22 Certain offences may be dealt with summarily (1) Where a person charged with an offence against Part II, Division 1, Subdivision 1, 2 or 3 or section 11Y is liable on being found guilty to a fine or to imprisonment for a term not exceeding 14 years, proceedings in respect of the commission of the offence may be taken summarily. (2) Despite subsection (1), a person who is charged with an offence referred to in section 36A(6) and who could, if found guilty of the offence, be declared under section 36A to be a drug trafficker is not to be tried summarily for the offence.
