#### 75 Ancillary mining activities 75 Ancillary mining activities > > (1) The Minister may, by order in writing, direct that— > > > > > (a) a specified ancillary mining activity be carried out in accordance with any condition specified in the order, or > > > > > (b) the carrying out of a specified ancillary mining activity be discontinued for such period as is specified in the order. > > > (1A) Subsection (1) (b) does not apply to an ancillary mining activity specified in a mining lease granted in respect of an ancillary mining activity or activities only. > > > (2) An order takes effect on the date on which written notice of the order is served on the holder of the mining lease concerned or on such later date as may be specified in the notice. > > > (3) A person on whom an order is served must not contravene the order. > > > > Maximum penalty—100 penalty units. > > **s 75:** Am 1996 No 137, Sch 1 \[68\]; 2000 No 90, Sch 1.1 \[5\]; 2017 No 27, Sch 1 \[5\] .
