Municipalities Assistance Act 1973

The Act defines several key terms by reference to other Victorian statutes, rather than providing self‑contained definitions. This cross‑referencing means that a practitioner must consult at least three other Acts to determine the scope of the subsidy.

A pensioner is defined in section 2(1) as “a person who is an eligible recipient within the meaning of the State Concessions Act 2004”. That Act sets out the categories of Commonwealth pensioners and concession card holders who qualify for state concessions. The Act does not itself define eligibility; it merely adopts the definition from the State Concessions Act. Consequently, any change to the State Concessions Act automatically alters who qualifies under this Act, without any amendment to the Municipalities Assistance Act itself.

A domestic partner of a person means (a) a person who is in a registered relationship with that person, or (b) a person to whom the person is not married but with whom the person is living as a couple on a genuine domestic basis, irrespective of gender. This definition was substituted by the Relationships Act 2008. For the purposes of the definition, “registered relationship” has the same meaning as in the Relationships Act 2008, and in determining whether persons not in a registered relationship are domestic partners, all circumstances of the relationship are to be taken into account, including any one or more of the matters referred to in section 35(2) of the Relationships Act 2008 as may be relevant. This is a broad, fact‑based test that creates an evidentiary burden for councils verifying the relationship when calculating the assistance formula.

A spouse means a person to whom the person is married. This is a straightforward definition that does not include de facto or registered relationships (those are covered by “domestic partner”).

The core operative concept is the excusal of rates, interest, or charges. The Act only applies where a council has excused payment upon application by a person who is a pensioner, in respect of property that is the “sole or principal residence” of that pensioner. The power to excuse is found in section 171(4) of the Local Government Act 1989, and the power to waive is in section 171(5A). The Act does not apply to concessions granted for other reasons, such as hardship not linked to pensioner status, or to rates on investment or commercial properties. The “sole or principal residence” requirement ensures the subsidy subsidises only the pensioner’s home.

The assistance amount is one‑half of the sum of the rate or charge and the total interest payable for all quarters in that year (or the amount validly excused if that is lower), subject to a formula when multiple persons are liable. If the pensioner is the only person liable, or if the only other person liable is the pensioner’s spouse or domestic partner, assistance is one‑half of that sum. If the pensioner (and optionally the spouse or domestic partner) are liable together with one or more other persons, the sum is divided by the total number of liable persons before halving. In all cases, the amount of assistance cannot exceed the amount validly excused. This creates a cap: the State will not subsidise more than the council actually forgave.

The Act also contemplates waiver under section 171(5A) of the Local Government Act 1989. Section 2(5) requires the Treasurer, upon application of a council, to pay an amount equal to any amount the council validly waives under that provision. The waiver provision appears to be a separate head of assistance from the excusal mechanism, but the formula is not stated for waivers; presumably the same principles apply or the amount is simply the waived amount. The Act does not detail how the waiver amount is calculated for joint liability.

Finally, the Act gives the Treasurer a power to require information from a council or the Board of Works that the Treasurer considers necessary for the purposes of the Act (section 2(4)). This is the only verification mechanism in the Act. There is no requirement for the Treasurer to audit or verify the pensioner’s status or the council’s calculation before paying; the power is discretionary.

The Act directly affects three categories of actors: councils (and potentially the Board of Works), the Treasurer of Victoria, and pensioners who are ratepayers. However, the nature and intensity of the effect differ markedly.

Councils are the primary actors. They must decide whether to grant a rate concession to a pensioner; if they do, they may apply to the Treasurer for reimbursement of half the foregone revenue. The Act imposes no obligation on councils to grant concessions; it merely creates a financial incentive to do so. For a council weighing the cost of excusing a rate, the subsidy reduces the effective cost from 100% to 50% of the rate amount. This may make councils more willing to grant concessions, especially for smaller amounts where the administrative cost of applying is low. However, the council still bears the remaining 50% and must absorb the administrative cost of making the application, tracking the pensioner’s eligibility, and providing information on request. The Act applies to all Victorian councils, but in practice only those that exercise the power to excuse or waive under the Local Government Act will have any engagement with it. The Act also refers to the Board of Works, although the Melbourne and Metropolitan Board of Works was abolished in 1991; the reference may have no practical application, but it has not been repealed.

The Treasurer of Victoria is obliged to pay upon a valid application. This is a mandatory duty: “the Treasurer shall pay”. There is no discretion to refuse if the council’s application meets the conditions. However, the Act does not specify a timeframe for payment, nor does it provide for interest or penalties if payment is delayed. The Treasurer may require information under section 2(4), but that is a power, not a duty. The practical effect is that the State bears a contingent liability equal to half the value of all pensioner rate concessions granted by councils that choose to apply. This liability is not capped in the Act; it depends on council decisions. Over time, the aggregate cost to the state budget could be significant if many councils exercise the power.

Pensioners are indirect beneficiaries. They have no right under this Act to demand that a council apply for assistance, nor can they enforce the Treasurer’s obligation to pay. Their only direct right is to apply to the council for excusal or waiver under the Local Government Act. The existence of the Act may make councils more willing to approve such applications, but the pensioner cannot compel either the council or the Treasurer. The Act does not affect the pensioner’s liability: once the council excuses or waives, the pensioner owes nothing (or less, if only part is excused). The State subsidy simply reimburses the council; it does not alter the pensioner’s obligation.

Ratepayers generally are indirectly affected. The State subsidy is funded from consolidated revenue, which is ultimately paid by all Victorian taxpayers. If the Act successfully encourages more generous concessions, the cost of those concessions is shifted from the council’s local rate base to the broader state taxpayer base. This may create a cross‑subsidy from non‑pensioner ratepayers and other taxpayers to pensioner homeowners. Conversely, if councils would have granted concessions anyway, the Act simply reduces the cost to local ratepayers at the expense of state taxpayers.

Spouses and domestic partners of pensioners are affected only insofar as their presence or absence changes the calculation of the assistance amount. If a spouse or domestic partner is jointly liable, the formula treats them as part of the pensioner’s household (not as a separate liable person), so the assistance is still calculated as if the pensioner were the sole liable person for that share. This favours married or partnered pensioners over those living with unrelated co‑tenants, where the number of liable persons increases and the assistance is divided.

The Act creates a small set of clear legal duties and rights, mostly structured around the council‑Treasurer relationship. There are no duties or rights for pensioners directly under this Act; pensioners must look to the Local Government Act for their right to apply for concession.

Duty of the Treasurer to pay. The central obligation is in section 2(3): where a council has excused payment of a rate, interest or charge in the circumstances described, and that council (or the Board of Works) makes application to the Treasurer, “the Treasurer shall pay to that council … in respect of that rate interest or charge an amount” calculated according to the formula. The word “shall” imposes a mandatory duty. There is no discretion to refuse a valid application, no power to reduce the amount, and no condition that the Treasurer first verify the pensioner’s status. The duty is triggered by the council’s application, not by the pensioner’s application to the council. If the Treasurer fails to pay, the council may have a right to recover the debt through ordinary legal channels, although the Act does not specify a remedy.

Right of the council to apply. A council that has excused or waived rates is entitled to apply to the Treasurer. The Act uses permissive language: “the council … may make application”. The council has no duty to apply; it can decide to forego the subsidy. This is an important economic point: the Act does not require councils to pass on the benefit; a council could grant a concession and choose not to claim reimbursement, effectively bearing the full cost itself. In practice, most councils would apply to recover the money, but there is no compulsion.

Power of the Treasurer to require information. Section 2(4) provides: “The Treasurer may require any information which he considers necessary for the purposes of this Act from a council, or the Board of Works.” This is a discretionary power, not a duty. The Treasurer can demand information before paying, after paying, or not at all. The Act does not specify what kind of information (e.g., proof of pensioner status, property details, council resolution), nor does it set a timeframe for compliance. If a council fails to provide information, the Treasurer could potentially refuse to pay or seek recovery, but the Act does not provide explicit consequences. This power serves as a verification backstop but is weak in design.

No duty on the council to assist the pensioner. The Act does not impose any duty on the council to inform the pensioner about the existence of the subsidy, to apply for it on the pensioner’s behalf, or to use the funds for any particular purpose. Once the council receives the assistance, it becomes part of the council’s general revenue. The Act does not require that the council pass the money on to the pensioner or reduce other charges.

No private right of action. The Act does not create a private right for pensioners or any other person to enforce the Treasurer’s duty or to challenge a council’s failure to apply. The only parties with standing to enforce the duty are likely the councils themselves, and even then the Act does not specify a mechanism (such as judicial review or debt recovery). In practice, the duty is likely enforced through the state’s financial administration processes rather than through litigation.

No duty on the council to exercise its power to excuse. The Act does not create any obligation on a council to consider or grant an application for excusal or waiver. That power remains discretionary under the Local Government Act.

The Municipalities Assistance Act 1973 contains no penalty provisions whatsoever. It creates no offences, no fines, no civil penalties, and no administrative sanctions for non‑compliance. This is consistent with its character as a financial appropriation and reimbursement statute rather than a regulatory one. Enforcement is limited to the ordinary mechanisms of public finance and administrative law.

The only enforcement‑adjacent mechanism is the Treasurer’s power to require information under section 2(4). If a council fails to provide information, the Treasurer could in theory refuse to pay future applications or seek to recover past payments, but the Act does not expressly authorise such steps. The power to require information is given “for the purposes of this Act”, which could imply that the Treasurer can condition payment on provision of information, but the Act does not make payment contingent on information provision. The mandatory language of “shall pay” in section 2(3) suggests that the duty to pay arises upon application, not upon supply of information. The Treasurer might attempt to withhold payment pending information, but this could be challenged as inconsistent with the mandatory duty. A court would likely interpret the Act as requiring payment first and allowing the Treasurer to request information afterwards, with no express power to claw back overpayments if information is not provided.

If a council submits a false or inflated application, the Act provides no express remedy. The council would have potentially committed an offence under general criminal law (e.g., fraud or obtaining a financial advantage by deception), but that would arise under the Crimes Act or common law, not under this Act. The Act does not impose a duty of accuracy on the council’s application, nor does it create an express entitlement for the Treasurer to recover overpayments. Recovery would need to be pursued as a civil debt or under a restitutionary claim. The absence of express penalties or enforcement powers means the Act relies heavily on the honesty of councils and the Treasurer’s willingness to pursue other legal avenues. This is a significant weakness in the design, as it creates a moral hazard: councils may be tempted to overstate the amount excused or to claim for pensioners who do not qualify, knowing that detection is unlikely and that the Act provides no specific penalty.

The Act also does not impose any penalty on the Treasurer for late payment. If the Treasurer delays payment, the council cannot claim interest or damages under the Act. The council could seek mandamus compelling the Treasurer to pay, but that is an expensive and cumbersome remedy.

In summary, the enforcement framework is effectively non‑existent. The Act functions on a trust‑based model, where compliance depends on the integrity of councils and the goodwill of the Treasurer. This may be acceptable for a small‑scale, long‑standing program, but it would be inadequate if the subsidy were scaled up or if fraud became common.

The Act does not operate in isolation; its key definitions and operative provisions are embedded in a network of other Victorian statutes. Understanding these interactions is essential for any practitioner advising a council or pensioner.

Local Government Act 1989 (Vic). This is the most important interaction. The Act’s trigger for assistance is a council’s exercise of powers under section 171(4) (excusing payment of rates) or section 171(5A) (waiving rates) of that Act. The Municipalities Assistance Act does not create an independent power to excuse; it only provides a subsidy once the council has already acted under the Local Government Act. Conversely, the Local Government Act does not mention the Municipalities Assistance Act; councils are not required under the Local Government Act to apply for the subsidy. The two Acts are complementary but not cross‑referenced. A council must ensure that its excusal or waiver is valid under the Local Government Act before it applies for assistance; if the excusal is later found invalid, the Treasurer would arguably have no duty to pay, and any payment made could be recovered.

State Concessions Act 2004 (Vic). The definition of “pensioner” in section 2(1) of the Municipalities Assistance Act is entirely derivative: it means a person who is an eligible recipient within the meaning of the State Concessions Act 2004. That Act sets out a detailed list of eligible categories, such as age pensioners, disability support pensioners, and holders of certain concession cards. Any amendment to the State Concessions Act that adds or removes eligibility categories automatically changes the scope of persons for whom councils can claim assistance, without any amendment to the Municipalities Assistance Act. This creates a dynamic interaction: a practitioner must check the current version of the State Concessions Act to know who qualifies as a pensioner. The State Concessions Act also contains its own definitions, verification requirements, and administration. Councils must rely on the pensioner’s proof of eligibility under that Act.

Relationships Act 2008 (Vic). The definition of “domestic partner” in section 2(1) incorporates the concept of “registered relationship” from the Relationships Act 2008 and, for de facto relationships, the criteria in section 35(2) of that Act. The Relationships Act sets out how a registered relationship is created and how a de facto relationship is determined. This means that when applying the formula for joint liability, a council may need to determine whether a person who is not a spouse is a domestic partner, and that determination must be made in accordance with the Relationships Act. The incorporation is by reference, not by restatement, so any future changes to the Relationships Act (e.g., to the criteria for de facto relationships) will affect the operation of the formula.

Water (Consequential Amendments) Act 1989 (Vic). This Act deleted references to “Authority, sewerage Authority or Trust” from section 2(3) of the Municipalities Assistance Act, but left references to “the Board of Works”. The Board of Works (the Melbourne and Metropolitan Board of Works) was dissolved in 1991, and its functions were transferred to other entities. However, the statutory reference has never been repealed. This means the Act still appears to apply to the Board of Works, even though that body no longer exists. A court would likely treat the reference as redundant or as having been impliedly repealed, but it remains a potential source of confusion. Practitioners dealing with water‑related rate concessions should not rely on this Act; the mechanism is effectively defunct.

Original Local Government Act 1958. The long title of the Act refers to rates deferred or excused under section 298 of the Local Government Act 1958. That Act has been repealed and replaced. The reference is now wholly historic; current operations are under the 1989 Act. The 1958 reference does not affect current law.

Other Victorian statutes. The Act does not interact with Commonwealth legislation, except indirectly through the State Concessions Act, which often deems holders of Commonwealth concession cards as eligible recipients. There is no interaction with the Income Tax Assessment Act; the subsidy is a transfer to the council, not taxable income of the pensioner.

The Municipalities Assistance Act 1973 has been amended extensively, with most of its original provisions modified or repealed. The amending Acts are listed in the endnotes and reveal a pattern of gradual obsolescence as the local government and water industry were restructured and as the definition of pensioner was centralised in the State Concessions Act.

The Act received its first amendment in 1974 via the Municipalities Assistance (Amendment) Act (No. 8613), which altered section 2(1) and repealed the original subsection (2) (the current subsection (2) was later inserted by the 2004 amendments). The 1975 amendments (Pensioners’ Rates Remission Act 1975, No. 8670) inserted subsection (3A) and amended subsection (5); subsection (3A) was later repealed in 1975 by another Act (No. 8794). The same year, the Pensioners’ Water and Sewerage Rates Remission Act 1975 (No. 8794) made extensive changes to section 2, including repealing subsection (3A) and inserting a new subsection (4). Further amendments in 1976 (No. 8893) and 1980 (No. 9385) adjusted the definition of pensioner and the scope of rates covered.

The most significant structural change came in 1981 with the Pensioners’ Rates Remission Act 1981 (No. 9684), which substituted new paragraphs (i) and (ii) in section 2(3), effectively rewriting the formula for calculating assistance. That formula has remained in place since, subject only to minor amendments to definitions.

In 1983 and 1984, two amendments (Nos 9915 and 10070) expanded the categories of eligible persons, adding sole parents and rehabilitation allowance recipients. These amendments were later overtaken by the State Concessions Act in 1986.

The State Concessions Act 1986 (No. 109/1986) substituted a new section 2(1) (the current version) to replace the definition of “pensioner” with a cross‑reference to the State Concessions Act. That amendment also removed the need for the Act to list eligible categories. This was a fundamental change: from that point on, the Act no longer defined pensioner substantively.

The Local Government (Consequential Provisions) Act 1989 (No. 12/1989) and the Water (Consequential Amendments) Act 1989 (No. 81/1989) deleted numerous references to water authorities and the old Local Government Act 1958. Subsections (3)(c) to (f) were repealed, removing references to the Authority, sewerage Authority, and Trust. This left the Act applicable only to councils and the Board of Works.

The Local Government (Rating) Act 1991 (No. 78/1991) inserted a new subsection (5) requiring the Treasurer to pay an amount equal to any amount a council validly waives under section 171(5A) of the Local Government Act 1989. This added waiver as a separate head of assistance alongside excusal.

The State Concessions Act 2004 (No. 82/2004) substituted the definition of “pensioner” in section 2(1) to refer to the newly enacted State Concessions Act 2004 (replacing the 1986 Act). It also inserted a new subsection (2) providing for the meaning of “eligible recipient”, but this was later replaced.

Finally, the Relationships Act 2008 (No. 12/2008) substituted the definition of “domestic partner” in section 2(1) and inserted the current subsection (2) which cross‑references the Relationships Act 2008 for registered relationships and the factors for determining de facto relationships. This amendment recognised same‑sex and registered relationships for the first time.

Since 2008, no further amendments have been made. The version as at 4 October 2012 remains the current version. The Act is now essentially a historical instrument, maintained on the statute book but with limited practical application as state concession policy has moved to other mechanisms.

The source provides no indication of any reported litigation under the Municipalities Assistance Act 1973. The endnotes state “No entries at date of publication” for explanatory details, and no cases are cited. This absence is consistent with the Act’s nature as a straightforward, non‑controversial financial mechanism. Cases under the Local Government Act 1989 may touch on the council’s power to excuse or waive rates, but those would not be cases under this Act. Any dispute over the Treasurer’s obligation to pay would likely be an administrative law matter (judicial review of a refusal to pay) or a debt claim, but no such case appears in the source.

Practitioners should not assume that the Act has never been litigated; the source simply does not mention any cases. The most likely type of dispute would involve a council claiming that the Treasurer wrongfully refused to pay or paid an incorrect amount. Given the small monetary values involved for individual pensioner concessions, such disputes would rarely justify litigation. The absence of a private right of action for pensioners further reduces the likelihood of litigation.

Several features of the Act could trip up unwary practitioners. The most significant are:

Obsolete references. The Act still refers to the “Board of Works” in sections 2(3) and 2(4). That body was dissolved in 1991. No council or practitioner should rely on this reference. Similarly, the long title references the Local Government Act 1958, which is long repealed. The operative provisions now refer to the Local Government Act 1989, but the title has never been updated.

Definition of pensioner not self‑contained. The Act does not define who is a pensioner. A practitioner must go to the State Concessions Act 2004 and determine whether the person is an “eligible recipient” under that Act. That Act itself may cross‑refer to Commonwealth legislation. The pensioner’s status must be verified at the time the council grants the concession; changes to the State Concessions Act after the concession may affect eligibility for assistance but the Act does not specify whether the status is determined at the date of the council’s decision or at the date of application to the Treasurer.

Application is council’s, not pensioner’s. A pensioner cannot apply for assistance under this Act. Only the council can. If a council chooses not to apply (or is unaware of the Act), the pensioner has no recourse. The Act does not require the council to apply, and there is no time limit for the council to do so.

No timeframe for payment. The Treasurer “shall pay” upon application, but the Act says nothing about when. A council could wait years for payment with no statutory right to interest.

The cap can reduce assistance below the formula. The proviso at the end of section 2(3) states that “the amount of assistance paid shall not in any instance exceed the amount of the rate or of the rate and interest (as the case may be) validly excused”. This means that if the formula produces an amount larger than what was actually excused (e.g., because the council excused only part of the rate), the assistance is capped at the actual excused amount. The formula is applied first, then the cap is checked.

The “sole or principal residence” requirement. The Act only applies if the property is the sole or principal residence of the pensioner. This excludes rental properties, vacant land, and holiday homes. A council that grants a concession for a non‑principal residence cannot claim assistance. The Act does not define “sole or principal residence”, so a council must apply ordinary real property concepts.

Joint liability formula complexity. The formula in section 2(3)(ii) is: one‑half of (rate + interest) divided by total number of liable persons. That is not the same as (one‑half of rate + interest) divided by number of persons. A miscalculation could lead to an over‑ or under‑claim. The Act also does not specify what happens if some liable persons pay their share and others do not; the formula assumes all are equally liable. The Act is silent on whether the council must first attempt to recover from non‑pensioner co‑owners.

No verification mechanism. The Treasurer can only request information; there is no duty on the council to provide it, and no power to withhold payment if information is not given. This creates a risk of fraud or overclaiming.

Waiver under s 171(5A) is separate but lacks detail. Section 2(5) requires the Treasurer to pay for valid waivers, but the Act does not apply the same formula or cap. It says “an amount equal to any amount the council validly waives”. That could be interpreted as 100% reimbursement, not 50%. However, that reading would create an inconsistency with the 50% rule for excusals. It is more likely that the intent is the same, but the text is ambiguous. Practitioners should be cautious and seek Treasurer’s guidance.

No sunset or review clause. The Act has been in force since 1973 with no expiry. It could be resurrected if councils and the Treasurer began using it again.

Compliance with the Municipalities Assistance Act 1973 is straightforward for councils, provided they follow the steps accurately. The Act does not impose a regulatory compliance burden on pensioners or the general public; councils are the only parties with active obligations.

Step 1: Determine pensioner eligibility. Before excusing or waiving any rate, interest, or charge, the council must ensure that the applicant is a pensioner as defined: an eligible recipient under the State Concessions Act 2004. The council should request acceptable proof (e.g., a current concession card or a letter from Centrelink). The council should also confirm that the property is the pensioner’s sole or principal residence. This may require a statutory declaration or rate records showing occupancy.

Step 2: Exercise the power under the Local Government Act. The council must validly excuse payment under section 171(4) or waive under section 171(5A) of the Local Government Act 1989. The resolution or decision should be documented, specifying the amount excused or waived, the property address, the pensioner’s name, and the date. The council must ensure it has the power to grant the concession (e.g., the pensioner must have applied, and the council must have considered the application).

Step 3: Determine liable persons and calculate assistance. If excusing (not waiving), the council must identify all persons liable to pay the rate, interest, or charge in respect of that property. If only the pensioner is liable, or if the only other liable person is the pensioner’s spouse or domestic partner (as defined), the assistance is one‑half of the sum of the rate (or charge) and total interest payable for all quarters in that year, but not exceeding the amount actually excused. If multiple persons are liable (including the pensioner, and potentially a spouse or domestic partner, plus others), the council must first divide the sum (rate + interest) by the total number of liable persons, then halve that result, again capped at the excused amount. The council must determine whether any co‑owner is a spouse or domestic partner, as that affects the formula (if the only other liable person is a spouse/domestic partner, the pensioner is treated as if solely liable for that share). This requires the council to obtain information about relationships, which may be sensitive.

Step 4: Make application to the Treasurer. The council must submit an application to the Treasurer. The Act does not prescribe a form; a letter or electronic submission will suffice. The application should include the calculation, the council’s resolution, details of the pensioner, and the amount excused. The council should keep copies of all supporting documents.

Step 5: Provide information on request. If the Treasurer requests further information under section 2(4), the council must provide it promptly. Failure to do so could damage the relationship and potentially lead to refusal to pay future claims, even if the Act does not expressly authorise such refusal.

Step 6: Receive payment. Upon payment, the council should account for the funds as general revenue. There is no requirement to use the funds for any specific purpose.

For the Treasurer, compliance is simpler: upon receiving a council application, the Treasurer must pay the calculated amount. The Treasurer may, but is not required to, verify the application. If the Treasurer suspects an error or fraud, he or she can request information and then decide whether to pay. However, the mandatory “shall pay” language suggests that payment should not be withheld except in clear cases of invalidity (e.g., the council had no power to excuse). The Treasurer should keep records of applications and payments for audit purposes.

For pensioners, there are no compliance obligations under this Act. They need only apply to their council for a rate concession under the Local Government Act. They may want to ensure the council applies for the subsidy, but the pensioner cannot compel this. The pensioner’s only leverage is to ask the council to do so; the council may be more inclined to grant a concession if it knows the state will reimburse part of the cost.

Best practices. Councils should adopt a formal policy for handling rate concessions and assistance applications. They should document all decisions, maintain a register of concession recipients, and periodically reconcile with concessions granted. Given the age of the Act and the potential for it to be amended or replaced, councils should also check whether any newer or more beneficial schemes exist under the State Concessions Act or other state programs before relying on this Act.
