428 Borrowing for nominal defendant fund The nominal defendant may borrow the amounts that the nominal defendant considers necessary to satisfy applications for defined benefits in relation to motor accidents for which an insolvent insurer is the relevant insurer, motor accident claims and judgments for MAI policies issued by an insolvent insurer if the nominal defendant would not otherwise be able to satisfy the applications, claims and judgments from the nominal defendant fund.
