#### 124 Appeals against forfeiture and proceeds orders 124 Appeals against forfeiture and proceeds orders > > (1) A person who has an interest in a motor vehicle the subject of a forfeiture order may appeal against the order in the same manner as if the order were, or were part of, an order imposing a penalty in respect of the offence (whether or not the person was convicted of the offence that resulted in the order). > > > (2) A person against whom a proceeds order is made may appeal against the order in the same manner as if it were, or were part of, an order imposing a penalty in respect of the offence that resulted in the order. > > > (3) The court to which an appeal is made in respect of a forfeiture order may, pending the hearing and determination of the appeal, make such orders as it thinks fit for the custody of the motor vehicle the subject of the order. > > > (4) On appeal, a forfeiture order or a proceeds order may be confirmed, revoked or varied.
