#### 4 Damages in respect of motor accidents 4.1 Damages in respect of motor accidents (cf s 122 MACA) > > (1) This Part applies to and in respect of an award of damages that relates to the death of or injury to a person caused by the fault of the owner or driver of a motor vehicle in the use or operation of the vehicle. > > > (2) This Part applies to and in respect of— > > > > > (a) the award of damages by a court, and > > > > > (b) the assessment of the amount of damages by the Commission. > > > > A reference in this Part to the award of damages includes a reference to any such assessment of the amount of damages. > > Note. > > See [Motor Accidents Act 1988](/view/html/inforce/current/act-1988-102) for motor accidents occurring before the commencement of the [Motor Accidents Compensation Act 1999](/view/html/inforce/current/act-1999-041).
