Motor Vehicle Drivers Instructors Act 1963

The Act rests on a few central concepts that structure rights, duties and administrative processes. Those concepts are: driving instructor; licence and permit; competence and qualification; Director General discretion; delegation and agreements for performance of functions; records and evidentiary certificates; and regulation-making power.

• Driving instructor. The statutory definition is broad. A driving instructor is anyone who, for fee or other remuneration and whether acting on their own account, jointly, or as an employee, gives advice, instructions or demonstrations for the purpose of teaching a person to drive a motor vehicle (s 3, definition of driving instructor). The definition captures paid instruction in all forms and by any employment status, but it excludes unpaid informal instruction.

• Licence and permit. A licence is a valid and current authorisation to act as a driving instructor and includes renewals (s 3, definition of licence). A permit is a temporary authorisation with similar status (s 3, definition of permit). Licences by default cover all vehicle kinds and uses unless the licence specifies otherwise (s 6(2)-(3)). Licences expire after 12 months unless renewed (s 6(4)-(5)). Permits last for such period not exceeding six months as the Director General determines (s 11(2)(a)).

• Competence and qualifications. Applications require prescribed forms and fees (s 7(1)). The Director General shall or may cause enquiries into the applicant’s character (s 7(2)). The Director General has express power to require applicants to submit to tests of driving competency and knowledge of road law (s 7(3)). A prescribed body may provide a certificate that the applicant is competent, and if such a certificate is produced the Director General must dispense with the tests (s 7(4)). The tests and course of training that the prescribed body requires must cover statutory road law matters, driving practice, vehicle manipulation and teaching technique and must be approved by the Director General (s 8(1)-(2)).

• Director General discretion and conditions. The Director General grants licences where certain cumulative criteria are satisfied, including age 21, good character, fit and proper person, competency or certificate, and current driving licence with a continuous holding period normally of 3 years (s 7(5)(a)-(e)). The Director General may add, revoke or vary licence conditions by notice (s 7(6)-(7)). Cancellation and suspension are also discretionary under enumerated grounds (s 9).

• Delegation and agreements for performance. The Director General may delegate any power or duty in writing, although delegation to non-departmental persons requires Ministerial approval (s 4(1)-(4)). Delegates may not sub-delegate (s 4(5)). Separately, the Director General may enter agreements under which functions are performed by others, including police, local governments or non-public bodies, and acts done under such agreements are treated as effectual as if done by the Director General (s 4A(1)-(5)). A function depending on Director General opinion may be performed under the agreement on the opinion of the performing body (s 4A(4)).

• Records and evidence. The Director General must keep records of licences and permits and related matters (s 12(1)). A certificate signed by the Director General or prescribed officer certifying particulars from those records is admissible as evidence without proof of signature or production of the record (s 12(2)).

• Regulation-making scope. The Governor may make detailed regulations to implement the scheme, including provisions about display of licences on vehicles, identification, advertising methods, carriage of passengers during instruction, special equipment, medical fitness evidence, incident notification, exemptions and penalties up to $500 (s 14(1)(a)-(k)). The regulations may explicitly address transitional authorisations where vehicle classification regimes change (s 14(1)(aa)).

These concepts allocate authority to the Director General to administer entry to the instructor market, to set and enforce standards via licence conditions and revocations, and to outsource or delegate performance to other public or private entities under agreement. The statutory architecture thus combines administrative licensing with delegated operational delivery and regulatory detail left to subordinate instrument.

The Act creates legal obligations and operational constraints primarily for the following groups.

• Individual driving instructors. Anyone who gives paid instruction in driving is captured by the definition and must hold an appropriate licence or permit to act as a driving instructor after the three month transitional period (s 3; s 5(1)(a)). Individuals must satisfy eligibility criteria: at least 21 years of age (s 7(5)(a)); of good character and fit and proper to be an instructor (s 7(5)(b)-(c)); competent to teach the driving of vehicles authorised by the licence (s 7(5)(d)); and the holder of a current driver’s licence for the relevant vehicle classes and ordinarily holding that driver’s licence for at least three years before the application (s 7(5)(e)).

• Employers and principals. Employers who engage persons to act as driving instructors face a statutory backstop liability. If an employee commits an offence under s 5(1) while acting as an employee, the employer is guilty of an offence under s 5(2) unless they can prove they did not know and could not with reasonable diligence have discovered that the employee lacked an appropriate licence, or acted in contravention of licence conditions. The prescribed penalty for that employer liability is $1 000 (s 5(2)).

• Drivers seeking instruction. Indirectly affected, prospective learners face a regulated market. Vehicle safety and instructor competence are the statutory focal points; vehicles used for instruction must meet regulatory equipment requirements and the Road Traffic (Vehicles) Act 2012 construction/equipment standards applicable to the vehicle (s 5(1)(d); s 14(1)(f)).

• Director General and department. The Director General is the central decision-maker for licensing, testing requirements, record-keeping and enforcement (ss 3; 4; 7-12). The statutory scheme gives the Director General discretion over tests, condition attachment, revocation, suspension and grant of licences, and power to delegate or contract-out functions (s 4; s 4A; s 7; s 9).

• Third parties authorised to perform functions. The Director General may enter agreements under s 4A with the Commissioner of Police, local governments, or any other person or body to perform specified Director General functions. That arrangement means public or private bodies authorised under agreement may conduct functions such as testing, issuing permits, or performing inspections on the Director General’s behalf, and their acts are treated as effectual as if done by the Director General (s 4A(2)-(5)).

• Prescribed bodies that test and certify competence. The Act contemplates prescribed bodies issuing competency certificates that, if produced, dispense with Director General-imposed tests (s 7(4)). Those bodies must run tests and courses covering specific subject matter and approved by the Director General (s 8(1)-(2)). The Act therefore affects entities delivering training and assessment services, who will be subject to approval, fee-setting and curriculum requirements.

• Regulated persons under subordinate instruments. The Governor’s regulations may require licence display, identification, medical evidence, incident notification, and impose penalties for regulation breaches (s 14). Persons using vehicles for instruction, persons advertising instruction services, and people who must produce licences to prescribed persons are placed under duties by regulation.

• Courts and the State Administrative Tribunal. Courts are required to forward particulars of convictions under the Act to the Director General (s 5(3)). The State Administrative Tribunal is the statutory review forum for decisions by the Director General to refuse, cancel, suspend, or add or vary conditions to a licence (s 10(1)-(2)). That creates administrative procedural pathways affecting practitioners and their legal advisers.

Who pays in practice. Costs flow to instructors and their employers in the form of application fees, prescribed testing and course fees, vehicle equipment and compliance costs to meet regulations and the Road Traffic (Vehicles) Act 2012 standards, and the time and administrative costs of undergoing character enquiries and possible medical assessments (s 7(1); s 8(1); s 14(1)(f), (g)). The Director General’s department bears administrative costs of record-keeping, processing, testing (pass-through where outsourced), and enforcement. If the Director General uses agreements with external bodies under s 4A, some operational costs may be borne by those bodies subject to the terms of the agreement.

Key duties imposed by the Act are articulated in primary statutory sections and amplified by regulations that may be made under s 14. Rights largely centre on administrative procedural protections and review.

Principal duties.

• Licence or permit requirement. A person must not act as a driving instructor without a licence or permit authorising that activity (s 5(1)(a)). Advertising duties require any advertisement, notification or statement that a person acts or is willing to act as a driving instructor to specify the kinds of motor vehicle and the kinds of use for which the person acts or is willing to act, and the person must hold a licence or permit authorising those things (s 5(1)(b)).

• Vehicle equipment and legal compliance. While acting as an instructor on a road, the motor vehicle used must be equipped as required by regulations and must comply with the Road Traffic (Vehicles) Act 2012 and its regulations relating to construction and equipment (s 5(1)(d)). Regulations may further prescribe special equipment and its provision and use (s 14(1)(f)).

• Application formalities and fees. Applications for a licence or renewal must be in the prescribed form and accompanied by the prescribed fee (s 7(1)). A prescribed body’s course or test will require payment of a prescribed fee (s 8(1)(b)).

• Tests and certification. The Director General may require applicants to submit to competency and road law knowledge tests (s 7(3)). Conversely, if an applicant presents a certificate from a prescribed body that they are competent for the class of vehicle sought, the Director General must dispense with his own tests (s 7(4)). The content of those prescribed-body tests and courses is set out in s 8.

• Notification and records. The Director General must keep records of licences and permits and related actions (s 12(1)). Courts must forward particulars of convictions under this Act to the Director General (s 5(3)). Regulations can require notification to the Director General of injuries or damage occasioned during instruction (s 14(1)(h)).

• Employer due diligence defence. Where an employee commits an offence under s 5(1) while acting as an employee, the employer may defend liability by proving knowledge or the exercise of reasonable diligence to discover a missing licence or contravention of licence conditions (s 5(2)).

Principal rights.

• Administrative review. Where the Director General refuses an application, cancels or suspends a licence, issues a licence subject to conditions, revokes or varies conditions, or attaches new conditions, the Director General must notify the person in writing of the decision and the grounds (s 10(1)). The affected person may then apply to the State Administrative Tribunal for a review (s 10(2)). That confers a statutory right of merits review.

• Procedural notice. The statutory requirement to notify grounds (s 10(1)) is a right enabling meaningful review and response.

• Reliance on prescribed-body certification. An applicant who obtains the specified certificate from a prescribed body is entitled to have the Director General dispense with the Director General’s tests (s 7(4)). That vests a right in applicants to avoid duplicate testing where they have met prescribed-body standards.

• Evidentiary facility. Third parties and courts may rely on certificates signed by the Director General as evidence of entries in the licence and permit records without further proof (s 12(2)). That simplifies proof of status for both enforcement and civil processes.

Discretion and safeguards.

• The Act vests wide substantive discretion in the Director General on fit and proper person assessments, competence, and the imposition or variation of conditions (s 7(5), (6)-(7)). The Act imposes review avenues but does not prescribe detailed procedural steps beyond notification and access to the State Administrative Tribunal. The Director General’s ability to enter agreements under s 4A and to delegate powers under s 4 means enforcement and decision-making may be performed by parties other than the Director General, subject to the terms of agreements or delegations.

Taken together, the duties push compliance responsibilities onto individual instructors and their employers, while rights are concentrated on administrative review and evidential assurance. Obligations are backed by cancellation and suspension powers, employer liability provisions and regulation-enabled penalties.

The Act contains a limited set of express penalties and multiple administrative enforcement mechanisms. It gives the Director General both investigative and remedial tools, and it confers enforceable duties via regulations.

Express penalties and pecuniary sanctions.

• Employer liability. If a person commits an offence under s 5(1) while acting as an employee, the employer or principal is guilty of an offence under s 5(2). The prescribed penalty for that offence is $1 000 (s 5(2)). The employer has a statutory defence if they prove lack of knowledge and that they could not with reasonable diligence have discovered the employee lacked the appropriate licence or acted in breach of licence conditions.

• Regulation-level penalties. The Governor may make regulations imposing penalties not exceeding $500 for breach of any regulation made under s 14(1)(k). These are subordinate instrument penalties, so the Act anticipates and relies upon regulation-making to fill out the enforcement schedule for many day-to-day operational breaches such as failure to display licences, failure to notify incidents, or breaches of advertising rules.

Notable absence. The Act’s text reproduced here sets out the prohibition in s 5(1) against acting as a driving instructor without a licence or permit, but it does not specify a penalty in s 5(1) for the individual who acts without authorisation. The only explicit monetary penalty in the main body is the employer penalty in s 5(2) and the regulation-level cap in s 14(1)(k). That means the primary criminal or quasi-criminal sanction for individual instructors may be established by regulation or by other written laws not reproduced here. Practitioners should not assume a statutory fine for the principal offender exists within the Act’s sections as printed; instead, check the regulations and other road transport laws for primary offence penalties.

Administrative enforcement and remedies.

• Cancellation and suspension. The Director General may cancel or suspend licences where they were issued erroneously or on fraudulent documents, where prescribed fees are unpaid, where the licence-holder is convicted of an offence under the Act, or where the Director General is no longer satisfied that the holder meets the qualifying requirements of s 7(5) (s 9(1)). On cancellation or suspension, the licence-holder must deliver the licence to the Director General within the period specified in the notice (s 9(2)). The Director General must record cancellations and suspensions in the register (s 9(3)).

• Permit revocation and condition variation. The Director General may revoke permits at any time, vary conditions, or attach new conditions (s 11(3)). When a licence is issued to the holder of a permit, the Director General shall revoke the permit and may refund part of the permit fee (s 11(4)).

• Records and court reporting. Courts must forward particulars of convictions under the Act to the Director General (s 5(3)). The Director General maintains records and certificates that are admissible as evidence without production of records (s 12(1)-(2)). That evidentiary device eases enforcement actions and prosecution.

• Delegation and contracted enforcement. Delegations under s 4 allow the Director General to delegate powers and duties in writing to officers, subject to Ministerial approval for delegates who are not departmental employees (s 4(1)-(4)). Agreements under s 4A permit third parties, including police and local governments, to perform Director General functions, and acts done under those agreements are as effectual as if done by the Director General (s 4A(1)-(5)). This statutory structure permits enforcement tasks such as inspections, testing, or issuing permits to be carried out by others, potentially streamlining operational enforcement capacity.

Procedural safeguards.

• Notification and review. The Director General must notify the affected person of a refusal, cancellation, suspension, or conditions and the grounds for the decision (s 10(1)). The affected person may apply to the State Administrative Tribunal for review (s 10(2)). That provides a statutory merits review mechanism for contested administrative decisions.

Practical enforcement considerations.

• The evidentiary certificate under s 12(2) reduces proof costs for the regulator in establishing the existence or absence of qualifying entries in the register. The wide delegation and agreement powers under ss 4 and 4A expand the universe of possible enforcement actors. Because the Act vests substantial discretion in the Director General and because regulations may create a comprehensive penalty regime for operational matters, enforcement in practice will be a mix of administrative cancellation/suspension, statutory prosecutions where an offence is specified in subordinate instruments, and employer prosecutions under s 5(2).

In short, enforcement rests on administrative controls backed by relatively modest express fines in the Act itself coupled with regulatory penalties. The Director General’s discretionary powers and outsourcing options are central to the operation of enforcement.

The Act is explicitly integrated with other Western Australian road and administrative laws. The Act cross-refers to definitions and complements technical standards, and it establishes administrative interaction points with the courts and the State Administrative Tribunal.

Cross-references to road law and vehicle standards.

• Definitions. The Act adopts defined terms from other road laws. The definitions of motor vehicle and road are taken from the Road Traffic (Administration) Act 2008 s 4, by express reference in s 3. This ties the licensing regime’s subject matter to the definitions used across road transport legislation.

• Driver authorisation. The Act requires applicants to be the holder of a current and valid driver’s licence under the Road Traffic (Authorisation to Drive) Act 2008 to drive the motor vehicles that persons would be taught under the sought licence (s 7(5)(e)). It also contemplates the Director General approving different continuous holding periods for prior driver’s licences in particular cases (s 7(5)(e)).

• Vehicle construction and equipment. The Act requires that motor vehicles used by driving instructors while acting as such on roads be equipped as required by regulations, and it specifically requires compliance with the provisions of the Road Traffic (Vehicles) Act 2012 and its regulations relating to construction and equipment (s 5(1)(d)). Regulations under s 14 may specify special equipment and its use (s 14(1)(f)). That creates an operational dependency between instructor licensing and statutory vehicle standards enforced under separate vehicles legislation.

Administrative law and review.

• State Administrative Tribunal. The Act confers a statutory right to apply to the State Administrative Tribunal (SAT) for review of decisions of the Director General under s 10(2). The compilation notes confirm that conferral is contemporaneous with the State Administrative Tribunal legislative framework and transitional matters addressed by the State Administrative Tribunal Act 2004 and its regulations (compilation notes and the listed amendments, e.g. State Administrative Tribunal (Conferral of Jurisdiction) Amendment and Repeal Act 2004 Pt. 2).

• Courts as reporting nodes. Courts have a duty to transmit particulars of convictions under the Act to the Director General (s 5(3)). That links criminal/quasi-criminal adjudication back into the administrative register and supports decisions about cancellation or suspension under s 9.

Delegation and outsourcing interactions.

• Delegation to and agreements with other bodies. Sections 4 and 4A enable inter-instrumental cooperation. Delegation under s 4 requires written notice and, for non-departmental delegates, Ministerial approval (s 4(1)-(4)). Agreements under s 4A may be struck with the Commissioner of Police, local governments, or private or non-public bodies (s 4A(2)). A function that depends on the Director General’s subjective opinion may be performed under the agreement on the opinion of the third party specified in the agreement (s 4A(4)). Acts done under the agreement are as effectual as acts of the Director General (s 4A(5)). Those provisions enable functional alignment with policing, local government regulatory activity, and private training bodies, but they also create dependence on the terms of those agreements to define process and safeguards.

Regulatory complementarity and subordinate instruments.

• Regulations may prescribe detailed operational matters and penalties up to $500 (s 14(1)). Those regulations will interact with the Road Traffic (Vehicles) Act 2012 rules on vehicle equipment and with licensing and driver authorisation under the Road Traffic (Authorisation to Drive) Act 2008. In practice, the Act delegates a large portion of detailed compliance obligations to subordinate legislation.

Transitional and historical interactions.

• The compilation table records multiple amendments over time, including reprints and changes to delegations and conferral provisions. The Machinery of Government amendments and subsequent reprints referenced in the compilation table set out transitional continuities with older transport coordination provisions (compilation notes 2 and 3). Practitioners should consult the Road Traffic and other transport Acts and regulations to understand how the instructor regime intersects with contemporary vehicle standards and driver licensing requirements.

In sum, the Act is not a standalone code. It is operationally interconnected with driver authorisation, vehicle standards, administrative review under the SAT regime, court reporting obligations, and a subordinate regulatory regime that will, in practice, define many compliance obligations and penalties. Any compliance or enforcement strategy must therefore consider the full set of linked instruments.

The compilation table appended to the Act provides a clear chronology of amendments and reprints. Key amendments and dates are as follows.

• Original enactment. Motor Vehicle Drivers Instructors Act 1963, No. 10 of 1963, assented 15 October 1963, commenced 28 February 1964 (s 2 and Gazette reference). The Act has been reprinted and amended several times since.

• 1965 Decimal Currency Act and subsequent early amendments. Decimal Currency Act 1965 (No. 113 of 1965) affected timing of certain provisions; the Acts Amendment (Road Safety and Traffic) Act 1973 (No. 12 of 1973), and Acts Amendment (Road Traffic) Act 1974 (No. 58 of 1974) made amendments, with relevant commencement dates in 1973 and 1975 respectively. The compilation notes list amendments to s 3 and other sections by these and later Acts.

• 1981 and 1982 amendments. Acts Amendment (Traffic Board) Act 1981 Pt. I (No. 106 of 1981) commenced 2 February 1982. Motor Vehicle Drivers Instructors Amendment Act 1982 (No. 26 of 1982) was assented 27 May 1982 and commenced the same day.

• 1987 amendment. Motor Vehicle Drivers Instructors Amendment Act 1987 (No. 49 of 1987), assented 3 October 1987, commenced 31 October 1987.

• 1996 changes. Road Traffic Amendment Act 1996 (No. 76 of 1996) Pt. 3 Div. 4 amended various provisions and resulted in reprints. Section 13 was deleted by No. 76 of 1996 s 34.

• 1997 and 2000 amendments. Statutes (Repeals and Minor Amendments) Act 1997 s 91 (No. 57 of 1997) and Road Traffic Amendment Act 2000 Pt. 3 Div. 2 (No. 39 of 2000) amended the Act. A reprint including amendments to that date was produced 8 February 2002.

• Machinery of Government reforms in 2002. Machinery of Government (Planning and Infrastructure) Amendment Act 2002 (No. 7 of 2002) inserted new provisions. Notably, s 4 (Delegation) and s 4A (Agreements for performance of functions) were inserted by No. 7 of 2002 s 14. Those provisions reflect a shift towards enabling delegation and formal agreements to carry out functions formerly exercised directly by the Director General.

• 2004 SAT conferral. State Administrative Tribunal (Conferral of Jurisdiction) Amendment and Repeal Act 2004 (No. 55 of 2004) confers jurisdiction to the SAT and required transitional handling, with effect from 1 January 2005 for parts of the reforms. The compilation notes reference Pt. 5 and the State Administrative Tribunal Act 2004 s 167 and s 169 for transitional issues.

• 2006 and 2010 amendments. Road Traffic Amendment Act 2006 (No. 54 of 2006) and Standardisation of Formatting Act 2010 (No. 19 of 2010) made further changes. The 2006 changes came into operation on 30 June 2008 in the compilation table.

• 2012 amendment with later commencement. Road Traffic Legislation Amendment Act 2012 Pt. 4 Div. 36 (No. 8 of 2012) amends multiple transport statutes and the Act. Although assented in 2012, the amendments listed there commenced on 27 April 2015 as per the compilation table.

• Reprints. The Act has been reprinted at multiple points: 12 July 1977 reprint included initial amendments; reprints as at 8 February 2002 and 1 July 2005 reflect subsequent changes. The compilation table documents these reprints and the amendments included.

What changed materially.

• Delegation and agreements. The most substantive structural change recorded in the compilation table is the insertion of s 4 and s 4A in 2002, which broadened the Director General’s ability to delegate powers in writing and to enter agreements for the performance of the Director General’s functions, including with non-public bodies. This changes operational delivery and allows third parties to perform statutory functions.

• Linkages to SAT. The conferral of review jurisdiction to the State Administrative Tribunal in 2004 altered the review landscape for administrative decisions, replacing prior judicial review or appeal mechanisms with a statutory merits review path.

• Deletion of s 13. The deletion of section 13 in 1996 is recorded, though the content of the deleted provision is not reproduced in this compilation. Practitioners should consult historical versions for the prior content where relevant to transitional disputes.

For practitioners, the timeline matters because later amendments, particularly those inserting delegation and agreement powers and those aligning administrative review with the SAT framework, shifted where decisions can be made and where they can be challenged. The compilation table included in the Act is the authoritative chronology for changes to the Act.

The Act’s text as reproduced does not list any judicial decisions or cases. It does however create administrative and evidentiary structures that will commonly be the subject of litigation or administrative review. The statutory pathways and mechanisms that typically generate disputes, as shown in the Act, are:

• Administrative review to the State Administrative Tribunal. Section 10(2) grants aggrieved applicants and licence-holders a statutory route to apply to the State Administrative Tribunal for review of a refusal, cancellation, suspension or imposition or variation of licence conditions. The Act requires the Director General to notify the affected person in writing of decisions and the grounds (s 10(1)), which is a necessary precursor to review. Any substantive disputes about fitness and propriety, character assessments, licence conditions or the adequacy of procedural fairness are therefore likely to be litigated or reviewed in the SAT under the administrative review regime.

• Prosecutions and employer liability. Section 5(2) creates an employer offence with a specified penalty of $1 000, and courts must forward particulars of convictions to the Director General (s 5(3)). Enforcement actions against employers for failing to exercise due diligence in ensuring their employees are licensed may feature in litigation records. The Act’s lack of a primary individual penalty in the sections reproduced here means that related prosecutions may be anchored in regulations or other road statutes, potentially producing litigation focused on statutory interpretation and the proper application of subordinate instruments.

• Evidentiary certificates and administrative registers. Section 12(2) makes certificates purporting to be signed by the Director General evidence of matters recorded without proof of signature or production of the underlying record. Challenges to the accuracy of the register, or to the procedural propriety of how entries were made, could give rise to litigation in which the powers and scope of s 12(2) are contested.

• Delegation and agreements. Delegation under s 4 and agreements under s 4A permit third parties to exercise the Director General’s powers. Litigation might arise over whether a particular act was validly authorised by delegation, whether Ministerial approval was required and obtained for non-departmental delegates, or whether an agreement appropriately described the functions to be performed. Section 4(3)-(4) requires Ministerial approval for delegations to persons not employed in the Director General’s department, and s 4(5) prohibits sub-delegation. Section 4A(5) makes acts done under an agreement “as effectual as if” done by the Director General. Disputes about the legal effect of those arrangements, and about procedural fairness where third parties exercise statutory powers, are foreseeable.

• Cancellation and suspension disputes. The grounds for cancellation and suspension in s 9 are partly objective (unpaid fees) and partly subjective (Director General no longer satisfied that the holder meets requirements). Litigation or review will likely raise issues of evidence, natural justice, reasonableness and proportionality in decisions to cancel or suspend or in the imposition of conditions.

• Road law and vehicle compliance. Where an instructor uses a vehicle that does not comply with the Road Traffic (Vehicles) Act 2012 standards or regulations, enforcement actions and related disputes will involve interpretation and application of those vehicle statutes as well as s 5(1)(d) of this Act.

Absence of case law in the source. Because the Act provided does not name or summarise any cases, and the compilation table does not list decisions, this deep dive cannot identify particular litigation outcomes or precedent lines. For case law, practitioners must search the Western Australian reported decisions and SAT determinations where the Motor Vehicle Drivers Instructors Act 1963 has been engaged, focusing on themes of Director General discretion, delegation and the exercise of regulatory conditions.

In practice, litigation is likely to concentrate on director-level decisions about fitness, the scope and validity of conditions, the scope of agreements and delegations, evidentiary reliance on director-signed certificates, employer liability defences under s 5(2), and the interplay between vehicle standards and licensing obligations. The Act’s express review provision to the SAT makes that tribunal the primary venue for merits review of licensing decisions.

Several drafting features and operational gaps in the Act create practical risks and compliance traps for instructors, employers and advisers. The main gotchas, grounded in the Act’s text, are:

• No explicit primary individual penalty in the text. Section 5(1) creates the prohibition against acting as a driving instructor without a licence or permit, but the section does not specify a penalty for the individual who commits that offence. The only explicit monetary penalty in the main body is the employer liability penalty of $1 000 in s 5(2), and regulations may prescribe penalties not exceeding $500 (s 14(1)(k)). Do not assume a statutory fine for the individual acts exists in the Act’s main sections; check the regulations and other road statutes for express offence penalties and levels.

• Broad Director General discretion. The Director General’s assessment of “good character”, “fit and proper”, competence and the power to vary conditions (s 7(5)(b)-(d); s 7(6)-(7)) are inherently subjective. That means applicants face uncertainty about how those standards will be applied. The statutory remedy is review to the SAT (s 10(2)), but interim regulatory or market risks (e.g., lost work while awaiting review) can be material.

• Delegation and private performance of functions. Sections 4 and 4A permit delegation and agreements with non-public bodies, including private entities (s 4A(2)). That enables outsourcing of regulatory functions but also raises questions about accountability, the legal basis of decisions made by non-public bodies under agreement, and the practical variability of standards. Agreements can allow reliance on the opinion of the third party in place of the Director General’s opinion (s 4A(4)). Practitioners should seek the terms of any such agreements where relevant.

• Prescribed bodies and opaque accreditation. The Act requires prescribed bodies to issue competence certificates that will discharge the Director General from testing obligations (s 7(4)), and s 8 requires those bodies’ tests and training to be approved by the Director General (s 8(2)). The Act does not name the prescribed bodies or spell out approval criteria, so the identity, standards, fees and quality assurance for those bodies are left to subordinate instruments. That creates an information asymmetry for applicants and potential for inconsistent assessment standards.

• Advertising restrictions require specificity. Section 5(1)(b) requires advertisements to specify the kinds of vehicle and uses for which the person acts or is willing to act, and the person must hold a licence or permit authorising that specification. Casual or generic advertising that omits those particulars will fall foul of s 5(1)(b) unless the regulations provide further nuance (s 14(1)(d)).

• Vehicle compliance is multi-instrument. Vehicles used for instruction must be equipped per regulations and must comply with the Road Traffic (Vehicles) Act 2012 standards (s 5(1)(d)). This requires instructors to satisfy both the Act’s regulatory equipment rules and separate vehicles legislation. Practically, compliance may require technical inspections, vehicle modifications and record-keeping.

• Short licence duration and renewal burden. Licences last only 12 months (s 6(4)-(5)). That creates administrative renewal cycles and recurring fees, together with the possibility of conditions being newly imposed or varied at renewal time under s 7(6)-(7).

• Permit limits and interim reliance. Permits are limited to a maximum of six months (s 11(2)(a)). While permits permit work to continue while enquiries are ongoing (s 11(1)), they are temporary and revocable at any time (s 11(3)). Employers relying on permit-holders expose themselves to s 5(2) employer liability risks if the permit-holder is later found not to be entitled to instruct.

• Evidentiary presumption may shorten legal contest. Certificates signed by the Director General that state particulars about the register are evidence without proof of signature or production of the underlying record (s 12(2)). Challenging those certificates can be procedurally more difficult because the statutory certificate carries evidentiary weight.

• Regulations will carry operational load. Section 14 gives the Governor broad powers including making exemptions (s 14(1)(i)), prescribing display and advertising rules (s 14(1)(b)-(d)), medical evidence requirements (s 14(1)(g)(i)), and incident reporting duties (s 14(1)(h)). The detail that actually governs day-to-day compliance is likely to be in regulations, so practitioners must inspect current regulations closely; the Act itself leaves many operational elements to subordinate legislation.

• Continuous driving licence period may be waived. Section 7(5)(e) ordinarily requires the applicant to have held a driver’s licence for a continuous period of not less than three years, but the Director General may approve another period in a particular case. Reliance on that discretion is uncertain and cannot be presumed.

• Deleted and historical provisions. Section 13 has been deleted (see marginal note), and numerous amendments over decades mean historical compliance content may differ from present operation. Where actions occurred during transitional periods, historical provisions and reprint notes in the compilation table may be relevant.

These are practical gotchas based on the Act’s text. They point to places where uncertainties, delegated execution, and subordinate instruments combine to create compliance risk unless the regulations and operational agreements are inspected and understood.

To operate legally and minimise regulatory and commercial risk under the Act, a practitioner should adopt a compliance roadmap that addresses licensing, operational equipment, advertising, record-keeping, and management of delegation and permit processes. Below are concrete compliance steps grounded in the Act.

1. Establish baseline eligibility and documentation.

• Age and driver licence. Ensure the instructor applicant is at least 21 years old and holds the required current driving licence for the vehicle classes to be taught (s 7(5)(a), (e)). Document the continuous holding period of the driving licence; if it is less than three years, secure written confirmation from the Director General that a shorter period is acceptable for that case (s 7(5)(e)).

• Character, fitness and medical evidence. Prepare supporting evidence of good character and fitness to act as an instructor, including police checks or references where available. Be ready to produce medical fitness evidence if required by regulations (s 7(2); s 14(1)(g)(i)). Because the Director General may request such evidence, maintain an organised file of supporting documents.

2. Use accredited training and testing pathways.

• Prescribed-body certificate. Identify the prescribed body or bodies authorised by regulation to issue competency certificates. Complete the required tests or course of training approved by the Director General and obtain the certificate. Producing a prescribed-body certificate dispenses with Director General testing under s 7(4). Ensure you have receipts for the prescribed fees (s 8(1)(b)).

• If a prescribed-body certificate is not available, prepare to submit to Director General tests of competency and road law knowledge (s 7(3)). Keep records of test bookings, participation and outcomes.

3. Apply correctly and pay fees.

• Prescribed application form and fee. Lodge the application for a licence or renewal in the prescribed form and with the prescribed fee (s 7(1)). For renewals, start the process early given the 12 month licence duration (s 6(4)-(5)).

• If the Director General is conducting enquiries, consider requesting a permit and paying the prescribed permit fee so instruction can continue lawfully while enquiries proceed (s 11(1)-(2)). Remember permits are limited to up to six months and are revocable at any time (s 11(2)(a); s 11(3)).

4. Meet vehicle and equipment requirements.

• Vehicle compliance. Ensure any vehicle used for instruction complies with the required equipment specified in regulations and with the Road Traffic (Vehicles) Act 2012 construction and equipment provisions applicable to the vehicle (s 5(1)(d); s 14(1)(f)). Maintain inspection and compliance records and receipts for equipment purchases.

• Display and identification. Regulations may require the display of licences or means of identifying the instructor on or in the vehicle and the production of licences to prescribed persons (s 14(1)(b)-(c)). Keep licences accessible and ensure vehicles bear required identification.

5. Comply with advertising limits.

• Specificity in advertising. Any advertisement, notification or statement that a person acts or is willing to act as a driving instructor must specify the kinds of motor vehicle and uses for which the person is authorised (s 5(1)(b)). Ensure advertisements across all media, websites and business listings include that information and correspond to the licence or permit held.

6. Maintain records and handle incidents.

• Record-keeping. Maintain records of licences, permits, renewals and any correspondence with the Director General, mirroring the register the Director General keeps under s 12(1). These records support due diligence defences under s 5(2) and help evidence compliance.

• Incident notification. Regulations may require notification to the Director General and others of injuries or damage that occur during the course of instruction (s 14(1)(h)). Establish incident reporting protocols and templates to meet any prescribed timeframes and content.

7. Manage employer due diligence and staff oversight.

• Employee checks. Employers should conduct reasonable diligence before permitting staff to act as instructors. Keep documentation showing verification of licences and permits, training certificates, and checks performed. That documentation supports the defence in s 5(2) if a staff member acts without authorisation.

• Supervision of permit-holders. Where staff operate under permits, monitor the status of the permit, avoid relying on permits beyond six months, and be prepared to suspend instruction if the Director General revokes a permit (s 11(2)-(3)).

8. Prepare for conditions and review.

• Monitor licence conditions. Licences may be issued subject to conditions and conditions may be varied or revoked by notice (s 7(6)-(7)). Track condition notices and respond within any timeframes. If a licence is refused, suspended, cancelled or conditioned, seek prompt written reasons and consider applying to the State Administrative Tribunal for review under s 10(2).

• Legal representation for reviews. For contested decisions, compile a factual record, legal submissions and evidence of compliance to present to the SAT. Ensure procedural fairness issues and the Director General’s reasoning are addressed.

9. Check current regulations and agreements.

• Review the regulations in force under s 14 for penalties, equipment standards, prescribed bodies, application forms and fees, and advertising and display requirements. Because many operational details are in regulations, compliance requires up-to-date knowledge of the current subordinate instrument.

• Where functions are performed under agreements entered into by the Director General under s 4A, ascertain the terms of the agreement to understand processes, appeals pathways and who to engage with operationally.

10. Keep up with legislative changes and reprints.

• Consult the compilation table and reprints to understand amendment history and transitional provisions that may affect current obligations. Significant structural changes occurred in 2002 (delegation and agreements) and 2004 (SAT conferral), so historical compliance positions may differ from current practice.

Following these steps aligns an operator with the statutory obligations in the Act as reproduced. Because the Act leaves substantial detail to regulations and to the terms of delegated powers and agreements, the critical ongoing compliance task is to maintain current knowledge of regulations, prescribed bodies authorised to certify competence, and any agreements under which functions are performed.
