#### 46 Mandatory licence cancellations 46 Mandatory licence cancellations > The Secretary must cancel a licence under this Division if the Secretary is satisfied that there are any of the following grounds for taking disciplinary action against the licence holder— > > > (a) the licence holder (other than the holder of a tradesperson’s certificate) has (as an adult) been found guilty, within the preceding 10 years, of a motor vehicle stealing offence, > > > (b) the licence holder is not a fit and proper person to hold a licence. > > > > Note. > > > > Section 27 sets out the criteria for determining whether a person is a fit and proper person to hold a licence.
