MOTOR VEHICLES REGULATIONS 1977

The Regulations centrally operationalise three recurring legal concepts: classification, information flow, and the administrative lifecycle of damaged vehicles. Each concept is treated by a discrete regulation cluster.

Classification. Regulation 4C supplies a classification regime for licences, mapping lettered classes to vehicle types and imposing a hierarchical ordering. The table in r 4C(1) sets the substantive legal entitlements attached to a licence: a C licence covers motor vehicles with gross vehicle mass (GVM) not greater than 4.5 t or a construction/agricultural vehicle; LR covers vehicles >4.5 t and <=8 t; MR covers rigid 2‑axle >8 t; HR covers rigid 3+ axles or articulated motor omnibuses >8 t; HC covers prime movers with single semi‑trailers or rigid vehicles towing trailers over 9 t; MC covers any motor vehicle or combination. The regulation contains cross‑driving rules, including that licence holders are entitled to drive lower classes automatically, r 4C(2), and sets limited conditions under which a licensee may drive a higher class, r 4C(3)-(4). Endorsements alter entitlements: an "A" endorsement restricts to automatic transmission vehicles if the test was in an automatic vehicle, r 4C(6)-(8); a "B" endorsement restricts to synchromesh transmission for heavy vehicle licence obtained after a synchromesh‑fitted test, r 4C(9)-(11). Part B sets motorcycle classifications and introduces a special novice class Rr with machine approval constraints under regulation 5.

Information flow. Regulation 15 is the explicit schema for the Registrar to disclose information contained in vehicle and driver records. It lists classes of recipients, enumerates purposes for disclosure, and attaches the condition that, for many classes, the prescribed fee must be paid. Table 1 covers vehicle information and allows access for accident parties, insurers, owners or occupiers of impacted premises, administrators of estates, guardians, registered charities for locating missing persons, interstate regulators and competent authorities, Austroads/NEVDIS participants, CrimTrac, the National Heavy Vehicle Regulator and Commonwealth border/immigration/passport agencies, among others. Table 2 covers licence information disclosure to similar classes and for identity confirmation, address and licence status purposes. The regulation also defines terms central to the information exchange environment, including NEVDIS and CrimTrac, and relies on the Motor Vehicles (Fees and Charges) Regulations 2008 for monetary prerequisites.

Administrative lifecycle of damaged vehicles. The Regulations define "total loss", "statutory write‑off" and "repairable write‑off" at r 4A(1). The statutory write‑off definition is highly prescriptive: immersion thresholds differ for cars and motorcycles, fire and stripping outcomes qualify, and specified impact damage indicators for motor vehicles and motor cycles are listed, r 4A(1) statutory write‑off paras (a)-(f). Regulation 17 prescribes the content and accompanying statutory declaration required in a notice of destruction delivered to the Registrar under s 19A of the Act. Regulation 18 requires the Registrar to maintain a Register of Written‑off Vehicles containing the notice information for vehicles where the manufacture date is not earlier than 15 years before delivery of the notice, and provides paid access to that information, r 18(3)-(4). This creates a controlled, searchable administrative record for certain categories of written‑off vehicles that can be used by purchasers, insurers and regulators.

Other concepts to note are exclusions and interactions with corresponding laws. Regulation 4BA declares that all provisions of these Regulations are excluded provisions for s 5A(2)(h) of the Act, limiting where certain Act protections or exceptions apply. Regulations 5A, 7B and 19 create practical exemptions where a heavy vehicle carries a national heavy vehicle number plate but is registered under a corresponding law, affecting surrender and production duties and changing plate ownership status at r 10. The Regulations also exclude particular low‑speed mobility devices and certain pedal‑assist bicycles from the Act’s definitions at r 4D.

The mechanical logic is that the Act provides the broad powers and offences, and these Regulations set the machine‑readable parameters and operational obligations. Each defined term, table entry, and procedural step changes how registration, licensing, data disclosure and write off processing occur in practice.

The Regulations affect a discrete set of stakeholders by imposing obligations or enabling entitlements.

Primary affected groups

• Licence holders and applicants. Anyone applying for or holding a licence under sections 9 or 10 of the Act is affected by classification rules r 4C, by the endorsement and limitation rules r 4C(6)-(11), by conditions such as wearing corrective lenses where endorsed "S" r 7, and by the AIL licence conditions if they hold an AIL licence under s 10(4A) of the Act and r 7A.
• Novice motor cycle riders and motorcycle suppliers. Regulation 5 establishes a novice rider category and requires the Registrar to approve motor cycle makes and models as suitable for novices r 5(1), and sets a performance envelope and prohibition on performance enhancing modifications r 5(1),(6).
• Commercial passenger vehicle drivers and applicants. Regulation 9A makes the Registrar responsible for refusing to grant or renew a licence to drive a commercial passenger vehicle unless satisfied the person is fit and proper and medically fit r 9A(1), and provides criteria the Registrar must consider r 9A(2).
• Owners, buyers and traders of damaged vehicles. Regulation 17 requires specific information and a statutory declaration to be provided when a vehicle is declared destroyed r 17(1), and the Register at r 18 stores that information for vehicles of certain ages, which affects post‑loss disposal, resale and rebuild possibilities.
• Heavy vehicle operators and owners. Regulations 5A, 7B, 10 and 19 deal with national heavy vehicle number plates: exemptions from surrender or production where the vehicle is registered under a corresponding law r 5A, 7B, 19; ownership of national heavy vehicle number plates declared as property of the Territory with an exception when the vehicle is registered under a corresponding law r 10.
• Approved persons and suppliers. The Registrar approves persons to assess damaged vehicles and may approve motor cycle models and AIL suppliers. Approved suppliers and approved assessors have duties and powers under r 5, r 7A and r 17. AIL approved suppliers are entitled to receive authorisations to release device data from licensees within 7 days of a request r 7A(j).
• Public sector agencies and interstate regulators. Regulation 15 authorises disclosure of Registrar records to Commonwealth agencies responsible for border or passport functions, CrimTrac, interstate regulators, the National Heavy Vehicle Regulator, NEVDIS participants and other listed competent authorities r 15 Table entries.
• Charities and persons searching for missing persons. Registered charities are an enumerated class that may obtain information for the purpose of locating missing persons under r 15 Tables 1 and 2, subject to the prescribed fee.

Costs are concentrated and diffuse depending on role. Concentrated costs fall on:

• Licence holders required to fit, maintain, and use an approved AIL where applicable, and to comply with authorisation and inspection obligations at r 7A. Those persons face direct device acquisition, installation and servicing costs, and compliance costs from recordkeeping and authorisations.
• Traders and assessors who must prepare statutory declarations and notices of destruction with prescribed fields r 17, and who may need Registrar approval to be recognised as competent to declare total losses r 17(1)(b)(iv).
• Applicants for commercial passenger vehicle licences who may need to demonstrate fitness and medical capability to the Registrar r 9A.

Diffuse costs include administrative processing fees for obtaining information, and the compliance overhead for small businesses buying and selling damaged vehicles that will need to check r 18. The Regulations specify who decides more often than they prescribe penalties. The Registrar is a central decision maker for approvals, records management and conditional licensing, meaning affected parties must interact with the Registrar’s processes and records to exercise rights or meet obligations.

The Regulations allocate specific duties and rights to named actors. Key duties are administrative and compliance obligations; rights include limited entitlements to information or to rely on plate ownership rules.

Duties (selected, by regulation reference)

• Registrar duties:

  • To approve motor cycle models suitable for novice riders, r 5(1).
  • To reclassify a licence from Rr to R when a person ceases to be a novice motor cycle rider, r 5(4).
  • To require periodic tests or medical examinations for persons approved under section 25B(2) of the Act after specified intervals, r 6.
  • To maintain a Register of Written‑off Vehicles and provide information on payment of the prescribed fee, r 18(1),(4).
  • To give information to persons of classes listed in regulation 15 for specified purposes, subject to conditions in the Tables r 15(1).

• Licence holder duties:

  • Where licence endorsed "S", not to drive unless wearing corrective lenses, r 7.
  • AIL licence holders must ensure the vehicle is fitted with an approved AIL, must not drive a commercial passenger vehicle, must observe low alcohol thresholds or absolute sobriety where applicable, must comply with AIL supplier agreements, must use and maintain the AIL in accordance with manufacturer or Registrar instructions, must not interfere with the proper operation of the AIL, must permit police inspection, and must within 7 days authorise the approved supplier and the Registrar in writing to provide AIL information as requested r 7A(a)-(k).
  • Persons making notices of destruction must provide a statutory declaration containing specific data points about the vehicle and their credentials, r 17(1)(a)-(b).

• Vehicle owner duties:

  • National heavy vehicle number plates are property of the Territory unless the vehicle is registered under a corresponding law, in which case ownership ceases r 10(1)-(2). New owners of heavy vehicles with national plates are exempt from surrender where the vehicle is registered under a corresponding law, r 5A.

• Information requester duties:

  • Where regulation 15 Tables specify, the recipient must pay the prescribed fee to obtain information r 15(1) Table column 3 and r 15(2) definition of prescribed fee.

Rights and entitlements

• Right to drive lower class vehicles automatically. A licence entitles a person to drive lower class vehicles within the hierarchy, r 4C(2).
• Conditional entitlement to drive higher class vehicles if requirements are met, including presence of a licensed person in the nearest practicable seat, conspicuous display of the driver instruction notice, and for motor omnibuses, not conveying passengers for reward, r 4C(3).
• Access to Registrar information for named persons and purposes when conditions are met, and on payment of the prescribed fee where applicable r 15(1) and Table entries.
• Exemptions from plate surrender and production duties for new owners or registrants of heavy vehicles with national heavy vehicle number plates where the vehicle is registered under a corresponding law, r 5A, 7B, 19.

Specific, technical duties that create compliance risks. For example:

• AIL licence condition r 7A(j) obliges the licensee to authorise the approved supplier, within 7 days of request, to provide information obtained from the AIL to the Registrar. This creates a compliance window and an interparty data flow obligation.
• Regulation 17 prescribes the precise contents of the notice of destruction and the statutory declaration signatory pool, including insurer, trader, approved assessor or qualified person r 17(1)(a)-(b). Failing to include required fields or to have an authorised declarant may make the notice noncompliant for registration of a write‑off and affect whether the vehicle is entered on the Register r 18.

These duties create administrative pathways and correspond to rights. The Registrar’s discretion in approvals, fitness decisions, and whether to give information is constrained by the Regulations’ enumerated classes and purposes, but the Regulations leave operational judgement in the Registrar’s hands for approval and fitness matters, r 5(1), r 9A(1), r 17(1)(b)(iv).

The Regulations themselves primarily prescribe administrative requirements and do not set out standalone penalty schedules in the text provided. The enforcement framework is instead embedded by reference to the Act and related statutes where contraventions or failures to comply attract penalties under the principal Act. The Regulations do, however, create compliance triggers which may expose regulated persons to enforcement action under the Act.

What the text establishes about enforcement and practical obligations:

• Police powers and inspections. Regulation 7A(i) compels AIL licence holders to permit police officers to inspect an AIL fitted to a vehicle immediately upon request. That obligation is operationally enforceable by police powers under traffic law and the Act.
• Registrar decisions. The Registrar is required to be satisfied that applicants for commercial passenger vehicle licences are fit and proper and medically fit before granting or renewing, r 9A(1). The Registrar’s exercise of that power is a regulatory gatekeeping step; refusal or cancellation decisions under the Act are typically subject to administrative review or appeal mechanisms in the principal legislation, although the Regulations do not set those appeal mechanics.
• Obligations to produce documents. Regulations 5A, 7B and 19 give specific exemptions to requirements under sections 21A(2), 98(1) and 132(3)(a) of the Act, respectively, for national heavy vehicle number plates where the vehicle is registered under a corresponding law. Absent these exemptions, failure to surrender or produce a plate where required would attract the Act’s penalties; the Regulations narrow the reach of those duties in the enumerated circumstances.
• Recordkeeping and access fees. Regulation 18(4) conditions access to the Register of Written‑off Vehicles on payment of the prescribed fee. Failure to pay where required is a practical barrier rather than a criminal sanction. Civil or administrative consequences from non‑compliance with the device and notice requirements arise from the Act’s enforcement mechanisms more generally.

Because the Regulations cross‑refer to offences and obligations in the Act, an enforcement practitioner must map non‑compliance with a Regulation onto the Act provisions that create offences or sanctions. The Regulations create documentary and operational triggers that feed the Act’s regulatory enforcement (for example, a non‑compliant notice of destruction may affect the legal status of a vehicle and the availability of registration pathways, potentially exposing sellers or insurers to civil liability or administrative rejection). The source text does not itself quantify fines or imprisonment terms, nor provide a standalone penalty table.

Compliance will thus be enforced by:

• direct operational checks by police in the field, notably inspection of AILs on request r 7A(i);
• administrative refusals or cancellations by the Registrar concerning fitness to hold certain licences r 9A;
• the Registrar declining to record or to provide services where statutory notices are defective r 17, r 18, or where fees are unpaid r 15 and r 18;
• and the broader enforcement machinery and sanctions which sit in the Motor Vehicles Act 1949 and related Acts referenced throughout the Regulations.

Readers should therefore consult the Motor Vehicles Act 1949 and relevant penalty schedules in that Act or in related Territory legislation for the specific offences and sanctions that apply where the Regulations are contravened.

The Regulations are heavily cross‑referenced to the Motor Vehicles Act 1949 and repeatedly interact with other statutory frameworks and national systems. The principal interactions in the text are as follows.

Cross references to the Act. The Regulations operate under the Motor Vehicles Act 1949 and frequently implement specific Act sections. For example:

• Licence classifications, endorsements, and testing mechanics are implemented under powers to grant licences in sections 9 and 10 of the Act, as noted at regulation 4C heading and r 4C(1).
• Exemptions referencing surrender or production duties link to Act provisions: regulation 5A refers to section 21A(2) of the Act, r 7B to s 98(1), and r 19 to s 132(3)(a).
• Notices of destruction and the Register of Written‑off Vehicles proceed under s 19A of the Act and its document delivery rules, r 17 and r 18.

Interaction with Commonwealth and interstate systems. The Regulations explicitly provide for sharing with and reliance upon national information systems and interstate regulators:

• NEVDIS. Regulation 15(2) defines NEVDIS and regulation 15 Table entries allow information sharing with entities engaged to host information sharing systems between driver licensing and vehicle registration regulators and other agencies, and with participants and users as defined in the NEVDIS Participation Agreement, thereby enabling national exchange of driver and vehicle data r 15(1)(Table entries) and r 15(2) definitions.
• CrimTrac. Regulation 15 allows disclosure to CrimTrac and participants and users and similarly to other Commonwealth agencies handling border control, immigration, citizenship and passports r 15(1) Table entries and r 15(2).
• National Heavy Vehicle Regulator. Regulation 15 Table 1 item 8 allows disclosure to the National Heavy Vehicle Regulator for heavy vehicles for purposes of the national scheme under the Heavy Vehicle National Law.

Interaction with national vehicle and safety rules. Definitions reference the Australian Design Rules and Australian Road Rules. For example, the definition of moped references the Australian Design Rules r 4A(1) and r 4D excludes items defined in the Australian Road Rules r 4D. The Regulations therefore incorporate national vehicle design standards and road rules by reference.

Interaction with fees regulations. Several information disclosure rights and Register access rights are conditioned on payment of the prescribed fee under the Motor Vehicles (Fees and Charges) Regulations 2008, r 15(1) and r 18(4). Compliance with those subordinate fees rules is necessary to obtain Registrar services or records.

Interaction with other Territory Acts. The Regulations condition fitness to hold commercial passenger vehicle licences on compliance with the Commercial Passenger (Road) Transport Act 1991 and medical or alcohol fitness under the Traffic Act 1987, r 9A and r 7A(c)-(d). For AIL licences, licence holders who are subject to s 24 or 25 of the Traffic Act 1987 must not drive if their breath or blood contains alcohol r 7A(c).

Interaction with corresponding law and interstate registration regimes. Several provisions govern national heavy vehicle number plates and create exemptions when vehicles are registered under a corresponding law, r 5A, r 7B, r 10, r 19. The concept of corresponding law is defined at r 4A(1) to mean a State or Territory law that provides for registration of heavy vehicles. These rules create cross‑jurisdictional effects and relieve certain duties where interstate or national registration regimes are in operation.

Statutory instrument relationship and exclusions. Regulation 4BA declares that all provisions of these Regulations are excluded provisions for s 5A(2)(h) of the Act, which affects how that part of the Act interacts with these Regulations. The Regulations also amend or omit provisions over time, as set out in the Endnotes; readers must check commencement clauses and savings to know which amendments are in force.

In short, the Regulations are not stand‑alone. They are a node in a network of statutory rules, national data systems and regulatory regimes. Practical compliance requires attention to the Motor Vehicles Act 1949, the Motor Vehicles (Fees and Charges) Regulations 2008, the Australian Design Rules, Australian Road Rules, NEVDIS participation rules, the Heavy Vehicle National Law and Territory Acts referenced in the Regulations.

The Regulations include a detailed amendment and commencement history in the Endnotes. They were originally made as the Motor Vehicles Regulations (SL No. 11, 1977), notified 29 July 1977 and commenced 12 August 1977 under r 3. The Endnotes list multiple amendment instruments and Acts across decades. Select milestones from the provided text:

• 1980s and early changes. Amendments appeared through the 1980s and early 1990s, including SL No. 17 of 1980, SL No. 31 of 1981, SL No. 37 of 1984, SL No. 8 and SL No. 48 of 1986, and SL No. 27 of 1990 (r 4A inserted No. 37, 1984; r 4AB, 4AC, 4AD inserted and later repealed).
• 1992-2003 amendments. SL No. 61 of 1992 made several insertions; subsequent amendments included SL No. 54 of 2000 and SL No. 39 of 2002. The Commercial Passenger (Road) Transport (Consequential Amendments) Act 2003 is recorded as affecting the Regulations (assent 7 July 2003).
• 2006-2013 changes. The Commercial Passenger Vehicles Legislation Amendment Act 2006 and Transport Legislation (Road Safety) Amendment Act 2007 made changes; SL No. 6 of 2008, SL No. 9 of 2009 introduced AIL provisions at r 7A; the Motor Vehicles Amendment Regulations and other instruments refined definitions and processes. The Penalties Amendment (Miscellaneous) Act 2013 affected commencement and penalties.
• 2019-2022 adjustments. Transport Legislation Amendment Regulations 2019 (SL No. 11 and SL No. 20, 2019) were notified and commenced 1 and 31 July 2019 respectively, with operational commencement 1 August 2019. Transport Legislation Amendment Act 2022 (Act No. 1, 2022) commenced 4 May 2022 and introduced r 4D exclusions in that amendment sequence.
• 2020-2025. The Transport Legislation Amendment Act 2020 (Act No. 23, 2020) made amendments that commenced 1 July 2021 for certain parts. The Motor Vehicle Amendment Regulations 2020 (SL No. 28, 2020) and the Statute Law Revision Act 2020 also produced changes. Transport Legislation Amendment Act 2025 (Act No. 23, 2025) assented 12 September 2025 and is noted to have parts 2, 4, 5 and 6 not commenced and the remainder as of 18 November 2025, per the Endnotes.

The Endnotes provide a granular list of which provisions were inserted, amended, substituted or repealed by the named instruments and Acts. For example:

• Regulation 4B was inserted by SL No. 37, 2012 to address the meaning of construction or agricultural vehicles.
• Regulation 7A was inserted by SL No. 9, 2009 concerning Alcohol Ignition Locks and later amended by Act No. 22, 2011 s 44.
• Regulation 15 was inserted by SL No. 27, 1990 and later amended by subsequent instruments including SL No. 39, 2002 and Act No. 23, 2020 s 37.

Practical implication. The amendment history shows iterative refinement of vehicle classification, data sharing and safety device regulation over years. Users must consult the Endnotes to trace the provenance of each clause and look to commencement notes to determine whether newer Act amendments are in force. The Endnotes explicitly list instruments and exact sections that effected changes; for compliance or litigation purposes, those references must be checked to confirm the operative text at a given date.

The Regulations as printed do not record any judicial decisions or litigation history. The source material contains no cases, no tribunal decisions and no references to contested administrative appeals. It lists only statutory amendment and commencement information in the Endnotes, and does not report judicial interpretation.

Practical consequences of that absence for practitioners and researchers:

• Interpretive uncertainty. Where the Regulations set out technical or discretionary standards, such as the Registrar’s satisfaction that a person is "fit and proper" for a commercial passenger vehicle licence under r 9A(1),there is no recorded line of authority in the provided material to indicate how courts or tribunals have construed those standards in the Territory. Practitioners should therefore expect that many issues of statutory interpretation or procedural fairness around Registrar decisions may be novel in the Territory context and may ultimately be litigated under the Motor Vehicles Act or related procedural statutes.
• Administrative review channels. The source does not supply information on appeals or merits review specific to these Regulations, so one must consult the Motor Vehicles Act 1949 and general administrative law frameworks in the Northern Territory for appeal and review rights against Registrar decisions.
• Evidence and proof. Because the Regulations prescribe evidentiary content for notices of destruction and statutory declarations r 17, the absence of litigation history means there is no settled jurisprudence cited here on what will satisfy the Registrar’s requirements in borderline cases. Parties should comply strictly with the listed fields and declared qualifications in r 17(1)(a)-(b), and preserve documentary proof of delivery and fee payments where required, r 18(4) and r 15.
• Data disclosure disputes. Regulation 15 authorises disclosure to specified recipients for specified purposes, subject to conditions. The Regulations do not show any case law on the limits of these disclosure powers, or on privacy or administrative restraint claims when disclosures are refused or made. Where data sharing raises privacy or statutory construction issues, the absence of local litigation history in the text indicates the need to search case law under the Act or appeal decisions from Registrar rulings, and to be prepared to test the boundaries.

In short, the Regulations document operational rules but do not include litigation precedent. Any legal argument about statutory interpretation, reasonableness of Registrar decisions, or the statutory limits of information sharing will have to be developed from first principles, comparative case law from other jurisdictions where relevant, and the general administrative law corpus rather than from decisions recorded in this source. Practitioners should therefore ensure factual compliance and maintain documentary trails to support administrative review if disputes arise.

This section identifies specific, concrete traps and high‑risk points where regulated parties commonly misstep because the Regulations are technical and prescriptive.

Notice and display dimensions. Regulation 9 prescribes an exact size for the "DRIVER UNDER INSTRUCTION" notice (not less than 530 mm x 300 mm) and minimum letter height (not less than 75 mm) with a yellow background. A smaller notice, different colours, or missing notice will fail the condition in r 4C(3)(b) required for driving higher‑class vehicles under the permitted exception. Practitioners should not rely on non‑compliant signage.

Higher class driving conditionality. Regulation 4C(3) allows a licensee to drive a motor vehicle of a higher class only if a person licensed to drive the vehicle is occupying the nearest practicable seat, the prescribed notice is conspicuously displayed, and, where the vehicle is a motor omnibus, it is not used to convey passengers for reward. Each subcondition must be satisfied; having only one or two met will not activate the exception.

Automatic and synchromesh endorsements. The "A" and "B" endorsements are restrictive, not permissive. If a licence is endorsed "A" or "B" the licensee is restricted to the specified transmission type unless there is a licensed person occupying the seat next to the licensee r 4C(7),(11). Misunderstanding these endorsements can lead to inadvertent unlawful driving.

Novice motor cycle approvals. The novice motor cycle regime at r 5 limits approved machines to engines not greater than 660 mL and power to weight ratios not exceeding 150 kW/tonne, and forbids performance enhancing modifications r 5(1),(6). Importantly, a machine may be approved by the Registrar; absence from the Registrar’s approved list means the machine cannot be used by novices even if it meets the numeric thresholds.

Learner and moped interaction. Although a moped is included in Part A classifications r 4C(13), subregulation (14) states that a person issued a learner licence under section 9 after that subregulation commenced is not licensed to drive a moped. That creates a potential trap for learners who assume universal entitlement to mopeds under the C/LR entitlements.

Statutory write‑off thresholds are specific and varied. Regulation 4A(1) sets different immersion thresholds for motor cars and motor cycles, requires inspection for combinations of impact indicators to qualify as a statutory write‑off, and lists stripping and burning as disqualifying salvage conditions. Parties reselling, repairing or registering vehicles should compare assessments to each enumerated threshold because small measurement differences (for example, roof damage area measured at 300 mm) matter legally.

Register capture is age‑limited. The Register of Written‑off Vehicles only contains information for vehicles whose date of manufacture is not earlier than 15 years before the notice delivery date r 18(3). Consequently, older vehicles that have been declared destroyed will not appear in the Register, potentially misleading buyers who assume the Register is exhaustive.

Prescribed fee conditions. Several information disclosure entries in regulation 15 Table require the prescribed fee to be paid. Failure to pay will block access, and unpaid fee disputes can delay insurance claims, estate administration or property clean‑up where Registrar data is essential.

AIL authorisation windows. Under r 7A(j) and (k), licensees must, within 7 days of a request from the approved supplier or the Registrar, provide written authorisation to enable data transfer. Practically, an AIL licence holder who fails to provide timely written authorisation risks breaching a licence condition.

Exemptions tied to corresponding law. The exemptions that remove the duty to surrender or produce a national heavy vehicle number plate depend on the vehicle being registered under a corresponding law r 5A, r 7B, r 19, and r 10(2) alters ownership only where registration under a corresponding law applies. Parties changing ownership, moving interstate, or re‑registering should check whether the corresponding law condition is satisfied, rather than assuming the exemption applies.

Prescribed registration period for small trailers. Regulation 7C defines trailers with GVM not exceeding 750 kg as a prescribed class and sets a 3 year registration period for them r 7C(1)-(2). Stakeholders who rely on annual registration cycles should update systems to reflect this triennial default where the Act permits variation.

Excluded vehicles and mobility devices. Regulation 4D excludes low speed motorised wheelchairs, certain motorised scooters, pedal‑assist bicycles up to 200 W, and bicycles meeting EN 15194 standards. Misclassifying these devices as motor vehicles or cycles can create unnecessary compliance work or enforcement exposure.

Administrative discretion without recorded precedent. The Registrar holds several discretionary approvals and fitness decisions r 5(1), r 6, r 9A(1). With no litigation record in the source, administrative practice may vary, and applicants should expect additional documentary evidence requests.

This section sets out concrete compliance steps tied to the Regulations. Practitioners should map these steps to their clients’ roles: licence applicants, AIL licence holders, heavy vehicle owners, insurers and traders, and information requesters.

Licence applicants and holders

• Check the correct classification. When applying under s 9 or s 10 of the Act, identify the relevant class in r 4C(1) and ensure testing is carried out in the appropriate class vehicle. Be aware of the hierarchy in r 4C(4) and that lower class entitlements flow automatically r 4C(2).
• Understand endorsements. If the driving test was in an automatic vehicle and the licence is provisional, expect an "A" endorsement r 4C(6). If the test was in a vehicle with synchromesh transmission for >4.5 t vehicles, expect a "B" endorsement r 4C(9). If you require unrestricted entitlements, take the appropriate test or ensure the licensed driver accompanying the vehicle meets the seat requirement r 4C(3).
• For provisional or learner licences, note the specific restriction regarding mopeds for learners issued after subregulation (14) r 4C(14).

AIL licence holders (r 7A)

• Fit an approved AIL. Ensure the vehicle is fitted with an approved alcohol interlock device r 7A(a). Obtain and retain device certification and manufacturer/approved supplier documentation.
• Do not drive commercial passenger vehicles. AIL licence holders must not drive commercial passenger vehicles r 7A(b).
• Maintain device and comply with agreements. Enter into and comply with any agreement with the approved supplier, maintain and service the AIL according to manufacturer specifications, use the AIL according to instructions, and do not interfere with its operation r 7A(e)-(i).
• Comply with alcohol thresholds. If subject to Traffic Act 1987 s 24 or s 25, do not drive with alcohol in breath or blood r 7A(c). Otherwise observe the 0.02 g/210 L breath or 0.02 g/100 mL blood thresholds r 7A(d).
• Provide data authorisations. Within 7 days of a supplier or Registrar request, provide written authorisations permitting transfer of AIL data to the Registrar and from the Registrar to other persons where requested r 7A(j)-(k).
• Consent to inspection. Permit police inspection of the AIL immediately on request r 7A(i).

Notices of destruction, traders, insurers (r 17 and r 18)

• Complete notice fields fully. Provide all required information in r 17(1)(a) when delivering a notice of destruction, including registered owner name and address, registration number, make and model, vehicle type, VIN, manufacture date on RAV or manufacturer identification device, cause of destruction, and declarant qualifications r 17(1)(a)(i)-(xi).
• Use an authorised declarant. The statutory declaration must be made by a permitted person under r 17(1)(b): the registered owner, the insurer that declared the vehicle a total loss, a trader, an approved assessor, or a qualified person. If delivering on behalf of the owner, the permitted persons under r 17(2) may deliver the notice to the Registrar.
• Keep records for Register eligibility. If you want the vehicle recorded on the Register of Written‑off Vehicles, ensure the vehicle’s manufacture date is not earlier than 15 years before the notice delivery date r 18(3). Maintain proof of delivery and fee payment for Registrar records r 18(4).

Register and information access (r 15 and r 18)

• Pay the prescribed fee where required. When requesting information under regulation 15 Tables, confirm whether the Table entry requires the prescribed fee, and pay the amount set in the Motor Vehicles (Fees and Charges) Regulations 2008 r 15(1) Table columns and r 15(2) definition of prescribed fee.
• Use correct purpose and recipient category. Only request information for the permitted purpose listed in Table columns for your class of person r 15(1). Misrepresenting purpose risks refusal and potential administrative sanction.
• For heavy vehicle data. Heavy vehicle operators and regulators should note Table 1 item 8 allows disclosure to the National Heavy Vehicle Regulator for national heavy vehicle matters r 15(1) Table 1 item 8.

National heavy vehicle number plates and exemptions (r 5A, r 7B, r 10, r 19)

• If acquiring a heavy vehicle with a national plate, verify whether you are registering it under a corresponding law. If so, the new owner is exempt from s 21A(2) surrender obligations r 5A, and from plate return requirements under s 98(1) r 7B, and from producing plates under s 132(3)(a) r 19. Confirm via Registrar records whether plate ownership has ceased r 10(2).
• Document registration under corresponding law. Keep documentary proof of corresponding law registration and the vehicle registration number shown on the plate to demonstrate exemption eligibility.

Commercial passenger vehicle licences (r 9A)

• Prepare fit and proper evidence. Applicants or renewers must satisfy the Registrar that they are fit and proper and medically fit r 9A(1). The Registrar will consider patterns of offending and any other relevant circumstances r 9A(2). Provide accurate criminal history disclosures, medical certificates, and employment or conduct references as required.
• Maintain updated medical and fitness documentation. Keep medical certificates current and be ready to produce them on renewal or upon the Registrar’s request.

Trailer registration period (r 7C)

• For trailers with GVM <= 750 kg, apply a 3‑year registration cycle r 7C(1)-(2). Adjust fleet renewal calendars and accounting schedules accordingly.

General practice advice

• Keep strict documentary trails. For statutory declarations, notices of destruction, AIL authorisations, requested information and fee payments, maintain dated copies and proof of delivery.
• Confirm applicable commencement dates. Several amendments and Acts have specific commencement notes in the Endnotes. Verify the operative version of each regulation at the relevant date.
• Liaise with the Registrar early. For approvals (motor cycle types, assessors), for fitness assessments, or if you anticipate unusual registration scenarios, apply to the Registrar in advance to avoid delays.
• Check national system requirements. If you interact with NEVDIS, CrimTrac or the National Heavy Vehicle Regulator, ensure any participation agreements or data sharing consents are in place and compliant with the NEVDIS Participation Agreement referenced in regulation 15(2).

These compliance steps flow directly from the Regulations’ text. Confirmation of fees, specific manufacturer authorisations for AIL devices, and any forms required should be sought from the Motor Vehicle Registry and the Motor Vehicles (Fees and Charges) Regulations 2008 where those instruments are referenced by the Regulations.
