#### 393 Declarations that certain persons are not fit and proper persons for authorisations 393 Declarations that certain persons are not fit and proper persons for authorisations > > (1) If the decision-maker is satisfied that a relevant person is not a fit and proper person, the decision-maker may, by written order given to the person, declare that the person is not a fit and proper person (a declared person). > > > (2) The decision-maker may make a declaration at any time, including at the request of the Minister or on the decision-maker’s own initiative. > > > (3) The decision-maker may, without limiting other matters that can be taken into consideration, take into consideration matters specified by the regulations for the following purposes— > > > > > (a) deciding whether a person is or is not a fit and proper person, > > > > > (b) deciding whether to make a declaration. > > **s 393:** Ins 2022 No 21, Sch 1\[152\].
