21 Death benefits may be paid in respect of certain injured persons Where a person who, if the person had died in or as a result of the accident would have been a qualifying person is a full-time patient in a hospital or other institution because of injuries received in or as a result of an accident and, in the opinion of the Commission, the person is likely permanently to remain a full-time patient in a hospital or institution, the Commission may, at the written request of the spouse of the person, determine that this Part shall apply to and in relation to that person, and on that determination being made the person shall, for the purposes of this Part, be deemed to have died on the date of the determination and to have been a qualifying person on that date.
