#### 130‑20 Restarting commercial production (1) If, after the \*suspension day for a mining project interest happens, the miner that has the interest is carrying on \*upstream mining operations for the interest with a view to restarting commercial production of \*taxable resources from the \*project area for the interest, for the purposes of the \*MRRT law: (a) the interest (the original interest) is taken to cease to exist; and (b) a separate mining project interest relating to extraction of taxable resources from the project area is taken to come into existence at that time. (2) To avoid doubt, the original interest ceasing to exist and the separate mining project interest coming into existence do not constitute a \*mining project transfer.
