What it does
The Mineral Resources Regulations 2026 prescribe operational details under Tasmania’s Mineral Resources Development Act 1995. They set royalty rates and calculation rules, application fees and land rents; specify marking-out requirements for lease applications; and impose royalty record-keeping and audit-reporting requirements. They also prescribe minerals for categories under the Act, identify two areas by reference to plans in the Central Plan Register, and rescind the Mineral Resources Regulations 2016 (reg 21; sch 5).
The regulations were made on 13 April 2026 and notified in the Gazette on 22 April 2026. Regulation 2 says they take effect on the day their making is notified, so the supplied text identifies 22 April 2026 as their commencement date. They are administered in the Department of State Growth.
The financial mechanisms differ by mineral. Schedule 1 prescribes specific rates for listed minerals, including petroleum and coal seam gas at 12% of gross well-head value, and several industrial materials at fixed rates per tonne. For minerals outside Schedule 1, reg 8 provides a formula involving yearly net sales and yearly profit, subject to a maximum rate and a lower-sales rule. The supplied text represents the formula as images but does not show the equations themselves. The components are described in reg 8(8), but the precise calculation cannot be reliably reconstructed from this text alone.
The instrument also sets fees in fee units, rents by area or land size, and payment and reporting timeframes. It does not itself reproduce the wider Act. The stated powers and legal effects of provisions in the Act therefore cannot be fully explained from these regulations alone.
