38 Penalty for offence involving procurement of young child (1) This section applies in relation to an offence against this Act that, under section 43BG or 43BH of the Criminal Code, a person is taken to have committed because the person procured a young child to: (a) commit the offence; or (b) engage in conduct as mentioned in section 43BH(1)(a) of the Criminal Code.

Misuse of Drugs Act 1990 76 (2) Despite section 43BG or 43BH of the Criminal Code, the person is liable to a maximum penalty of life imprisonment for the offence. young child means a person who has not attained the age of
