Motor Car Traders (Fees) Regulations 2018

The Regulations rely on three core concepts derived from the enabling framework they operate within: fee units, prescribed linkage to Act provisions, and a limited role confined to quantifying fees (not creating substantive licensing obligations).

Fee units: Most fees are stated in "fee units" rather than dollars (regs 5, 6, 7, 9, 10 and 11). The explanatory material states that the Monetary Units Act 2004 defines a fee unit, that the amount payable is calculated by multiplying the number of prescribed fee units by the value of a fee unit under section 7 of that Act, and that the Treasurer fixes the fee‑unit value for future financial years under section 5 of that Act (Endnote 4). The published value for the financial year beginning 1 July 2018 is $14.45 (Endnote 4). The calculation may be rounded to the nearest 10 cents (Endnote 4). The text in the Regulations therefore decouples the nominal charge from a fixed dollar amount so that the dollar liability moves with the Treasurer’s annual fee‑unit proclamation.

Prescribed linkage to Act provisions: Each numeric prescription is expressly tied to a particular subsection of the Motor Car Traders Act 1986. For example, the application fee is "for the purposes of section 8(3) of the Act" (reg 5); the first annual fee is "for the purposes of section 13(10) of the Act" (reg 6); the late payment fee is "for the purposes of section 24A(1) of the Act" (reg 10); and permission application fees are tied to ss 29A(2), 29B(2) and 29C(2) of the Act (reg 11). That textual formula means the Regulations supply the numeric input to statutory triggers and processes located in the Act itself. The Regulations do not restate the policy or the administrative procedure set out in the Act; they supply the monetary inputs the Act requires.

Fixed dollar exception: The fee for inspection or copying of the register is an explicit fixed dollar rate: $5.00 per page (reg 8). It does not rely on fee units and therefore will not vary automatically with the Treasurer’s fee‑unit adjustment. This creates an asymmetry between per‑transaction, per‑page charges and the other licence fees that track the fee‑unit value.

Sunset and publication mechanics: The Regulations will sunset on 3 July 2028 under the Subordinate Legislation Act 1994 (Endnotes). The Treasurer must publish the value of a fee unit for future financial years in the Government Gazette and a Victorian newspaper before 1 June in the preceding financial year (Endnote 4). These administrative publication requirements determine predictability of fee levels for practitioners and businesses planning for future compliance costs.

Interpretation and form: The published Statutory Rule includes endnotes that state certain interpretative effects of the Interpretation of Legislation Act 1984 (such as headings forming part of a Statutory Rule when made on or after 1 January 2001). It also contains a specific statement that explanatory memoranda, tables of provisions, endnotes and other material printed after the Endnotes do not form part of the Statutory Rule (Endnote 1). That distinction matters for legal reliance: the Regulations themselves set the fees, while the explanatory text supplies context and explanatory calculations that are not themselves part of the legal instrument.

These core concepts determine how a practitioner converts the numeric prescriptions in the Regulations into payment obligations, how predictable the dollar amounts will be over time, and which parts of the published material are legally operative.

Primary payers: The Regulations primarily affect applicants for motor car trader licences and holders of those licences. The prescribed application fee (reg 5) is payable by applicants under s 8(3) of the Act. The first annual fee (reg 6) and the subsequent annual licence fee (reg 9) are payable by licence holders at the times those sections of the Act require payment. A licensee who applies to the Authority to revoke or vary a condition restricting trading from a residential address or restricting trading to wholesaling must pay the fee prescribed in reg 7 (linked to s 14(1)(c) of the Act). Licence holders who fail to pay or to lodge required material on time may incur the late payment or lodgement fee in reg 10 (linked to s 24A(1) of the Act).

Applicants for permission: Parties who must apply to the Authority for permission under sections 29A, 29B or 29C of the Act are affected by reg 11, which prescribes the numerically stated fee for those permission applications. The Regulations therefore impose a financial cost on administrative requests for discretion under those specific Act provisions.

Users of the register: Any person who inspects or copies the Motor Car Traders register will be affected by reg 8. The inspection/copying fee is a fixed dollar amount of $5.00 per page, and it applies for inspection, copying, or both, under s 22(3) of the Act. That places a transaction cost on access to registry data.

Authority and government role: The Regulations affect the Authority named in the Act by specifying the sums it is to accept and bank for the statutory processes. The Treasurer also plays a role: the monetary amount an individual ultimately pays for fees stated in fee units is a product of the number of fee units in the Regulation and the Treasurer’s value of the fee unit for the relevant financial year under the Monetary Units Act 2004 (Endnote 4). The Regulations therefore allocate decision‑making on numeric values between the Governor in Council (making the Regulations and fixing fee unit counts) and the Treasurer (fixing the fee unit value each year).

Administrative and compliance cost burdens: Businesses operating as motor car traders, applicants seeking licences, licensees seeking variations or permissions, and researchers or competitors seeking register data all face direct costs established by the Regulations. Because most fees are pegged to fee units, those costs can change each financial year with the Treasurer’s unit value. The fixed per‑page register fee does not vary automatically and therefore may become relatively more or less significant over time.

Indirectly affected parties: Accounting and compliance advisers, solicitors advising motor car traders, and auditors preparing renewal materials will be affected insofar as clients must budget for application and annual licence fees and for any fees associated with variation or permission applications. Journalists and researchers who rely on register copies will face per‑page costs set by reg 8.

Concentration of impact: The Regulations concentrate costs on the regulated class , applicants, licensees and register‑users. The benefit of clarity about the fee quantum accrues to the Authority and to applicants who can budget the charge, but the Regulations do not allocate any apparent offsetting benefit or rebate within the instrument itself.

Duties to pay: The Regulations create monetary obligations by reference to the statutory processes in the Act. An applicant for a licence under s 8(3) of the Act must pay the application fee in reg 5. A person obtaining their first annual licence must pay the first annual fee set in reg 6, for the purposes of s 13(10) of the Act. Licence holders renewing or holding a licence after the first year must pay the subsequent annual licence fee in reg 9 in accordance with s 23(1) of the Act. A licensee applying under s 14(1)(c) to revoke or vary a condition restricting trading from a residential address or as a wholesaler must pay the fee in reg 7. Persons lodging material late or paying late are liable for the late payment or lodgement fee specified in reg 10 in relation to s 24A(1) of the Act. Applicants seeking permission under ss 29A(2), 29B(2) or 29C(2) of the Act must pay the prescribed fee in reg 11.

Right to access the register subject to fee: The Regulations preserve the statutory right to inspect or copy the register under s 22(3) of the Act but quantify the cost: $5.00 per page for inspection and/or copying (reg 8). The per‑page figure must be paid to obtain access as provided in the Act.

Calculation duties: Where a fee is stated in fee units, an applicant or licensee has the practical duty of converting the fee unit count into a dollar amount by multiplying the prescribed number of fee units by the fee‑unit value fixed by the Treasurer under the Monetary Units Act 2004, section 7, and then, if applicable, rounding to the nearest 10 cents (Endnote 4). The Regulations themselves do not record the conversion formula in their operative text; the Explanatory Details set out that calculation and quote the fee unit value for 2018, but those explanatory paragraphs are part of the published material and the Monetary Units Act is the statutory source for the conversion. Practically, therefore, compliance requires confirming the Treasurer’s published fee‑unit value for the relevant financial year.

Timing duties: The Regulations link fees to timing provisions in the Act: application fee on application, annual fees on first issue and subsequent renewals, late fee for late payment or lodgement (reg 10). The statute (the Act) will contain the timing and procedural hooks; the Regulations fix the numbers that must accompany those procedural steps.

Rights to apply and to seek variation or permission: The Regulations do not remove any rights created by the Act to apply for licences, to apply to vary or revoke certain conditions, or to apply for permission under ss 29A, 29B or 29C. They do, however, impose a financial cost on those exercises of statutory rights through the fees prescribed in regs 7 and 11, respectively.

Recording and rounding practices: The Explanatory Details state the fee calculation may be rounded to the nearest 10 cents (Endnote 4). For a person exercising a right under the Act, the practical duty includes ensuring the fee is converted and rounded in accordance with the Monetary Units Act procedures before payment to the Authority.

No self‑executing discounts, exemptions or payment methods: The Regulations do not create concessions, instalment options or exemptions from the prescribed fees. They do not specify payment methods, nor do they provide fee waivers; those matters, if they exist, would be in the Act or in administrative policy documents of the Authority. The Regulations only prescribe the amounts due.

In short, the Regulations impose calculable monetary duties tied to specific Act processes; they preserve statutory rights to apply and access the register, but they place a cost barrier at each enumerated intersection with the Act.

The Regulations themselves do not create criminal offences or administrative sanctions; they operate as numerical inputs to the enforcement and administrative machinery established by the Motor Car Traders Act 1986. The only enforcement‑adjacent instrument contained in the Regulations is the prescribed late payment or lodgement fee under reg 10, which is expressly "for the purposes of section 24A(1) of the Act". That text indicates that the Authority’s statutory power to apply a late fee arises in the Act and the Regulations set its monetary amount.

Consequences of non‑payment: The Regulations do not specify the consequences that follow if an applicant or licensee fails to pay the prescribed fee. Those consequences , whether a refusal to process an application, suspension or cancellation of a licence, or other administrative or civil consequences , are governed by the Act and any administrative regime created under the Act. Practitioners must therefore consult the Motor Car Traders Act 1986 and the Authority’s procedural materials to determine the specific enforcement outcomes for non‑payment or late payment beyond the monetary late fee in reg 10.

Mechanics of the late fee: Reg 10 fixes the late payment or lodgement fee at 1.7 fee units, and the explanatory material explains that fee units are converted to dollars under the Monetary Units Act 2004 (Endnote 4). The late fee is therefore a specified quantity but one that will vary in dollar terms from year to year with the Treasurer’s fee‑unit proclamation. The Regulations do not say whether the late fee is cumulative, how it is applied in the case of partial payments, or whether interest is charged; those procedural and remedial rules will come from the Act or from administrative directions.

Enforcement discretion remains with the Authority: The Act is the instrument that sets out the licensing powers, powers to impose conditions, to grant or refuse licences, and to enforce compliance. The Regulations delegate numbers to those powers; they do not enlarge or curtail the Authority’s enforcement discretions except by setting the monetary thresholds. Any exercise of administrative enforcement that uses the fee amounts must therefore be consistent with the Act’s procedural protections and any decision‑making standards in that primary legislation.

No penalties in the Statutory Rule: The Table of Provisions and the text of the Regulations do not list penalties, infringements or offence provisions. The Endnotes record that the Regulations were made under section 90 of the Act (Endnotes), but they do not create new offence provisions that would, for example, criminalise non‑payment beyond the Act’s own regime.

Publication and notice requirements relevant to enforcement: Practically, enforcement relies on the Treasurer’s publication of the fee‑unit value before 1 June preceding the financial year (Endnote 4). If the fee‑unit value is not published in time, there could be operational uncertainty about the precise dollar amount of fees and late fees payable. The Regulations do not provide a fallback calculation in that event; such a contingency must be handled under the Monetary Units Act procedures and the Authority’s practice.

In summary, the Regulations prescribe the amounts to be collected; enforcement of payment and the substantive remedial consequences of non‑payment are matters addressed in the Motor Car Traders Act 1986 and the Authority’s administrative procedures rather than in the Regulations themselves.

Monetary Units Act 2004: The Regulations rely on the Monetary Units Act 2004 for converting fee units into dollar amounts. The Explanatory Details state that the fee value is to be calculated in accordance with section 7 of the Monetary Units Act 2004 by multiplying the number of fee units by the value of a fee unit (Endnote 4). The Regulations do not themselves specify the dollar amounts for fee‑unit items. The Treasurer’s power under section 5 of the Monetary Units Act is the mechanism that fixes the value of a fee unit for each financial year. The Regulations therefore interact dynamically with the Monetary Units Act: the numeric prescriptions expressed as fee units are stable until changed by regulation, but the dollar consequence of those prescriptions moves with the Treasurer’s annual determination.

Motor Car Traders Act 1986: The Regulations are expressly made under section 90 of the Motor Car Traders Act 1986 (reg 2). Each fee is tied to a specific section of the Act (for example, reg 5 to s 8(3); reg 6 to s 13(10); reg 7 to s 14(1)(c); reg 8 to s 22(3); reg 9 to s 23(1); reg 10 to s 24A(1); reg 11 to ss 29A(2), 29B(2) and 29C(2)). As a result, the Regulations function as subsidiary legislation that completes the statutory scheme in the Act by supplying the monetary inputs that those sections envision. Any procedural, discretionary or remedial effects, such as licensing refusal, condition application, or late payment consequences, are governed by the parent Act, not by the Regulations.

Subordinate Legislation Act 1994: The Explanatory Endnotes note that the Regulations will sunset ten years after the day of making on 3 July 2028 in accordance with section 5 of the Subordinate Legislation Act 1994 (Endnotes). This temporal interaction imposes a statutory limit on the Regulations’ lifespan unless re‑made or extended pursuant to the Subordinate Legislation Act provisions. Practically, the sunset requires the regulator and stakeholders to anticipate potential re‑enactment, amendment or replacement of fee prescriptions prior to the sunset date.

Interpretation of Legislation Act 1984 (ILA) and publication formalities: The published instrument includes text noting the interpretative effects of the ILA (Endnotes). Those ILA provisions affect how headings, examples, diagrams, notes and punctuation are to be treated in a Statutory Rule made after 1 January 2001 (Endnote 1). The Endnotes also expressly state that "any explanatory memorandum, table of provisions, endnotes, index and other material printed after the Endnotes does not form part of a Statutory Rule" (Endnote 1). That procedural statement interacts with how a practitioner treats the explanatory material in the published instrument: the Regs are operative in their own right and the ancillary explanatory material assists understanding but is not itself part of the legal text.

Publication law: The Treasurer’s obligation to publish the fee unit value in the Government Gazette and a Victorian newspaper before 1 June in the preceding financial year is itself a statutory precondition that interacts with the practical operation of these Regulations (Endnote 4). That publication requirement originates in the Monetary Units Act 2004 and shapes the timeline for calculation of dollar fees.

No specified interaction with other federal or state statutes in the Regulations: The instrument does not identify interactions with consumer protection statutes, taxation laws or other licensing regimes. Any such interactions must be inferred by reference to the Motor Car Traders Act 1986 and other relevant legislation. Within the published material, only the Monetary Units Act 2004, the Subordinate Legislation Act 1994 and the Interpretation of Legislation Act 1984 are explicitly referenced.

In effect, these Regulations sit as numerical supplements to the Motor Car Traders Act 1986, their dollar effect mediated by the Monetary Units Act process, subject to the temporal limit of subordinate legislation rules in the Subordinate Legislation Act, and published within the interpretative conventions of the ILA.

The statutory publication records provided in the Endnotes state that there are no amendments to the Motor Car Traders (Fees) Regulations 2018 by subsequent statutory rules, subordinate instruments or Acts as at the version date of 1 September 2018 (Endnotes, Table of Amendments). The Table of Amendments entry explicitly records "There are no amendments made to the Motor Car Traders (Fees) Regulations 2018 by statutory rules, subordinate instruments and Acts." The "Amendments Not in Operation" section likewise records that there are no amendments which were not in operation at the publication date (Endnotes).

Initial making and commencement: The Regulations were made on 3 July 2018 by the Lieutenant‑Governor as the Governor’s deputy, with the advice of Executive Council, under section 90 of the Motor Car Traders Act 1986, and they came into operation on 1 September 2018 (Endnotes; reg 3). The text labels this Version No. 001 as at 1 September 2018.

Sunset provision derived from subordinate legislation rules: The Endnotes flag that these Regulations will sunset on 3 July 2028, ten years after the day of making, pursuant to section 5 of the Subordinate Legislation Act 1994. That means that unless re‑made, replaced or extended pursuant to the procedures of the Subordinate Legislation Act, their legal force will cease on that date.

Fee unit fluctuations and implicit amendment mechanism: Although the Regulations prescribe the number of fee units for most fees, the actual dollar amount payable changes every financial year as a result of the Treasurer’s proclamation under the Monetary Units Act 2004. That means practical dollar amounts change without amendment to the Regulations themselves. Such changes are not recorded as amendments to these Regulations but are produced through the Treasurer’s separate proclamation mechanism tied to existing law.

No recorded past amendments: For this version, there are no recorded insertions, deletions or substitutions to the Regulations. Any future changes to the fee quantum as a number of fee units would require a new Statutory Rule or amendment instrument under section 90 of the Motor Car Traders Act 1986 unless a different mechanism is provided in law.

Practical implication for users: Practitioners should treat Version No. 001 as the operative fee schedule as at 1 September 2018, but remain alert to the Treasurer’s annual fee‑unit value publication, and to possible future Statutory Rules altering the unit counts, which would appear in later versions or amendment entries.

The published Statutory Rule and accompanying Endnotes do not record any litigation history. There are no decisions, appeals, test cases or reported disputes referenced in the instrument. The Table of Provisions and Endnotes are silent on any court challenges to the making, validity, or application of these Regulations.

What that absence signifies in practice: The Regulations are numerically prescriptive subsidiary legislation. Challenges that typically arise with fee schedules include claims about procedural fairness in fee setting, ultra vires challenges to whether the enabling Act authorises certain fees, or disputes about the correct conversion of fee units into dollars. None of those disputes are recorded in the instrument as at the version date. That means practitioners should not assume there is an established body of case law interpreting these precise fee amounts or their conversion mechanism on the basis of this document alone.

Where litigation would be heard: Any dispute about the legality of the Regulations themselves, including whether the Governor in Council correctly exercised section 90 of the Motor Car Traders Act 1986 in prescribing fees, would proceed through the Victorian courts and administrative review channels. Disputes about the operation of the fees in relation to licence decisions, or the Authority’s exercise of powers under the Act, would arise from decisions made under the Act and might be subject to the Act’s internal review routes before court challenges. The Regulations, being fee prescriptions, are procedural inputs that a court would view in the context of the parent Act and relevant principles of subordinate legislation.

No recorded statutory adjudication: The Endnotes do not identify any internal adjudicative rulings, merits review decisions, or Tribunal determinations that have interpreted these Regulations. Users should therefore plan on applying the text of the Regulations and the relevant Act without the benefit of judicial gloss until and unless case law emerges.

Practical caution: Given the lack of recorded litigation, if a practitioner anticipates a novel question (for example, a contention about whether a fee was properly payable in a particular factual scenario), the absence of precedent means there is legal uncertainty. In that situation, early administrative engagement with the Authority or consideration of a declaratory application may be advisable, noting the Act provides the statutory framework for licence decisions.

1. Fee units versus dollars: Most fees are expressed in fee units (regs 5, 6, 7, 9, 10 and 11). The published explanatory note states the value of a fee unit for the 2018 financial year is $14.45 and that amounts "may be rounded to the nearest 10 cents" (Endnote 4). The explanatory material that quotes $14.45 is not part of the Statutory Rule itself, so the legally authoritative source for conversion is the Monetary Units Act 2004 and the Treasurer’s published fee‑unit value. Practitioners must therefore not rely on the printed $14.45 alone for later years and must check the Treasurer’s Gazette notice before calculating the payable dollar sum.

2. Rounding ambiguity: The Explanatory Details say the calculated fee "may be rounded to the nearest 10 cents" (Endnote 4). The permissive "may" leaves open whether the rounding is mandatory in every transactional context, and the Regulations do not specify the rounding direction for exact half‑cents beyond "nearest 10 cents". Administrative practice may fill that gap, but the Regulations alone do not resolve edge cases.

3. Fixed per‑page inspection fee: The register inspection/copying fee is a fixed $5.00 per page (reg 8). That means small or large searches can attract significant per‑page costs that do not automatically change with inflation unless the Regulation is amended. Users should budget for potentially high costs when copying bulk records.

4. Late fee small in units but varies in dollars: The late payment or lodgement fee is low in unit terms at 1.7 fee units (reg 10). Converted into dollars using the 2018 value given in the Explanatory Details, that equates to approximately $24.60 (1.7 x $14.45 rounded). However the dollar sum will change year to year with the Treasurer’s fee‑unit proclamation, so the practical deterrent effect of the fee varies.

5. Sunset date requires monitoring: These Regulations will sunset on 3 July 2028 (Endnotes). That requires stakeholders to monitor whether the Regulations are re‑made or amended before that date and to watch for transitional arrangements that might affect fees when a new instrument replaces them.

6. No methodology for partial refunds or offsets: The Regulations do not say whether, for example, an application fee is refundable in the event of a withdrawn or refused application, or whether fees can be offset against other charges. Practitioners must consult the Act or the Authority’s administrative policies for refund or credit rules.

7. Explanatory material is not operative law: The Endnotes repeatedly remind readers that explanatory memoranda and endnotes do not form part of the Statutory Rule (Endnote 1). While the Explanatory Details provide helpful calculation steps and a 2018 fee‑unit value, that material is not itself the legal text. Legal certainty about dollar amounts therefore requires reference to the Monetary Units Act publication and to the Treasurer’s actual proclamation.

8. Asymmetric indexing: Because the bulk of fees track the Treasurer’s fee unit but the register inspection fee is fixed, relative cost shifts will occur over time. A per‑page $5.00 charge that seems modest in 2018 could become comparatively low or high depending on annual fee‑unit movements. Budgeting should therefore treat the inspection fee as a separate, non‑indexed expense.

9. No payment method or lodgement channel specified: The Regulations fix amounts but do not specify how to pay them or where to lodge payment. The Act or the Authority’s published procedures will dictate acceptable payment methods and lodgement addresses. This gap can cause practical delays if a practitioner assumes a method not accepted by the Authority.

10. Permissions fee is comparatively large in unit terms: The permission application fee (reg 11) is 119.4 fee units. Converted at the 2018 unit value quoted in the Explanatory Details, that is approximately $1,725.30 when rounded (119.4 x $14.45). Applicants for permissions under ss 29A, 29B or 29C need to budget for a material up‑front cost that might be significant for small operators.

11. Variation application niche: The revocation or variation fee in reg 7 applies specifically to licensees applying to revoke or vary a condition restricting trading from a residential address or as a wholesaler (reg 7, linked to s 14(1)(c) of the Act). Practitioners should ensure the precise factual circumstances match this limited description before assuming the fee applies; there is no broader fee for other types of condition change recorded in these Regulations.

12. Dependence on the Authority’s interpretation: The Regulations tie numbers to particular Act provisions. Where the Act’s text is ambiguous about when a fee is triggered (for example, whether a document requires payment at lodgement or at processing), the Authority’s administrative interpretation will often govern day‑to‑day practice.

These are the principal practical traps that arise from the combination of fee‑unit indexing, fixed per‑page charges, publication requirements, and the limited scope of the Regulations.

Step 1 , identify the applicable fee and statutory hook: Determine which Act provision applies to your interaction with the Authority. Use the Regulation cross‑references: application fee (reg 5 for s 8(3) of the Act), first annual fee (reg 6 for s 13(10)), revocation/variation fee (reg 7 for s 14(1)(c)), inspection/copying fee (reg 8 for s 22(3)), subsequent annual fee (reg 9 for s 23(1)), late fee (reg 10 for s 24A(1)), permission application fee (reg 11 for ss 29A(2), 29B(2), 29C(2)).

Step 2 , check the current fee‑unit value: For fees expressed in fee units, obtain the Treasurer’s published fee‑unit value for the relevant financial year. The Monetary Units Act 2004 requires the Treasurer to fix the value and to publish it in the Government Gazette and a Victorian newspaper before 1 June preceding the financial year (Endnote 4). Do not rely solely on the 2018 example in the Explanatory Details; that $14.45 figure is informational for 2018 only.

Step 3 , calculate the dollar amount: Multiply the number of fee units given in the applicable Regulation by the Treasurer’s fee‑unit value as required by the Monetary Units Act (Endnote 4). For example, using the 2018 fee‑unit figure in the Explanatory Details, the calculation method would be applied to convert 103.1 fee units into a dollar fee for an annual licence. Round the calculated amount to the nearest 10 cents if rounding is applicable in administrative practice, noting the Explanatory Details state that the amount "may be rounded to the nearest 10 cents" (Endnote 4). Maintain a record of the calculation, including the Government Gazette reference for the fee unit value used.

Step 4 , allow for the inspection/copying per‑page charge where relevant: If the interaction requires inspection or copying of the register, calculate $5.00 per page as prescribed in reg 8. Confirm whether the Authority charges for inspection and copying separately or a combined fee and whether any minimum page charges apply.

Step 5 , include the fee with the lodgement: The Regulations define the fee quantum but not the Authority’s preferred payment methods. Consult the Motor Car Traders Act 1986 and the Authority’s published application forms and instructions to determine whether payment must accompany the application or licence renewal, the modes of payment accepted, and where to send cheques or electronic payments. Prepare to include proof of payment with the lodgement.

Step 6 , watch timing to avoid the late fee: Be aware of statutory timeframes for payment and lodgement under the Act. If you expect to be late, account for the late payment or lodgement fee prescribed in reg 10 (1.7 fee units). Calculate the late fee using the Treasurer’s fee unit for the relevant year.

Step 7 , document and retain receipts: Keep formal records of payment, including the calculation used, the Gazette notice of the fee‑unit value, the application reference numbers, and any acknowledgment of receipt from the Authority. Those records will be necessary in any dispute about whether a fee was properly paid.

Step 8 , engage early for permissions or condition variations: Given the permission application fee in reg 11 is numerically substantial (119.4 fee units), and the revocation/variation fee in reg 7 also involves a material payment (48.0 fee units), consider budgeting and cashflow steps before lodging these applications. Early engagement with the Authority can clarify whether an application is the correct procedural avenue and avoid unnecessary fees.

Step 9 , monitor for legislative or regulatory change: The Regulations will sunset on 3 July 2028 and can be amended by further Statutory Rules. Maintain a watch on the legislation register for any later versions, amendments, or replacement instruments. Also monitor the Treasurer’s annual fee‑unit proclamation so that the dollar equivalents used in budget planning and invoicing remain correct.

Step 10 , where in doubt, check the Act and the Authority’s guidance: The Regulations supply fee amounts but not procedural detail, refund policy, or payment methods. For matters such as refund eligibility, timing of payment triggers, acceptable forms of lodging applications, or dispute resolution, consult the Motor Car Traders Act 1986 and the Authority’s published guidance or contact the Authority for confirmation.

Step 11 , consider professional advice for complex matters: If your application involves mixed issues (for example, a licence change that may trigger multiple fees, or a disputed late fee), obtain legal or accounting advice to ensure correct calculation, correct timing, and appropriate challenge routes. Remember that the Regulations establish invoice amounts, but the Act sets the legal framework within which any dispute is to be resolved.

Following these steps will align an applicant or licence holder with the numerical prescriptions of the Regulations and the administrative conversion mechanisms set out in the Monetary Units Act framework.
