#### 378U Recovery of costs of lodging caveat 378U Recovery of costs of lodging caveat > > (1) A person or public authority who lodges a caveat in respect of land to which a restraining order applies under section 378S may, by written notice, require the defendant to pay all or any of the reasonable costs and expenses incurred by the person or authority in respect of the lodgment and registration of the caveat (including the costs of withdrawal of the caveat). > > > (2) The person or public authority may recover from the defendant any unpaid amounts specified in the notice as a debt in a court of competent jurisdiction. > > **pt 17A, div 3 (ss 378L–378X):** Ins 2008 No 19, Sch 1 \[258\].
