pt 4 items 6-14; Pt 5 items 15-30).
• River Murray Act 2003: interaction clauses and Ministerial functions are amended to include furthering the objects of the Murray‑Darling Basin Act 2008 and giving effect to Agreement terms and Basin Plan purposes (Sch 1 Pt 6 items 31-34).
• Waterworks Act 1932: references to the Murray‑Darling Basin Commission are replaced by the Murray‑Darling Basin Authority (Sch 1 Pt 7 item 35).

Repeal of previous State Act: The Murray‑Darling Basin Act 1993 is repealed by Sch 1 Pt 8 s 36. Transitional references convert older statutory references to the Commission into references to the Authority, subject to regulatory exceptions (Sch 1 Pt 9 s 37(1)-(4)).

Interaction with Land Acquisition Act 1969 and compensation law: Compulsory acquisition powers under s 7(1) are subjected to the Land Acquisition Act 1969 (s 7(2)). The Minister’s power to pay compensation for damage under s 10 must be read alongside the Land Acquisition Act and other compensation mechanisms for compulsorily acquired land.

Administrative law overlay: The Act imposes statutory duties to "take into account" intergovernmental instruments when making decisions under amended State Acts. Those duties will be enforceable through administrative law mechanisms such as judicial review and, where available, merits review under the particular act in question. The Act does not remove existing review rights under affected statutes.

Regulatory and subordinate law powers: The Governor may make regulations that are necessary or expedient for carrying out the Act (s 20). Regulations may provide for different treatment according to circumstances and may vest determinations in Ministerial discretion or other prescribed persons (s 20(2)(a)-(b)). Those regulations will interact with the functions and powers delegated under s 18 and with other subordinate instruments under the amended State Acts.

Parliamentary appropriation and financial law: Section 16 requires that all State money required to be provided under the Agreement be provided from Parliamentary appropriation, linking executive action under the Agreement to constitutional appropriation procedures and oversight.

Overlap with Commonwealth law: Because the Agreement is referenced and the Basin Plan under the Commonwealth Water Act 2007 is explicitly to be taken into account in decision‑making, State administrative actions that significantly affect Basin water resources will have to be consistent with Commonwealth instruments. Where State action conflicts with Commonwealth law, constitutional principles such as inconsistency under section 109 of the Commonwealth Constitution may be engaged. The Act, however, operates primarily to align State administrative obligations with the Agreement and the Basin Plan rather than to create federal legislative supremacy.

Enactment and commencement: The Murray‑Darling Basin Act 2008 (No 41 of 2008) received assent on 6 November 2008 and commenced generally on 15 December 2008 (Gazette 11.12.2008 p 5475), except for Schedule 1 Part 5 which commenced on 1 July 2009 (Gazette 11.6.2009 p 2726). These dates are recorded in the Legislative history note at the end of the Act.

Repeal and consequential amendments: Schedule 1 undertakes extensive consequential amendments. It replaces earlier State references to the "Murray‑Darling Basin" with the Commonwealth Water Act 2007 definition, substitutes the Murray‑Darling Basin Commission reference with the Murray‑Darling Basin Authority, and inserts the requirement that many State decisions "take into account" the Agreement and ministerial resolutions and Basin Plan where relevant. The Murray‑Darling Basin Act 1993 is repealed by Sch 1 Pt 8 s 36.

Transitional provisions and references: Sch 1 Pt 9 s 37 provides transitional rules. It specifies that references to the Murray‑Darling Basin in any Act will be taken to reference the Basin within the meaning of the Water Act 2007 of the Commonwealth (s 37(1)). It also provides that references to the Commission in any Act will be read as references to the Authority, unless regulations specify exceptions (s 37(2)-(4)). These transitional provisions enable continuity of statutory references while allowing the Executive to specify exceptions by regulation.

Staggered implementation of Schedule items: Not all Schedule 1 amendments commenced immediately with the principal Act. The legislative history notes that Schedule 1 Part 5 commenced later on 1 July 2009. Practitioners must note staggered commencement where particular amendments to the Natural Resources Management Act 2004 took effect on that later date.

No further amendments recorded in the Act text: The text of the Act as provided sets out the original 2008 enactment and Schedule amendments. There is no later amendment history included in the provided text. Any subsequent alterations to the Act or the Schedule would need to be checked against consolidated legislation on the South Australian legislation website for updates beyond the principal Act.

Parliamentary reporting obligation timing: Section 17 imposes a standing obligation on the Minister to lay copies of the Authority’s annual reports and any amendments of the Agreement before Parliament within 15 sitting days. That requirement effectively creates a rolling point at which the Parliament receives information and may signal future State action by the Executive, and it fixes timetables for the State to report following Commonwealth or intergovernmental changes.

Interplay with Commonwealth implementation: Because the Act imports the Agreement "as in force from time to time" (s 3(1)), changes at Commonwealth or intergovernmental level will have immediate legal relevance in South Australia. The Schedule amendments which require decision makers to "take into account" the Agreement and Basin Plan will consequently change interpretation and administrative obligations in step with Commonwealth action without further State amendment. This operational dependency is a structural feature of the amendment approach adopted in 2008.

The text of the Murray‑Darling Basin Act 2008 as provided does not record any judicial decisions, reported litigation, or judicial interpretation. The Act itself contains no cited cases and the legislative history at the end lists enactment and commencement dates only. Therefore there is no litigation history contained within the instrument as supplied.

That said, the Act creates statutory hooks and duties that are likely to generate disputes that would be resolved in administrative and civil litigation contexts. Practitioners should note the following categories of legal questions that the Act makes latent and that could attract judicial review or civil claims:

• Validity of appointments and acts by purported appointees: Sections 4(3) and 4(6) state that appointments and actions are not invalidated by defects, irregularities or absence of occasion to act. Litigation may nevertheless arise about whether particular persons were validly appointed, whether the public service employment requirement in s 4(2) was observed, and the legal effect of actions taken by persons purporting to act. Disputes could raise questions of administrative law and agency authority.

• Compulsory acquisition and compensation: Section 7(2) subjects compulsory takings to the Land Acquisition Act 1969. Litigation is likely in cases where landowners dispute necessity for acquisition, valuation, compensation sufficiency or procedural compliance. The Act authorises compensation (s 10) but does not set valuation or timing; the Land Acquisition Act will govern procedures and disputes.

• Lawfulness of entry and occupation: Sections 13-14 set notice, consent and certificate requirements. Civil actions could arise regarding unlawful entry, trespass, or damage caused during occupation. Conversely, prosecutions for obstruction (s 14(5)) may be litigated where occupiers claim authorised persons lacked proper authority or did not comply with notice and certificate requirements.

• Interpretation of "take into account" duties: The Schedule adds multiple provisions requiring decision makers to "take into account the terms or requirements of the Murray‑Darling Basin Agreement and any resolution of the Ministerial Council under that agreement" and relevant Basin Plan provisions. Litigation may test the scope of that duty, whether decision makers properly considered the Agreement or the Basin Plan, whether consideration was substantive and adequate, and whether failures amount to jurisdictional error or merits reviewable error.

• Crimes and protection of works: Section 19 sets serious criminal penalties for damage to works. Prosecutions under this provision would raise factual and legal questions about the scope of "works", whether the conduct was without lawful excuse and the appropriate sentence or penalty.

• Delegation and improper exercise of discretion: The Minister’s broad delegation powers (s 18) and the potential for regulations to leave matters to Ministerial discretion (s 20(2)(b)) create room for litigation about whether delegates exceeded their authority, whether discretionary decisions were made lawfully and for legitimate reasons, and whether revocations or further delegations complied with the written instrument requirement (s 18(2)(a)).

• Constitutional and Commonwealth‑State inconsistency: Because the Act dynamically incorporates elements of the Commonwealth Water Act arrangements and Basin Plan, litigation could arise over consistency between State actions and Commonwealth law, or over the extent to which State law can operate where Commonwealth constitutional powers are engaged. Section 3’s reference to meanings in the Agreement may be central to such disputes.

No reported cases are cited in the Act text. For accurate, up‑to‑date litigation history, practitioners should consult court databases and law reports for decisions that interpret or apply the Murray‑Darling Basin Act 2008, and track challenges to administrative decisions under the amended State Acts following its commencement and the Basin Plan implementation. The Act’s provisions create predictable points of legal contest, but specific judicial outcomes are not contained in the statute itself.

Dynamic incorporation of Commonwealth instruments: The Act defines the Agreement by reference to the copy in Schedule 1 of the Commonwealth Water Act 2007 "as in force from time to time" (s 3(1)). This means Commonwealth or intergovernmental changes can have immediate consequences for State decision making under the suite of amended State Acts. Practitioners must note that what a State regulator is required to "take into account" will change if the Agreement or Basin Plan is amended, potentially without further State parliamentary action.

Ambiguous standard of "take into account": Schedule 1 repeatedly inserts the requirement that decisions "take into account the terms or requirements of the Murray‑Darling Basin Agreement and any resolution of the Ministerial Council under that agreement (insofar as they may be relevant)" and relevant Basin Plan provisions (see e.g. Sch 1 Pt 4 items 10-14). The statutory phrase "take into account" is less prescriptive than "comply with" or "be consistent with". It creates an obligation to consider, but the statute does not specify weight, primacy, or how conflicts between State policy and Agreement obligations are to be resolved. This can give rise to administrative uncertainty and litigation over adequacy of consideration.

Occupation and entry constraints: Authorised persons must provide a certificate of authority and produce it if requested (s 13(2)-(4)). Entry generally requires 7 days written notice, but the requirement does not apply in an emergency or with consent to a shorter period (s 14(1), (3)). Entry to residential premises requires occupier consent (s 14(2)). Landowners who permit shorter notice may inadvertently waive procedural protections. Authorised persons must "cause as little harm and inconvenience as possible" and "leave the land as nearly as possible in the condition in which the Minister or authorised person found it" (s 14(4)(a), (c)), but the Act does not define "as little" or "as nearly as possible", which may be contested.

Compulsory acquisition subject to separate statute: The Minister may acquire land compulsorily but must do so in accordance with the Land Acquisition Act 1969 (s 7(2)). That external procedural framework governs notice, valuation and compensation. Practitioners should not assume the Act itself sets out compensation formulae. Instead affected parties must engage the Land Acquisition Act processes.

Delegation is revocable and may be further delegated: Delegations must be in writing and are revocable at will (s 18(2)(a), (d)). Further delegation is allowed if the instrument permits it (s 18(3)). This creates potential instability for parties relying on delegated decisions or representations, because the Minister retains the ability to revoke delegations and to act personally, and sub‑delegation can shift responsibility down the administrative chain.

Exemption from local charges and rates: Section 15 exempts works and property used or held by a Contracting Government or Constructing Authority from rates, taxes, charges and fees under an Act or statutory instrument. Local authorities and ratepayers may be affected; the scope of exemption could be contested if it is unclear whether a property is "used or held" for the purposes of any works. The Act does not set out a registration or notice mechanism for exemptions.

Appointment constraints and public service requirement: Only persons employed in the Public Service are eligible for appointment as the State’s Basin Officials Committee member (s 4(2)), and office becomes vacant if the person ceases Public Service employment (s 5(3)). That may limit the pool of expert candidates and change membership when public servants move between roles. Appointments and acts purporting to be done by acting members are protected from invalidation for defects (s 4(3), (6)), which narrows avenues for challenging acts on procedural grounds.

Penalty severity and criminalisation scope: The damage offence in s 19 carries a significant maximum penalty of $100 000 or five years imprisonment. The Act does not define "works" beyond the definition in s 3(1) which includes works constructed under former or current Agreements. Persons who interact with infrastructure must be aware that damage or destruction will attract high civil and criminal exposure.

Parliamentary reporting requirement timing: The Minister must lay copies of the Authority’s annual reports and any amendments of the Agreement before each House of Parliament within 15 sitting days (s 17). The term "sitting days" can create tight deadlines during parliamentary recesses or where multiple amendments occur in short order. Non‑compliance would be a procedural parliamentary issue.

Interaction with multiple Acts and administrative complexity: The Schedule 1 amendments cut across a wide range of State instruments and decision points: licences, allocations, transfers, approvals, site use, delivery capacity entitlements, and planning decisions. Practitioners must track which statutory decisions require the new consideration duty and whether transitional provisions apply. The staggered commencement of certain Schedule items (Sch 1 Pt 5 commenced 1 July 2009) means that historic decisions prior to that date may be assessed under a different statutory framework.

Regulatory discretion left to Minister or prescribed persons: Section 20(2)(b) allows regulations to provide that specified matters are to be determined according to the discretion of the Minister or any other person or body prescribed. This places potentially decisive power in the hands of the Executive and could concentrate decision making in a way that may be challenged where discretion is exercised unlawfully or without procedural fairness.

No private right of action for "take into account" failures in the statute: The Act imposes duties to take the Agreement and Basin Plan into account but does not create an express private right of action or remedial regime in the Act itself. Remedies will therefore depend on existing administrative law pathways, potentially producing delayed, costly litigation rather than immediate statutory enforcement mechanisms.

For landowners and occupiers

• When you receive a written notice under s 14, check the notice date, the identifying details and whether seven days’ notice was given. If entry is to residential premises, verify that the authorised person has the occupier’s consent where required (s 14(2)-(3)).
• Request to see the authorised person’s certificate of authority under s 13(4) and retain a copy. The certificate must state the Act, the person’s name, the powers conferred and expiry (s 13(3)).
• Document the condition of the land before and after any occupation, including photographs and witness statements, because authorised persons have a statutory duty to leave the land in as nearly the original condition as possible (s 14(4)(c)), and compensation claims may follow under s 10 or the Land Acquisition Act 1969 for damage.
• If the land is subject to compulsory acquisition, engage early with the Land Acquisition Act 1969 process for notice and valuation. The Act expressly subjects compulsory acquisition to the Land Acquisition Act (s 7(2)).
• Do not obstruct authorised persons without reasonable excuse, because obstruction is a criminal offence under s 14(5) with a maximum penalty of $5 000.

For licensees, entitlement holders and applicants

• Where your licence, allocation, transfer or works approval relates to a water resource in the Murray‑Darling Basin, identify the parts of the Murray‑Darling Basin Agreement and relevant provisions of the Basin Plan that could be "relevant" to the decision maker’s statutory obligation to take them into account (Sch 1 Pt 4 & Pt 5).
• Ensure applications clearly address how the project aligns with or impacts on Agreement requirements and the Basin Plan, and provide supporting analysis and documentation so decision makers can discharge the "take into account" duty. The repeated statutory requirement across many decision points means administrative decision makers will expect explicit submissions on Agreement and Basin Plan matters.
• If a decision adversely affects entitlements, consider whether administrative review or judicial review remedies are appropriate. Challengeable failures include not properly considering the Agreement or Basin Plan where relevant.

For developers and planning applicants

• Check whether your development falls within areas identified as Murray‑Darling Basin for State purposes, bearing in mind the statutory change aligning the Basin definition with the Commonwealth Water Act 2007 (Sch 1 Pt 2 item 2).
• Address Agreement terms and any Ministerial Council resolutions in statements of environmental effect, planning reports and development applications, and be ready to show how the development is consistent with, or appropriately mitigates impacts upon, Basin requirements.

For the Minister and public authorities

• Ensure written instruments of delegation comply with s 18(2)(a). Keep delegation registers current, specify whether further delegation is permitted, and note that delegations are revocable at will (s 18(2)(d), (3)).
• When appointing the State’s Basin Officials Committee member, verify the appointee is employed in the Public Service (s 4(2)) and document terms, period and conditions of appointment in a clear instrument as required by s 5(1).
• Maintain records and processes to enable timely laying of the Authority’s annual reports and Agreement amendments before Parliament within 15 sitting days (s 17).
• When implementing works, follow Land Acquisition Act 1969 procedures for compulsory acquisition and document compensation arrangements and budgets consistent with Parliamentary appropriation requirements (ss 7(2), 16).

For contractors and private parties engaged in works

• Obtain contractual terms that allocate risk for damage to works and for compliance with entry and occupation obligations. The criminal offence for damaging works (s 19) creates both reputational and legal risk.
• Ensure personnel authorised to enter land carry and can produce the required s 13 certificate; train staff on occupancy obligations (minimise harm, limit occupation, co‑operate and leave land in original condition (s 14(4))).

For local government and charging authorities

• Review rating and charging practices in light of s 15’s exemption for works and property used or held by a Contracting Government or Constructing Authority. Establish procedures to identify exempt properties and to address claims for refund or exemption.

For compliance and risk teams

• Monitor Commonwealth developments to catch changes to the Agreement and the Basin Plan "as in force from time to time" (s 3(1)). Because the Agreement is dynamically incorporated, any intergovernmental change may require adjustments to State policy, licences and approvals without separate State amendment.
• Develop templates to demonstrate "taking into account" the Agreement and Basin Plan in administrative decisions, including checklists, cross references, and written reasons that explain how relevant elements were considered and weighed.
• Maintain clear records of notices given to landowners for entry, copies of certificates produced, and photographs and reports documenting land condition both before and after occupation to support or defend compensation claims.

For litigators and advisors

• Anticipate disputes in the areas identified under "Litigation history": validity of appointments, lawfulness of entry, compulsory acquisition and compensation, adequacy of "take into account" consideration, and challenges to delegated decisions. Prepare evidence and procedural strategies accordingly.
• Use the Land Acquisition Act 1969 as the primary procedural framework for compulsory acquisitions referenced by s 7(2), and ensure any valuation and compensation claims are made in accordance with that Act.

Record keeping and audit trails

• Across all actors, maintain contemporaneous records to evidence compliance with statutory procedures: certificates of authority, notices, delegation instruments, appointment instruments, decisions and reasons showing how Agreement/Basin Plan considerations were taken into account, damage and compensation records, and parliamentary submissions or laid documents as per s 17.

By following the statutory prescriptions in the Act and cross‑referenced instruments, and by creating administrative processes to evidence the "take into account" duties and entry/occupation formalities, parties can reduce legal and operational risk stemming from the Act’s requirements.
