5B Determinations with respect to road vehicles

(1) The Minister may, by legislative instrument, determine that vehicles of a particular class or description are not road vehicles for the purposes of this Act or of a specified provision of this Act. (2) The Minister may declare, in writing, that a vehicle is not a road vehicle for the purposes of this Act or of a specified provision of this Act. (4) Declarations under subsection (2): (a) are not legislative instruments; and (b) are notifiable by publication in the Gazette.
