(1) This Part applies to any claim, whether or not the insurer admits or denies liability.

(2) Nothing in this Part prevents a claim from being settled at any time.

Note.

Section 108 provides that a person cannot commence court proceedings in respect of a claim unless it has been referred for assessment under this Part and a certificate as to the exclusion of the claim from assessment or as to the results of assessment has been issued.
