sec.53 Approved scheme regulates development etc. of site
The mixed use scheme regulates the development and use of land within the site. The mixed use scheme modifies any planning scheme in force in relation to the site to the extent the planning scheme is inconsistent with the mixed use scheme. However, the mixed use scheme cannot increase the uses permitted by the planning scheme. Part 5 (Subdivision applications) of the Local Government (Planning and Environment) Act 1990 does not apply to the site. Subdivision of land by-laws made under the Local Government Act 1936 do not apply to the site. By-laws or ordinances made by a local authority under any Act do not apply to the site so far as they are inconsistent with this Act or the scheme. Any land, building or structure may be used within a precinct without the consent of the local government, for any of the purposes set out in the scheme as a permitted use in relation to the precinct. s 53 amd 1999 No. 30 s 98 sch 3 pt 1 (sec.53-ssec.1) The mixed use scheme regulates the development and use of land within the site.
