Mines and Works Inspection Regulations 2013

Definitions and role allocation: The Regulations begin by defining terms and allocating roles. Chief Inspector and Director are identified, authorised persons are those authorised under section 7 of the Act, and a competent person is defined by qualification through experience, training, or both (r 3). “Owner” is the liable person on whom many duties fall; the Regulations make explicit that, for workforce counts, the owner is not included but contractors working in the mine are included (r 3(2)). Several cross‑references tie meaning to other Acts; “petroleum” and “precious stones” adopt the meanings provided in other South Australian statutes (r 3).

Approval and notice regime: A threshold approval rule requires written approval from the Chief Inspector or a designated person before preparing a new deposit, opening or reworking an old mine, or constructing plant for treatment of mineral at the site (r 7(1)). The owner must give at least 21 days written notice with sufficient detail to enable decision‑making (r 7(2)). That approval requirement is not universal; it expressly does not apply to mining under a Mining Act 1971 lease or licence, precious stones recovery on a precious stones field, or petroleum recovery (r 7(3)). A separate short notice obligation requires owners to notify the Chief Inspector within three business days following acquisition (of a working mine), commencement of work, or recommencement after cessation (r 8(1)). The Regulations define “cessation of work” to exclude holidays, repairs, and industrial action (r 8(2)).

Plans, programs and documentation standards: The Chief Inspector may require accurate maps, plans, sections, and development programs (r 9(1)). When required, the owner must prepare them to the Chief Inspector’s requirements and Schedule 2 standards, deliver three copies to the Chief Inspector, and keep the original or an accurate copy at the mine office (r 9(2)(a)-(c)). Updating rules require maps and plans to be refreshed at intervals not exceeding seven years and immediately before abandonment, with three copies delivered and an original retained (r 9(2)(d)(i)). Development programs must be updated at intervals not exceeding seven years or on a period the Chief Inspector directs (r 9(2)(d)(ii)). The Regulations state that work adversely affecting amenity cannot be carried out until the Chief Inspector approves the development program or gives specific approval (r 9(4)), and operators must not carry out work contrary to a development program (r 9(5)).

Inspection facilitation and equipment duties: Owners must facilitate inspections by allowing mechanical lowering or raising into shafts, providing access to all parts of mines and plant, and doing all necessary things to enable an inspection (r 10). Owners must provide and maintain materials and equipment necessary to comply with the Regulations and ensure they are used appropriately (r 11(1)). Contractors are subject to the same duty for the part of the mine they operate in (r 11(2)). Inspectors can inspect documents at reasonable times and require production of those documents (r 9(6)-(7)).

Environmental and amenity duties: Part 3 sets substantive obligations. General duties require operations to minimise interference with amenity, avoid unnecessary damage to vegetation within and around site, avoid creating nuisance from undue noise or dust, and prevent degradation of sea, groundwater, or water bodies (r 12). Topsoil must be separated and stored to maximise usefulness for rehabilitation and protected from erosion (r 13). Operators must not place overburden, waste, dams or materials so as to interfere with drainage, cause damage, unduly interfere with amenity or permit water degradation (r 14(1)). There are further duties on avoiding air pollution from release of material, taking steps to avoid erosion, and minimising groundwater degradation where operations intersect aquifers of different quality (r 14(2)-(5)). Owners must provide decommissioning notices at completion, at removal of plant and materials, and when land has been rehabilitated (r 15). Owners must leave sites clean, tidy, stable and safe (r 16) and rehabilitate properly within two years of cessation of work, in accordance with any directions of the Chief Inspector (r 17).

Enforcement and exemptions: Contraventions attract a maximum penalty of $1,000 (r 19(1)). Owners have specific statutory responsibility to ensure compliance and are penalised for failures by themselves or others, and must not knowingly allow contraventions (r 19(2)-(4)). The Chief Inspector may grant exemptions where compliance is unnecessary, impractical or undesirable or where a satisfactory alternative procedure will be adopted, subject to conditions and revocation if conditions are contravened or circumstances change (r 18).

Prescribed plan content: Schedule 2 prescribes the content and format of locality plans, working plans, and development programs, including scale, contours, identification of utilities, existing infrastructure, boreholes, bench floors and slopes, dams, overburden dumps, proposed situations for specified years, methods of operation, pollution prevention measures and progressive rehabilitation methods (Schedule 2).

Together these concepts create a framework in which administrative approval, documentation, inspection and environmental standards are linked through the Chief Inspector’s powers and a set of specific obligations on owners and contractors.

Primary regulated persons: The Regulations place primary duties on the owner of the mine. The owner must obtain approvals where required (r 7(1)), give statutory notices on acquisition/commencement/recommencement (r 8(1)), comply with document production and updating requirements (r 9(2)), facilitate inspections (r 10), provide equipment (r 11), discharge environmental and amenity duties (rr 12-14), give decommissioning notices (r 15), rehabilitate within two years (r 17), and ensure overall compliance with these regulations under criminal penalty exposure (r 19(2)-(4)). The owner is also the person who will ordinarily seek approvals, apply for exemptions and receive notices from the Chief Inspector.

Contractors: Contractors operating within a mine are explicitly placed under duties for the parts of the mine in which they operate. Regulation 11(2) makes contractors responsible for providing and maintaining the equipment necessary to comply with the Regulations in their working areas and to ensure appropriate use for persons under their authority. Regulation 3(2) provides that contractors are to be counted for workforce computations, whereas the owner is excluded.

Inspectors and authorised persons: Inspectors and authorised persons perform oversight and inspection functions. The Regulations define an authorised person as someone authorised under s 7 of the Act (r 3) and grant inspectors powers to inspect and examine documents kept at a mine at reasonable times (r 9(6)-(7)). Regulation 10 imposes on owners a duty to facilitate inspections by authorised persons.

Chief Inspector and designated persons: The Chief Inspector is the central decision-maker under these Regulations. The Chief Inspector may grant or refuse approvals described in r 7, designate persons to give approvals (r 7(4)), serve notices requiring plans and programs (r 9(1)), approve development programs or specific works (r 9(4)), exercise the exemption discretion and impose conditions or revoke exemptions (r 18), and issue directions relevant to rehabilitation (r 17). The Chief Inspector also receives notices required by r 8 and documents required by r 9.

Other statutory regimes and agencies: The Regulations reference other Acts and regimes whose holders or operators may therefore be affected indirectly. The approval requirement in r 7 does not apply where mining is being carried out under a Mining Act 1971 lease or licence, for recovery of precious stones on a precious stones field under the Opal Mining Act 1995, or for recovery of petroleum (r 7(3)). The definitions for “petroleum” and “precious stones” adopt meanings in other Acts (r 3). Transitional provisions reference the South Australian Civil and Administrative Tribunal where a right to review is affected (Mines and Works Inspection (SACAT) Variation Regulations 2018, Sch 1).

Third parties and neighbours: The duties in Part 3 are framed to protect amenity and surrounding environment. Those duties therefore affect landowners and occupiers in the vicinity by creating a statutory obligation on operators not to unduly interfere with vegetation (r 12(2)), not to create a nuisance from noise or dust (r 12(3)), and not to permit degradation of water bodies (r 12(4), r 14). Owners must also avoid placing overburden, waste or structures that interfere with natural drainage or cause damage (r 14(1)). These are duties that operate in relation to neighbouring land and public resources.

Persons preparing plans and programs: Where the Chief Inspector issues a notice under r 9(1), persons preparing maps, plans, sections or development programs must conform to technical standards in the notice and the requirements of Schedule 2, including scale, contour intervals, and specific content such as borehole positions and proposed rehabilitation stages (r 9(2)(a), r 9(3), Sch 2). The Regulations also require that such documents be prepared by competent persons, a term defined in r 3.

Who bears regulatory risk: The owner carries primary regulatory and criminal exposure under r 19(2)-(4). If another person causes a contravention, both the person and the owner may be guilty of an offence (r 19(3)). The owner must not knowingly allow contraventions (r 19(4)). The General defence provision r 20 provides some protection where the accused proves the matter related to something beyond their control and beyond what they could reasonably have been expected to control, but the onus is on the accused to establish that defence.

Operational managers and mine offices: The Regulations require originals or accurate copies of plans and programs to be kept at the mine office (r 9(2)(c)). This places document custodial responsibilities on mine managers or their equivalent, although the Regulations have had terms like “manager” varied or deleted in amendments recorded in the legislative history.

In short, the Regulations allocate responsibility and legal exposure primarily to owners, allocate operational responsibility to contractors for their working areas, give the Chief Inspector central administrative control, and create duties that affect neighbouring landholders and public environmental interests.

Owners’ duties: The Regulations impose many express duties on the owner of a mine. These include obtaining written approval before preparing or developing a new deposit, opening or reworking old mines, or constructing processing plant at the site unless the activity is excepted (r 7(1)-(3)); furnishing the Chief Inspector with a notice within three business days after acquisition, commencement or recommencement (r 8(1)); preparing and delivering maps, plans, sections and development programs when required by the Chief Inspector, meeting the requirements in r 9 and Schedule 2, delivering three copies to the Chief Inspector and retaining originals at the mine office (r 9(1)-(3), Sch 2); not carrying out any work that adversely affects amenity until the Chief Inspector approves the development program or gives specific approval (r 9(4)); ensuring maps, plans and programs are updated at intervals not exceeding seven years and immediately before abandonment, and delivering updated copies (r 9(2)(d)); ensuring inspectors have access and are facilitated during inspections including mechanical lowering and access to plant and machinery (r 10); providing and maintaining materials and equipment necessary to comply with the Regulations and ensuring they are used appropriately (r 11(1)); complying with amenity, vegetation, noise, dust and water protection duties (r 12); conserving topsoil for rehabilitation and protecting stored topsoil from undue erosion (r 13); avoiding placement of waste or overburden that interferes with drainage, causes damage or degrades water (r 14(1)); taking reasonable action to avoid erosion (r 14(3)) and minimising groundwater degradation where aquifers are intersected (r 14(5)); furnishing decommissioning notices and rehabilitating in a clean, tidy, stable and safe condition and rehabilitating within two years after cessation of work in accordance with Chief Inspector directions (rr 15-17); and ensuring overall compliance with the Regulations (r 19(2)).

Contractor duties and scope: Contractors operating in a mine have the same duty as the owner under r 11(1) for the part of the mine in which the contractor operates and for persons under the contractor’s authority (r 11(2)). Regulation 3(2) makes clear that contractors count in workforce computations. If an act or default resulting in non‑compliance is committed by a person other than the owner, both that person and the owner may be guilty of an offence (r 19(3)), so owners and contractors face shared exposure depending on who performs the non‑compliant act.

Inspection rights and owner obligations to facilitate: Inspectors and authorised persons may inspect and examine any map, plan, section or program kept at a mine at any reasonable time (r 9(6)) and may require production of such documents from those who have possession, custody or control (r 9(7)). Owners must facilitate inspections through mechanical lowering or other transport within workings, ensure access to all parts of the mine and plant, and do all things necessary to enable inspection (r 10).

Chief Inspector discretions and rights: The Chief Inspector can require preparation of plans and programs by notice (r 9(1)), approve development programs and specific works (r 9(4)), grant approvals under r 7 for opening or reworking mines and construction of treatment plants (r 7(1)-(2)), designate persons to issue approvals (r 7(4)), grant exemptions from the operation of a regulation where compliance is unnecessary, impractical or undesirable or where a satisfactory alternative will be adopted (r 18(1)(a)-(b)), impose conditions on exemptions (r 18(2)), and revoke exemptions where conditions are contravened or circumstances alter (r 18(3)). The Chief Inspector also receives the three copies of plans or updated documents and retains authority to direct rehabilitation under r 17.

Rights to exemption and conditions: A regulated person may apply for and the Chief Inspector may grant an exemption under r 18. Exemptions can be conditioned and are revocable. The Regulations do not prescribe an application form or process in the text provided, but r 18 creates discretion to exempt classes or persons and to impose limitations.

Duty not to carry out work inconsistent with development program: An explicit duty is that owners must not carry out, or allow to be carried out, work that is contrary to or inconsistent with a relevant development program (r 9(5)). They must also not carry out work that adversely affects amenity unless the Chief Inspector has approved the development program or given specific approval (r 9(4)). The combination of these rules gives the Chief Inspector a gatekeeping role over activities that materially affect amenity.

Documentation duties and retention: When the Chief Inspector issues a notice under r 9(1), owners must ensure the documents conform to the notice and Schedule 2, deliver 3 copies to the Chief Inspector, and keep the original or accurate copy at the mine office (r 9(2)(a)-(c)). Maps, plans and sections must be updated at intervals not exceeding seven years and immediately before abandonment, with three copies provided to the Chief Inspector and originals retained (r 9(2)(d)(i)-(ii)). The Schedule prescribes required content for locality plans, working plans and development programs and requires scales, contour intervals and specific detail such as borehole positions, utilities, storage locations and proposed reclamation stages (Schedule 2).

Offences, penalties and defences: Contravention of any provision of the Regulations is an offence carrying a maximum penalty of $1,000 (r 19(1)). Owners must ensure compliance and risk the same maximum penalty (r 19(2)). If someone other than the owner causes non‑compliance, both that person and the owner are guilty of an offence (r 19(3)), and the owner must not knowingly allow contraventions (r 19(4)). Regulation 20 provides a general defence that the accused can prove the offence relates to a matter over which they did not have control and could not reasonably have been expected to have control.

Administrative rights to inspect documents and enforce: Inspectors have the right to inspect documents at reasonable times (r 9(6)-(7)), and the owner must facilitate inspections physically (r 10). The Chief Inspector’s power to issue notices requiring plans and to approve or refuse activities and development programs is an administrative power that underpins enforcement, including potential revocation of exemptions (r 18).

Collectively the duties allocate operational responsibility for safety, environmental protection and documentation to owners and contractors, while vesting significant administrative discretion and oversight with the Chief Inspector.

Offence structure and monetary cap: Regulation 19 states that failure to comply with any provision of these Regulations is an offence, with a maximum penalty of $1,000 (r 19(1)). The owner’s duty to ensure compliance is separately identified and carries the same maximum penalty (r 19(2)). Regulation 19(3) provides that if a contravention is committed by a person other than the owner, both that person and the owner may be guilty of an offence. Regulation 19(4) makes it an offence for an owner to knowingly allow or permit a person to contravene a provision, with a maximum penalty of $1,000. The text sets monetary exposure in absolute terms without adding tiers, injunctions, administrative monetary penalties, or higher criminal sanctions in the document itself.

Enforcement mechanics through documentation and inspections: The Regulations create a compliance architecture where enforcement is supported by documentation and inspection powers. The Chief Inspector can require preparation of maps, plans, sections and development programs and set technical requirements (r 9(1)-(3); Schedule 2). Inspectors and authorised persons may inspect and examine such documents kept at a mine at any reasonable time (r 9(6)) and may require production from those who have possession, custody or control (r 9(7)). Regulation 10 obliges owners to facilitate inspections materially, including mechanical lowering into shafts and ensuring access to all parts of the mine and plant (r 10(a)-(c)). These provisions operationalise enforcement by making it easier for inspectors to establish non‑compliance through direct observation and document review.

Shared liability and allocation of fault: The Regulations make clear that liability can be shared between the owner and the acting party. If a contravention arises from an act or default by a person other than the owner, both the person and the owner are guilty of an offence (r 19(3)). This creates a legal mechanism to hold owners responsible for acts performed by contractors or other persons in the mine unless a statutory defence applies. Regulation 19(4) adds an express duty on the owner not to knowingly allow contraventions.

Available defence: Regulation 20 provides a statutory general defence. It states that it is a defence for an accused to prove the offence relates to a matter over which the accused did not have control and could not reasonably have been expected to have control. The onus is on the accused to establish that defence. This is a limited, fact‑sensitive defence that can mitigate liability where a failure is caused by factors genuinely beyond an accused’s reasonably expected control.

Exemption and conditional compliance: Regulation 18 permits the Chief Inspector, in their discretion, to exempt persons or classes from the operation of a regulation where compliance is unnecessary, impractical or undesirable or where a satisfactory alternative procedure or installation will be adopted (r 18(1)). Exemptions can be conditional (r 18(2)) and are revocable if a condition is contravened or circumstances alter (r 18(3)). The exemption power thereby creates a compliance pathway where some regulated obligations can be modified administratively, subject to conditions and revocation, which interacts with enforcement insofar as a contravention occurring under an active exemption is not an offence provided the exemption conditions are met.

Administrative remedies and directions: The Regulations empower the Chief Inspector to approve or refuse development programs and specific works (r 9(4)). The Chief Inspector may also issue directions relating to rehabilitation (r 17). Those administrative powers function as remedial and preventive enforcement tools: refusal or conditional approval can halt activities adverse to amenity, and directions can be used to require remedial action, with contraventions attracting the statutory penalty if directions or conditions are not followed.

Practical enforcement signals in the text: The text prescribes tight procedural obligations that facilitate detection of non‑compliance. Short timeframes for notice (21 days ahead for some activities r 7(2); three business days for acquisition or commencement r 8(1)), the three‑copy delivery requirement for documents (r 9(2)(b)), requirement to keep originals at the mine office (r 9(2)(c)), and periodic updating of maps and programs (r 9(2)(d)) combine to create predictable points at which the Chief Inspector can review and inspect. Regulation 10’s obligation to mechanically lower or raise inspectors and ensure full access materially reduces the chance that non‑compliance can be concealed.

Limitations in sanction design: The Regulations provide a single monetary maximum penalty figure of $1,000 for all contraventions and owner liabilities (r 19). There are no higher penalties, daily fines, or explicit corrective notice/administrative penalty mechanisms set out in the Regulations text provided. The presence of a relatively modest maximum penalty and an administrative exemption power (r 18) are design features that shape enforcement incentives: inspectors rely on document review, approvals and access powers, and the legal remedy for breach is nominal monetary sanction unless other regimes apply.

Interaction with other enforcement regimes: The Regulations themselves do not set out civil enforcement remedies such as injunctions, but the Chief Inspector’s approval and direction powers and the statutory offence framework provide administrative leverage. The Regulations also expressly exclude certain activities subject to other Acts from the approval regime (r 7(3)), which means enforcement responsibilities for those activities will in practice be shaped by the parallel statutory regimes under which they fall.

In short, enforcement relies on document obligations, inspection facilitation, an administrative approval and exemption architecture vested in the Chief Inspector, and criminal penalties capped at $1,000 for contraventions, with a limited statutory defence where lack of control can be established.

Cross‑references to primary Acts and excluded activities: The Regulations operate under the Mines and Works Inspection Act 1920 (the Act). They expressly exclude certain activities from the approval requirement in regulation 7(3): mining operations carried out under a lease or licence under the Mining Act 1971, recovery of precious stones on a precious stones field under the Opal Mining Act 1995, and recovery of petroleum under its relevant Act (r 7(3)). The definitions in regulation 3 adopt terms from other Acts: “petroleum” is given the same meaning as in the Petroleum and Geothermal Energy Act 2000; “precious stones” and “precious stones field” adopt the Opal Mining Act 1995 definitions (r 3). Those cross‑references show that the Regulations are intended to sit alongside, and defer in part to, other sectoral statutes.

Administrative review and tribunal jurisdiction in transitional provisions: The legislative history records transitional provisions in the Mines and Works Inspection (SACAT) Variation Regulations 2018 which reallocated the right of review of a decision of the Chief Inspector under an earlier clause to the South Australian Civil and Administrative Tribunal (SACAT) established under the South Australian Civil and Administrative Tribunal Act 2013 (Mines and Works Inspection (SACAT) Variation Regulations 2018, Sch 1). That transitional note indicates that decisions under the regulatory scheme may be amenable to administrative review under tribunal jurisdiction where provided by the enabling variation. The Regulations’ text itself does not set out internal merits review but the legislative history shows administrative review pathways have been a matter of statutory amendment.

Overlap and division of regulatory responsibilities: The Regulations create duties that overlap with environmental protection, planning, and water laws. For example, r 12(4) and r 14(1)(d)-(5) regulate degradation of the sea, groundwater, rivers and other water bodies. Where other environmental legislation provides detailed permitting, water quality standards, wastewater discharge limits or pollution offences, those regimes will operate concurrently. The Regulations do not preclude other regulatory action; they set obligations specific to mines under the Act but their water and pollution duties sit alongside general environmental protection laws. Similarly, the exclusion in r 7(3) means that mining activities authorised under a Mining Act 1971 lease or licence are governed by that licensing framework for the conduct of mining operations, potentially including planning and environmental approvals in that regime.

Interaction with land title and property rights: Schedule 2 requires plans to show boundaries of sections and allotments and the names and addresses of occupiers and owners (Sch 2 cl 1(1)(a)-(c)). This creates a point of intersection with land title records and local government planning processes. Obligations to avoid interfering with natural drainage, causing damage to property, or unduly interfering with amenity (r 14(1)(a)-(c)) create duties that have consequences under private law (nuisance, negligence) even though the Regulations themselves prescribe administrative and criminal sanctions.

Consistency with safety and mines regulation: The Regulations require owners to provide and install materials and equipment necessary to enable compliance with these regulations and to maintain them in good condition (r 11). That duty will be read alongside safety provisions in the Act and potential other occupational health and safety laws that apply to mining operations. The Regulations also make documents available to inspectors and require mechanical facilitation of inspections (r 10 and r 9(6)-(7)), which integrates with the statutory inspection apparatus under the Act.

Legislative revision and publication framework: The legislative history notes that references in legislation to other legislation, instruments or office titles are not automatically updated by the revision and publication program (Legislative history notes). It also notes deletions and variations of particular provisions across regulations published in the Gazette and indicates that certain provisions have been omitted under the Legislation Revision and Publication Act 2002. Those procedural interactions indicate that the text of the Regulations may be edited administratively over time and that care should be taken to consult current consolidated versions and the primary Acts for up‑to‑date cross‑references.

Tribunal and appeal processes: The transitional provisions recorded indicate that rights to review certain Chief Inspector decisions have been redirected to the South Australian Civil and Administrative Tribunal under the SACAT Act for decisions that would otherwise have gone to a Ministerial review under a former clause. This indicates an administrative law pathway for review of certain regulatory decisions, the scope of which is governed by the amendments recorded in the legislative history rather than by the Regulations’ operative text alone.

In summary, the Regulations integrate with other South Australian mining, opal/precious stones, petroleum and administrative law regimes by means of explicit exclusions, cross‑definitions and legislative amendments that reallocate review jurisdiction. They create an overlay of mine‑specific documentation, inspection and environmental duties that sit alongside other statutory regimes rather than wholly displacing them.

Overview of principal instruments and revocations: The Mines and Works Inspection Regulations 2013 are recorded in the legislative history as having revoked the Mines and Works Inspection Regulations 1998. The principal regulations and subsequent variations are listed with Gazette references and commencement dates. The Regulations came into force with the principal instrument listed as 2013 No 222, Gazette 29.8.2013 p3715, with commencement on 1.9.2013 for r 2 (Legislative history).

Subsequent variations and their commencement: The legislative history lists multiple amending instruments and commencement dates. Notably:

• 2014 No 101 (Gazette 19.6.2014 p2557), commenced 1.7.2014.
• 2014 No 256 (Gazette 30.10.2014 p6224), commenced 30.10.2014.
• 2015 No 116 (Gazette 18.6.2015 p2696), commenced 1.7.2015.
• 2016 No 143 (Gazette 23.6.2016 p2375), commenced 1.7.2016.
• 2017 No 164 (Gazette 22.6.2017 p2440), commenced 1.7.2017.
• 2018 No 90 (Gazette 21.6.2018 p2221), commenced 1.7.2018.
• 2018 No 182 (Gazette 28.6.2018 p2654), commenced 4.10.2018 for r 2.
• 2019 No 65 (Gazette 13.6.2019 p1845), commenced 1.7.2019.
• 2020 No 84 (Gazette 4.6.2020 p2845), commenced 1.7.2020.
• 2020 No 301 (Gazette 19.11.2020 p5195), commenced 1.1.2021 for r 2.

These entries show a sequence of periodic revisions and targeted variations to the principal Regulations.

Specific provision variations and deletions: The legislative history records particular provisions that were varied or deleted by later instruments. Examples recorded include:

• Part 2 Division 1 was deleted by 301/2020 r 5, commencing 1.1.2021.
• Regulation 3 had several changes: r 3(1) entries were varied and some terms like Board of Examiners and manager were deleted in certain amendments (256/2014 r 4; 301/2020 r 4(1)).
• Regulation 8(1) was varied by 301/2020 r 6, commencing 1.1.2021.
• Regulation 10 was varied by 301/2020 r 7, commencing 1.1.2021.
• Regulation 19(4) was varied by 301/2020 r 8, commencing 1.1.2021.
• Schedule 1 was substituted by 256/2014 r 5 on 30.10.2014 and subsequently Sch 1 and other Schedules were deleted or substituted across later amendments.

Transitional provisions and reallocation of review rights: The Mines and Works Inspection Variation Regulations 2014 included a transitional provision stating that a member of the Board of Examiners for Mine Managers ceases to hold office on commencement of the 2014 regulations (Pt 3). The SACAT variation in 2018 included transitional provisions that a right to apply to the Minister for review of a decision of the Chief Inspector under a prior clause would be exercised as if the revised clause had been in operation so that proceedings could be commenced before the Tribunal rather than the Minister (Mines and Works Inspection (SACAT) Variation Regulations 2018, Sch 1). The transitional clause preserved proceedings already commenced before the relevant day.

Effect of amendments on regulatory language and roles: The legislative history notes deletion or variation of certain role references and clauses, such as deletion of the Board of Examiners references and manager references and the omission of certain parts under the Legislation Revision and Publication Act 2002. These changes indicate an administrative updating of roles and references, but the Regulations as provided do not include the text of prior versions, so the history shows where specific textual changes have been made (Legislative history: Provisions varied).

Schedule amendments: Schedule 2 and other schedules were subject to substitutions and deletions across multiple amending instruments. The legislative history lists the various acts that substituted or deleted different schedules across 2014-2020 and indicates that Schedule 3 and Schedule 4 were substituted or deleted at different times. The current Schedule 2 content included in the Regulations reflects the consolidated position after these amendments, but the history makes clear schedules have been a locus of change.

Practical reading for users: The legislative history section includes a note advising readers that references to other legislation or offices are not automatically updated under the revision program and may be obsolete. It also lists historical versions and the dates for consolidated versions (1.7.2014, 30.10.2014, 1.7.2015, 1.7.2016, 1.7.2017, 1.7.2018, 4.10.2018, 1.7.2019, 1.7.2020). Practitioners should therefore be careful to check the consolidated text and any amending instruments relevant to their target timeframe.

Implications of the amendment pattern: The pattern of frequent variations, deletions and substitutions shows an active regulatory maintenance regime. Deletions of particular clauses, transfers of review rights to SACAT and deletions of role references like manager and Board of Examiners indicate periodic reconfigurations of administrative structures rather than wholesale changes to the core duties in Part 3. The legislative history therefore provides a roadmap to particular changes and their commencement dates, which is essential for historical compliance checks and for determining which version applied at a particular time.

In sum, the amendment history records multiple, incremental changes across 2013-2021, affecting roles, specific procedural provisions and schedules, with transitional provisions moving some review functions to SACAT and administrative deletions or substitutions of schedule content.

No cases or judicial decisions are named or recorded in the text provided. The Regulations themselves do not include a section listing litigation or case law. The legislative history records amendments, substitutions and deletions but does not record any judicial interpretation or decisions arising from these Regulations.

Consequences of an absence of recorded litigation in the instrument: The absence of judicial authorities in the Regulations means that primary interpretative guidance about ambiguous or contested provisions will need to be developed through administrative decisions by the Chief Inspector, tribunal review where applicable, or through future court decisions. The legislative history records that review rights under a prior clause were reallocated to the South Australian Civil and Administrative Tribunal (SACAT) via variation regulations in 2018, indicating that some administrative decisions may be subject to merits review by the Tribunal. That suggests SACAT decisions about Chief Inspector actions could become a major source of interpretative authority even where the Regulations themselves do not cite any litigation.

Tribunal and administrative review pathway noted in transitional provisions: The Mines and Works Inspection (SACAT) Variation Regulations 2018 contain transitional provisions specifying that a right to apply for review of a decision of the Chief Inspector under an earlier clause will be exercised before SACAT rather than the Minister, with savings for proceedings already commenced (Mines and Works Inspection (SACAT) Variation Regulations 2018, Sch 1). That indicates a potential administrative review avenue and suggests that tribunal decisions, rather than superior court decisions, may be the earlier locus of authoritative rulings about the Chief Inspector’s exercise of discretion.

Practical implication for practitioners: In the absence of reported litigation in the statutory text, practitioners should expect that interpretative disputes about the Regulations will be decided in administrative reviews or in the course of unreported enforcement actions before relevant bodies. For contentious points, such as the scope of the Chief Inspector’s discretion to grant exemptions under r 18, the content required under Schedule 2, or the reach of the general defence in r 20,expect that initial authoritative statements will come from enforcement agencies or SACAT decisions rather than from high court precedent.

Records and research: Because the legislative history and the Regulations do not list litigation, researchers or practitioners looking for interpretative guidance should consult SACAT decisions, the records of the Department that administers the Act, and any published enforcement notices or decisions by the Chief Inspector. They should also check consolidated legislation databases and the Gazette notices referenced in the legislative history for context on amendments that may have been in dispute.

In short, the instrument as provided contains no litigation history; administrative and tribunal review mechanisms recorded in the legislative history make SACAT an expected early forum for disputes about decisions under the Regulations.

Short notice and tight timeframes: The Regulations impose several short statutory deadlines that can catch owners and operators unprepared. Regulation 8 requires the owner of a mine to notify the Chief Inspector within three business days after acquisition of a working mine, commencement of work, or recommencement after cessation (r 8(1)). Regulation 7 requires at least 21 days’ notice before preparing or developing a new deposit, opening or reworking an old mine, or commencing construction of a building or plant for mineral treatment (r 7(2)). Failure to meet these timelines exposes the owner to the statutory offence regime with a maximum penalty of $1,000 (r 19(1), (2)). The definition of “cessation of work” excludes holidays, repairs and industrial action (r 8(2)), which can affect the application of the recommencement notice obligation.

Owner liability for third party acts: The Regulations make owners strictly responsible to ensure compliance in multiple ways. If a contravention is committed by another person, both that person and the owner can be guilty of an offence (r 19(3)). Owners must not knowingly allow contraventions (r 19(4)). That means owners retain regulatory exposure for acts by contractors and subcontractors even where the owner did not themselves perform the offending act. The general defence in r 20 is narrow and requires proof that the matter was outside the accused’s control and could not reasonably have been expected to be controlled by them.

Document production and copy obligations: When a notice is issued under r 9(1), owners must prepare documents in accordance with Schedule 2, deliver three copies to the Chief Inspector, and keep the original or an accurate copy at the mine office (r 9(2)(a)-(c)). Failure to keep originals on site or to deliver the required number of copies can be a technical non‑compliance ground. The Schedule mandates specific content and contour intervals and requires plans to show not less than a specified number of metres outside mine boundaries (Sch 2 cl 1(1)). Practitioners should note these technical form requirements are enforceable obligations.

Work that may be delayed by approval rules: Regulation 9(4) forbids carrying out work that adversely affects or is likely to adversely affect the amenity of the site until the Chief Inspector has approved the development program or given a specific approval. Work that is inconsistent with a development program is prohibited (r 9(5)). These rules can delay redevelopment or rehabilitation works until the Chief Inspector completes review and approval. If the owner commences prohibited work, that is a contravention actionable under r 19.

Exemption process is discretionary and revocable: While r 18 permits exemptions where compliance is unnecessary, impractical or undesirable, or where satisfactory alternatives are to be adopted, the power is discretionary and not an entitlement. Exemptions can be granted subject to conditions and may be revoked if conditions are contravened or circumstances alter (r 18(1)-(3)). Relying on an expectation of exemption without having a formal grant in writing risks enforcement action.

Rehabilitation time limit and Chief Inspector directions: Owners must rehabilitate within two years after cessation of work in accordance with any directions of the Chief Inspector (r 17). The combination of a fixed two‑year timeframe and an open‑ended direction power means owners need to plan for timely rehabilitation and be ready to follow specific remediation directions. Failure to rehabilitate within the statutory period or not to follow directions could trigger the offence provisions.

Overlap with other statutory regimes: The approval exclusion in r 7(3) for activities under the Mining Act 1971, Opal Mining Act 1995 and petroleum recovery suggests owners must map which regulatory pathway governs their operation. Misunderstanding which regime applies may result in missed obligations under these Regulations or under the other statutory regime. For example, an operator who assumes an activity is covered by a Mining Act licence and therefore not subject to r 7 might still be caught by other obligations in these Regulations, such as the environmental duties in Part 3.

Physical facilitation obligations: Regulation 10 requires owners to cause inspectors to be lowered into or raised from a shaft, or otherwise mechanically transported within workings, and to ensure access to all parts of the mine, plant and machinery (r 10(a)-(b)). Practical issues such as the availability of working shafts, elevators, or safe transport for inspectors, and the health and safety requirements for allowing third parties into workings, need operational planning. Failure to facilitate inspections or to provide safe means of mechanical access can create conflict between safety and the statutory facilitation duty.

Low maximum penalty relative to potential harms: The Regulations set a maximum penalty of $1,000 for contraventions (r 19). Practitioners should note that while the monetary exposure per these Regulations is capped at that figure, other statutes (environmental protection, water, or safety laws) may impose higher penalties. The low figure in these Regulations does not preclude concurrent enforcement under other Acts.

Technical specification in Schedule 2: Schedule 2 prescribes detailed technical requirements for plans, including contour intervals not exceeding 3 metres, identification of utilities and protected sites, showing bench floors and slopes, and proposed situations for specified years (Sch 2). Failure to meet the technical standards in Schedule 2 when a notice requires plans can be a compliance breach. Preparing such plans may require competent technical consultants and surveying, with associated time and cost.

Record keeping at the mine office: Owners must keep originals or accurate copies of required plans and programs at the mine office (r 9(2)(c)). For operations without a permanent on‑site office or where site management is remote, compliance may require additional administrative arrangements.

Counting contractors as workers and excluding owner: For purposes of computing the number of persons working in a mine, the owner is not included but a contractor is included if the contractor is working in the mine (r 3(2)). This can affect thresholds in other regulatory regimes or in internal policies that depend on workforce size. Failure to account correctly could affect compliance with other statutory obligations.

In summary, the practical “gotchas” are tight notice and document timelines, owner liability for third‑party acts, technical plan requirements, facilitation logistics for inspections, potential overlap with other legal regimes, the conditional and revocable nature of exemptions, and the two‑year rehabilitation deadline.

Assign regulatory responsibilities and governance: The owner should designate a responsible officer for compliance with these Regulations who maintains contact with the Chief Inspector and ensures documentation, notices and approvals are managed in the required timeframes. Given the owner carries primary exposure under r 19(2)-(4), that officer should have authority to ensure contractors and site staff comply with duties including equipment provision, facilitation of inspections and environmental controls.

Notifications and approvals: Put formal processes in place to ensure:

• For activities in r 7(1) (preparing or developing a new deposit, opening/reworking an old mine, or starting construction of plant for mineral treatment at the site), provide the Chief Inspector or designated person with written notice at least 21 days before the proposed activity and include sufficient detail to enable a decision (r 7(2)). Obtain written approval before commencing work.
• On acquisition of a working mine, commencement of work, or recommencement after cessation, furnish the Chief Inspector with a written notice within three business days setting out name and address of owner, situation of the mine, the mineral/substance mined, and estimated number of persons employed (r 8(1)(d)-(g)). Ensure internal workflows capture acquisitions and recommencements promptly, and understand that “cessation of work” excludes holidays, repairs and industrial action (r 8(2)).

Plans, programs and document management: Where the Chief Inspector serves a notice under r 9(1):

• Engage competent persons to prepare accurate maps, plans, sections and development programs in accordance with the notice and Schedule 2 (r 9(2)(a); r 3 definition of competent person; Sch 2).
• Deliver three copies of each map, plan, section or program to the Chief Inspector’s principal office within the time required by the notice, retain originals or accurate copies at the mine office (r 9(2)(b)-(c)).
• Ensure maps, plans and sections are updated at intervals not exceeding seven years and immediately before abandonment, and that development programs are updated at intervals not exceeding seven years (or other period as the Chief Inspector determines), with three copies delivered and originals retained (r 9(2)(d)(i)-(ii)).
• Guarantee plans are drawn to scales approved by the Chief Inspector and include required details under Schedule 2 (r 9(3); Sch 2). Maintain records of delivery and receipt confirmations from the Chief Inspector.

Operational conformity with development programs: Do not carry out work that is contrary to or inconsistent with an approved development program (r 9(5)). Do not carry out work likely to adversely affect amenity until the Chief Inspector has approved the development program or granted specific approval (r 9(4)). Therefore, integrate approval status checks into operational planning and procurement so that site works do not commence prematurely.

Inspection facilitation and equipment provision: Prepare for inspections by ensuring:

• Inspectors and authorised persons can be mechanically lowered, raised or otherwise mechanically transported within workings, and have access to all parts of the mine and plant at the request of an inspector (r 10(a)-(b)). Ensure safe systems of work and risk assessments are in place for inspector movement and attendance to reconcile inspection facilitation with occupational health and safety obligations.
• Provide and install materials and equipment necessary to comply with the Regulations and maintain them in good condition and use them appropriately (r 11(1)). Contractors operating in parts of the mine have the same duties for their areas (r 11(2)). Document equipment inventories, maintenance schedules, and records of usage.

Environmental and amenity protection: Operational procedures must ensure compliance with Part 3 duties:

• Minimise interference with amenity, protect vegetation within and around the site, avoid undue noise or dust during operations, and prevent degradation of sea, groundwater and other water bodies (r 12(1)-(4)).
• Manage topsoil by separating it from overburden where practicable, storing it to maximise usefulness for rehabilitation and protecting stored topsoil from undue erosion (r 13(a)-(b)). Maintain topsoil stockpile logs and erosion control measures.
• Avoid placing overburden, waste material, dams or other materials where they interfere with natural drainage, cause damage to property, unduly interfere with amenity, or permit water degradation (r 14(1)). Implement drainage designs, erosion and sediment controls, and regular monitoring of water quality where applicable.
• Where operations intersect two or more aquifers of different groundwater qualities, implement measures to minimise groundwater degradation both during operations and decommissioning (r 14(5)). Record hydrogeological assessments and mitigation measures.

Decommissioning and rehabilitation planning: Prepare a decommissioning and rehabilitation plan that acknowledges statutory steps:

• Furnish the Chief Inspector with a notice when mining operations are complete, when plant, machinery and materials are removed, and when the land has been rehabilitated in the owner’s opinion (r 15).
• Ensure the site is left in a clean, tidy, stable and safe condition (r 16).
• Carry out proper rehabilitation within two years after cessation of work in accordance with any directions of the Chief Inspector (r 17). Include timelines, budgets and contractor arrangements to meet the two‑year requirement and be prepared to engage with the Chief Inspector on directions.

Exemption handling and record of conditions: If compliance is unnecessary, impractical or undesirable, or where a satisfactory alternative exists, make a formal application to the Chief Inspector for exemption under r 18. If an exemption is granted, record any conditions and comply strictly because conditions can be revoked if contravened or if circumstances alter (r 18(2)-(3)). Keep formal records of exemption applications, decisions, and condition compliance.

Liability and contractor management: Given owners can be guilty where contractors breach the Regulations (r 19(3)), owners should:

• Include express compliance obligations in contracts with contractors and subcontractors, with reporting requirements and indemnities where appropriate.
• Conduct competence verification and site induction processes to ensure contractors are “competent persons” where required to prepare or supervise work (r 3 definition).
• Maintain oversight arrangements to assure compliance, including audits, supervision and documented corrective actions.

Record keeping, copies and mine office obligations: Keep originals or accurate copies of required documents at the mine office as required by r 9(2)(c). Maintain version control of plans and development programs, and ensure updated documents are delivered to the Chief Inspector and retained on site as required.

Prepare for inspections and enforcement: Ensure evidence is available to support defence under r 20 where matters could not reasonably have been controlled. This includes documented risk assessments, maintenance records, contractor supervision records and contemporaneous logs demonstrating lack of control where applicable.

Training and competence: Identify and appoint competent persons to prepare technical documents, manage rehabilitation and supervise operations as needed by the Regulations (r 3). Maintain records of qualifications, training, and experience for personnel tasked with compliance responsibilities.

Integration with other regulatory frameworks: Map obligations under the Regulations against other applicable statutory regimes such as Mining Act 1971 licences, environmental protection statutes, water regulation, and safety laws. Ensure that compliance plans incorporate the full suite of obligations, given that r 7(3) carves out some activities from the approval requirement but does not exempt operations from Part 3 duties or inspection facilitation.

Document flow and confirmation: Establish internal workflows for producing and submitting the three required copies of plans and programs, tracking receipt by the Chief Inspector’s office, and retaining proof of delivery. Use checklists tied to Schedule 2 content to ensure technical compliance before submission.

In practice these steps allocate responsibilities, create documentary trails, and align operational planning with the timelines and technical standards required by the Regulations to minimise the risk of contravention and to be able to demonstrate compliance if inspected or charged.
