19R Presumption on appeal Where: (a) a person who was legally represented before the Local Court on the trial of an offence with respect to a prohibited plant, dangerous drug or precursor pleaded guilty to the charge; (b) an appeal is made against any determination of the Local Court with respect to the offence; and (c) before the appeal is heard: (i) the prohibited plant, dangerous drug or precursor is destroyed under section 19B or 19P or under an order under this Part; or (ii) a substance or thing seized in relation to the offence is destroyed, disposed of or dealt with under section 19PB, any particular in the information as to the nature or quantity of the prohibited plant, dangerous drug, precursor, substance or thing is, for the purposes of the appeal, presumed to be true.
