111 Disputes to which Division applies
> > (1) Motor dealer disputes This Division applies to disputes between motor dealers and purchasers and owners of motor vehicles arising out of the application of this Act, including (but not limited to) the following—
> >
> > > (a) the existence or extent of any obligation under Division 4 of Part 4 on the part of the motor dealer to the purchaser or the owner,
> >
> > > (b) the manner of carrying out any such obligation,
> >
> > > (c) the amount of the fair cost of repairing or making good any defect referred to in a defect notice.

> > (2) Repair disputes This Division applies to disputes between motor vehicle repairers and owners of motor vehicles arising out of the application of this Act, including (but not limited to) the following—
> >
> > > (a) the manner in which any repair work has been done,
> >
> > > (b) the fair cost owed by the owner to the repairer for the carrying out of any repair work.

> > (3) Excluded disputes An application cannot be made or dealt with under this Division in relation to a matter in dispute if—
> >
> > > (a) proceedings in respect of the matter have been commenced in a court or tribunal and have not been discontinued before being finally determined, or
> >
> > > (b) the matter has been previously dealt with under this Division.
