sec.82 Subdivision of group title lot by building units plan

If the statement accompanying a group titles plan identifies a group title lot that is proposed to be subdivided by way of a building units plan, the building units plan may be— approved by the local government; and registered by the registrar of titles. The Building Units and Group Titles Act 1980 , section 10 (1A) , does not apply to a subdivision by a building units plan mentioned in subsection (1) . Despite the Building Units and Group Titles Act 1980 , the registration of a building units plan under subsection (1) has effect as if the subdivision by the plan were a subdivision of the original group titles plan. If a building units plan subdivides a lot created by a group titles plan, a further body corporate is not created by registration of the building units plan. For the purposes of the Building Units and Group Titles Act 1980 , the body corporate created by registration of the group titles plan is taken to be the body corporate created by the registration of the building units plan.
