#### 91 Compensation 91 Compensation (Former clause 74 of 2010 Reg) > > (1) For the purposes of section 265 (3) of the Act, the prescribed period is the period of 28 days beginning on the date on which the mining lease takes effect. > > > (2) For the purposes of section 272 (1) (a) of the Act, the prescribed manner of assessing compensation is by making an assessment that has regard to the following factors— > > > > > (a) the nature, quality, area and particular characteristics of the land concerned, > > > > > (b) the proximity of the land to any building, structure, road, track or other facility, > > > > > (c) the purpose for which the land is normally used, > > > > > (d) the use of the land that is approved under any development consent that is in force in respect of the land.
