#### 40 Statement to accompany notice of decisions (1) Where the Minister makes a decision of a kind referred to in subsection 39(1) and gives to a person whose interests are affected by the decision notice in writing of the decision, that notice is to include a statement to the effect that: (a) subject to the Administrative Appeals Tribunal Act 1975, application may be made by or on behalf of that person to the Administrative Appeals Tribunal for review of that decision; and (b) except where subsection 28(4) of that Act applies, application may be made in accordance with section 28 of that Act by or on behalf of that person for a statement in writing setting out the reasons for the decision. (2) Any contravention of subsection (1) in relation to a decision does not affect the validity of the decision.
