#### 78 Determination of economic loss 78 Determination of economic loss > A court shall reduce the amount of economic loss of an injured person or deceased person as a consequence of a motor accident by the amount of any entitlement to or payment of: > > > (a) (Repealed) > > > (b) compensation for expenses under the [Victims Compensation Act 1996](/view/html/repealed/current/act-1996-115) for the injury suffered in the accident, and > > > (c) amounts, payments or benefits comprising payments made to or on behalf of the claimant by an insurer or Nominal Defendant in relation to a claim made by the claimant (including amounts, costs and expenses paid under section 37 and payments made under section 45), and > > > (d) an amount, payment or benefit of a class or description of amounts, payments or benefits prescribed for the purposes of this section. > > **s 78:** Am 1989 No 47, Sch 1 (37); 1998 No 120, Sch 2.24 \[1\]; 1999 No 41, Sch 3 \[15\]; 1999 No 85, Sch 2.39.
