#### 55 Application of Division 55 Application of Division > > (1) This Division applies to or in respect of the sale by auction or otherwise of a motor vehicle. > > > (2) This Division does not apply to or in respect of the following motor vehicle sales— > > > > > (a) a sale of a motor vehicle that was registered for the first time, or the registration of which was renewed, within 90 days of the sale concerned, > > > > > (b) a sale to a motor dealer, motor vehicle recycler or financier, > > > > > (c) a sale by a motor vehicle recycler of a substantially demolished or dismantled motor vehicle. > > > (3) In this Division, auction of a motor vehicle includes a proposed auction, and sale of a motor vehicle includes a proposed sale.
