135 Transitional provision—2006 amendments A person who held a licence immediately before the commencement of section 26(2) of the **Mineral Resources Development (Sustainable Development) Act 2006** is not required to provide a community engagement plan in accordance with section 40(3)(b)(ii) as part of the work plan for that licence if the person before that commencement had lodged a work plan under section 40 and the work plan had not been approved. A licensee who is not required under section 135 to provide a community engagement plan under section 40 as part of the initial work plan may be required to provide a community engagement plan when the work plan is subsequently varied or the licence is renewed.
