89G Code of Practice (1) Subject to subsection (2), a person is not liable to any civil or criminal proceedings merely because the person has failed to observe any provision of a Code of Practice. S. 89G(2) substituted by No. 10/2014 s. 39. (2) Subjection (1) does not apply to— (a) the holder of an extractive industry work authority that is subject to a condition of compliance with a Code of Practice under section 77J(2); or (b) the holder of a mining licence that is subject to a condition of compliance with a Code of Practice under section 26(2A); or (c) the holder of a prospecting licence that is subject to a condition of compliance with a Code of Practice under section 26(2A).
