MOTOR VEHICLE (HIRE CAR) REGULATIONS 1985

The central concept is the hire car. Regulation 4 defines a hire car as a private hire car, limousine or taxi. This is a broad, sector-spanning definition. It means that the regulations potentially apply to three distinct types of passenger vehicles. The distinction matters because some duties attach to all hire cars (licensing, conduct, ID display) while others attach only to a sub-category (taxis for taximeter operation, private hire cars for the touting prohibition). The regulation does not define the sub-categories further, so their meanings likely derive from the Act or from common industry usage, but the source text gives no elaboration. A limousine is specifically included, which may capture vehicles that are neither traditional taxis nor pre-booked private hire cars.

The term licence has two meanings depending on context. For most of the regulations (outside Part II Division 2 and regulation 72, which is now repealed), a licence means one granted under section 26(1) or 27(1) of the Act. For Part II Division 2 (which contains regulations 6, 7, 8, 9) and regulation 72 (repealed), a licence means one granted under section 10(1) of the Act entitling the holder to drive a hire car of a specified type. This dual definition creates potential for confusion. The licensing provisions in Part II rely on the narrower definition tied to section 10(1). This suggests that the hire car driver licence is a distinct authorisation separate from any vehicle licence under sections 26 or 27. A driver may need both a vehicle licence (for the car) and a driver licence (for themselves) under different sections of the Act.

The concept of passenger is defined inclusively to include the hirer but exclude the driver. This ensures that the term covers both the person who pays for the hire and any other occupants. The definition may be relevant to regulation 10 (conduct towards a passenger) and regulation 70 (touting for passengers).

The Registrar is not defined in the regulations themselves, but is the official appointed under the Motor Vehicles Act with functions related to licensing and enforcement. The Registrar has significant discretion: satisfaction as to good character and fitness (regulation 7), approval of the certificate of fitness and competency (regulation 8), decision to require a medical certificate (regulation 9), and approval of the type, photograph, and manner of display for identification cards (regulation 10A). These are not prescribed in detail in the regulations, leaving administrative discretion.

Regulatory offence is a classification under NT law that typically imposes strict liability, with the penalty set by the regulations (here 15 penalty units for each offence). The classification affects enforcement mechanisms, such as the ability to issue infringement notices.

The defence of accident or unavoidable cause under regulation 76 requires the defendant to prove on the balance of probabilities that the occurrence was accidental or could not have been avoided by reasonable efforts. This reverses the usual criminal burden of proof. It is a narrow shield, not a general excuse; the defendant must show the cause was outside their control and not due to any failure to take reasonable precautions.

The regulations directly affect several distinct groups, though the scope of coverage is narrower than it was before the 2017 amendments.

The primary duty bearers are drivers of hire cars in the Northern Territory. Any person who drives a vehicle that falls within the definition of hire car (private hire car, limousine or taxi) for hire or reward must comply. This includes both employees of taxi companies and owner-operators of limousine services and private hire vehicles. The obligation to hold a special licence under regulation 6 applies regardless of whether the driver works full-time, part-time, or on a casual basis. A driver who drives a hire car without the requisite endorsement commits an offence with a maximum penalty of 15 penalty units.

The regulations also impose obligations on the Registrar (an administrative officer) who must exercise powers of assessment and approval. The Registrar must be satisfied of good character and fitness before granting a licence (regulation 7). This requires the Registrar to establish criteria, gather information, and potentially conduct checks. The Registrar may also require a medical certificate, imposing a gatekeeping function regarding medical fitness to drive a hire car.

Applicants for a hire car driver licence are affected by regulations 7, 8, and 9. They must satisfy the Registrar of good character and fitness. They must answer questions in an approved certificate of fitness and competency. They may be required to undergo a medical examination and provide a certificate from a medical testing officer. Failure to comply with a requirement may result in the licence not being granted or renewed, though the regulations do not explicitly state consequences for non-cooperation (the duty to answer is mandatory for the certificate, but the medical certificate is conditional on the Registrar's request).

Passengers and intending passengers are indirect beneficiaries of the regulations. The conduct duty under regulation 10 runs towards them; they are entitled to be treated with civility and propriety. The identification card requirement under regulation 10A aids passenger safety and accountability, allowing passengers to identify the driver. The taximeter rules protect passengers from being overcharged (by ensuring the meter is not started before hiring) and from incomplete metering (by requiring it to be stopped immediately upon hire termination).

Private hire car drivers specifically are affected by the touting prohibition in regulation 70. This restricts their ability to solicit passengers directly, unlike taxi drivers who may be permitted to pick up street hails under other laws. The restriction affects the business model of private hire car operations, requiring them to rely on pre-booked trips rather than immediate street trade.

The definitions also affect vehicle owners and operators, though indirectly. If a vehicle is used as a hire car, the driver must have the appropriate licence. An owner who permits an unlicensed driver to drive a hire car may not commit an offence under these regulations (the offence is only against the driver under regulation 6), but could face liability under the Act or other laws. Similarly, the identification card requirement (regulation 10A) applies to the driver while employed, which could impose obligations on the employer to ensure compliance.

The general public, as road users and potential passengers, are affected by the medical fitness requirement for drivers (regulation 9), which aims to ensure that drivers are medically fit with regard to the health and safety of passengers and the public.

The regulations create several duties, with a limited set of corresponding rights.

Duty to hold a special licence (regulation 6). A person must not drive a hire car as a hire car unless they hold a licence that specifies they are licensed to drive that type. This is a prohibitory duty with a maximum penalty of 15 penalty units. The duty applies to all three categories of hire car. There is no exception for occasional or casual drivers; the licence must be held at the time of driving.

Duty to satisfy the Registrar of good character and fitness (regulation 7). This is placed on the Registrar, but indirectly imposes a duty on the applicant to demonstrate the required qualities. The Registrar must not grant the licence unless satisfied. This gives the Registrar a power to refuse, but does not create a duty on the applicant beyond providing information requested.

Duty to answer questions in certificate of fitness and competency (regulation 8). An applicant must answer in writing the questions specified in an approved certificate. The regulation does not specify the content of the certificate or the nature of the questions. The duty is to answer, not necessarily to answer truthfully (though other laws such as the Criminal Code would penalise false statements). Failure to answer likely means the application is incomplete and the Registrar cannot grant the licence.

Right of the Registrar to require a medical certificate (regulation 9). Before granting or renewing a licence, the Registrar may require the applicant to present a medical certificate from a medical testing officer. The certificate must state that the officer personally examined the applicant and opines that the applicant is medically fit and proper to drive a hire car, having regard to the health and safety of passengers and the public. This is a discretionary power, not an automatic requirement. The applicant has no right to refuse; if the Registrar requires it, the applicant must comply to obtain the licence.

Duty to act with civility and propriety (regulation 10). The driver must act in an orderly manner and with civility and propriety towards a passenger or intending passenger. The terms are subjective and open to interpretation. Enforcement depends on the facts. The duty is owed to passengers and intending passengers, who arguably have a correlative right to be treated accordingly, though the regulations provide no private right of action.

Duty to display identification card (regulation 10A). While employed as a driver, the driver must display an identification card of a type, containing their photograph, and displayed in a manner approved by the Registrar. This is a continuous duty while the driver is employed (i.e., while working as a hire car driver). The card must be approved by the Registrar, giving the Registrar control over its design and placement.

Duty to operate taximeter correctly (regulation 32). Applies only to taxis with a taximeter. The driver must set the taximeter in operation as soon as the car is hired, but not sooner. This prevents pre-setting before the passenger enters. The driver must stop the taximeter immediately upon termination of the hiring. This ensures the fare is calculated only for the period of hire. Breach is 15 penalty units.

Duty not to tout for passengers (regulation 70). The driver of a private hire car shall not tout for passengers or importune a person to use the car. This is a specific prohibition on active solicitation. It does not prevent a private hire car from displaying signs or taking bookings, but it prevents the driver from actively seeking passengers in person. This restricts the driver's ability to compete with taxis for immediate street trade.

Defence of accident or unavoidable cause (regulation 76). This is a right in the sense of an exculpatory defence. A person charged with an offence may prove that the occurrence was the result of accident or could not have been avoided by any reasonable effort on their part. The burden is on the defendant on the balance of probabilities. This is a narrow defence; it does not excuse deliberate conduct or negligence that could have been avoided with reasonable effort.

The regulations do not create any private rights for passengers or third parties to sue for breach. Enforcement is through prosecution (or infringement notice) brought by authorities. There is no right to a hearing before the Registrar's decision (other than any general administrative law remedies).

All substantive obligations in the regulations carry a maximum penalty of 15 penalty units. The penalty unit value in the Northern Territory is set by the Penalty Units Act; as of the date of the regulations (20 June 2018), the value was likely $154 per unit, making the maximum fine $2,310. This amount is subject to periodic indexation. The consistent penalty level across all provisions suggests a standardised approach, with no gradation for the seriousness of the breach.

Regulation 75 classifies any offence of contravening or failing to comply with the regulations as a regulatory offence. Under NT law, a regulatory offence is typically one of strict liability, meaning the prosecution does not need to prove fault (intention or recklessness). The defence of honest and reasonable mistake of fact may be available, but it is not codified in these regulations. The classification also typically allows for enforcement by way of infringement notice (on-the-spot fine) rather than requiring court prosecution, though the regulations themselves do not create that mechanism; it would come from the general infringement notice scheme under NT law.

The maximum penalty of 15 penalty units applies to each of the following offences: driving without a special licence (regulation 6), failing to act with civility (regulation 10), failing to display an identification card (regulation 10A), improper taximeter operation (regulation 32), and touting by a private hire car driver (regulation 70). There is no separate penalty for failing to answer the certificate of fitness and competency (regulation 8) or failing to provide a medical certificate when required (regulation 9), as those are conditions precedent to licensing rather than freestanding offences. However, if an applicant provides false information, that could be an offence under other laws (e.g., fraud or perjury).

The defence under regulation 76 provides a complete defence if the defendant proves that the occurrence was the result of accident or could not have been avoided by any reasonable effort on their part. This shifts the evidentiary burden to the defendant. The defence is available for any offence against the regulations. It is not an excuse for negligence; the defendant must show it could not have been avoided even with reasonable effort. This is a high threshold. The defence may cover situations like a sudden medical episode, a mechanical failure that could not have been anticipated, or an unavoidable collision. However, it would not cover ordinary traffic infringements or forgetfulness (e.g., forgetting to display the ID card).

Enforcement is likely carried out by the police or by authorised officers under the Motor Vehicles Act. The regulations do not specify who may enforce them. Given the regulatory offence classification, inspectors under the Commercial Passenger (Road) Transport Act or transport department officers may also have enforcement powers.

The transitional provisions in regulation 77 deal with the repeal of the 1953 regulations and the continuation of certain notices, instruments, conversion cards, and suspensions made under the old regulations. These are now likely spent, as they refer to provisions that were repealed long ago. However, they could theoretically still affect any ancient licence conditions that have persisted.

There is no provision for suspension or cancellation of a hire car driver licence within these regulations. Any such action would need to be taken under the Motor Vehicles Act 1949, which is not reproduced here.

The Motor Vehicle (Hire Car) Regulations 1985 is a subordinate instrument under the Motor Vehicles Act 1949 (NT). The Act itself is not reproduced in the source, but the regulation's text repeatedly refers to it: for the definition of "licence" (referencing sections 26(1), 27(1), and 10(1) of the Act), for the concept of the Registrar (who is an official under the Act), and for the broader legislative framework. The Act would set out the general rules for driver licensing, vehicle registration, and enforcement powers. The regulations add specific hire-car-related conditions on top of that general framework.

The Commercial Passenger (Road) Transport Act (referred to in the amendment list via the Commercial Passenger (Road) Transport (Consequential Amendments) Act 2003) is a key interacting law. That Act likely replaced or supplemented the earlier regulatory regime for commercial passenger vehicles. The 2003 amendments to these regulations were consequential upon the enactment of the Commercial Passenger (Road) Transport Act, which suggests that many hire-car matters were moved to that Act or to new regulations made under it. The 2017 amendments (SL No. 34 of 2017) further stripped out provisions that may have been duplicated or superseded by that newer legislative scheme.

The Penalties Amendment (Miscellaneous) Act 2013 amended these regulations (specifically regulation 74, now repealed) to standardise penalty units, indicating that the penalty provisions are aligned with the NT government's broader penalty reform agenda.

The Statute Law Revision Acts (1987, 1988, 2003, 2018) made formal amendments (e.g., renumbering, updating references) to keep the regulations consistent with legislative drafting standards. These do not change substantive policy.

There is also interplay with general criminal law: if a driver provides false information on the certificate of fitness and competency or in a medical certificate, they may be subject to offences under the Criminal Code Act (NT) for fraud or false statements. The regulations do not create their own perjury offence.

The Interpretation Legislation Amendment Act 2018 made general amendments of a formal nature to regulations 1 and 77, highlighting that the regulations are subject to NT interpretation statutes that govern subordinate legislation.

The absence of regulation of other matters (fares, vehicle standards, driver records, insurance) means those aspects are now governed by other instruments. A practitioner would need to consult the Commercial Passenger (Road) Transport Act and any regulations made under it, as well as the Motor Vehicles Act and its regulations, for a complete picture of a hire car driver's legal obligations.

The interaction between the touting prohibition (regulation 70) and other laws is notable. Taxi drivers are not prohibited from touting under this regulation (the prohibition only applies to private hire cars). Taxi drivers may be subject to other laws regulating how they solicit passengers. Private hire car drivers are more restricted, which affects market competition. This differential treatment reflects a policy choice at the time of the regulations.

The defence of accident or unavoidable cause (regulation 76) interacts with the general criminal law defence of honest and reasonable mistake of fact, which may be available for strict liability offences. However, regulation 76 provides a specific, additional defence. A defendant could raise both. The regulation 76 defence places a burden on the defendant to prove the unavoidable cause, whereas the common law defence (where available) may require the prosecution to disprove the mistake.

The regulations were originally made as SL No. 30 of 1985, notified on 6 November 1985, and commenced on 18 November 1985. Since then, they have been amended multiple times. The most significant amendment in terms of scope was the Commercial Passenger Vehicle Legislation Amendment Regulations 2016 (SL No. 33 of 2016) and the even more substantial Commercial Passenger Vehicle Legislation Amendment Regulations 2017 (SL No. 34 of 2017). The 2017 amendments (commenced 1 December 2017) repealed the vast majority of the regulations. The endnotes list dozens of regulations that were repealed: regulations 5, 11 to 31, 33 to 69, 72 to 74, and Schedules 1 and 3. Also, regulation 70 (touting) was originally listed as repealed in the 2017 amendments? The list of amendments shows "r 70 rep No. 34, 2017, r 41". But in the body of the regulations as provided, regulation 70 appears in Part VIII. This is contradictory. The endnotes show that regulation 70 was repealed by the 2017 amendments. However, the text we have includes regulation 70. This is likely an error in the source provided: the version "as in force at 20 June 2018" should reflect the 2017 repeals. But the text we have includes regulation 70. We must treat the source as given, but we can note the discrepancy from the amendment list. To be safe, we will note that according to the amendment list, regulation 70 was repealed, but the printed text includes it. The safe approach is to describe the regulation as it appears in the source, but note the amendment history conflict. Alternatively, the amendment list might be from a different version. The deep dive must be source-grounded. Since the source includes regulation 70 in the main text, we will treat it as operative. We can flag the possible inconsistency.

Earlier amendments include Statute Law Revision Acts (1987, 1988, 2003) and the Commercial Passenger (Road) Transport (Consequential Amendments) Act 2003, which amended definitions and repealed some provisions. The Penalties Amendment (Miscellaneous) Act 2013 amended regulation 74 (penalties) before it was repealed. The 2016 amendments added and amended some provisions (e.g., regulations 28, 39, 41, 44 were amended or substituted) but most were repealed in 2017.

The Statute Law Revision Act 2018 (assented 23 May 2018, commenced 20 June 2018) made formal amendments to the Part II heading and repealed Division 1 of Part II (which contained definitions of "operator"?). This gives the current version as at 20 June 2018.

The result is that the regulations are now a pale remnant of their original form. Most operational rules have been moved elsewhere (likely to the Commercial Passenger (Road) Transport regulations). The remaining provisions are those not yet repealed: Part I (preliminary), Part II Division 2 (licensing of drivers), Part III Division 1 (conduct, etc., but only regulations 10, 10A, 32 survive), and Part VIII (miscellaneous: regulations 70, 75, 76, 77). It is unclear whether regulation 70 was intended to remain or was accidentally included in the 2017 repeal. Future amendments are likely to clean up the text or fully repeal it.

The source text contains no references to cases, court decisions, or tribunal rulings. The endnotes and the regulations themselves do not cite any litigation history. This is not surprising because the regulations are a subordinate instrument with limited subject matter, and the NT has a small population and correspondingly few reported decisions on hire car regulation. The 2017 repeal of most provisions means there is even less basis for litigation. Cases that may have interpreted the repealed provisions are no longer relevant to the remaining text.

It is possible that some litigation occurred under the original 1985 regulations or the earlier 1953 regulations (e.g., disputes about licensing decisions, fare disputes, disciplinary actions), but nothing appears in the provided source. A practitioner would need to search the NT Supreme Court and magistrates court databases for any decisions citing these regulations.

The absence of named cases in the source means we cannot add any. We can only state that the source does not record any litigation history.

Several provisions are easily overlooked or misinterpreted.

Definition of hire car includes limousine. Many people assume that hire car regulations apply only to taxis and maybe rideshare vehicles. But the definition expressly includes limousines. A person driving a stretch limousine for hire (even for an event) must hold the appropriate special licence and comply with the identification and conduct duties. The regulations do not differentiate between a standard taxi and a high-end limousine.

Touting prohibition applies only to private hire cars, not taxis. Regulation 70 restricts drivers of private hire cars from touting or importuning. Taxi drivers appear to be exempt from this specific prohibition (though other laws may restrict their conduct). This means a private hire car driver cannot solicit passengers on the street or at taxi ranks, while a taxi driver can. This is a critical distinction that affects business operations.

Medical certificate requirement is discretionary, but refusal to comply can block licensing. The Registrar may require a medical certificate under regulation 9. If required, the applicant must present one. There is no appeal mechanism in these regulations. The Registrar's discretion to require a medical certificate is unfettered (subject only to the general requirement to act reasonably under administrative law). This gives the Registrar power to impose a potentially costly requirement on any applicant.

Certificate of fitness and competency (regulation 8) is mandatory. Unlike the medical certificate, this is not discretionary. Every applicant must answer the questions in the approved certificate. The content of the certificate is not defined in the regulations, so the Registrar controls what questions are asked. The applicant must answer in writing. There is no right to a hearing on the answers.

Good character and fit and proper person test (regulation 7) is a broad standard. The Registrar must be satisfied. There are no criteria listed in the regulations. This gives wide discretion. Past criminal convictions, driving record, bankruptcy, or even personal reputation could be considered. The lack of definition creates uncertainty for applicants.

Display of identification card (regulation 10A) requires Registrar approval of type, photograph, and manner. The driver cannot simply display any ID; it must be of a type approved by the Registrar. This gives the Registrar control over the design and placement. If the Registrar does not approve a particular card, the driver cannot comply. This could be a practical obstacle if the Registrar delays approval.

Defence of accident (regulation 76) places burden on the defendant. The defendant must prove the occurrence was accidental or unavoidable. This is a reverse onus. In practice, this means that a driver charged with not displaying an ID card because the card fell off the dashboard must prove that the falling was an unavoidable accident. Mere assertion is unlikely to suffice; evidence (e.g., witness statements, photos) may be required.

Transitional provisions (regulation 77) may preserve ancient conditions. The regulation continues notices, instruments, conversion cards, and suspensions from the 1953 regulations. These could theoretically be decades old. Anyone driving under an old licence should check whether it is still valid and subject to any terms.

Penalty consistency masks varying gravity. All offences carry 15 penalty units, regardless of whether the breach is failing to display an ID card or driving without a licence. This lack of differentiation may influence prosecution discretion, but it also means that trivial breaches are treated as severely as serious ones.

Regulation 32 applies only to taxis with a taximeter. It does not apply to private hire cars or limousines that do not have a taximeter. However, if a limousine does have a meter, does it become a taxi? The definition of taxi is not given. There is potential overlap.

The regulations do not specify how a hire car driver obtains the special licence. They set out conditions but not the application process. Practitioners must look to the Motor Vehicles Act or to any administrative procedures issued by the Registrar.

The source text may contain an error regarding regulation 70. According to the amendment list, regulation 70 was repealed by SL No. 34 of 2017. Yet the body of the regulations includes it. If the amendment list is correct, then regulation 70 may not actually be in force, and a person could be prosecuted under a repealed provision. This is a significant gotcha. Careful checking of the official NT legislation register is essential.

To comply with the Motor Vehicle (Hire Car) Regulations 1985 as in force at 20 June 2018, a driver of a hire car (taxi, private hire car, or limousine) must take the following steps.

Obtain a hire car driver licence. Before driving a hire car, the driver must hold a licence issued under section 10(1) of the Motor Vehicles Act that specifies they are licensed to drive a hire car of the relevant type (regulation 6). To obtain this licence, the applicant must satisfy the Registrar that they are a person of good character and a fit and proper person (regulation 7). The applicant must answer in writing the questions on an approved certificate of fitness and competency (regulation 8). The applicant should expect to provide personal details, driving history, and possibly undergo a background check. The applicant may be required to present a medical certificate from a medical testing officer confirming medical fitness (regulation 9). It is advisable to proactively ask the Registrar whether a medical certificate is needed, rather than waiting for a request.

Display an identification card. While employed as a hire car driver, the driver must display an identification card in the car. The card must be of a type approved by the Registrar, contain the driver's photograph, and be displayed in a manner approved by the Registrar (regulation 10A). The driver should contact the Registrar to obtain the approved card and instructions on placement. The card must be displayed at all times while driving for hire.

Act with civility and propriety. The driver must act in an orderly manner with civility and propriety towards passengers and intending passengers (regulation 10). This means no abusive language, rude behaviour, or disorderly conduct. It also covers conduct before the passenger enters the car (towards intending passengers). Drivers should be trained in customer service standards.

If driving a taxi with a taximeter, the driver must set the taximeter in operation as soon as the car is hired (not before) and stop it immediately when the hiring ends (regulation 32). This prevents the meter from running while the taxi is empty or before the passenger is ready. Drivers should ensure the meter is functioning correctly and follow correct timing.

If driving a private hire car, do not tout for passengers or importune any person to use the car (regulation 70). Accept pre-booked trips only. Do not solicit passengers on the street, at taxi ranks, or in public places. Signs advertising the service are likely allowed, but active personal solicitation is prohibited.

In the event of an alleged breach, the driver may rely on the accident or unavoidable cause defence (regulation 76). To rely on this, the driver must be able to prove that the occurrence was accidental or could not have been avoided by any reasonable effort. This requires documentation (e.g., evidence of sudden mechanical failure, medical emergency, or other circumstances outside the driver's control). Drivers should maintain records of maintenance, incidents, and any unforeseeable events.

Monitor the status of the regulations. Given the extensive repeals in 2017, it is possible that further amendments or a complete repeal are pending. Drivers and operators should check the current version on the NT legislation website regularly. The apparent conflict regarding regulation 70's repeal underscores the need for verification.

Maintain records of licence, identification card, and medical certificates. While the regulations do not expressly require record-keeping, it is prudent to keep copies of the hire car driver licence, the approved identification card, and any medical certificates provided. These may be needed if an officer asks to see the licence or if there is a dispute about compliance.

Understand that these regulations are only part of the legal framework. Compliance with the regulations does not guarantee compliance with the Motor Vehicles Act, the Commercial Passenger (Road) Transport Act, or any other applicable laws. Additional requirements may include vehicle registration, insurance, driver accreditation under the Commercial Passenger (Road) Transport Act, and adherence to fare and booking regulations. Seek advice from the NT Department of Infrastructure, Planning and Logistics or a legal practitioner.
