Monetary Units Act 2004

Fee unit, penalty unit and annual rate. The Act foregrounds three core concepts: the fee unit, the penalty unit and the annual rate. A fee (broadly defined to include charges) expressed in fee units must be read as dollars equal to the number of fee units multiplied by the fee unit amount fixed by the Treasurer (s 4; s 7(1)). A penalty unit has the same statutory meaning as in s 110 of the Sentencing Act 1991 (s 3). The Treasurer fixes values for a fee unit and a penalty unit for each financial year by notice in the Government Gazette (s 5(1)-(3)). The Treasurer must fix an annual rate, the percentage rate used to adjust the unit values from the previous financial year to the next, before 1 March annually (s 5(4)). If the Treasurer fails to fix a rate, the prior year’s rate continues by operation of s 5(5).

Calculation and rounding. The arithmetic is specified: multiply the number of units by the Treasurer-fixed value (s 7(1)-(2)). The Act mandates rounding conventions: fees calculated under s 7 may be rounded to the nearest 10 cents (s 7(3)); penalties calculated under s 7 may be rounded to the nearest dollar (s 7(4)). For certain historical conversions to units taking effect on or before 1 July 2004, the Act prescribes that the conversion is deemed to have used a divisor of $10 for fee units and $100 for penalty units (s 9(2)(a)(i), (b)(i)), with a rounding rule to two decimal places (s 9(3)).

Authorised conversions and regulatory exemptions. The Governor in Council may, on the Treasurer’s certificate and recommendation, make regulations converting statutory-rule fees and penalties specified in monetary amounts to fees or penalties specified by reference to units, converting existing unit references to the unit values under this Act, and converting fee units to monetary amounts and penalty units to monetary amounts (s 9(1)(a)-(f)). Further, the Governor in Council may make regulations to increase fees that have remained in monetary amounts by the amount of cumulative annual rates fixed by the Treasurer for the period that the fee remained without increase (s 9(1)(g)). Part 2 of the Subordinate Legislation Act 1994 does not apply to such regulations if the Treasurer certifies compliance with one of the specific formulae listed in s 9(2)(a)-(h), which sets out preconditions and numerical rules for different classes of conversion regulations.

Publication and notification duties. The Treasurer must publish values of units in the Gazette and a newspaper by 1 June each year (s 6). The Minister responsible for an Act or statutory rule that provides fees or penalties by units must take reasonable steps to ensure that notice of the monetary amounts calculated under s 7 is given to the public or the affected sector (s 10(1)). This notification duty extends to legislative instruments under a statutory rule where such instruments provide for fees in fee units (s 10(2)).

Interaction with other Acts. The Act expressly links to the Sentencing Act 1991 for the penalty unit definition (s 3) and modifies the relationship with the Subordinate Legislation Act 1994 by exempting certain unit-fixing actions from its application (s 12). The stated purposes include converting penalty units in the Petroleum (Submerged Lands) Act 1982 to monetary amounts and making consequential amendments to the Sentencing Act 1991 and the Subordinate Legislation Act 1994 (s 1(e)-(f)).

Transitional and special provisions. Section 11 provides specific figures and an annual rate for the 2012-2013 financial year: fee unit $12.53, penalty unit $140.84, annual rate 2.5% (s 11(1)-(3)). Section 12 excludes the Subordinate Legislation Act 1994 from applying to the fixing of fee or penalty units and the annual rate (s 12). Amendments inserted by later Acts introduce definitions for instrument maker and legislative instrument (s 3 notes), and require the Treasurer to publish the annual rate on the Department’s website (s 5(8)), among other changes.

Administrative discretion and statutory limits. The Treasurer’s power to fix unit values and the annual rate is subject to a numerical cap: the amount fixed for a fee unit or penalty unit for a financial year must not exceed the product of the previous year’s value multiplied by the annual rate, rounded to the nearest cent (s 5(6)-(7)). That cap creates a statutory ceiling tied to the annual rate but does not obligate the Treasurer to set the ceiling as the new value; the Treasurer may set lower values (s 5(6)-(7)).

Primary decision-makers. The principal decision-maker under the Act is the Treasurer, who fixes the monetary values of fee and penalty units by notice in the Government Gazette (s 5(1)-(3)) and must set an annual rate before 1 March each year (s 5(4)). The Governor in Council, acting on the Treasurer’s certificate and recommendation, may make regulations converting amounts or units in statutory rules (s 9(1)). Ministers responsible for administering Acts or statutory rules are obliged to take reasonable steps to notify affected persons of the monetary amounts that result from unit conversion or determination (s 10). Instrument makers under the Subordinate Legislation Act 1994 are explicitly recognised as authorised to prescribe fees by reference to fee units in legislative instruments (s 8(1A)).

Regulated entities and payers. Businesses, professionals, public users and other entities that pay fees or penalties under Victorian Acts, statutory rules or legislative instruments are directly affected. When fees or penalties are expressed in units, the dollar charge will vary year to year as the Treasurer adjusts unit values (s 4; s 5). Entities that historically paid static monetary fees that have not been updated may be affected if regulations are made to convert the money figure to units and then apply cumulative annual rates (s 9(1)(g)), because that conversion and retrospective indexing can increase what had been nominally fixed charges.

Statutory rule-makers and instrument makers. The Act reaches statutory rule-makers who currently prescribe fees and penalties in statutory rules. The Governor in Council may amend statutory rules to express fees or penalties as units (s 9(1)(a)-(c)). Instrument makers who create legislative instruments under an Act can adopt fee units for those instruments (s 8(1A)), and Ministers must give notice of monetary equivalents for instruments under s 10(2).

Public sector administrators. Departments and agencies that collect fees or impose penalties must implement the arithmetic and rounding rules in operational systems (s 7(1)-(4)). They must also track and apply notices published by the Treasurer, meet publication deadlines (s 6), and ensure public notification obligations are performed (s 10). The Act’s requirement that the annual rate be published on the administering Department’s website (s 5(8)) imposes a digital publishing task.

Legal advisers and counsel. Legal practitioners advising government agencies, ministers, statutory rule drafters, and regulated parties must account for the conversion mechanics, the substantive effect of conversion regulations (including the potential to increase previously static fees under s 9(1)(g)) and the special transitional rules (s 9(2)). The Act’s interaction with the Sentencing Act 1991 for penalty units (s 3) and the Subordinate Legislation Act 1994’s procedural exclusions (s 9(2); s 12) will be material in regulatory design and legal risk assessment.

Members of the public. Citizens, consumers and non-government organisations that interact with public services subject to fees will experience year-on-year changes in prices where services are priced in fee units. The Minister’s duty to take reasonable steps to publicise monetary equivalents (s 10) is the statutory channel intended to inform those users.

Those indirectly affected. Entities with long-term contracts referencing particular statutory fees or penalties should be attentive. If those contracts refer to fees "as prescribed" or to units, the contractual payment obligations will move in line with Treasurer notices under the Act. Similarly, public bodies that budget on a static nominal-fee basis face potential budgetary adjustments if fees are converted and indexed under s 9(1)(g).

Who decides and who pays. The Treasurer decides unit values and the annual rate (s 5). The Governor in Council, on the Treasurer’s certificate, decides conversion regulations (s 9). Ministers and instrument makers prescribe fee schedules in rules and instruments, and the public and regulated entities ultimately pay the fees and penalties as calculated under s 7 and notified under s 10.

Treasurer’s core duties. The Treasurer must fix the value of a fee unit and a penalty unit for each financial year by notice published in the Government Gazette (s 5(1)-(3)). The Treasurer must set the annual rate before 1 March each year (s 5(4)), and if the Treasurer does not, the prior year’s annual rate continues (s 5(5)). The Treasurer must ensure the annual rate is published on the Department’s website as soon as practicable after fixing it (s 5(8)). The Treasurer’s fixation of unit values is subject to a statutory ceiling: the amount fixed must not exceed the previous year’s unit value multiplied by the annual rate, rounded to the nearest cent (s 5(6)-(7)). Those provisions create a duty to publish, a timeline, and a numeric limit on increases.

Governor in Council power to make conversion regulations. The Governor in Council, on the Treasurer’s certificate and recommendation, may make regulations to convert existing statutory-rule fees or penalties specified in monetary amounts to fee or penalty units, to convert fee or penalty unit references to the equivalents under this Act, to convert unit references to monetary amounts, and to increase fees specified in monetary amounts by cumulative annual rates where appropriate (s 9(1)(a)-(g)). The regulations can be drafted to implement either forward conversion (monetary amounts to units) or backward conversion (units to monetary amounts).

Certification and Part 2 exemption mechanics. Part 2 of the Subordinate Legislation Act 1994 does not apply to a regulation made under s 9 if the Treasurer certifies in writing that specific formulae and conversion methods were used (s 9(2)). The Act articulates precise conversion formulae depending on the timing and nature of conversion (for example, dividing by $10 or $100 for conversions taking effect on or before 1 July 2004; dividing by current unit value for later conversions) (s 9(2)(a)-(b)). The Treasurer’s certificate is therefore a procedural gateway that removes certain subordinate legislation processes for conversion regulations.

Publication and notification duties of Ministers. The Minister responsible for administering an Act or statutory rule providing for fees or penalties by units must take reasonable steps to notify the public or affected sector of the monetary amounts of those fees and penalties as calculated under s 7 (s 10(1)). Where a legislative instrument under a statutory rule prescribes fees by fee units, the administering Minister has the same reasonable-steps duty to notify (s 10(2)). Those duties are framed as best-efforts obligations rather than strict prescriptive steps, but they require an administrative response from Ministers and agencies.

Instrument maker authorisation. A provision authorising an instrument maker to make a legislative instrument that prescribes or charges a fee can be construed as authorising the instrument maker to do so by reference to fee units (s 8(1A)). That is a delegated-right allocation: instrument makers under the Subordinate Legislation Act may adopt the unit model without further statutory authorisation.

Calculation and rounding rules as mandatory duties. Once units are set, the fee or penalty is calculated by multiplying the applicable number of units by the Treasurer-fixed value (s 7(1)-(2)). Fees may be rounded to the nearest 10 cents (s 7(3)). Penalties may be rounded to the nearest dollar (s 7(4)). For certain conversion regulations taking effect on or before 1 July 2004, units are to be rounded up to two decimal places (s 9(3)); for conversions to fees, rounding to the nearest 10 cents is deemed compliant (s 9(4)); for conversions to penalties, rounding to the nearest dollar is deemed compliant (s 9(5)).

Statutory rights and limits. The Act does not create private entitlements to set unit values; it assigns that power to the Treasurer. Regulated parties do not have a statutory veto. The statutory limits on increases (the "must not exceed" formula in s 5(6)-(7)) cap Treasurer discretion upwards but do not prescribe a minimum or require the Treasurer to index by the full rate. The Act gives a right to public notification (for Ministers to take reasonable steps, s 10), which creates administrative duties that evidence an expectation of transparency but not a private cause of action stated in the Act.

Transitional specific duties. For the financial year commencing 1 July 2012 the Act prescribed specific values and rate, overriding s 5 for that year (s 11(1)-(4)). Administrators were therefore obliged to apply those figures for that year instead of relying on treasure-fixed values for s 5.

Exclusions from Subordinate Legislation Act oversight. The Act removes the Subordinate Legislation Act’s application to the fixing of a unit value and the annual rate (s 12). That exclusion reduces procedural oversight for that executive action. However, conversion regulations still require a Treasurer’s certificate for Part 2 exemptions (s 9(2)).

Record and publication duties as compliance checkpoints. The Treasurer’s publication in the Government Gazette and a newspaper (s 6), and on the Department’s website (s 5(8)), and Ministers’ reasonable notification (s 10), are the statutory mechanisms intended to inform both officials and the public. Compliance with these duties will determine whether regulated parties can be said to have been given sufficient notice of fee changes.

The Act itself contains no new criminal offences or stated penalties for non-compliance with its provisions. Its enforcement model is administrative rather than penal: responsibilities are imposed on the Treasurer, the Governor in Council and Ministers in the form of duties to fix values, publish notices and take reasonable steps to notify affected sectors (s 5; s 6; s 10). The Act prescribes the arithmetic by which existing statutory penalties denominated in penalty units are converted into dollars once the Treasurer fixes a penalty-unit value (s 7(2)), and the rounding convention for penalties (s 7(4)). The Act does not, however, specify sanctions or penalty provisions for a failure by the Treasurer, Ministers or instrument makers to comply with the statutory duties.

Regulatory compliance and procedural consequences. Where a regulation to convert fees or penalties is made under s 9, the regulation’s validity and effect depend upon whether it complies with the conversion method and whether the Treasurer has provided the written certificate required for certain Part 2 exemptions (s 9(2)). The Act makes a regulatory procedural distinction: some conversion regulations may be excluded from Part 2 of the Subordinate Legislation Act 1994 if the Treasurer certifies the conversion followed the listed numerical rules (s 9(2)). That procedural pathway could affect the legal reviewability and parliamentary oversight of conversion regulations because Part 2 procedural requirements would otherwise apply. The Act does not itself state the legal consequences of failing to obtain a Treasurer’s certificate; such consequences would arise from the Subordinate Legislation Act’s usual operation.

Administrative law avenues remain. The Act’s concentration of discretion in the Treasurer and the Governor in Council suggests that affected parties retain ordinary public law remedies where a conversion regulation or unit-fixing decision is alleged to be invalid, unreasonable or made in bad faith, subject to the usual grounds and limitations of judicial review. The Act itself provides no internal appeal or penalty regime for non-public-law misconduct by officials.

Rounding and calculation compliance. The Act prescribes rounding rules (s 7(3)-(4); s 9(3)-(5)). Failure to apply the statutory rounding and multiplication could render a fee, penalty or conversion regulation inconsistent with the Act, which in turn could be a basis for challenge to the lawfulness of the amount charged or prescribed. Again, the Act does not specify a sanction; the normative remedy lies in administrative or judicial review remedies applicable to statutory instruments and government action.

Notification obligations as compliance markers. The Minister’s obligation to take reasonable steps to notify the public of the monetary equivalents (s 10) is a duty that, while fact-specific, creates an administrative standard. Non-compliance could give rise to reputational, political or administrative consequences and potential legal disputes about whether adequate notice was provided before enforcing a fee or penalty. The Act does not create a private right to compensation where notification is inadequate.

Limits on review for certain procedural exemptions. Because certain conversion regulations are excluded from Part 2 of the Subordinate Legislation Act if the Treasurer certifies compliance (s 9(2)), there is a procedural effect: fewer automatic parliamentary checkboxes will apply to those regulations. That may affect the speed and administrative oversight of conversion regulations but does not, per se, remove judicial review or other legal remedies for persons affected by a regulation.

Special transitional provision. Section 11 prescribes, for the 2012-2013 year, specific numerical values and an annual rate. Those figures govern calculation for that year. Failure by administrators to apply s 11 could be corrected administratively or through legal challenge insofar as it affects the lawful calculation of fees or penalties for that financial year.

Sentencing Act 1991. The Act adopts the definition of penalty unit as having the same meaning as in s 110 of the Sentencing Act 1991 (s 3). That linkage integrates Victoria’s sentencing penalty-unit regime into the unit arithmetic used by this Act. Penalties expressed in penalty units in other Acts or statutory rules will therefore be converted to dollar amounts using the penalty-unit value fixed annually under s 5 (s 7(2)).

Subordinate Legislation Act 1994. The Act modifies how the Subordinate Legislation Act applies in two ways. First, it inserts an authorising construction allowing provisions that permit the Governor in Council to make rules prescribing fees to be read as authorising rules prescribing fees by reference to fee units (s 8(1)). It similarly authorises instrument makers to prescribe fees by fee units in legislative instruments (s 8(1A)). Second, the Act expressly exempts the fixing of a fee or penalty unit and the annual rate from the Subordinate Legislation Act (s 12). Further, Part 2 of the Subordinate Legislation Act does not apply to regulations under s 9 if the Treasurer issues a certificate that specified conversion formulae have been followed (s 9(2)). These interactions alter the procedural oversight and drafting freedoms for statutory rule-makers and instrument makers.

Acts and statutory rules with monetary references. The Act creates an authorising pathway that allows existing Acts and statutory rules which currently specify fees or penalties in dollars to be converted into unit-based references by regulation (s 9(1)(a)-(b)). It also allows conversion in the opposite direction, fee and penalty units to monetary amounts (s 9(1)(e)-(f)). That means many Victorian Acts and statutory rules that currently state fees or penalties as fixed dollar amounts can be re-expressed as unit-based amounts without primary legislation changes, provided conversion regulations are made under s 9.

Petroleum (Submerged Lands) Act 1982 and other specific Acts. The purposes clause explicitly mentions converting penalty units in the Petroleum (Submerged Lands) Act 1982 to monetary amounts (s 1(e)). The Act also states that it will amend the Sentencing Act 1991 and the Subordinate Legislation Act 1994 (s 1(f)), which is reflected in the cross-references in s 3 and s 12. In practice, the Act establishes a conversion and indexing framework that can be applied across statutory regimes.

Legislative instruments. The Act defines and authorises the use of fee units in legislative instruments, aligning the treatment of delegated legislative instruments with statutory rules (s 3; s 8(1A); s 10(2)). Where a legislative instrument prescribes a fee by reference to fee units, the administering Minister has the same notification duty to take reasonable steps to inform the public of the monetary equivalents (s 10(2)).

Rounding and conversion rules impact prior legislative choices. Conversion regulations made under s 9 are constrained by formulae specifying initial divisors (for pre-1 July 2004 conversions) and rounding methods (s 9(2)(a)-(b); s 9(3)-(5)). Those formulae aim to produce a numerically equivalent or rounded unit count when converting legacy monetary amounts, but they also give regulators a clear method to change nominal dollar figures into indexed units.

Interaction with budgeting and contract law. The Act will affect how fees and penalties operate in budgets and contracts that refer to statutory fees. Contracts that reference fees in statutory instruments or refer to "the fee prescribed under X Act" will track the Treasurer’s unit determinations and any conversion regulations. The Act does not alter general contract law; it changes the statutory reference point for amounts owed under statute or instrument and therefore may change contractual payment obligations where they are linked to statutory charges.

Parliamentary oversight and procedure. By enabling s 9 conversion regulations to bypass Part 2 of the Subordinate Legislation Act where a Treasurer’s certificate is provided (s 9(2)), the Act reduces some procedural safeguards designed to ensure that subordinate instruments get parliamentary and public scrutiny. The Act does not remove all interaction with parliamentary processes; it instead channels certain conversion decisions through executive certification.

The publication includes a table of amendments showing four instruments that altered the Monetary Units Act 2004. Those instruments are named in the Act’s endnotes and Table of Amendments.

1. Monetary Units Amendment Act 2012, No. 33/2012 (Assent 13 June 2012). The amendment’s commencement entry shows s 3 commenced on 1 July 2012 (Table of Amendments). Section 11 of the principal Act was substituted by No. 33/2012 s 3, creating the special provisions for the 2012-2013 financial year (s 11).

2. Statute Law Revision Act 2013, No. 70/2013 (Assent 19 November 2013). Commencement details indicate particular items repealed by s 3(Sch. 1 item 36) commenced on 1 December 2013. The Act’s endnotes show that ss 13-16 and Schedules 1 and 2 were repealed by No. 70/2013 s 3(Sch. 1 item 36).

3. Regulatory Legislation Amendment (Reform) Act 2024, No. 6/2024 (Assent 5 March 2024). This amending Act effected changes to sections 3-7 (commencement 6 March 2024 for these sections) and inserted definitions and amendments reflected in the revised s 3, s 4, s 7, s 8 and s 10. The endnotes indicate specific subsections were inserted or amended by No. 6/2024: for example, s 3 definitions for instrument maker and legislative instrument, s 4 amended by No. 6/2024 s 4, s 7(1) amended, s 8(1) amended and s 8(1A) inserted, and s 10 amended to add s 10(2).

4. Subordinate Legislation and Administrative Arrangements Amendment Act 2024, No. 47/2024 (Assent 26 November 2024). This amending Act inserted s 5(8) requiring publication of the annual rate on the administering Department’s website and included other changes (commencement of s 26 on 1 March 2025). The endnotes note s 5(8) inserted by No. 47/2024 s 26.

The version printed is Version No. 008, incorporating amendments as at 1 March 2025. The Endnotes record that the Act was assented to on 11 May 2004 and detail commencement of various sections (s 2). The endnotes also reference the Minister’s second reading speech dates and provide background on interpretation provisions for legislative style and format (Interpretaion of Legislation Act 1984 references).

Amendments changed definitional coverage (instrument maker, legislative instrument), introduced additional publication duties (website publication of the annual rate), adjusted construction provisions to explicitly encompass legislative instruments (s 8(1A)), and clarified notification duties (s 10(2)). The 2012 amendment set one-off numeric values for 2012-2013. The 2013 revision removed certain sections and schedules. The 2024 Acts reorganised and modernised aspects of the Act’s interaction with subordinate legislation and the regulatory framework.

Readers should treat the Table of Amendments and endnotes in the Act as the authoritative source for each amendment’s citation, assent date and commencement date. The Act’s own endnotes identify the exact sections altered by each amending instrument, and the current consolidated version reflects those changes.

The statute’s endnotes and the published text do not record any case law or litigation history arising from the Monetary Units Act 2004. The Act itself does not list litigated disputes or judicial interpretations, and the endnotes contain no decisions or references to court proceedings. Therefore, there is no litigation history recorded in the provided text of the Act.

That absence in the Act and endnotes does not mean the Act has not been considered in courts or tribunals elsewhere, but no such cases are named or discussed in the printed materials supplied. Users seeking judicial interpretation or challenge history should consult legal databases and court records beyond the Act’s text. The Act’s procedural changes, particularly the removal of Part 2 procedures for certain conversion regulations upon Treasurer certification (s 9(2)) and the exclusion of the Subordinate Legislation Act from applying to unit-fixing (s 12),create potential areas where legal challenges could be brought (for example, about the validity of a conversion regulation or adequacy of notification), but the Act’s text includes no recorded litigated outcomes.

For clients or practitioners anticipating disputes, the absence of identified case law in the Act’s endnotes means advisory work will need to rely on general administrative law principles, subordinate legislation doctrine and the specific statutory wording in the Monetary Units Act when assessing reviewability, validity and procedural compliance of conversion regulations and executive notices.

Rounding rules produce small but concrete differences. Fees are rounded to the nearest 10 cents while penalties are rounded to the nearest dollar (s 7(3)-(4)). For conversions under s 9, deemed compliance rules set lower-level rounding standards (s 9(4)-(5)). For pre-1 July 2004 conversions the Act prescribes divisors ($10 and $100) and requires rounding up to two decimal places when calculating number of units (s 9(2)(a)(i), (b)(i); s 9(3)). These numerical rules can produce apparently small but legally binding deviations from simple proportional equivalence. In bulk applications, cumulative rounding can shift revenue or liability amounts in aggregate.

Conversion regulations can increase long-stagnant monetary fees. Section 9(1)(g) gives explicit power to increase fees that have remained in monetary amounts by the amount of the cumulative annual rates fixed by the Treasurer for the period the fee had effect without increase. The mechanism is available by regulation, not by primary legislation. That means a fee which had been frozen nominally could be converted and adjusted administratively, materially altering the cost to regulated parties without primary-legislation amendment.

Part 2 procedural exemptions can limit parliamentary scrutiny. For conversion regulations, a Treasurer’s certificate can make Part 2 of the Subordinate Legislation Act 1994 inapplicable (s 9(2)). Those certificates require the Treasurer to certify that defined numerical conversion methods were used (s 9(2)(a)-(h)). That certification is therefore a crucial step that can alter the regulatory process. Practitioners should note the precise formulae in s 9(2) to assess whether the certificate is correctly used.

The Treasurer’s discretion over the annual rate is pivotal. The Treasurer must set the annual rate before 1 March (s 5(4)) but, subject to the statutory ceiling, may set unit values below the product of prior value and annual rate (s 5(6)-(7)). If the Treasurer does not set an annual rate, the previous rate applies (s 5(5)), which can freeze indexation inadvertently. The Act thus creates a single point of discretion whose inaction or choices materially affect fees and penalties system-wide. Delays in setting the rate are mitigated by the carry-over rule (s 5(5)), but that itself affects budget predictability for agencies and regulated parties.

Publication and notification timing is specific. The Treasurer must publish unit values in the Government Gazette and a statewide newspaper before 1 June for the coming financial year (s 6). The annual-rate deadline is before 1 March (s 5(4)). Administrators must ensure these dates are met; missing publication steps can disrupt statutory calculation and public notice. The Act requires the annual rate to be posted to the Department’s website "as soon as practicable" after it's fixed (s 5(8)), a term that creates practical but not strictly defined timings.

"Reasonable steps" standard for Ministers is fact-sensitive. Section 10 requires responsible Ministers to take "reasonable steps" to notify the public or affected sectors of monetary equivalents (s 10(1)-(2)). That standard is not prescriptive; agencies must document their notification processes and be prepared to show reasonableness if challenged. The Act confers a duty but leaves room for administrative discretion on what counts as sufficient notification.

Interplay with contracts and budgets. Entities with contracts referencing statutory fees need to check whether their contracts reference a unit or a fixed monetary amount. Conversion regulations or annual unit changes can alter liabilities and predictable cash flows. Public bodies budgeting under the assumption of static fees should test whether conversion or indexation could change revenue projections.

Transitional quirks. The Act contains specific transitional figures for 2012-2013 (s 11). Practitioners must be careful when reviewing historical fee calculations to apply the s 11 figures to that financial year. Also, pre-1 July 2004 conversion rules use different fixed divisors than post-2004 conversions (s 9(2)).

No sanctions for non-publication in the Act. The Act places duties on the Treasurer and Ministers to publish and notify, but it contains no penalty or enforcement mechanism for failure to publish. Administrative remedies and reputational risk are the practical enforcement channels; statutory sanctions are not provided.

Definitions and delegated power scope have changed. Amendments in 2024 added or clarified definitions (instrument maker, legislative instrument) and expanded the Act’s application to legislative instruments (s 3; s 8(1A)). Those changes broaden the drafters’ toolkit but also enlarge the range of instruments subject to notification obligations under s 10(2).

For Treasurers and finance branches. Establish a calendar aligned to s 5 and s 6: determine the annual rate before 1 March (s 5(4)), publish the annual rate on the administering Department’s website "as soon as practicable" after fixing it (s 5(8)), and publish notices in the Government Gazette and a newspaper circulating generally throughout Victoria of the fee-unit and penalty-unit values before 1 June (s 6). Ensure any unit value fixed for the coming financial year does not exceed the statutory ceiling (previous value multiplied by annual rate, rounded to nearest cent) (s 5(6)-(7)). Where the Treasurer does not set an annual rate, document the use of the prior year’s rate (s 5(5)). Maintain precise records of the notices and publication dates to evidence compliance.

For statutory rule drafters and Governor in Council. If making conversion regulations under s 9, follow the conversion formulae set out in s 9(2) where the Treasurer intends to rely on the Part 2 exemption. Obtain the Treasurer’s written certificate explicitly recording which s 9(2) limb is engaged and verifying the mathematical conversion has been performed in the manner prescribed. Ensure that rounding conventions are applied as specified (s 9(3)-(5)). Where a regulation will increase a monetary fee by accumulated annual rates (s 9(1)(g)), prepare an explanatory statement showing the cumulative annual rates applied and the period covered to support the Treasurer’s certification.

For Ministers and instrument makers. Where an Act, statutory rule or legislative instrument provides for fees or penalties by units, prepare a notification plan to fulfil s 10’s "reasonable steps" requirement. Practical measures include publishing a clear schedule of monetary equivalents on the administering agency’s website, sending targeted notices or circulars to professional bodies and industry stakeholders likely to be affected, and placing notices in commonly used channels for the regulated sector. Retain documentary evidence of these steps and reasons for chosen notification media to show administrative compliance.

For agencies operationalising fees and penalties. Update billing systems and enforcement systems to use the s 7 calculation: multiply the number of units by the Treasurer-fixed unit value (s 7(1)-(2)), and apply rounding rules (s 7(3)-(4)). For fees, round to the nearest 10 cents; for penalties, round to the nearest dollar. Where conversion regulations are made, check the regulation’s retrospective or prospective application dates and apply the correct conversion method (s 9(1)-(2)). Ensure IT and accounting systems capture unit values and recompute schedules annually at the Treasurer’s notice.

For regulated entities and legal advisers. Monitor Treasurer notices in the Government Gazette and the administering Department’s website for unit values and the annual rate (s 5(1)-(3); s 5(8)). Review statutory rules and legislative instruments that govern the services you use to see if they are expressed in fee or penalty units, and track whether conversion regulations have been made under s 9 which may alter nominal charges. Where your organisation holds contracts referencing statutory fees, check whether those contracts specify whether fees are fixed dollar amounts or "as prescribed by" statutory instruments so you can anticipate conversions or indexation effects.

Documentation and audit trails. Maintain contemporaneous records of all notices, Treasurer certifications, and publication steps. These records will be necessary for administrative audits, budget planning, and any legal review over whether notification and calculation obligations have been met.

Risk management and stakeholder communication. If your agency or business faces material revenue or cost changes because of unit conversions or indexation, prepare stakeholder communication plans timed to the Treasurer’s publication deadlines (s 5; s 6). For public-facing fees, ensure consumer-facing materials (web pages, forms, fee schedules) are updated promptly to reflect new dollar amounts derived from unit values, and retain evidence of when and how those updates were made to demonstrate compliance with s 10.

Checklists and operational steps summary.

• Treasurer/finance: set annual rate by 1 March (s 5(4)); publish rate on Department website promptly (s 5(8)); fix unit values and publish in Gazette and widely circulating newspaper before 1 June (s 5(1)-(3); s 6); ensure unit values do not exceed statutory ceiling (s 5(6)-(7)).

• Governor in Council/regulatory drafters: prepare conversion regulations consistent with s 9(1); if relying on Part 2 exemption, secure Treasurer’s written certificate aligned to a specific s 9(2) limb and apply the precise numerical and rounding methods (s 9(2)-(5)).

• Ministers/instrument makers: where legislative instruments or statutory rules provide fees in units, take reasonable steps to notify public or affected sectors of monetary equivalents and keep proof of notification actions (s 10(1)-(2); s 8(1A)).

• Agencies/operational units: update billing and enforcement systems to apply s 7 multiplication and rounding; test systems annually after Treasurer notices; track conversion regulations and transitional rules such as s 11 where applicable.

• Regulated parties: monitor Gazette and Department website notices; review statutory instruments for unit references; check contractual exposure to changed statutory fee amounts.

Following these steps will align practice with statutory requirements and reduce operational, budgetary and legal risk associated with fee and penalty unit calculations, conversions and notifications under the Monetary Units Act 2004.
